The big opinions are starting to drop, and we're doing our best to keep pace. We first discuss Landor v. Louisiana Department of Corrections, which concerns religious liberty, the scope of Congress's power to create remedies against individuals under the Spending Clause, and whether there's any redress if government officials literally throw your rights into a trash can. We then turn to United States v. Hemani, where the Court found that a federal law barring gun possession by unlawful drug users violated the Second Amendment and revealed that some of the Justices are surprisingly open-minded about marijuana's role in American society. Key Topics[00:07:07] - Landor v. Louisiana Department of Corrections[00:08:02] - The facts of Landor's case and the prison's decision to ignore prior religious-hair protections[00:10:52] - RFRA, RLUIPA, and the path from Employment Division v. Smith to modern religious-liberty litigation[00:14:54] - The Spending Clause theory behind federal funding conditions and why the remedy question matters[00:19:54] - The majority's reasoning: why money-damages suits against officials were held unconstitutional here[00:21:33] - Sabri, the Necessary and Proper Clause, and the debate over third-party liability[00:26:04] - The parade of horribles: transgender sports, vaccines, and other funding-condition hypotheticals[00:33:03] - The constitutional background: “general welfare,” the spending clause, and the comma-versus-semicolon debate[00:38:49] - Why the Court granted the case and whether the facts pushed the legal outcome[00:42:13] - Hemani and the federal statute banning gun possession by unlawful drug users[00:44:05] - Historical analogies, habitual drunkards, and how Bruen and Rahimi are functioning together[00:47:17] - Discussion of the Court's analogical method and its practical limits in lower courts[00:54:26] - Justice Thomas's concurrence on jurisdictional hooks after Lopez[00:55:31] - Justice Jackson's concurrence on Bruen and Justice Alito's surprising marijuana comparison[00:57:51] - The real-world use of marijuana versus alcohol at the founding, and why the analogy is controversialRelevant LinksDivided Argument: https://www.dividedargument.com/Podcast merchandise: https://store.dividedargument.com/Podcast commentary and blog: https://blog.dividedargument.com/RLUIPA overview (Cornell LII): https://www.law.cornell.edu/wex/rluipaRFRA overview (Cornell LII): https://www.law.cornell.edu/wex/religious_freedom_restoration_actDistrict of Columbia v. On Tuesday, the Supreme Court ruled 6–3 that federal law protecting prisoners' religious exercise does not extend to a lawsuit brought by an incarcerated Rastafarian man who sought damages after prison officials forcibly shaved his head. The man, Damon Landor, sued both the Louisiana Department of Corrections and several of its officers individually under the Religious Land Use and Institutionalized Persons Act (RLUIPA), which defines the religious rights of people held in institutions that receive federal funding. However, the Court's majority found that the law does not apply to the prison officials named in the suit, as they had not entered into a formal agreement with the federal government. Officials regularly review each resident's behavior, needs, and progress to ensure placements support both institutional safety and rehabilitation efforts. By matching people with appropriate medical, educational, and mental health resources, Missouri aims to promote successful reentry while maintaining secure correctional environments.

Could a Nonprofit Prison Actually Fix Corrections in America? Brian Koehn spent 28 years as a warden in private corrections, running five facilities and overseeing security at 65 more. Now he's building Social Purpose Corrections, a nonprofit prison model that doesn't exist anywhere else in the US, designed to fix the incentives that keep the system broken. Mark Edge talks with Brian about why correctional officer turnover is the root cause behind almost every failure in American prisons, why "hard on crime" wins elections but makes outcomes worse, and why the real recidivism numbers are nowhere close to what most states report. They also get into the case for "smart on crime" over "hard on crime," and why Brian, having actually run the system, sees a distinction that matters more than most politicians want to admit. British-Nigerian artist, filmmaker, and researcher Onyeka Igwe talks with curator Jeanette Pacher about her project No Archive Can Restore this Chorus of (Diasporic) Shame (2024/26) that lends its title also to her solo show; her interest in sound, especially protest songs, and her love for sacred harp singing, filming in the abandoned Nigerian Film Unit in Lagos, and her iterative practice. Their conversation was recorded on 11 June 2026 at the Secession. Onyeka Igwe No Archive Can Restore this Chorus of (Diasporic) Shame 12.6. – 30.8.2026 In the exhibition, two video works unfold in close relation to one another. The film traces the afterlives of British colonialism in Nigeria through the abandoned site of the former Nigerian Film Unit in Lagos – once a key outpost of the Colonial Film Unit's propaganda apparatus. Today, the building stands in disrepair. The images once housed there are difficult to access – not only due to their material degradation, but also because of a broader reluctance to confront what they contain. Presented on the window front, the moving image blends with the institution's