In this week's chapter of Beyond the Brink and Fighting Back Rosemary Armao talks with Times Union opinion writers and guests at their monthly public affairs salon about the First Amendment in light of the Charlie Kirk assassination. We are in Hitler Germany territory they conclude. What exactly does the First Amendment protect, what government incursions on that amendment mean for our future and how the media are not defending our rights against Trump and FCC head Brendan Carr as they ought to be.

FCC Chairman Brandon Carr says will take additional action after Jimmy Kimmel was allowed back on the air following his comments about Charlie Kirk's shooter. See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.
Today's Headlines: A gunman opened fire from a Dallas rooftop into an ICE detention center yesterday, killing one detainee, critically injuring two others, and then taking his own life. The FBI says they found a bullet at the scene marked “ANTI-ICE,” and are investigating the shooting as targeted ideological violence. Meanwhile, Trump's Justice Department is reportedly teeing up criminal charges against former FBI director James Comey (for allegedly lying to Congress in 2020) and pushing a shaky mortgage fraud case against New York AG Letitia James—after swapping out the U.S. attorney who refused to pursue it. Over in late-night drama, Jimmy Kimmel pulled 6 million viewers for his defiant return, which sent Trump into an all-caps meltdown online threatening ABC. FCC chair Brendan Carr, who helped push Kimmel's initial suspension, says he's not stopping there—hinting at targeting The View and even SNL next. Also, two GOP reps are pushing to mint $400,000 coins featuring Charlie Kirk's face (yes, real currency). On the Hill, Democrats flipped Raul Grijalva's Arizona seat with his daughter Adelita, giving them 218 votes—just enough to force a floor vote on releasing the Epstein files. That news came as an anonymous golden statue of Trump and Epstein holding hands briefly appeared on the National Mall before being quietly removed. And in Florida, records suggest that more than 1,200 men detained at the so-called “Alligator Alcatraz” ICE camp this summer have since gone missing from government databases, with officials giving only vague “call ICE” notes as explanations. Matt is joined by Puck's Eriq Gardner to discuss the return of ‘Jimmy Kimmel Live!' and unpack what could happen next. They talk about why Brendan Carr and the FCC may not be as powerful as they might seem, whether affiliate stations can preempt ‘Jimmy Kimmel Live!' indefinitely, and whether Disney could leverage its power by withholding its most valuable content—like the NFL and college football—from these affiliate networks (02:47). Sarah Isgur and David French sit down with Justin Driver, the Robert R. Slaughter Professor of Law at Yale Law School, to talk about his new book, The Fall of Affirmative Action: Race, the Supreme Court, and the Future of Higher Education. They explore the landmark case Students for Fair Admissions v. Harvard, a ruling celebrated by conservatives as a victory for colorblind principles and criticized by progressives as a blow to racial equity. But according to Driver, both perspectives miss the mark. On this week's episode, delayed slightly due to technical difficulties, Sonny, Peter, and Alyssa broke down the struggle between Jimmy Kimmel, Disney, Nexstar/Sinclair, and Brendan Carr at the FCC. Is this just business as usual at the FCC, or has the regulatory administration overstepped its bounds here. Then we said goodbye to Robert Redford, looking at some of his 1970s classics like All the President's Men, Three Days of the Condor, and The Sting, among other titles. SEASON 4 EPISODE 17: COUNTDOWN WITH KEITH OLBERMANN A-Block (2:30) SPECIAL COMMENT: How about this for a plot twist? I'll believe it when I see it - it still depends on television executives doing the moral, right, professional thing AND tacitly admitting they are correcting a mistake, but multiple sources insist that at least at this moment the ABC people expect Jimmy Kimmel to not only not be fired but to return, on the air, in late night, probably