How nasty is the Republican Party’s massive campaign to thwart democracy? Ask the good people of Florida. This was one of only three states that permanently took away the voting rights of felons – who’d completed their punishment. In 2018, though, a whopping 65 percent of Floridians voted for a state constitutional amendment that finally struck this malicious bit of legal ugliness from the books, thus restoring the political personhood of about a million people who’d served their time. But, led by Ron DeSantis, Florida’s right-wing goose of a governor, the GOP demanded that an appeals court of hyper-partisan federal judges overrule 2018’s landmark vote by the people and slam the door once more on the rights of discharged felons. They’re not entitled to vote, squawked these vindictive ballot suppressors, unless and until they’ve paid off the full amount of court costs and fees they were assessed. Money, asserted Republican leaders, must trump social justice, human decency, and political rights for these mostly indigent people who’re unable to pony up a thousand bucks or so. Even if ex-felons are regularly making payments to clear the debt – tough luck say the Republican repressors, no vote until every penny is paid. It’s a flagrant case of rigging the system to steal the votes of a low-income constituency generally inclined to support Democratic policies and candidates. It also amounts to an unconstitutional poll tax, made more intolerable by applying it to one class of citizens (largely people of color) specifically to disenfranchise them. The court’s six-judge Republican majority (five appointed by Trump) cynically defied the US Constitution and the Florida electorate just weeks before November’s presidential election, effectively incarcerating some 774,000 potential voters in a partisan debtor’s prison. Yet, the people’s battle for justice goes on – to say connected, go to Florida Rights Restoration Coalition: FloridaRRC.com.

A federal appeals court ruled last week that Florida can require former felons to pay all outstanding fines and fees before gaining the right to vote, overturning a judge who said the requirement was an unconstitutional “pay to vote” system that would bar nearly a million people from the ballot box. Today's episode brings you some good news from the 11th Circuit Court of Appeals with respect to Florida's effort to restore the vote to felons who have completed their sentences -- and the Republicans' ongoing efforts to stop it. We also revisit the emoluments clause litigations pending in two jurisdictions as well as tackle a novel question from one of our listeners. You won't want to miss it! We begin with a brief Andrew Was Wrong / Andrew Was Right segment regarding emoluments. Friend of the show Seth Barrett Tillman writes in to correct us on two procedural issues and also to venture an opinion that any future emoluments cases would have to be brought by both houses of Congress. Find out why Andrew disagrees and stands by his original recommendation in Episode 361 that Nancy Pelosi authorize a new vote by the full House of Representatives to re-file the case originally brought in Blumenthal v. Trump. Then it's time for our main segment on the breaking decision out of the 11th Circuit striking down the Florida legislature's effort to gut Amendment 4 (which was meant to restore voting rights to ex-felons). Find out why the court ruled the way it did, what happens next, and why there may be cause for optimism in the Sunshine State! After that, it's time for a fascinating, clever, but (sadly) wrong suggestion from a listener regarding a writ of mandamus and the current logjam in Congress. Ms. Lewis runs an organization dedicated to helping former inmates find jobs, preparation for interviews, and she advocates for them in court. This dynamic organization is based in Arkansas but Ms. Lewis will go whereever she's needed. She started Lewis Burnett Employment Finders when her son, who spent a short time in prison had trouble finding a job when we came home. She believes her son, like many of the men and women who've had this issue in their background are still good people. They made a mistake and shouldn't be penalized for the rest of their lives. Many come home to nothing, and often have to resort back to the same activity that got them in trouble in the first place. For many, it's about survival. Ms. Lewis is putting an end to that. "If someone doesn't step up to help them, they're going back to prison," she passionately explains. She believes God has given her this assignment and even with health challenges she refuses to quit. If she can keep going, so can a former inmate. You can contact Ms. Lewis on their Facebook page. She's currently seeking assistance with getting a website and office space.