architecture and urban surroundings, situating its sonic and visual field within the specific conditions of its display. More Onyeka Igwe is a London-born & based moving image artist and researcher. Her work is aimed at the question: how do we live together? Not to provide a rigid answer as such, but to pull apart the nuances of mutuality and co-existence in our deeply individualized world. Onyeka's practice figures sensorial, spatial and counter-hegemonic ways of knowing as central to that task. For her, the body, archives and narratives both oral and textual act as a mode of enquiry that makes possible the exposition of overlooked histories. The work comprises untying strands and threads, anchored by a rhythmic editing style, as well as close attention to the dissonance, reflection and amplification that occurs between image and sound. Solo exhibitions include our generous mother, Tate Britain (2025), history is a living weapon in yr hand, Bonington Gallery and Peer, UK (2024), A Repertoire of Protest (No Dance, No Palaver), MoMA PS1, New York (2023), The Miracle on George Green, The High Line, New York, USA (2022), a so-called archive, LUX, London, UK and THE REAL STORY IS WHAT'S IN THAT ROOM, Mercer Union, Toronto, Canada (2021), and Corrections, with Aliya Pabani, Trinity Square Video, Toronto, Canada (2018). Onyeka jointly received the 2025 Film London Jarman Award, was awarded the 2021 Foundwork Artist Prize (2021), Arts Foundation Futures Award for Experimental Short Film (2020) and was the recipient of the Berwick New Cinema Award in 2019. Her video works are screened at film festivals internationally. Jeanette Pacher is a curator at the Vienna Secession since 2007. Send us Fan MailWhen I decided to talk about police reform I immediately thought of Brad Seifers. I had the pleasure of working extensively with Brad over the years and new that if anyone had solid thoughts on police reform it would be Brad.Brad recently retired from law enforcement after a 32-year career. He started at the Indiana University Police academy in 1994, then spent over 22 years in municipal policing. He served in every roll from patrol officer to lieutenant of patrol and detectives. He then made the transition back to higher education policing by rejoining the IUPD as a lieutenant. Brad eventually moved up in the ranks to become the deputy superintendent of IUPD which is the position he retired from in January of 2026. Brad slso spent 29 years serving the US Army, retiring with the rank of Command Sergeant Major. That career was predominately in military police. He also holds a BA in Criminal Justice and a Master of Science in Performance Improvement.Brad was gracious enough to give us some time.

Send us Fan MailYou can build the best peer support team on paper, fund the best wellness initiatives, and still miss the people who are hurting the most. That's where this conversation with Dr. Stacey Raymond goes, and we don't stay polite about it. We talk about why first responder mental health needs to start at the academy level, with a clear warning: the job will expose you to traumatic events, and it will change your sleep, your relationships, and how you see the world. We also get specific about a topic that frustrates a lot of officers and clinicians alike: what “vetted therapist” should actually mean. If you're a clinician who wants to work with police, fire, EMS, or dispatch, cultural competence isn't a buzzword. It's ride-alongs, learning how calls really flow, understanding why police often don't get to process between calls, and recognizing how trust is earned minute by minute. Along the way we highlight the hidden load carried by 911 dispatchers, including relentless exposure to crisis audio, limited movement, and little closure due to HIPAA. Then we zoom out to leadership and risk. Chiefs and supervisors often want certainty about who is “safe,” but human behavior is dynamic and can shift fast with substances, gambling addiction, and life stress. Dr. Raymond shares research using the ACEs questionnaire and adult attachment patterns, showing how certain adverse childhood experiences correlate with avoidant, mistrustful coping, meaning some officers will bypass peer support and refuse therapy even when they know they're struggling. If you care about police wellness, first responder resilience, EMDR-informed trauma treatment, and building a culture where getting help doesn't feel dangerous, hit play. Erik Wetterling, Founder and Editor of The Hedgeless Horseman website, joins me to reflect on the status of the gold and silver bull market, after the corrective moves of the last few months. He also outlines how he is approaching rebalancing his portfolio from a high-conviction standpoint, and by weighting his positioning heaviest to the junior resource stocks with compelling alpha catalysts on tap in their coming newsflow. He starts off noting that the correction thus far in gold and silver, from the high peaks earlier this year to the recent lows is almost getting as extreme, on a percentage basis, as the moves seen in the metals during the Great Financial Crisis. For this reason he believes most of the downside price moves have already occurred across the sector, and he is not expecting a prolonged multi-year bear market from here. With regards to the junior resource stocks, his perspective is that these deeper corrections bring clarity to one's conviction in any given portfolio position. When analyzing the downside