A group of libraries, librarians, and related organizations sue Arkansas 28 prosecuting attorneys in the federal District Court for the Western District of Arkansas. The District Court issued a preliminary injunction, preventing the law from going into effect. Or does it?

This was flyting, a sort of medieval equivalent of battle rap, and it was so popular at the time that the King himself wrote instructions for how to do it well. Writer and Scots language campaigner Ishbel McFarlane and historical linguist Joanna Kopaczyk explain the art of flyting, where an insult becomes slander, what's going on within the speech act of performative diss-trading, and what the legal consequences could be of being accused of witchcraft. Paxton decision.  Fun fact: Associate Justice Potter Stewart, who wrote the “I know it when I see it” line in a 1964 obscenity opinion, later concluded that any such obscenity test would be unconstitutionally vague. ABOUT THE SPEAKERS: Eugene Volokh is a senior fellow at the Hoover Institution. For thirty years, he had been a professor at the University of California – Los Angeles School of Law, where he has taught First Amendment law, copyright law, criminal law, tort law, and firearms regulation policy. Volokh is the author of the textbooks The First Amendment and Related Statutes (8th ed., 2023) and Academic Legal Writing (5th ed., 2016), as well as more than one hundred law review articles. He is the founder and coauthor of The Volokh Conspiracy, a leading legal blog. Before coming to UCLA, Volokh clerked for Justice Sandra Day O'Connor on the US Supreme Court. Jane Bambauer is the Brechner Eminent Scholar at the University of Florida's Levin College of Law and the College of Journalism and Communications. She teaches Torts, First Amendment, Media Law, Criminal Procedure, and Privacy Law. Bambauer's research assesses the social costs and benefits of Big Data, AI, and predictive algorithms. Her work analyzes how the regulation of these new information technologies will affect free speech, privacy, law enforcement, health and safety, competitive markets, and government accountability. As states navigate a post-Dobbs world, a series of federal and state regulations known as Comstock Laws are being discussed as avenues to further restrict access to abortion drugs and birth control. In 2018, with Roe v. Wade still the law of the land, Rawles and Amy Werbel discussed the fiery namesake of those laws and Werbel's book Lust on Trial: Censorship and the Rise of American Obscenity in the Age of Anthony Comstock. It sheds light on how a 19th-century U.S. Postal Service agent funded by the Young Men's Christian Association created obscenity restrictions so sweeping that medical textbooks were seized and destroyed for displaying anatomical diagrams. This month we continue our series on speech and censorship by discussing an extraordinary book published in 1996, The Repeal of Reticence: America's Cultural and Legal Struggles Over Free Speech, Obscenity, Sexual Liberation, and Modern Art. It's terrific book of political, social, cultural history and analysis. It covers an amazingly broad range of topics, from 19th century literary sensibilities to early 20th century Supreme Court obscenity jurisprudence to the midcentury New York public intellectual scene. Its author, Rochelle Gurstein, sketches two broad, cultural movements: the party of reticence and the party of exposure. Our conversation is devoted to elucidating the discourse around privacy and obscenity in a variety of contexts. We take up invasive journalism, sexual education, and literary realism. We try to understand why the party of exposure seemed to gain victory after victory as the decades passed. Gurstein articulates what the party of reticence understands about human life that partisans of exposure often miss. At the conclusion of our conversation, Gurstein reflects on her mentor, the great Christopher Lasch.

(Steve and John give Lieberman a thumbs-up, while Lucretia. . .)All three of us independently chose the same article for our picks for Article of the Week—Walter Russell Mead's Tablet magazine piece entitled "Twilight of the Wonks." It has some magnificently harsh language about the leaders of our elite educational institutions, such as "moral jellyfish," and leaders who are "careerist mediocrities who specialize in uttering the approved platitudes of the moment." We're less sure about Mead's diagnosis about the role of narrow specialization in the decay of our universities.At least we have Krispy Kreme donuts coming soon to McDonald's to look forward to.