before the end of the month. Maybe even this week. Yep. The fascist FCC Commissioner Brendan Carr may have delivered Liberals the biggest gift of the year. The blowback towards ABC is untenable (even polling: the Carr threat was "unacceptable" is above water by 17%; the Kimmel monologue was acceptable, 43%-36%) and the desire to keep Kimmel and maybe now even extend his contract has only grown since last week. And that's in large part because so many key right wingers from Ted Cruz and Rand Paul to Scott Dilbert Adams and Ben Shapiro are enraged by Carr's bullying and rightly recognize that if Trump can do this to ABC, what could a Democratic president do to Murdoch and NewsMax and... THEM. I mean, two out of three MAGAs have podcasts, right? My sources pointed to seven landmarks. First: they HAVEN’T fired him. Second: they actually haven’t said ANYTHING about him since the one sentence announcement about taking him off. Third: HE hasn’t said ANYTHING about ABC, good bad or indifferent. Fourth: remember the Sinclair owned local stations that started all the trouble? The ones who were bribing Trump and FCC Commissioner Brendan Carr by DEMANDING Kimmel be sidelined, so Trump and Carr would waive the rules and let Sinclair buy more than the legal limit OF local stations? Remember their plan to run a Charlie Kirk tribute last Friday night in Kimmel’s time slot? They didn’t run it. They put it on YouTube. No other explanation. Fifth: what happened to the Sinclair demand that Kimmel apologize and pay a bribe, uh, make a donation to Kirk’s scam Turning Point Company? Sixth: how much grief did ABC take for folding to Trump AND for not defending Kimmel as the entire right wing misquoted him? So much that no human can estimate it. And Seventh: how could you possibly put all the Kimmel and Kirk toothpaste back in the tube? As Eric Idle said: All You Need Is Cash. ALSO: Grandpa posts a self-incriminating note to Pam Bondi that he must have thought was being printed or emailed or lord knows what. He is running out of prosecutors who'll prosecute innocent opponents about whom there's no evidence. The Tom Homan $50,000 scandal also involves Emil Bove (and how in the hell did we not see that coming? He literally has the word "HO" in his name). And a self-proclaimed prophetess says she saw Charlie Kirk get his reward in Heaven: a large ice cream cone. B-Block (40:20) THE WORST PERSONS IN THE WORLD: Congressman Randy Fine sets a new high in low. Stephen A. Smith thinks the Kimmel-Kirk controversy is over a joke. And Vanity Fair's hiring of Olivia Nuzzi is not sitting well with journalists (as one put it, all of them who DON'T sext their sources). C-Block (52:00) THINGS I PROMISED NOT TO TELL: Hard to understand anything she says or writes but I'm pretty sure Nancy Mace threatened to end my career over Charlie Kirk. Thus I need to review the efforts to end my career, which professionally date back only to 1984 but if you count my semi-pro days in college actually stretch back to late 1977. Virtually everybody who declared me done is out of the business, or deceased. Take a number, Nance.See omnystudio.com/listener for privacy information.
After the abrupt suspension of “Jimmy Kimmel Live!” last week over comments host Jimmy Kimmel made following the killing of Charlie Kirk, many credited one person for getting Kimmel off the air: Brendan Carr, chair of the Federal Communications Commission. Hours before the suspension was announced, Carr seemed to threaten FCC action against networks, saying “we can do this the easy way or the hard way,” and advising Disney and other media companies to “find ways to change conduct.” Carr denies playing a direct role in the Kimmel suspension, but critics say Carr has emerged as Trump's top enforcer in the president's war against the media. Host Elahe Izadi talks to media reporter Scott Nover about Carr's background, his role in the Jimmy Kimmel drama and how he may be trying to expand the power of the FCC. Today's show was produced by Peter Bresnan, with help from Elana Gordon. It was edited by Ariel Plotnick and mixed by Sam Bair. Special thanks to James Graff. Subscribe to The Washington Post here.
