My guest this week is Pastor Derek Reimer of Calgary. Derek feeds and ministers to the homeless in Calgary but was arrested for peacefully presenting biblical truth at a “Drag Queen Story Hour.” He was arrested again for attempting to discuss—with a library manager—the use of a public library for these types of events. He served 105 days behind bars and has now served 9 months of a 12-month sentence under house arrest. He is not allowed to pastor at his church and his regular work as a drywaller has been limited by restrictions imposed by his probation officer. This has seriously reduced his family's income. The rising number of people on electronically-monitored bail is being used to explain a surge in absconders. Figures released to Newstalk ZB through the Official Information Act show cases of a breach rose from 64 in 2015, to 832 last year. Corrections Chief Probation Officer Toni Stewart told Heather du Plessis-Allan over the last 10 years the courts have granted more electronically monitored bail. Jake Phillips is Associate Professor at the University of Cambridge where he is the director of the MSt in Applied Penology, a masters course for people working in managerial and leadership roles in the criminal justice system. Prior to moving to Cambridge he worked at Sheffield Hallam University for 12 years. Before doing his PhD – at Cambridge – he worked in various roles in the criminal justice system such as drug interventions worker and various roles supporting people on probation to find work and access drug treatment. His academic research focuses primarily on probation policy and practice although he has carried out research in prisons, the police, parole and youth justice. He has carried out research on the emotional labour of probation work, probation practitioner wellbeing, the impact of inspection on probation, people who die whilst under probation supervision, privatisation in probation and, more recently, the concept of hope in the probation context. Jeffrey Epstein's probation terms following his 2008 conviction were astonishingly lenient, especially given the gravity of the charges. Despite being labeled a sex offender, Epstein was allowed to serve just 13 months of an 18-month sentence in a private wing of the Palm Beach County Jail, with most of that time spent outside the facility under a “work release” privilege. He was permitted to leave the jail for up to 12 hours a day, six days a week, supposedly for professional obligations—an arrangement virtually unheard of for registered sex offenders. During these hours, Epstein operated from a private office where he allegedly continued to receive young female visitors, all while being “supervised” by deputies who largely looked the other way.The terms of his probation were equally toothless. Epstein was granted permission to travel extensively between his residences in New York, Florida, and the U.S. Virgin Islands with minimal oversight. He was required to register as a sex offender, but compliance was inconsistent and, in some jurisdictions, poorly enforced. He didn't wear an ankle monitor, and his communications and finances were largely unmonitored, allowing him to continue managing his wealth and potentially facilitating further abuse. Former Justice Secretary and Lord Chancellor David Gauke joins James Heale to talk about his review into prison sentencing. The former Tory minister was appointed by the current Labour Justice Secretary Shabana Mahmood, but says there is a clear centre-right argument for prison reform. He talks James through his policy proposals and the political reaction to them, the thinking behind expanding chemical castration for sex offenders and why deportation is complicated when dealing with the very worst foreign criminals.
