The Heartland Institute's Donald Kendal, Jim Lakely, and S. T. Karnick present episode 461 of the In The Tank Podcast. The concept of free speech is once again under assault. The Europe Union's Digital Commissioner Thierry Breton wrote an open letter to X CEO Elon Musk warning him to stop the "amplification of harmful content." Meanwhile, authorities in the UK have been cracking down on so-called "hate speech" on social media, even going as far as threatening American citizens of extradition over supposed incitement of violence. Are any of these restrictions justifiable? Should free speech be absolute? The In The Tank crew discusses these topics and more.PRIMARY TOPIC - FREE SPEECH UNDER ASSAULT CNBC - EU warns Elon Musk ahead of Trump interview to keep hate speech off Xhttps://www.cnbc.com/2024/08/12/eu-warns-elon-musk-ahead-of-trump-interview-to-keep-hate-speech-off-of-x-.htmlPolitico - EU's Breton warns Musk on hate speech ahead of Trump interview; receives profane responsehttps://www.politico.eu/article/eu-warns-elon-musk-hate-speech-donald-trump-interview-breton-x/The Guardian - Two men jailed for social media posts that stirred up far-right violencehttps://www.theguardian.com/politics/article/2024/aug/09/two-men-jailed-for-social-media-posts-that-stirred-up-far-right-violence NYP - UK police commissioner threatens to extradite, jail US citizens over online posts: ‘We'll come after you'https://nypost.com/2024/08/10/media/uk-police-commissioner-threatens-to-extradite-jail-us-citizens-over-online-posts-well-come-after-you/ Reason - VP Candidate Tim Walz on "There's No Guarantee to Free Speech on Misinformation or Hate Speech, and Especially Around Our Democracy"https://reason.com/volokh/2024/08/08/vp-candidate-tim-walz-on-theres-no-guarantee-to-free-speech-on-misinformation-or-hate-speech-and-especially-around-our-democracy/The Conversation - Americans love free speech, survey finds − until they realize everyone else has it, toohttps://theconversation.com/americans-love-free-speech-survey-finds-until-they-realize-everyone-else-has-it-too-234884

Data Privacy Detective - how data is regulated, managed, protected, collected, mined, stolen, defended and transcended.

Europe finds UK data privacy system adequate, for now. On June 28, 2021, the Europe Union granted two adequacy decisions to the United Kingdom for personal privacy purposes. 1. Decision on the adequate protection of personal data by the United Kingdom - General Data Protection Regulation 2. Decision on the adequate protection of personal data by the United Kingdom - Law Enforcement Directive This assures, for now, that data flows between the EU and UK can continue without restrictions. But for the first time, the EU's decisions were not permanent and will last only four years. What's going on? Because of Brexit, the UK and the EU reached a transition agreement at the end of 2020. This included six months for the UK and EU to reach an agreement about data privacy flows. The deadline approached, and the EU decision was made just in time (the UK had already issued its own adequacy decision regarding data going to the EU). Had it not been made, one estimate was that UK businesses would face immediate compliance costs of about 1.6 billion pounds, aside from other costs. So, UK businesses can rest easy – for a time. According to Kim Walker, a leading UK privacy attorney at the firm of Shakespeare Martineau (Kim Walker | Shakespeare Martineau (shma.co.uk), 11% of global data flows through the UK, and 70% of UK data flows through the EU. Why the last-minute timing and why the unusual temporary grant of an adequacy decision? The answer lies in the same surveillance issues that restrict data flows between the EU and the United States. Without a comprehensive and protective federal personal data privacy law, the United States is unlikely to receive an adequacy decision from the EU indefinitely. The EU is particularly skeptical of mass surveillance by U.S. authorities. The British mass surveillance system is not that different from the American approach to how and when public authorities can access private personal information. The EU is concerned that by granting adequacy to the UK, this could create a back door for the UK to grant unrestricted data flow to the United States, thus undermining Europe's basic GDPR approach to restricting data flows that may disrupt the protections of personal privacy at the heart of GDPR. Writer and broadcaster Maria Margaronis follows the route taken by migrants fleeing war or poverty who are risking their lives to reach the Europe Union. It is estimated that around 75 thousand people are attempting to make the perilous journey each year in the hands of unscrupulous traffickers. They are fleeing from war-torn countries like Afghanistan and Somalia or simply in search of a better life where their economic prospects aren't so bleak. Some of them never make it, suffocating in the back of a crowded lorry or drowning in the fast flowing river that marks the border between Turkey and Greece. The programme meets up with migrants in Istanbul, on the narrow Bosphorus Strait, which has served as the crossroads of the world for thousands of years. There are children making the journey on their own and one man who has lost his fingers and toes to frostbite on a perilous journey over the mountains from Iran. Two of his companions died. The Turkish authorities confess to being overwhelmed by the numbers which are estimated to be up to 250 people a day. Illegal migrants are detained but seldom, it seems, sent back to the countries they came from. There has been an attempt to clamp down on the people traffickers but there are huge profits to be made. The most dangerous part of the trip is along Turkey's border with Greece. The Greeks are supposed to be building an eight mile fence but that still leaves a river which is 125 miles long. Traffickers put their charges into cheap inflatable boats and push them across, regardless of whether they are able to handle a boat or to swim. Many of them can't. For those that do make it, there is no Promised Land but an economic crisis and yet more troubles ahead.
