Mary and Andrew begin this week by addressing the Department of Justice dropping the subpoenas they ordered against New York Times journalists who reported on security concerns regarding President Trump's new Qatari-government-gifted Air Force One jet, noting that the attempt to subpoena the writers speaks to a failed effort of “chilling and intimidating” other reporters. But still, there were even more subpoenas: last week, the DOJ filed subpoenas for 14 major law firms as part of an ongoing lawsuit between the American Bar Association (ABA) and the Executive Office of the President, which Mary and Andrew believe is an effort by the government to try and “get the law firms to pressure the ABA to drop this lawsuit.” They also touch on an update to journalist Katie Phang's lawsuit against the federal government over Epstein files redactions and address Jack Smith's criminal referral by House Judiciary Committee Chair Jim Jordan. Plus, two immigration-related cases: a judge's decision to throw out a DOJ lawsuit challenging Minnesota immigration laws and an appeal court's decision to reverse a lower court decision releasing Pro-Palestinian activist Mohsen Mahdawi. Alright guys, this week we're kicking it off with Tate Bradfield, founder of Process Based Hunter. Tate's got one of the more interesting backstories I've heard on this show — went from working in a mine, to door-to-door sales, to guiding elk for other outfitters, to eventually running his own semi-guided elk hunting courses where he takes 150-180 people a year and actually teaches them how to hunt instead of just pointing at a bull and telling them to shoot. We riff on a ton of stuff in this one — his "at-bats" philosophy for picking a guided hunt (spoiler: stop asking how big the bulls are and start asking how many encounters per day you'll get), why he thinks cow calling during rifle season is one of the most underused tactics out there, how he snuck within 60 yards of a 200-inch mule deer with a cow elk decoy and no rifle in hand, and why most guys pack way too much gear and focus on the wrong stuff before a hunt. As Andrew puts it, Chief Justice John Roberts is “cherry-picking.” He's flying solo in this short edition of Main Justice (more to come with Mary in the next episode). Andrew also touches on the Court's decision to uphold a Mississippi law to allow mail-in ballots that are sent by Election Day to be counted but saves his deepest analysis for two similar cases with opposing decisions: the firings of Lisa Cook and Rebecca Slaughter. While the Court ruled that the Trump administration must have cause to dismiss Cook from the Federal Reserve, it allowed the government to fire Slaughter from the Federal Trade Commission, a decision which Andrew calls deeply flawed showing the conservative majority's support for a “unitary executive.” And finally, Andrew breaks down the Court's narrow decision to uphold birthright citizenship, and why the tight 5-4 split is the story. There's a lot on the docket today. To pull apart the Iran “deal” framework, Mary and Andrew are joined by Tess Bridgeman, an international law expert who served as a legal advisor in the Obama administration through the 2015 nuclear deal with Iran. Tess lays out how President Trump's 14-point memorandum of understanding differs from what was brokered in 2015, and what to watch for as negotiations continue. After a week of decisions coming in from all corners, Mary and Andrew begin with a court order issued to remove President Trump's name off the Kennedy Center after a failed, last-minute attempt by the administration to stop it from happening. Mary refers to this as “good news in the fight against revisionist history,” which she ties into their second beat: a preliminary injunction issued to restore changes to National Parks that were made after Trump issued an executive order calling for modifications to monuments, parks and memorials to rewrite and censor American history and science. Then, onto a federal judge in Virginia officially blocking the $1.776 Billion slush fund after mixed messaging from the administration about whether it would be set up, plus a decision by Judge Mehta in DC to overturn the Department of Energy's cancellation of $82.1 Million in clean energy grants to “Blue” states across the country. Decisions are happening fast — and the consequences are showing. Last week, Trump announced he would nominate Acting Attorney General Todd Blanche to the top post at the Justice Department, after Blanche nixed the $1.776 “Anti-Weaponization” fund while keeping the controversial release that shields Trump and his family from any liability. Mary and Andrew highlight the myriad of issues Blanche will need to answer for when a confirmation hearing comes, before moving to the Supreme Court ruling that allows Alabama to adopt a Republican-drawn congressional map eliminating one of only two majority-Black districts in the state. This nullifies a lower court's decision that the map was, in fact, intentionally discriminatory. Docket Alerts: Director of National Intelligence Tulsi Gabbard led a raid on the Fulton County Election Hub and Operating Center in Atlanta. ProPublica got the warrant. Mo Ivory, a Democratic commissioner for Fulton County, breaks it down on Instagram. In Chicago, Marimar Martinez has moved to unseal evidence from DOJ's failed effort to prosecute her for getting