The Rich Zeoli Show- Full Show (09/22/2025): 3:05pm- According to new data from CNN's Harry Enten, despite Donald Trump's personally low approval ratings, Republicans still possess massive polling advantages on three key issues: the economy, immigration, and crime. Enten joked that the Democrats have become the New Orlean Saints of political parties—which bodes poorly for the party's hopes of taking the House of Representatives and/or Senate in 2026. 3:10pm- On Sunday, Republican Jack Ciattarelli and Democrat Mikie Sherrill held their first NJ Gubernatorial debate at Rider University. During one notable moment, Sherrill refused to pledge that she wouldn't raise taxes on New Jersey citizens. One new poll now has Ciattarelli leading by 1-point. 3:30pm- During Sunday's debate, Mikie Sherrill attempted to explain why she voted in favor of a bipartisan House resolution honoring the life and legacy of Charlie Kirk—but publicly denounced Kirk, lying about his past comments and baselessly claiming he wanted to” roll back the rights of women and Black people.” Sherrill was unable to answer when confronted with her inconsistencies and falsehoods. 3:40pm- On Sunday, a memorial service for Charlie Kirk was held in Glendale, Arizona—with 73,000 inside of State Farm Stadium and an estimated 200,000 people in total showing up to the event. In a powerful moment during the ceremony, Erika Kirk said she forgives her husband's accused killer. 3:50pm- During her Monday briefing, White House Press Secretary Karoline Leavitt announced that President Donald Trump plans to sign an Executive Order designating Antifa as a terrorist organization. 4:05pm- Kimmel is Back: Last week, ABC/Disney indefinitely suspended “Jimmy Kimmel Live”—following Kimmel's comments on the killing of Charlie Kirk. The late-night host shamefully accused Republicans of using the death to “score political points.” While the network's move appeared to be a result of Kimmel's comments coupled with poor ratings, FCC Chairman Brendan Carr suggested his department could potentially investigate ABC/Disney over Kimmel's vitriolic remarks—muddying the waters. Many expressed concern that Carr's warning amounted to a First Amendment violation. ABC/Disney is now announcing that the suspension has concluded, and Kimmel will be back on-air Tuesday night. Rich notes that if Carr had not opened his mouth and baselessly threatened ABC/Disney, Kimmel's show would have likely ended permanently. Did Carr inadvertently save Kimmel's career? 4:20pm- Fox News reporter Peter Doocy asked President Trump: “If you could eat only one thing for a week, what would it be?” Trump responded, “probably steak.” 4:40pm- Joe Gruters—Chairman of the Republican National Committee—joins The Rich Zeoli Show for his first interview since becoming RNC Chair last month! Democrats on the Hill are hitting back after ABC suspended "Jimmy Kimmel Live!" indefinitely. They've introduced the No Political Enemies (or NOPE) Act, a bill that would protect people targeted for political speech, and called for the resignation of Federal Communications Commission chair Brendan Carr, whose comments targeting Kimmel came just hours before ABC pulled the show. Jimmy Kimmel was taken off the air by ABC, and the fallout continues. The Left rallies around Kimmel, but the Left cheered when Tucker Carlson was taken off the air. Leftists are absolutely unhinged over the Jimmy Kimmel situation. French President Emmanuel Macron and his wife, Brigitte, are preparing to provide "scientific evidence" that Brigitte is a woman. BULLETIN: SEASON 4 EPISODE 16, COUNTDOWN WITH KEITH OLBERMANN In an Oval Office news briefing crazy even by his standards, Trump answered a question about the FCC blackmailing of ABC over Charlie Kirk by changing the topic to himself, making up a statistic that "94, 95, 96, or 97 percent" of all network television stories about him are critical of him, and declaring of such criticism: "That's really illegal, in my opinion." In Trump's damaged condition he could forget this by morning. But after this week's mafioso style shakedown of ABC by the FCC and the owners of Sinclair to force Jimmy Kimmel off the air by FCC Commissioner, Brendan Carr, the real question is - what if he doesn't? What if somebody like Carr in his administration decides to curry favor with Trump by trying to enforce an "it's illegal to criticize Trump" declaration"? Taking the two stories together, and perhaps adding in Trump's threat to declare something that doesn't really exist (Antifa) a "terrorist organization" (which could just as easily lead to him declaring you a member of Antifa and thus a "terrorist") the FCC's action is so bad that it provoked serious, well-thought-out, sober yet angry condemnation Friday afternoon from the unlikeliest of sources: Senator Ted Cruz, who warned Republicans that the government needed to stay out of the bullying media business. Whether that will register with Trump remains to be seen. For now the gist is: Trump says criticizing him (or in the best possible interpretation, criticizing him a LOT) is illegal. He cannot remain president under such circumstances.See omnystudio.com/listener for privacy information.

