DOJ, striking down the federal statutes that have criminalized home distilling for over 150 years. The law, rooted in an 1868 tax act, made it a federal crime — punishable by up to five years in prison — to operate a still in any home, yard, shed, or enclosure connected to a residence. Remarkably, the basis for striking down the home distillation ban was the court's finding that the Federal government had exceeded its Constitutional tax authority—in other words, a court recognized that the federal government does not have infinite authority to suppress the liberties of American citizens simply by calling that suppression “a tax.”Today we'll break down the Fifth Circuit's full reasoning, which rests on two constitutional pillars: the Taxation Clause and the Necessary and Proper Clause. I'll explain exactly what those constitutional tests mean, how the court applied them, and what the government got wrong in its defense.This ruling is not the end of the story — a parallel case, Ream v. DOT, is currently pending before the Sixth Circuit, meaning there's a real possibility of a circuit split and eventual Supreme Court review. And while this decision enjoins federal enforcement, state laws on home distilling remain separately on the books. Andrew breaks down what the ruling actually does and doesn't do, what comes next legally, and why this case matters well beyond whiskey — as a serious check on the federal government's power to criminalize what Americans do inside their own homes. John is joined by Dennis H. Hranitzky, partner in Quinn Emanuel's Salt Lake City office, and Fritz Scanlon, of counsel in Quinn Emanuel's Washington, D.C. office. They discuss the recent Supreme Court decision invalidating all tariffs President Trump imposed under the International Emergency Economic Powers Act (IEEPA). IEEPA tariffs had generated an estimated $160 billion in revenue and were central to the administration's tariff policy.The administration justified these tariffs based on declared national emergencies, including fentanyl trafficking and persistent trade deficits. The Court did not rule on whether those circumstances constituted true emergencies. Instead, the Court held that the tariffs were invalid because the Constitution assigns all taxing authority to Congress, and the IEEPA did not expressly grant the President the power to impose tariffs.In response to the Supreme Court's ruling, the administration has now turned to other statutes, including Section 122 of the Trade Act of 1974, which allows temporary tariffs of up to 15 per cent for 150 days to address balance-of-payments concerns. Other tools, such as Section 232 of the Trade Expansion Act of 1962, permit product-specific tariffs tied to national security findings, but require administrative investigations and procedural safeguards. These mechanisms provide less unilateral flexibility than IEEPA had afforded.John, Dennis, and Fritz also discuss the prospects for companies obtaining refunds through litigation. Importers who directly paid the invalidated tariffs appear to have strong claims for reimbursement, primarily through the U.S. Court of International Trade in New York, which has exclusive jurisdiction over tariff disputes. A two-year statute of limitations generally applies. While companies' right to obtain refunds is viewed as legally solid, delays are anticipated through procedural defenses and litigation tactics. The US Supreme Court struck down President Donald Trump’s sweeping global tariffs, undercutting his signature economic policy and delivering his biggest legal defeat since he returned to the White House.Voting 6-3, the court said Trump exceeded his authority by invoking a federal emergency-powers law to impose his “reciprocal” tariffs across the globe as well as targeted import taxes the administration says address fentanyl trafficking.The justices didn’t address the extent to which importers are entitled to refunds, leaving it to a lower court to sort out those issues. If fully allowed, refunds could total as much as $170 billion - more than half the total revenue Trump’s tariffs have brought in. The world's leading philosophers and psychologists were based in Germany and Austria during the rise of Hitler. They studied the darkest chapter of human history while trying to make sense of it and survive it themselves. Their teachings are an urgent alarm for us today: fascists seek endless conflict through domination, and it will never be enough. Drawing on George Orwell's analysis of Hitler, we see that while democracy offers the radical concept of "having a good time," fascism preys on a neurotic, broken need for "struggle, danger, and death." It is an addiction to conflict, often first learned in the childhood home, according to Erich Fromm, that views empathy not as a virtue, but as a target.  Walter Benjamin, before losing his own life to suicide to avoid the concentration camps, pointed out that fascists seek pleasure in their own demise. It is the fleeting, hollow glee of a bully kicking over a sandcastle because he doesn't know how to build one. Joy is how we win. The hate-fueled fascist high is a non-renewable resource. It requires a constant supply of new enemies to sustain a house of cards built on lawlessness and corruption. True joy, born of community, love, and creation, is sustainable energy, even in the unlikeliest of places, as our heroes who came before us also showed us. Stay safe. Stay defiant.