Joe DeLoss is the founder of Hot Chicken Takeover, a Nashville-style, hot chicken restaurant chain based out of Ohio. What's more inspiring than delicious fried chicken? The mission behind the chicken and the resulting success and growth the company is enjoying. Joe will share how his competitive advantage (what he calls fair 'chance employment') is leading Hot Chicken Takeover to outperform its competitors in productivity 2 to 1. Join me and life-long entrepreneur Joe DeLoss to get inspired and to get new ideas to grow your business, life and relationships.  SHOW NOTES: "How can we sustainably tackle problems in our community through entrepreneurship?"  Meaningful employment = building positive job experiences for people who probably haven't had many due to homelessness, poor work history, incarceration, criminal record. One in 3 Americans have a criminal record from misdemeanor to felony. "The work we do isn't charitable. We hire really high character, high integrity people (who have been looked over by traditional employers) and have made our restaurant best in class." "Our team members are proving that their futures are bright and look much different than the past so many others hold them to." Turnover is 40% or less. We're performing 2 to 3 times better in terms of employee turnover + productivity in our segment. Love and community are disruptive for everybody and have been taken out of most environments. As an employer, these are key elements for us and it makes a difference for the community of employees and customers. "Challenge and adversity is part of life, but suffering is optional." "If you can reflect, empathize and lead with love instead of judgement you will start to understand that a lot can be done. You have that choice everyday. Take it. Lead with love, it will be more disruptive than any technology or application we will ever have." Hear more inspired dialogue around meaningful employment, check out Ep. 92 Ex-Felons to Farmers, highlighting Ironbound Hard Cider. JOE DELOSS LIVE INSPIRED 7  1. What is the best book you’ve ever read? Walden by Henry David Thoreau. Everytime I read it I find some peace and contentment. The idea of seeking and exploring a different way of living inspired me to take the reigns of what my life will look like. A life of exploration, understanding and reflection is the basis of growth.  2. What is a characteristic or trait that you possessed as a child that you wish you still exhibited today? Creativity and freedom from ego is really magical. Battling with my judgements of myself constrains me. The more I can be present, love and empathize with the world the way children do feels boundless. 3. Your house is on fire, all living things and people are out. You have the opportunity to run in and grab one item. What would it be? Nothing, if you press me I'll go straight tactical: My iPhone. 4. You are sitting on a bench overlooking a gorgeous beach. You have the opportunity to have a long conversation with anyone living or dead. Who would it be? I want mountains not beach! My wife, Lisa. Every meaningful conversation we have opens me up and gives me a different perspective.  5. What is the best advice you've ever received? As a leader, instead of answering the question, ask the question back. If you have the right community around you, they'll have the right answer. It is the most freeing thing.  6. What advice would you give your 20-year-old self? Slow down and be present. Make decision for the moment you are in not the moment you want to be in. In my 20s, I escaped to my future a lot. It damaged relationships, because it is not the place to be. 7. It’s been said that all great people can have their lives summed up in one sentence. How do you want yours to read? He was empathetic, saw and communicated the value that everybody has.  *** If you enjoyed today’s episode: Subscribe, rate & review wherever you get your podcasts. See you here next Thursday! Charles Rosen started Ironbound Hard Cider to rekindle the Newark economy by hiring it's chronically unemployed, formerly incarcerated population. James Williams is one such employee who shares his passion for working as a crew chief on the cidery's orchard. Reimagine what's possible in business, life, community, social enterprise + sustainable agriculture on today's episode: NOTES: "The Ironbound Hard Cider community is blended, guys wearing 'Make America Great Again' hats sitting side-by-side with black gang members from Newark and they treat each other like brothers." This business is an unintentional exploration into how to address the biggest gap that exists in our country: Urban v. rural. "We are much stronger as a collective then when thinking only of our own individual pursuits." Helping people shift out of a state of chronic poverty takes time. I'm not seeing entities in any sector willing to put in that time. Instead of a winner take all approach to business, our approach is that my success shouldn't come at the expense of yours. My success should actually be connected to yours. JAMES WILLIAMS’ LIVE INSPIRED 7 1. What is the best book you’ve ever read? Biography of Makaveli, Tupac Shakur. Tupac was naturally someone people looked up to in the urban community. 2. What is a characteristic or trait that you possessed as a child that you wish you still exhibited today? Listening. Listen first. Ask questions later. 3. Your house is on fire, all living things and people are out. You have the opportunity to run in and grab one item. What would it be? Honestly nothing, I'm good. 4. You are sitting on a bench overlooking a gorgeous beach. You have the opportunity to have a long conversation with anyone living or dead. Who would it be? Obama. I'd ask, "How did you do it?" 5. What is the best advice you've ever received? Don't give up. 6. What advice would you give your 20-year-old self? I wish I could take it back. I would have been in a different place, but I do accept where I am at now. 7. It’s been said that all great people can have their lives summed up in one sentence. How do you want yours to read? Very optimistic, eager to learn and capable. *** If you enjoyed today’s episode: Subscribe, rate & review wherever you get your podcasts. See you here next Thursday!
