Beach crews have found the first sea turtle nest on the Mississippi mainland in four years. A Harrison County Sand Beach crew that was cleaning up found what appeared to be turtle tracks just east of the Pass Christian Harbor, officials said. They protected the area and called the Institute for Marine Mammal Studies in Gulfport, which followed the tracks to a nesting site that is now marked off with stakes and tape. The eggs likely belong to a protected loggerhead sea turtle or an even rarer Kemp's ridley sea turtle, which is the most critically endangered species of sea turtle, said Moby Solangi, president of the marine studies group. The exact species of turtle won't be known until the eggs hatch in 50 to 60 days. Only about 1 in 10,000 sea turtle eggs reach adulthood. Turtles lay between 60 to 100 eggs in a nest and have multiple nests during a season, Solangi told The Sun Herald in Biloxi. This is the first sea turtle nest on mainland Mississippi since 2018, although there have been unofficial reports of nests on uninhabited barrier islands, officials said. The Mississippi Sound and Gulf of Mexico are important sea turtle habitats, but the 2010 oil spill and the 2019 opening of the Bonnet Carré Spillway hurt the turtle population, Solangi said. “After all the environmental disasters we've had, this is a good sign. When (turtle populations) have gone down, it means the ecosystem that supports them is having difficulty. When animals start breeding, it means things have started to get better,” Solangi said. Katrina Cases https://zalma.com/blog The United States District Court for the Southern District of Mississippi, Southern Division, entered an important decision with regard to water damage and insurance policy coverages raised after Hurricane Katrina. In Leonard v. Nationwide Mutual Insurance Co., 499 F.3d 419 (5th Cir. 08/30/2007), the first of the Katrina cases to go to trial, the court found that the Leonards' residence was not covered by any policy of flood insurance at the time of the storm. Flood insurance is available to anyone, regardless of which flood zone their residence is situated in, yet the plaintiffs did not purchase it; they purchased only a common homeowner's policy from Nationwide. The evidence presented at trial conclusively established the following points: That on August 29, 2005, the entire area surrounding Pascagoula, Mississippi, including the Leonard residence and its surrounding neighborhood, was subjected to violent winds in excess of 100 miles per hour. These winds increased gradually in the early morning hours and reached a peak of intensity between 9:00 a.m. and noon. Water from the Mississippi Sound was driven ashore by the storm, and the water level in the Leonard neighborhood rose to a peak level between 11:00 a.m. and noon. At its highest point, this water inundated the Leonard residence to a depth of approximately five feet. The Leonard residence is approximately 12 feet above sea level. This property is 515 feet from the beachfront to the south. The inundation of the ground floor of the Leonards' residence caused extensive damage to their floors, carpets, walls, and personal property. The second floor of the Leonards' property was not damaged. The physical damage to the roof of the Leonards' property consisted of a small number of broken shingles, and the watertight integrity of the roof was not breached during the storm. The attached garage on the Leonards' property was also extensively damaged during the storm. The only wind damage on the ground floor of the Leonards' residence was a hole in one window that witnesses described as “golf-ball sized.” The exterior of the Leonards' home and the attached garage were soiled by a combination of wind-driven materials and water-borne materials. Based on the findings of fact established by evidence at trial, the court concluded: The provisions of the Nationwide policy that exclude coverage for damages caused by water are valid and enforceable terms of the insurance contract. Similar policy terms have been enforced with respect to damage caused by high water associated with hurricanes in many reported decisions. ZALMA OPINION Whether a claims is for water damage, wind damage, or resulting mold infestations as a result of water infestation it is important that the insurer conduct a thorough investigation into the causes, determine which are due to a covered peril and those which are clearly and unambiguously excluded by the policy. In 1918 New Orleans residents George Walter and Annette McConnell Anderson purchased 24 acres of land facing the Mississippi Sound in Ocean Springs. Annette wished to establish a retreat for artists. They named their new venture, Fairhaven. Their three sons, Peter, Walter and Mac, shared Annette's love of the Arts and found inspiration there. Shearwater Pottery was founded in 1928 by Peter Anderson. In this episode, his nephew, John Anderson explains how Shearwater Pottery got it name. As a painter, Walter Anderson, lived the life of a hermit, spending much of his time on Horn Island, painting Gulf Coast wildlife in his own unique style. His youngest son, John, recalls his father's strained relationship with the rest of the family and shares an emotional early memory. Even though Walter Anderson died in 1965, his work was unknown to the Art world until the 1970s. John Anderson remembers how an exhibit at a Memphis gallery helped turn his father into a cultural icon. The Friends of Walter Anderson was established in 1974 to help catalog and preserve the late artist's work. Anderson explains how that group led to the establishment of the Walter Anderson Museum.

