If your kids are going to reach their God-given potential, though, they'll need to struggle some and find their own answers to the biggest questions in their lives. That's healthy, but that also involves taking a step back. Say the name "Ernie Kovacs" today and you may well be met with a quizzical look. But say "the video art pioneer who inspired SNL, Python, Laugh In, and MST3K among many others" and you'll be in business! Smart-ass adlibs, odd ball musical acts, and numerous (and sometimes surreal) camera tricks that we take for granted today were all part of Ernie's toolkit, and he was ubiquitous on 1950s tv. He also became a superb character actor and sketch comic, and - not surprisingly -- he was an early inductee into the Academy of Television Arts and Sciences Hall of Fame. Transcript below. https://youtu.be/EEj137ADBzY TRANSCRIPT Libertarian Answer Man: Oaths: With Kent Wellington Stephan Kinsella & Kent Wellington Oct. 17, 2021 00:00:03 STEPHAN KINSELLA: Okay, hey, this is Stephan Kinsella, Kinsella on Liberty.  This is another one of my episodes where someone asked to talk to me about something.  And I said yes, if I can record it in case there's anything of interest to listeners.  So this is Kent Wellington who briefly informed me he's not exactly a libertarian but just has some questions.  I don't really know what you want to talk about, but Kent, why don't you introduce yourself, however you want to do it, and then we can start? 00:00:27 KENT WELLINGTON: Hey there.  My name is Kent Wellington, and I just have been very anti-IP since I was a child really.  And when I realized that Mr. Kinsella was the one who wrote one of my favorite books, Against IP, I was really taken aback.  And then I was like, wow, I should reach out to him and just try to have a conversation with him because I've sort of been in the – what do you say – I've just been up in the towers on these topics for a long time, like my whole life. 00:01:14 And I've never – I never really get to talk about these topics with anybody one on one, and I just saw his – that he puts his email out there, so I was like, I'll just email him, see if he'll – he's willing to talk to me for even a minute.  So that's what we're doing right now, and I have some very different takes, I guess, what I think are some novel takes but maybe aren't, and I'd love to be proven wrong, or I just wanted to throw some things at you regarding contracts, IP, anarchism, a few different things.  Mainly, I guess my main hypothesis is – so I'm very into the quotes from Jesus on oaths, and I believe that, without – so I think that oaths are the key social mechanism of the state.  Do you – what do you think about that?  Are oaths not the key social mechanism of the state? 00:02:41 STEPHAN KINSELLA: Oaths?  O-A-T-H? 00:02:44 KENT WELLINGTON: Yes, oaths, yeah. 00:02:46 STEPHAN KINSELLA: I'm not sure I know what that means.  What do you mean? 00:02:51 KENT WELLINGTON: So oaths are – if you want to become a doctor in the US, at least a professionally recognized doctor, you have to take the Hippocratic Oath.  Others are – so our whole professional society is filled with oaths, which are really these sort of mystical activities, and our secular world is filled with these oaths.  To become a lawyer, you need to take the bar oath.  To become a politician, you just swear in.  You need to take an oath of office.  There's a bajillion oaths you need to take in modern society if you want to partake in modern society. 00:03:42 And so Jesus – and I'm not necessarily getting religious here.  You can just say that in one of the most popular books in the world, which the Bible is, well, the biggest guy, the most important guy in the book, in the New Testament, Jesus, in his biggest speech, the Sermon on the Mount, he says take no oaths at all.  Instead, just say yes or no.  Anything beyond this comes from the evil one.  So my interpretation of that is that anything beyond you giving your word,

I was asked some questions about intellectual property, and how you can sell something (like information, or ideas, or even your labor) if you don't own it, by Shea Fisker, a budding libertarian and fellow libertarian. He had just the right attitude. He listened and thought, and asked reasonable questions when he had an issue that puzzled him. Would that so many cocksure pro-IP libertarians, who really know almost nothing about IP law itself and the fundamentals of libertarian property theory, or even how to argue or discuss issues without being tendentious, equivocating, or question-begging. If someone is creating digital products, do you think it's OK to sell them, even though they are neither non-rivalrous nor non-excludable, simply with IP removed from the picture? For example, I noticed most of your books are in physical form, embodying legit private property, but one of your books is available in Kindle and isn't for free. Is the thought simply that selling such an informational, non-physical product is purely a voluntary, contractual exchange, and that it is only the stopping of people from freely sharing that good with others after that purchase (IP) that is wrong? There's seemingly something tricky about even the selling of the thing, say a piece of software, when the creator could hardly be considered the owner of it in the first place. But, perhaps I am confusing something here, because to say someone couldn't even sell a digital/informational product that they created, IP aside, seems akin to some sort of enforced communism. I hope that makes sense. I'd love to hear your thoughts. BTW, I'm from New Iberia and went to LSU in BR. In one way, it is analogous to say, charging someone for consulting, which is simply the exchange of words, which one can't be said to own. And to say one couldn't legitimately (according to libertarian principles) sell a digital product at scale, would be equivalent to saying one must be forced to do all consulting publicly for the whole world to consume anytime that one tries to privately exchange a one-to-one service that isn't physical. So I think I aiming to clarify two things here and am somehow wrongly mixing them up: 1) the physical vs. non-physical; and 2) IP vs. selling. I am still not sure where the concept of ownership fits in here, but if we grant that selling of anything that doesn't violate other peoples' property is fine, then it shouldn't matter whether the thing is scarce or not as to whether one can sell it for money. In other words, I could charge you $1000 for me to tell you “Hello” one time, if you consent to that exchange. *** Not to overload you here straight out the gate, but in one of your PorcFest talks I just heard you say “Creation is not a source of property, it's a source of wealth.” I think this point may be key in the issues I'm bringing up above. Kinsella: It would take me a bit to write up an answer.