shot by ICE. Reuters reports that Marcos Charles, the top official in ICE's Enforcement and Removal Operations division, issued new guidance instructing ICE to target only immigrants who have been arrested or convicted of crimes. This would be a huge improvement, but DHS won't comment. Main Show: Once again, this is all the Supreme Court's fault. Specifically, its rulings in J.G.G. v. Trump and Trump v. CASA led directly to the mayhem in Minnesota. First the Court forced immigrants challenging their detention to file thousands of individual habeas cases. And then they drastically limited the power of federal judges to issue relief when it "discovered" that nationwide injunctions are illegal. The Trump administration took this as an invitation to break the law, irrespective of how many courts tell them not to, on the theory that CASA means precedent doesn't count any more. DHS dummied up a memo saying that actually everyone without a green card must be held indefinitely. This is a gross misstatement of the law, as literally hundreds of courts have already ruled. But the Trump administration says because of CASA, they can continue to lock up people who've lived here for decades, checking in with DHS, working, paying taxes, and taking care of their families. Judges are deluged with habeas petitions, which differ from each other only in the particulars of the cruelty being visited upon the individual immigrant. After ICE failed to obey a court order to release a habeas petitioner, Chief Judge Patrick Schiltz in the District Court of Minnesota ordered Todd Lyons, the Acting Director of ICE, to either release the guy or show up and explain why he shouldn't be held in contempt of court. ICE released the petitioner, but Judge Schiltz was still furious. He published a list of 96 violations of court orders in January alone — and that's only in Minnesota! Thanks, Chief Justice Roberts! On the plus side, Judge Schiltz's colleague Judge John Tunheim issued a TRO ordering ICE to release every refugee detained under the erroneous memo and quit kidnapping them and spiriting them away to Texas. DOCKET ALERTS: Kash Patel brings UFC to FBI. WTF??? A federal judge in Maryland issued a TRO blocking the construction of an ICE detention facility without first undertaking the legally required environmental impact assessment. The Trump administration filed an "emergency" petition to the Supreme Court demanding that it be allowed to immediately deport 350,000 Haitians who have enjoyed Temporary Protected Status for decades. It insists an earlier shadow docket ruling allowing it to deport Venezuelan TPS holders is precedential. An amicus brief from 175 former judges points out that shadow docket orders are definitionally non-precedential. The USDA is teaming up with Robert Kennedy and his team of freaks at Health and Human Services to Make America Healthy Again … by shaming poor people for their food choices. SNAP recipients sued in DC to block a "pilot" program to allow states to restrict food benefits to exclude sugary foods. MAIN SHOW: DOGE destroyed the National Endowment for the Humanities in three weeks last spring. We wrote about it on the blog, and discussed the ongoing litigation. Turns out, the DOGE dudes are pissed that the plaintiffs released video of them smirking their way through depositions. On Monday, in the middle of trial, the Trump administration tried to blow up the antitrust lawsuit against Live Nation, the parent company of Ticketmaster. This leaves the 40 states which joined the suit as co-plaintiffs in the lurch. Judge Arun Subramanian has ordered the parties to huddle up and see if they can't negotiate a settlement. Will the case go forward next week without the lead plaintiff? And Andrew has an extended exploration of Trump's plan to use a little known federal agency called the United States International Development Finance Corporation (DFC) to get oil tankers to cross the Strait of Hormuz. The DFC has released a plan (or at least, concepts of a plan) to reinsure insurance companies that issue war riders. Which might help if insurance companies were refusing to issue policies to ships at sea – except that insurance companies are still underwriting as many marine policies as ever. As judges continue to weigh in, President Trump is finding that despite his litigious efforts, he can't always get what he wants. Mary and Andrew begin this week with the latest fallout from his $1.776 billion “anti-weaponization” fund, which is now under judicial review after a group of federal judges filed a motion arguing that the original lawsuit that prompted the fund was “itself a fraud on the court.” This prompted the news, first reported by Axios, that the Trump administration would abandon the fund altogether. Mary and Andrew tie this into another instance in which the administration is losing in the courts, with Judge Mehta's decision refusing to dismiss the indictment of Oath Keepers' leader Stewart Rhodes, among others whose sentences were commuted. They then move to a ruling ordering the removal of Trump's name from the Kennedy Center facade, a setback in his attempt to reshape the renowned preforming arts center. And after an update on the criminal case against the Southern Poverty Law Center, Andrew shares some insight into his recent New York Times op-ed which offers a path to stop vindictive prosecutions altogether.