Catastrophes and Anti-Concurrent Cause Policy Language https://zalma.com/blog The United States Court of Appeal, Fifth Circuit entered an important decision with regard to water damage and insurance policy coverage for claims resulting from water damage and catastrophe losses. In Leonard v. Nationwide, 499 F.3d 419, 37 A.L.R. 6th 785 (2007) the first of the Katrina cases to go to trial, found that anti-concurrent-causation clause was not ambiguous; the clause was not invalid under Mississippi law; and water damages exclusion unambiguously excluded damage caused to residence from storm surge. The Leonards' home lies twelve feet above sea level on the southernmost edge of Pascagoula, Mississippi, less than two hundred yards from the Mississippi Sound. Hurricane Katrina battered Pascagoula with torrential rain and sustained winds in excess of one hundred miles per hour. By midday, the storm had driven ashore a formidable tidal wave—also called a storm or tidal surge—that flooded the ground floor of the Leonards' two-story home. The Fifth Circuit found that the anti-concurrent causation “clause unambiguously excludes coverage for water damage ‘even if another peril”—e.g., wind— “contributed concurrently or in any sequence to cause the loss.' The plain language of the policy leaves the district court no interpretive leeway to conclude that recovery can be obtained for wind damage that ‘occurred concurrently or in sequence with the excluded water damage.'” For all these reasons, the Fifth Circuit “concluded that use of an anti-concurrent-cause clause to supplant the default causation regime is not forbidden by Mississippi caselaw (including the Camille cases which antedate such clauses), statutory law, or public policy. The Governor issues a series of Executive Orders and a Declaration of Emergency.Then, the Mississippi Sound is still recovering from last spring's opening of the Bonnet Carre Spillway. Now the spillway is open for the third year in a row. We talk to Secretary of State Michael Watson.Plus, how a lack of resources creates challenges for online college classes.Segment 1:Governor Tate Reeves has issued a Declaration of Emergency following the severe weather that passed through the state on Easter Sunday. The declaration enables all state agencies to ramp up coordination of their emergency responses with the Mississippi Emergency Management Agency and enable them to fast-track coordination at all levels of government in Mississippi. Greg Michel is the Executive Director of MEMA. He tells MPB's Alexandra Watts the early damage assessments are extensive. MEMA's initial report confirms 11 weather-related deaths in 6 counties. An estimated 72,000 are without power and at least 100 people are currently displaced.The Governor has also issued a series of Executive Orders related to the state's COVID-19 response. He announced these new measures at a press conference on Friday. In total, the Governor has issued six new Executive Orders this month, beginning with the shelter-in-place order on April 1st. Segment 2:The Bonnet Carre spillway, which lies on the western edge of St. Charles Parish in Louisiana, was built, in part, as a response to the great 1927 flood that decimated the lower Mississippi. The 5.7 mile chain of locks, traditionally opened at a frequency of once every ten years, is now open for the third consecutive spring. As Secretary of State Michael Watson tells our Michael Guidry, it is causing geological and economic damage to the Mississippi Sound.Segment 3:Universities and Colleges in Mississippi have transitioned to online distance learning to continue educating students during the Coronavirus pandemic. But, for some, transitioning to online instruction has not been easy. After professors convert all their materials to online resources, some students still may not have access to it. Sade Turnipseed, Assistant Professor at Mississippi Valley State University, tells MPB's Kobee Vance half of her students don't have internet access.Andy Harper is an Instructional Assistant Professor at the University of Mississippi. He says the challenges for professors is figuring out how to transition their classes to an online platform. He also believes a healthy compromise is essential when determining how to issue grades. Edmond Boudreaux’s family came to Biloxi in 1914 to work in the seafood factories. In this episode, he shares his family’s long history in the seafood industry and how his father would work in the factory as child before and after attending school each day. Growing up on “The Point” in East Biloxi, Boudreaux never thought of his family as poor. He recalls how he and his brothers would play and fish in the nearby marshes and bayous. According to Boudreaux, all people living on the Mississippi Sound develop a connection to the water. He explains how those ties remain constant, even as changes in technology have resulted in fewer people actually working in the seafood industry. Over the years, the Gulf Coast fishery has weathered challenges from hurricanes, floods, and pollution. Boudreaux discusses those challenges and how recent events have affected the livelihoods of Mississippi fishermen.
