To kick off this week's show, Dahlia Lithwick is joined by Slate senior writer Mark Joseph Stern, who explains why Wray's decision is very bad news for the law and the rule of law. Next, the planet: Last summer, we tried to absorb the sheer scale of the shift in the constitutional landscape following a run of cases at the end of the last term that gave the courts the power to reshape the administrative state from the bench, and to impede the tools of the environmental protection trade at a time when the climate is in crisis. But the news cycle moved on and the global climate alarm got snoozed again. That alarm was surely ringing again at One, First Street this week, when a case that could reshape the nation's biggest environmental law was argued at the Supreme Court. Seven County Infrastructure Coalition v. Eagle County, Colorado comes to the court as a dispute over how much review is due to a railroad plan that will carry waxy, crude oil through environmentally sensitive areas, and send said waxy crude on its way to already polluted and health blighted gulf communities. Sam Sankar of Earth Justice was on hand to explain how this weedy case paints a very clear picture of the Supreme Court conservative majority's fondness for grabbing cases that are vehicles for achieving their preferred policy outcomes, but then finding themselves in a bit of a pickle when its time to craft a new test for an old problem. The reports of Kari Lake being picked to be Donald Trump's ambassador to Mexico appear to have been false. But don't worry - Lake is still going to get a job in the administration, and it is one where she can do even more damage than if she were an ambassador. Lake will be the new leader of the government-run media agency called Voice of America, which means she will be Trump's new propaganda master.Republicans are already planning a retreat for January, and they are going to use this opportunity to line Donald Trump's pockets - just like they have been doing since he first entered politics. The retreat is going to be held at the end of January at Donald Trump's Doral golf resort in South Florida, meaning Trump will get to rake in tons of cash from the Republican Party because he refuses to divest from his business interests. According to MSNBC, incoming Senate Majority Leader John Thune has a secret plan that he's working on to tank at least 4 of Donald Trump's cabinet picks. The alleged plan would shield vulnerable Republicans from Trump and his allies' threats of retribution, but also give them enough leeway to block controversial picks who have no business holding a powerful position in the government. According to a new analysis of the budget proposals that have come from the Trump team, the policies of the incoming President are likely to hit his own voters in Red States the hardest. The impacts will obviously be felt nationwide, but the programs that Elon Musk and Vivek Ramaswamy intend to cut provide disproportionate relief to lower-income Americans and veterans living in red states.
