Our depo case digest episodes present a fast roundup of new deposition-related rulings nationwide. Today: (1) Two new rulings on relevance as a basis to instruct a witness not to answer a question, or to halt the deposition for purposes of seeking a protective order; (2) A ruling about a clever way to assure testimony is admissible when you use leading questions in deposing a witness considered "hostile" under rules of evidence; and (3) A case on excluding parties from depositions when their presence may traumatize deponents. All cases mentioned in this episode are cited in the show notes, with helpful parentheticals. Can't see all the cases? Not all podcast sites allow lengthy show notes. Click through to our home page, where the full notes are always accessible. Thanks for listening!SHOW NOTES:Delgado v. Donald J. Trump for President, Inc., et al., No. 19-CV-11764 (AT) (KHP), 2024 WL 3219809, (S.D.N.Y. June 28, 2024) (order denying pro se plaintiff's motion to compel certain answers that non-party deponent declined to answer following instruction by counsel based on relevance)Keplar v. Google, LLC, 346 F.R.D. 41, 51 (N.D. Tex. Mar. 8 2024) (“if counsel's questions go so far beyond the realm of possible revenue relevance where the deposition is being conducted in an abusive manner, i.e., in bad faith or in a manner that unreasonably annoys, embarrasses or oppresses the deponent or party, then it would be permissive to instruct the deponent not to answer and move for a protective order")Jenkins v. Miller, No. 2:12-CV-184, 2024 WL 3220349, at *2 (D. Vt. Jan. 2, 2024) While the Court cannot issue a general a ruling at this time, it acknowledges that Miller will likely be an important witness for all parties. The Court will therefore make itself available on January 18, 2024, the date on which the deposition is scheduled to take place, to issue rulings as necessary. Plaintiff's motion for leave to ask leading questions (ECF No. 745) is therefore denied at this time without prejudice, and may be renewed at the time of the deposition and/or thereafter as necessary.Austin v. Fordham University, et al, No. 23 CIV. 4696 (JLR) (GS), 2024 WL 3161854, at *4 (S.D.N.Y. June 25, 2024) (“The Court grants Austin's motion for a protective order preventing Sweeney from attending Austin's deposition in person. However, Sweeney may be present in the same location where the deposition is taken (but in a different office) and permitted to see and hear the deposition in real time via a one-way remote video feed. Sweeney's counsel may consult with his client during normal breaks in the testimony and may also leave the deposition room when he deems it necessary to consult with his client during the deposition”)Luce v. United States, 469 U.S. 38, 41, 105 S. Ct. 460, 463, 83 L. Ed. 2d 443 (1984) (“Although the Federal Rules of Evidence do not explicitly authorize in limine rulings, the practice has developed pursuant to the district court's inherent authority to manage the course of trials. See generally Fed.Rule Evid. 103(c).”)Fed.R.Evid. 611(c) (rule allowing the use of leading questions during what would otherwise be direct examination upon a showing the witness meets the test of hostility)Fed. R. Civ. P. 26(b)(1) (general discovery rule on allowing discovery "regarding any nonprivileged matter that is relevant...") Fed. R. Civ. P. 26(c)(1) (rule on grounds for protective orders)Fed. R. Civ. P. 30(d)(3)(A) (rule on terminating depositions for purposes of seeking protective orders)

Network 42 is an off-world television broadcaster and is expanding their territory to include Keplar 609c, the home planet of Neotropolis. In order to bring all the best news and reviews from the Blue Silver Planet, they're going to need as many tele-journalists as they can get their corpo hands on, so tune in to get all the details. Also, we're officially introducing Zirco, the pirate radio DJ at Neo Rebel Radio who's taking a very humanist approach to life in Neotopolis (don't give the A.I. any more rights). He doesn't care for Helix (the Corpos) or Endline (The Militants), and while he was a former member of The Resistance (The People), he didn't care much for their views on equality for sentient A.I. beings so he struck out on his own with his small band of likeminded