Ted Cruz compares FCC Chair Carr to Mafia boss in Jimmy Kimmel warningsRepublican Sen. Ted Cruz of Texas sharply criticized Federal Communications Commission Chairman Brendan Carr for his comments related to late-night host Jimmy Kimmel shortly before ABC pulled his show off the air.Cruz said he took issue with Carr threatening to cancel ABC's broadcast license over Kimmel's remarks about the death of conservative activist Charlie Kirk.“He says, ‘We can do this the easy way, or we can do this the hard way,'” the senator said of Carr in the latest episode of his podcast, “Verdict with Ted Cruz,” which aired Friday morning.“And I gotta say, that's right out of ‘Goodfellas,'” Cruz said, referring to the classic mob film.“That's right out of a mafioso coming into a bar going, ‘Nice bar you have here, it'd be a shame if something happened to it,'” he said.“Look, I like Brendan Carr. He's a good guy, he's the chairman of the FCC. I work closely with him, but what he said there is dangerous as hell,” Cruz said at another point in the episode.Cruz's comments put him at odds with President Donald Trump, who applauded Kimmel's suspension and later called Carr “outstanding.”Cruz said he's no fan of Kimmel's and that he is “thrilled that he was fired” over his comments about Kirk.“But let me tell you, if the government gets in the business of saying, ‘We don't like what you the media have said, we're going to ban you from the airwaves if you don't say what we like,' that will end up bad for conservatives,” Cruz said.Kimmel, who has been suspended but not fired, said in his opening monologue Monday night that “the MAGA gang” is “desperately trying to characterize this kid who murdered Charlie Kirk as anything other than one of them and doing everything they can to score political points from it.”On Wednesday, Carr slammed Kimmel at length during an appearance on right-wing commentator Benny Johnson's podcast.ABC has “a license granted by us at the FCC, and that comes with it an obligation to operate in the public interest,” Carr said.“But frankly, when you see stuff like this, I mean, look, we can do this the easy way or the hard way,” he said. “These companies can find ways to change conduct, to take action, frankly, on Kimmel, or you know, there's going to be additional work for the FCC ahead.”Hours later, ABC and Nexstar Media Group, which hosts ABC-affiliated local stations, pre-empted “Jimmy Kimmel Live!” indefinitely.Nexstar in August announced a planned $6.2 billion acquisition of Tegna — a merger that will require the FCC's approval.See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.
Earlier this week, ABC's late-night show "Jimmy Kimmel Live!" was suspended indefinitely by parent company Disney after Kimmel made remarks about Charlie Kirk's death. The announcement came after the chairman of the Federal Communications Commission, Brendan Carr, suggested the FCC could pull the broadcast licenses of ABC-owned stations, and the owners of some of these stations said they were dropping Kimmel's show. President Donald Trump has said that broadcast networks that are “against” him might have their licenses taken away. WSJ's Maggie Severns reports on Carr's approach to the FCC and how it has led to Kimmel's suspension. Ryan Knutson hosts. After the assassination of right-wing activist Charlie Kirk, both Republicans and Democrats called for unity and understanding — but polarizing rhetoric has continued to escalate. President Trump, Vice President JD Vance, and other White House officials have vowed to target the “radical left” for being politically violent. Democratic officials have warned that the White House may try to use the assassination to suppress speech. Those fears may have been realized when ABC was threatened over late-night host Jimmy Kimmel's comments about conservatives' reaction to Charlie Kirk's killing. Brendan Carr, the chairman of the Federal Communications Commission, pressured the network to pull Kimmel off the air indefinitely. How do Americans feel about a government agency censoring speech that they don't agree with? Whose responsibility is it to turn down the temperature when it comes to rhetoric and polarization? David Greene worked with country singer Ketch Secor of the band Old Crow Medicine Show to produce a music documentary called Louder Than Guns. Greene spent time with Secor, touring across the country and hearing Americans' reflections on gun violence and gun rights. When FOX News host Trey Gowdy said that Americans should have a conversation about preventing more gun violence, his fellow conservatives said he should be ashamed. How do we stop talking past each other during conversations about guns and create an open dialogue? Are Americans too enraged by each other to ever experience unity? This week, a listener asked Left, Right and Center about America's history of political violence and if our panel thinks anything has changed.

