Steve Wood, Ph.D. joins host Bill Kanasky, Jr., Ph.D. to talk about how to help witnesses navigate deposition situations where they may be thrown off by plaintiff's counsel disorganized approach or confusing questions, whether intentionally confusing or not. Bill and Steve describe what witnesses should do and be encouraged by defense counsel to do when plaintiff's counsel asks bad or poorly worded questions. What must be avoided is your witness trying to fix opposing counsel's poorly phrased question and providing a response to that since, regardless of how the question is worded, if the witness provides any answer to what they think the question is, they are stuck with their answer. It is critical to practice asking your witnesses bad questions and help them understand how to respond when they are asked poorly worded questions. Get a scouting report on opposing counsel to know what their style is for questioning and practice asking questions of your witness with that approach so the witness is able to experience it in the prep and be prepared when it happens at the deposition.

On The Patrick Madrid Show, listener Amari from South Bend, Indiana calls in with a classic Catholic dating dilemma: Should she marry her boyfriend even though he’s not Catholic? She’s been with her boyfriend for over two years, and they’re talking marriage. But there’s a big issue: she wants to raise their kids Catholic, send them to Catholic school, and keep the faith at the center of their family life. Her boyfriend? Not so much. He thinks Catholic school will make the kids weird and isn’t sold on the Church at all. Patrick's Red Flags Are Flashing Patrick believes that this is a major red flag. He reminds Amari that marriage is already hard enough without adding fundamental disagreements about faith into the mix. If she marries a man who isn’t on board with her Catholic values now, what happens when Sunday morning rolls around and she’s taking the kids to Mass alone while he stays home watching the game? Patrick shares a sobering stat: When dads don’t actively practice the faith, their kids are far more likely to leave it, even if mom is super devout. What Should Amari Do? Patrick encourages Amari to think long-term: Marriage thrives in unity: finding a Catholic spouse will make faith-based family life way easier. Don’t bank on a future conversion: Yes, God can work miracles, but assuming your spouse will “come around” is risky. Read up! He recommends Steve Wood’s books: The ABCs of Choosing a Good Husband (for Amari) The ABCs of Finding a Good Wife (for her boyfriend: Valentine’s Day gift, maybe?) Final Thoughts: Love vs. Faith Patrick isn’t trying to be overly critical, but he wants her to be realistic. If her faith is deeply important to her, she needs to consider what marrying someone with different beliefs could mean for her future, her kids, and even her own spiritual life. Amari seems open to Patrick’s advice and says she’ll talk to her boyfriend and check out those books. Will she call back in six months with an update? We’ll see. But for now, Patrick leaves her with one big piece of advice: Don’t ignore the red flags.

Bill Kanasky, Jr., Ph.D. joins host Steve Wood, Ph.D. to discuss five (5) problematic witness types. Steve and Bill talk about who these witnesses are, how to identify them, and how to work with each type of witness: 1) The overly agreeable witness - a witness who is willing to agree with everything opposing counsel says or implies; 2) The defensive witness - someone who wants to argue or won't agree with even basic facts; 3) The angry witness - a witness whose rage about many/all aspects of the litigation prevent them from working constructively with the legal team and/or who are defensive in their demeanor; 4) The apathetic witness - a witness who appears uncaring; 5) The experienced witness - a potentially arrogant witness who has prior experience with testifying and therefore may believe they know what to do and what to expect which could lead to a compromised performance during testimony. Each witness type can potentially fall victim to fight, flight, or freeze responses. Fight is an argumentative response when a witness wants to argue and defend their actions. Flight is when the witness feels scared or triggered and responds in a way to pacify the questioner via explanations and sharing too much information. And the freeze response is when the witness simply agrees with the assertions of the questioner and doesn't want to contradict them. Effective witness training requires proper neurocognitive assessment of the witness to determine their cognitive, emotional, and behavioral state and an appropriate amount of time to identify potential psychological barriers that will prevent the witness from fully understanding and embracing the training and prep so their testimony can be effective. In 2021, former prosecutor Steve Wood told May the Record Reflect that to grow as a trial advocate, he had to accept that he is “insufferably boring.” What did he mean by that? And, how can it help you grow as an advocate as well? In this self-deprecating but entirely serious conversation, Steve and fellow former prosecutor Laurie Gilbertson talk about the neuroscience of boredom, multisensory engagement in the courtroom, telling a compelling story, and how it all adds up to self-confidence and stronger advocacy for your client. One, admit that we're boring — all of us, all the time. Two, with the aid of people like Laurie, do the things that we can do to be less boring. And then three, never fall prey to the conceit that at any given time a majority of the trier of fact is paying attention. Assume the opposite. But what we can do, most primarily, is introduce change into the courtroom environment. That's our mission.” Steve Wood“. . . what I found often is that jurors who have watched so much tv, who have watched so many movies, who have read legal thrillers, who have maybe listened to true-crime podcasts — some of them, if not many of them, expect to be entertained, and when you, as the attorney, are not kind of doing all these things that Steve is talking about in terms of interjecting that change and keeping them entertained, a lot of the jurors are surprised that court is actually that boring. They expect it to be a lot more interesting.” Laurie GilbertsonResources Steve Wood (bio)Laurie Gilbertson (bio)Top 10 Tips that Make a Difference, with Steve Wood (episode)Thinking with Your Hands: The Surprising Science Behind How Gestures Shape Our Thoughts (book)