biological beings. This week on A Podcast About Catholic Things, Dan talks about the Mass--what it is and what it isn't (despite cultural trends). Eric gripes about the Tridentine Mass he attends. In current events, Whole Foods Markets stops selling straws, South Korea helps North Korea fight their food shortage, judges side against Trump in financial records fight with democrats (Eric theorizes about why), more fallout after the Mueller report, John Walker Lindh is to be released and Trump is mad, earth-like planets are discovered by the Keplar telescope in new algorithms, Trump sends more troops to the Persian Gulf, Alabama's abortion law is challenged in court, and the giant asteroid 1999 KW4, comes closer to Earth than ever before. In the land of NonSense, a man tries to fake his emissions test with a fake document drawn with a black marker, republicans are pelted with milk shakes, and a guy with a bat mobile fights crime. In this episode of the Lives That Speak podcast, Bryan spoke to Andrea Johnson Razzaghi '78, on the vastness of deep space, practicing for failure, the scariest seven minutes in engineering, and why you should always stop and smell the science. The director of the NASA Office of JPL Management Oversight at the Jet Propulsion Laboratory, Andrea has played a significant role in many exciting NASA endeavors over the course of her career. She's worked on missions that have earned the Nobel prize, landed an SUV-sized rover on Mars, helped to unravel the mysteries of the big bang, and discovered planets beyond our solar system, just to name a few. During the Clinton Administration, The White House requested that Andrea serve as a senior policy analyst in the Office of Science and Technology Policy. In that position, Andrea coordinated the activities of the National Science and Technology Council and the President's Council of Advisors on Science and Technology. Prior to her time at NASA, she worked as a Navy contractor. Andrea has won many awards for her service to NASA and the nation and was the 2014 recipient of the Brown University Engineering Alumni Medal and the 2020 Catholic University of America Engineering Distinguished Alumni Award.Video - 7 Minutes of Terror: Curiosity Rover's Risky Mars LandingFollow Sidwell FriendsSubscribe to us on Apple PodcastsSubscribe to us on SpotifyFollow us on FacebookFollow us on InstagramFollow us on Twitter

Convincing others to live their lives the way they are supposed to was hard to do during the medieval period. For God, King and Country, the people had to be convinced, come clean or simply die if they stepped out of line. But, how to make an impression while getting this accomplished? Lets examine the new and super handy tools that the people of the past came up with to get the job done. https://allthatsinteresting.com/medieval-torture-devices/3 (photos) History Extra: Q&A: Were ducking stools ever used as punishment for crimes other than witchcraft during the Middle Ages? https://www.historyextra.com/period/medieval/qa-were-ducking-stools-ever-used-as-punishment-for-crimes-other-than-witchcraft-during-the-middle-ages/ https://www.ancient-origins.net/artifacts-ancient-technology/brazen-bull-gruesome-ancient-greek-torture-device-turned-screams-music-021359 TORTURE IN THE MIDDLE AGES: https://www.history.co.uk/shows/britains-bloodiest-dynasty/articles/torture-in-the-middle-ages http://www.medievalwarfare.info/torture.htm#ducking http://www.medieval-life-and-times.info/medieval-torture-and-punishment/water-torture.htm https://tortureum.com/history-of-torture/ BIOLOGY13 Gory Details About What It's Like To Be Skinned Alive, Laura Allan Updated October 10, 2018 https://www.ranker.com/list/what-being-skinned-alive-feels-like/laura-allan Scold's Bridle - History of the Branks http://www.historyofmasks.net/famous-masks/scolds-bridle/ How the Spanish Inquisition Worked BY SHANNA FREEMAN https://history.howstuffworks.com/historical-figures/spanish-inquisition3.htm The Stomach-Turning History Of Rat Torture – Perhaps History’s Worst Way To Die By Wyatt Redd Published November 30, 2017 https://allthatsinteresting.com/rat-torture-method 10 Additional Gruesome Torture Devices VALENTINEDRAGON https://listverse.com/2010/07/18/10-additional-gruesome-torture-devices/ Fl Hirsch, A.
