Fractures have appeared in the foreign relations between South Africa and the United States following a series of events. These events included accusations from the US ambassador to South Africa that a Russian cargo ship, Lady R, was loaded with supplies for use against Ukraine, and a call between Minister of International Relations and Cooperation, Naledi Pandor, and the Hamas leader Ismail Haniyeh. But after a fairly friendly 20th AGOA Forum over the past week in Johannesburg, relations seem to be on the mend. In an interview with Biznews, Dr Piet Croukamp, political analyst and a senior lecturer at North-West University, said that it would be optimistic to think that South Africa is out of the danger zone because the country's “foreign policy is so unstable.” However, the idea that South Africa will be removed from the AGOA agreement appears to have dissipated. It appeared, he said, that the Americans were buying the idea that the agreement must be stretched over a longer period than five years, but he had doubts that a new agreement would materialise before 2025. He said that unless the South Africans did something “really stupid” and it is not impossible with Naledi Pandor at DIRCO, he could not see South Africa being removed from AGOA any time soon. The Americans will however not tolerate support for Hamas, he said. Dr Croukamp also warned that South Africa will have to do something about its infrastructure, electricity and roads as it would not be able to compete with American producers and service providers.
South Africa's President Cyril Ramaphosa has called on the US Congress to approve an early and "sufficiently lengthy" extension of the Africa Growth and Opportunity Act (Agoa) to provide investors looking to take advantage of the scheme's trade benefits with the certainty they need to "build new factories on the African continent". Opening the Agoa Forum in Johannesburg on Friday, Ramaphosa also underlined the "great value" of retaining all beneficiary countries to support the development of regional value chains and help industrialisation on the continent. His address followed confirmation that US President Joe Biden "strongly" supported a reauthorisation of the trade arrangement by Congress beyond its current 2025 expiry, as well as an announcement that Agoa benefits would be terminated on January 1, 2024, for Gabon, Niger, the Central African Republic, and Uganda. Gabon and Niger's eligibility had been terminated because of "unconstitutional changes of government", while benefits were withdrawn from the Central African Republic and Uganda because of "gross violations of internationally recognised human rights being perpetrated by those governments". Ahead of the announcement, which included confirmation that Mauritania's eligibility would be reinstated, there were 35 Agoa-eligible countries, against the 49 countries that are potentially eligible for inclusion under the unilateral scheme, which has been in place since 2000. South Africa's own eligibility was thrown into doubt earlier this year when Ambassador Reuben Brigety alleged in May that South Africa had loaded arms and ammunition on to the sanctioned Russian vessel, the Lady R, in December. President Cyril Ramaphosa commissioned a panel, led by retired Judge Phineas Mojapelo, to investigate the matter. While only an executive summary of the report was released, indicating the allegations to be incorrect, relations improved to the point where it was confirmed on September 20 that the forum would proceed in Johannesburg. Ramaphosa said an early reauthorisation and renewal would help to ensure that the legislation achieved its objectives and reached its full potential. "An early renewal can help to strengthen trade and investment. "At the same time, we see potential to enhance Agoa with reforms that will add more products and will make it easier for small and medium-sized businesses to use it," Ramaphosa said. Total goods imports into the US under Agoa recovered to $10-billion in 2022 from $6.8-billion in 2021, and South Africa emerged as the top exporter, with $3.6-billion in exports to the US last year. In his video address to the forum, Secretary of State Antony Blinken said that the Biden administration did not only want to extend Agoa but work with Congress "to make it even better", without elaborating on any possible improvements. In her address, US Trade Representative Ambassador Katherine Tai argued that "many things have changed" since the establishment of the scheme 23 years ago and suggested that the partnership should be modernised and transformed. She indicated that discussions should also focus on improving utilisation rates, exploring additional trade tools to complement the Agoa relationship, collaborating on the implementation of the African Continental Free Trade Agreement, and using the multilateral trading system for the benefit of underserved groups.

