Welcome to the LI Law Podcast. We feature legal issues and developments which affect Long Island residents and business owners. I am your host, Zehava Schechter. Our guest on this 62nd episode is Rachel Silverstein, a 2020 Touro Law Center graduate and GLAAD-nominated comic book writer. During law school, Rachel received the Exemplary Contributions to the Quality of Student Life Award at graduation. She was the president of the LGBT+ law society, served as teaching assistant for legal writing classes, and managed public relations for the intellectual property law society. Prior to law school, Rachel received her bachelor's degree in geology at College of Charleston and her master's degree in geoscience with a concentration in extinct elephant paleontology at East Tennessee State University. Her first co-written graphic novel, Renegade Rule, was published by Dark Horse Comics in 2021. Rachel's love of comic books began in middle school. She merged her affinity for comic books with that of the law in law school by publishing her first law review article about obscenity laws as they relate to comic books. It is called The Law of Obscenity in Comic Books and can be downloaded through the Touro Law Review digital commons here: "Obscenity in Comic Books" by Rachel Silverstein (tourolaw.edu). Her second review article discussed publicity laws as they relate to persons of interest or celebrities in comic books. It is called Comic Books, the First Amendment, and the “Best Test” for Right of Publicity Issues and can be downloaded through the Touro Law Review digital commons here: https://digitalcommons.tourolaw.edu/lawreview/vol36/iss4/19/. So, we definitely see a trend here in relation to comic books. Our topic of discussion is: All about comic books…and the law. This episode features an interview with Professor Meredith Miller of the Touro Law Center on her recently published article in the Indiana Law Review entitled Challenging Gender Discrimination in Closely Held Firms: The Hope and Hazard of Corporate Oppression Doctrine, in which she explores the possibilities and limits of using minority shareholder oppression doctrine as a potential tool to combat sex discrimination against co-owners of privately held companies who generally are considered non-employees outside the protection of Title VII and related anti-discrimination laws.
On this episode of Cut to the Chase:, Professor Rodger Citron from Touro Law Center goes through Justice Breyer's history, philosophy, and some of his significant cases. As an Administrative Law Professor, Professor Citron provides a detailed analysis of the Chevron doctrine, one of the most significant legal principles in how SCOTUS analyzes agency interpretations of their regulations. Whether it be the EPA determining whether it has jurisdiction to regulate Co2 or the FDA has authority to regulate children's food, what happens with the Chevron doctrine will be a major focus this upcoming term and the following ones as well. What, if anything, will be Justice Breyer's legacy? Take a listen to Professor Citron for his take on all these issues. Samuel Levine is a Professor of Law and Director of the Jewish Law Institute at Touro Law Center, which is part of the Touro College and University System. His work Was Yosef on the Spectrum? Understanding Joseph Through Torah, Midrash, and Classical Jewish Sources offers a unique examination of the life of Joseph (Yosef). Yosef's behaviors, interpersonal relationships, and personal development are often difficult to understand, and at times seem to defy explanation. This book offers a coherent and cohesive reading of the well-known Bible story, presenting a portrait of Yosef as an individual on the autism spectrum. Viewed through this lens, Yosef emerges as a more familiar and less enigmatic individual, exhibiting both strengths and weaknesses commonly associated with autism spectrum disorder. Patty Salkin, former Dean at Touro Law Center, discusses the conflicting interests and resulting tensions in New York law schools, which must prepare students for the UBE, ensure they meet pro bono and other licensing requirements, and make students understand that a New York practice will require more than knowledge of the Uniform Acts. Robert H. Montefusco has been practicing law since 1998 and concentrates in the areas of matrimonial law and family law. He is a very experienced and determined trial attorney, having conducted hundreds of trials and/or hearings. Mr. Montefusco graduated cum laude from Touro Law School. He was a recipient of the American Excellence Award for Family Law and Evidence, a member of the Dean's List and an editor of Touro Law Review. He is a former prosecutor for the Suffolk County District Attorney's Office, where he gained invaluable experience in the courtroom not otherwise available to private practitioners. On a daily basis, he was responsible for handling all levels of crimes, including serious felonies, from arraignment to trial and sentencing. He learned effective and persuasive litigation skills from conducting numerous trials over the course of his career in the District Attorney’s Office. On a personal note, Mr. Montefusco was involved in a very acrimonious divorce and, rather than focusing on the hardship and emotional pain of his contested divorce action which resulted in a trial, he believes that this experience was an opportunity for him to learn how to be a more compassionate and effective attorney. He intimately understands what it takes to be successful in divorce litigation, and can sympathize with what you may be experiencing. Outside the courtroom, Mr. Montefusco augments his education by routinely attending Continuing Legal Education seminars on the latest updates and trends in the law. He is an active participant in the Suffolk County matrimonial bar mentoring program, providing legal advice to less experienced attorneys. He has been a guest lecturer at Touro Law Center relating to issues of criminal procedure and practice and has been featured in Touro Law Center’s recruiting literature. He has also appeared on News12 and has been quoted in various newspapers. Mr. Montefusco is admitted to practice in New York State and the United States District Court for the Eastern District of New York.