Alright. It's time for some real talk. Patrick Madrid will tell you about this really alarming trend. Young men, especially teens and early adults, are becoming increasingly alienated from society. He blames much of this on the rise of social media and online dating, which often leave young men isolated and frustrated, especially when their online interactions don't lead to real, meaningful relationships. Patrick shares a clip from Professor Scott Galloway of NYU, who drops a pretty bold statement: "the most dangerous person in the world is a lonely, broke, young male." According to him, "we're producing millions of them." Oof! Prof. Galloway explains how young men are swiping hundreds of times on dating apps, only to get ghosted and rejected, leading to feelings of worthlessness and isolation. Add in the disappearance of hands-on jobs like auto and woodshop, and it's no wonder young men are struggling to find purpose. Now, Patrick doesn't pretend to have all the answers, but he's quick to note he's thankful he never had to deal with online dating (he's been married for decades). He paints a vivid picture of how different things are for today's youth – from face-to-face dating to today's swipe-happy culture, which can leave young people feeling more disconnected than ever. The stats don't lie: Prof. Galloway shares that 1 in 7 men has zero close friends, and 1 in 4 can't even name a best friend. Yikes! So, what's the solution? According to Patrick, it starts with good fathers stepping up. He urges dads to get out from behind their own screens and actively engage with their sons. Whether it's golfing, camping, or even just going for a walk, fathers need to spend quality time passing on wisdom and guiding their sons towards being godly, productive men. It's about creating fun moments where you can have one-on-one convos with your son about God, manhood, and what really matters in life. Time flies, and it's too easy to look back and wish you'd spent more time bonding with your kids. You don't want that regret! Patrick recommends Steve Wood's book "Legacy" as a good book for fathers to dig into. It will give solid advice on how to raise godly children and create a lasting impact. The loneliness epidemic won't fix itself, and it's up to fathers, and all of us, to help guide the next generation into a more connected, purposeful life. You can do this, dad! Feeling inspired? Share this with someone who could use a boost of fatherly wisdom!
Patrick continues the conversation with Dan about how to trust God when it comes to raising adult children. Mary - I think them using weed is a big factor as well as fathers not being in the home because of lack of testosterone. Stephanie - I have a financial burden and I want to be a stay at home mom. Can I get your advice on this? Melissa - I stayed home to raise my kids. I just want to assure Stephanie that everything will work out and it will be alright. Patrick sets the record straight that Steve Wood's wrote the book “ABC's of Finding a Good Husband/Wife” Mark - I went to confession and the priest said I can't forgive your sins - the sin I confess every time is that I am divorced and I remarried and I don't plan to change that. what should I do? Toni – (On Stephanie's call) She should get out while she can because something will always come up that takes her away. She can always go back to work once her kids are grown. Judy - I was a teacher and when I was teaching religion the book recommended that I do a pretend baptism - so I would pick kids who weren't baptized and would say the words and pour the water. Did I baptize them and do i need to go to confession?