Ramaphosa was addressing the nation on the conclusion of a panel investigation into the Lady R vessel which docked at Simonstown Naval Base last year. In May, US ambassador to South Africa Reuben Brigety accused South Africa of providing arms to Russia in the midst of Moscow's invasion of Ukraine. This prompted Ramaphosa to establish an inquiry into Brigety's remarks. President Ramaphosa says the three-member panel - head by retired Judge Phineas Mojapelo, found none of the allegations pertaining to the supply of weapons to Russia to be true. Deputy President Paul Mashatile says the government is still trying to persuade Russian President Vladimir Putin not to attend the next month's Brics summit. As a signatory to the Rome Statute of the International Criminal Court, which has issued a warrant for his arrest, South Africa is obliged to arrest Putin, should he come to SA. But this is an unthinkable proposition for the government, as the government invited him. "It's a big dilemma for us. Of course, we cannot arrest him. It's almost like you invite your friend to your house, and then arrest them. That's why for us, his not coming is the best solution. "The Russians are not happy, though. They want him to come," he said in an interview in Johannesburg on Friday. Mashatile was tasked with dealing with the dilemma by President Cyril Ramaphosa, and proposed three options, none of which have been accepted by all the Brics partners. These included relocating the summit to China, Putin not attending but sending his foreign minister in his place, and holding a virtual summit. "So, we are in a situation where the summit will probably be here, and the Russians want Putin to come. So, we've now decided to leave this matter with the president who is talking to Putin. The president is going to the Russia-Africa summit later this month, so they will continue to talk. We want to show him the challenges that we face because we are part of the Rome Statute and we can't wiggle out of this," Mashatile said. Minister of International Relations and Cooperation Naledi Pandor confirmed last week that the Brrics summit will be held in South Africa. Mashatile said that no decision had been taken to uninvite Putin, and the strategy remained one of persuasion until Ramaphosa met him in Russia at the end of July. Uninviting him was tricky as Russia had been an original member of Brics while SA joined later, he said. South Africa's bonds and currency were hit hard after the claim by US ambassador to SA Reuben Brigety that South Africa had sold arms to Russia, which were loaded onto the now famous Lady R, which had docked in Simonstown. Mashatile says he is keenly aware of the financial consequences for South Africa should Putin arrive and not be arrested.

Ukraine's ambassador to South Africa has been waiting six months for an audience with the country's Defence Minister to hear what happened with the Russian vessel Lady R, the alleged recipient of SA arms to Russia. Ambassador Luibov Abravitova remains hopeful on that, as she does about SA's ability to recognise it's impossible to be “non-aligned” on the UN Charter - or on granting immunity to international war criminals. It's a fascinating interview by the Ukrainian diplomat charged with one of her country's most challenging assignments. She reminds us that Ukraine and South Africa have a long history of cooperation and both are young democracies (Ukraine in 1991; SA in 1994) which sacrificed much for their freedom. Also, they both voluntarily gave up their nuclear arsenal, which, in Ukraine's instance, the world's third largest, which was and in return for supposedly rock-solid sovereign nation protection guarantees from the US, UK and Russia. Apology or not from the US ambassador in SA, the governments slack handling of the visit of the Russian freighter, the Lady R, to the Simon's Town naval base last year has become a huge deal from which there is no easy out. The American position continues to be that it strongly believes we have been selling weapons to Russia while it occupies, brutally, vast parts of Ukraine in a war that breaks everything we claim we stand against. Except we stand with Russia. Its commercial ships have special access to our naval base, its president to our president. Its aircraft use our military bases to deliver mail. Our defence minister is a huge fan and as Pretoria tries to squirm away from the notion that we have moved into the Russian came, claiming that we are non-aligned — a meaningless concept when you think that most members of the United Nations are also non-aligned and most have voted more than once to condemn the Russian invasion — the head of the South African army pops up in Moscow to discuss combat readiness which the comrades. We have, to use a maritime phrase, become unmoored from the West and there will be a terrible price to pay...