The Rich Zeoli Show- Hour 1: 3:05pm- Trump Should End the Federal Communications Commission (FCC): ABC/Disney has indefinitely suspended “Jimmy Kimmel Live”—following Kimmel's comments on the killing of Charlie Kirk. The late-night host shamefully accused Republicans of using the death to “score political points.” While the network's move appears to be a result of Kimmel's comments coupled with poor ratings, FCC Chairman Brendan Carr suggested his department could potentially investigate ABC/Disney over Kimmel's vitriolic remarks—muddying the waters. Many have expressed concern that Carr's warning amounts to a First Amendment violation. Republicans must be consistent defenders of free speech. Rich thinks Carr should mimic Linda McMahon's pledge to do away with the Department of Education and end the FCC once and for all. 3:20pm- During the Biden Administration, Democrats and media members called for widespread censorship of opinions they didn't like—suggesting those takes amounted to “dangerous misinformation.” Republicans should not be adopting a similar stance just because they're in power right now. 3:25pm- Flashback: In February 2022, then-White House Press Secretary Jen Psaki warned that if Spotify did not do more to police Joe Rogan's Covid-19 “misinformation,” the federal government would get involved. 3:40pm- Listeners weigh in: Should the Trump Administration do away with the Federal Communications Commission (FCC)? 3:50pm- On Friday, 38 Democrats—including Rep. Alexandria Ocasio Cortez—voted against a House resolution honoring the life and legacy of Charlie Kirk. The resolution ultimately passed with bipartisan support despite performative outrage from AOC.
Aaron McIntire unpacks the week's heavy hits: Erika Kirk's bold new role at TPUSA amid grief, the Jimmy Kimmel fallout exposing media cracks, Trump's UK tribute to Charlie Kirk, Ilhan Omar's dodged censure and expletive-filled retort, and a heartfelt story of one man's suit-fueled resolve to lead his family to church. Brendan Carr joins CNBC's "Squawk Box" to discuss the obligation of broadcasters to serve in the public's best interest. Is lying about Charlie Kirk's assassin's political leanings in the public's best interest? Kimmel's abysmal ratings suggest the answer is no. How the "hammer attack" of Paul Pelosi and the media's lies about the perpetrator follow the same modus operandi as the Charlie Kirk assassin lie.