trends that we've seen in precious metals stocks over the last few months, and especially during the sharp moves lower, like what we saw the end of last week; he encourages investors to reevaluate what they hold and why they got positioned in those stocks in the first place. One may feel compelled to accumulate a larger position as the price and valuation of a stock drops lower, because of the conviction they have in that company value catalysts on the horizon. The lower it goes, the more mispriced it will appear by the market, and the more compelling it will be on a risk/reward basis. In contrast, he points out being willing to sell out of a sector momentum beta position, especially if one gets lower conviction the more it corrects lower in price. This distinction will underscore that this position was more of a beta momentum trade, where the company was still dependent on higher metals prices strong sector sentiment to keep moving higher. He outlines that focusing on alpha catalysts in junior resource stocks, can end up meaning less outperformance during the really bullish periods, but conversely less downsize pressure during sector corrections. Erik highlights why Goliath Resources Limited (TSX-V: GOT) (OTCQX: GOTRF) is a good example of a stock that has corrected hard with the rest of the PM sector, but is fully-funded for a 50,000 meter drill program, with a high hit rate on the prior few seasons of drilling, and a propensity to rerate based on positive newsflow. He notes that this stock is demonstrating a pricing pattern he has seen over and over again in junior mining stocks. Often a correcting stock will briefly break downside support, which is where the weak-conviction retail investors capitulate, and then the equity will consolidate and then suddenly surge higher based on their unique alpha catalysts, leaving investors chasing it higher once again. Send us Fan MailReal reform requires honesty. It requires evidence. It requires experience. And most importantly—it requires conversation. Not lectures. Not slogans. And not screaming people into silence. That's what this podcast is about. Not defending bad policing. Not pretending problems don't exist. But talking honestly about what real police reform should actually look like—from the perspective of the people doing the job.Because for too long, police reform has been happening to officers instead of with them. And that's how you end up with bad policy, dangerous policy, and officers who feel abandoned by the very people making decisions about their profession. This season, we're going to talk to the people on the street. Patrol officers. Trainers. Detectives. Supervisors. The men and women actually doing the work. Not because they're perfect. But because if you want to reform policing, maybe you should start by listening to the people who actually police.

Markets continue to grind higher, but the rally is becoming increasingly dependent on one sector: Technology. While technical trends remain bullish overall, the acceleration in semiconductors and mega-cap tech is creating extreme deviations from long-term moving averages and historical norms. Lance Roberts examines why overbought markets can stay overbought, why narrow market leadership matters, and what history says about parabolic advances in speculative sectors. We also discuss why a 20% correction would not necessarily break the long-term bullish trend, what types of events could trigger a broader reversal, and why risk management becomes critical when momentum accelerates too quickly. We review long-term charts of the S&P 500 and Semiconductors, the growing dependence on Technology leadership, and why investors chasing performance should consider rebalancing and taking profits before volatility returns. Wall Street still defines a “bear market” as a 20% decline, but does that rule still apply in today's market environment? Lance Roberts & Jon Penn break down why traditional definitions of corrections and bear markets may be obsolete after 17 years of Fed intervention, massive liquidity injections, and historically elevated valuations. We also answer one of the biggest questions investors are asking right now: how do you balance staying invested while also remaining defensive? We discuss risk management, position sizing, portfolio hedging, and how investors can recognize when it may be time to become more cautious without abandoning long-term investment discipline. Lance & Jon also iscuss one of the biggest behavioral mistakes investors make during strong bull markets: allowing the “tax tail” to wag the investment dog. We examine strategies for trimming concentrated positions, managing capital gains, utilizing Donor Advised Funds, exploring option collars for risk management, and remembering that paying taxes usually means you made money in the first place. Corrections gets judged by headlines it didn't write, so I'm taking you behind the scenes of a month that reminded me why this profession deserves real respect. From Correctional Officers Week events to national recognition, I share the moments that felt like the “best of corrections” and the lessons we can bring back to our own agencies. We start at the One Voice United conference (link below), where I join Pete Bludworth (Corrections Unfiltered) and Sarah Robuck (Lexipol and Corrections1) to talk about our jobs and our voices. If we don't tell the truth about what correctional officers do, nature abhors a vacuum, and the public