SEASON 4 EPISODE 15: COUNTDOWN WITH KEITH OLBERMANN A-Block (2:30) SPECIAL COMMENT: Charlie Kirk died because he lived amid the violent madness of Donald Trump's America. Now that we can say with some certainty that if Tyler Robinson indeed shot Charlie Kirk, he shot him for personal reasons, that he saw Kirk as a direct threat to someone he loved, that Robinson was NOT a stochastic proxy murderer from Antifa or the Groypers or the Right Wingers who had so recently called Kirk a fraud like Laura Loomer, it is also clear that there is truly only ONE person whose WORDS created, amplified, mainstreamed, and manufactured the nightmarish environment that led to Charlie Kirk’s indefensible death. The leading threat in this country in this moment, to the safety and the lives of Conservatives and Republicans and MAGA commentators and politicians and citizens - the leading threat to ALL of us - is Trump. The America in which Charlie Kirk was murdered… the America in which Melissa and Mark Hortman were murdered… the America in which Paul Pelosi was beaten… the America in which Donald Trump was shot is DONALD TRUMP’s America. THIS is Donald Trump’s America and ALL THOSE who are endangered by it, and all those who fall dead at its feet, are the victims of one man and one man alone: Donald Trump. The institutionalization of vengeance is Trump. The introduction of political persecution is Trump. The inspiration for the only attempted VIOLENT OVERTHROW AND COUP against the government of the United States is Trump. The weaponization of the mob and the government against individuals he names and hopes somebody else hurts is Trump. The TERROR is Trump. B-Block (29:20) BREAKING NEWS: And the transformation of flawed democracy into lethal autocracy… is Donald Trump. After the FCC Commissioner Brendan Carr took a page from the Goebbels playbook in 1930's Germany and threatened to revoke ABC's ownership of local stations because Jimmy Kimmel dared to tell the truth about Charlie Kirk's hate speech and the MAGA exploitation of his death, Bob Iger - the Disney chairman desperate to hold on to his job and his money and his only purpose in a failed life - folded to the fascists. Kimmel is off the air, indefinitely, probably for good, and has no legal recourse to be reinstated. All he can get is the money. C-Block (49:00) THINGS I PROMISED NOT TO TELL: Robert Redford, RIP. BULLETIN, SEASON 4 EPISODE 14, COUNTDOWN WITH KEITH OLBERMANN BULLETIN (2:55): ABC announced late this afternoon that it had taken "Jimmy Kimmel Live!" off the network's air effective immediately, because Kimmel had the nerve to tell the truth about how Trump and the MAGA terrorists have exploited the indefensible assassination of Charlie Kirk, how they have tried to blame the left without evidence and with increasing evidence that this was an instance of a man who feared Kirk was a direct threat to a person he loved, and how they have ruthlessly tried to suppress all public comment that contradicts their narrative, or the nonsensical whitewashing of Kirk's violent, ultra-right platform that once included him publicly calling for the execution of President Biden. “We hit some new lows over the weekend with the MAGA gang desperately trying to characterize this kid who murdered Charlie Kirk as anything other than one of them and doing everything they can to score political points from it,” Kimmel said Monday. By this afternoon FCC chairman Brendan Carr dipped into the Goebbels playbook and threatened ABC's station licenses if it did not take Kimmel off the air, and the Nexstar stations that own many ABC affiliates, said they would not broadcast any more of Kimmel's shows. At that point ABC simply said the show was off the air "for the foreseeable future." Fascism can truly overtake this country's democracy only with the collaboration of Disney and ABC and people they run them - desperate people like Bob Iger, who reclaimed the chairmanship of the company and will do anything he can to maintain it - including selling this country out to the fascists. I'll also discuss why Kimmel has no recourse against the action and will most likely not appear again, and why ABC's only contractual obligation to him is to pay him the remaining year of his salary. This part of it I've personally been through - though under far less dire circumstances. See omnystudio.com/listener for privacy information.
President Trump has said for years that he wants Jimmy Kimmel off the air. Now, ABC and its parent company Disney have put the show on indefinite hiatus. One key player here is the chairman of the Federal Communications Commission, Brendan Carr. Today he applauded ABC's decision, posting on X, “Broadcast TV stations have always been required by their licenses to operate in the public interest.”Kimmel's cancellation reopens questions about free speech, the role of the FCC, and the relationship between the commission and the White House.NPR political editor and correspondent Domenico Montanaro and former FCC chairman Tom Wheeler shed some light on those questions. Carr told MSNBC: “We're on a cable show right now. You don't have an FCC license and an obligation to serve the public interest. Podcasts don't either...Kimmel is free to do that—but if you have a broadcast TV license...it comes with an obligation to serve the public interest.” Rich points out that Carr's comments aren't helpful and allow Democrats to claim Kimmel is a victim of government-led censorship. 3:50pm- Callers weigh in on comments from the FCC Chairman and ABC/Disney's decision to end Jimmy Kimmel's show. Is the Trump Administration making a massive mistake getting involved in Kimmel's termination? Most seem to agree, this is problematic.