story gets filled with TV myths, one-sided news, and silence about the good work happening inside facilities. We also dig into wellness in corrections, efforts to get lawmakers to walk through prisons before setting policy on staffing and funding, and a powerful account from New York's union leadership caught between political pressure and officers pushed past the breaking point. Then we pivot to the stories many people never hear: the role correctional staff played during 9/11 recovery, and how corrections shows up in emergencies with resources and readiness. I also talk about practical support for staff, including a vendor focused on home loans for public servants that explicitly includes corrections, and the National Medal of Honor for Corrections banquet, where courage and service are honored on a national stage. One of the vendors I met at OVU (link below) is a company that is working to get public service heroes, including correctional officers, into houses. American Hero Home Loans uses its Hero Advantage+™ to connect eligible heroes with trusted real estate, lending, title, settlement, insurance, and home service partners. We close with training and leadership: field training insights from the Southeast Field Training Officers Association (SEFTOA - link below). I also share with a new leadership class my framework for handling change by reframing fear and walking through the next door of their life with skill and confidence. If you care about corrections leadership, correctional officer wellness, and changing public perception of corrections, this one's for you. Subscribe, share it with a coworker, and leave a review so more staff can find these stories. One Voice United & The National Medal of Honor for Corrections https://onevoiceunited.org/American Heroes Home LoansCorrections Webpage:ahhlusa.com/correctionsAHHL Flyer:https://canva.link/theprisonofficer Joe FerraroFounder & CEOAmerican Heroes Homes and Lending631-767-9073joe.ferraro@ahhlusa.com or joeferraro@annie-mac.comAngela HarrenDirector of Business Development & MarketingAmerican Heroes Homes and Lending612-423-4423angela.harren@ahhlusa.comSoutheastern Field Training Officers Associationhttps://seftoa.org/For my new book: Weight of Justice: Leadership Lessons from Inside America's Toughest Prisons: A Correctional Officer's JourneyMichael Cantrell's books: https://www.cantrellwrites.com/Amazon: https://amzn.to/4utqUSOSend us Fan Mail PepperBallFrom crowd control to cell extractions, the PepperBall system is the safe, non-lethal option.Command PresenceBringing prisons and jails the training they deserve!Disclaimer: This post contains affiliate links. The prosecution's sentencing memorandum in the Kouri Richins case included pre-sentencing communications in which the defendant stated she intended to "expose this county, the prosecution, the judge, the Richins, the investigation." The language — "they picked the wrong one" and "they haven't seen anything yet" — preceded a life-without-parole sentence and raises substantive questions about post-conviction conduct from within the Utah correctional system.Eric Faddis examines the legal instruments available to those identified in the defendant's communications: protective orders, no-contact orders, Department of Corrections communication restrictions, and the procedural differences between guardian-directed contact cessation and court-ordered prohibitions. He addresses the legal complexities of third-party proxy contact — a scenario where individuals acting on behalf of a convicted person may not technically be subject to the same restrictions. The defendant faces twenty-six additional pending felony charges in a separate financial crimes prosecution, including mortgage fraud, money laundering, forgery, and communications fraud. Faddis evaluates whether that pending caseload provides any additional legal leverage for those seeking protection. The three minor children are currently in the custody of the victim's sister, with all contact terminated since April 2024.Footer Links:Join Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Hidden Killers With Tony Brueski | True Crime News & Commentary
The prosecution's sentencing memo included a message Kouri Richins wrote before the judge even ruled. She said she'd "expose this county, the prosecution, the judge, the Richins, the investigation." She wrote "they picked the wrong one" and "they haven't seen anything yet." This isn't speculation about what she might do — it's what she already put in writing from a jail cell.Eric Faddis breaks down the legal architecture of protection available to the witnesses, the Richins family, the prosecutors she named, and anyone else in her orbit. He explains the difference between a guardian's decision to cut off contact and a court order that enforces it. He walks through what the Utah Department of Corrections monitors automatically versus what the people on the outside have to actively request. He addresses the proxy problem — when a convicted person doesn't reach out directly but uses family members, admirers, or third parties who aren't technically violating anything. And he connects the twenty-six pending felony charges in Kouri's separate financial crimes case to whether that caseload gives anyone on the outside additional legal leverage.Because the sentence is life without parole. But the reach from inside doesn't end at sentencing.Footer Links:Join Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video?
