Former president Jacob Zuma has extended his trip to Moscow as the Department of Correctional Services (DCS) decides whether he should return to prison. News24 understands from two sources who have knowledge of Zuma's trip that he was meant to return on Tuesday, but that he extended the trip. He is seeking medical treatment in the Russian capital, although the details of his illness are unknown. The DCS said on Wednesday that the department was yet to decide on Zuma's fate. Jacob Zuma Foundation spokesperson Mzwanele Manyi confirmed that Zuma had not returned from Moscow. "I don't know when he will be coming back," he said. Manyi, who is also an Economic Freedom Fighters member of Parliament, said he did not know what Zuma's health condition was. A source said Zuma planned to return next Wednesday, but Manyi said he could not confirm when the former head of State would return. Last Thursday, the Constitutional Court dismissed the Department of Correctional Services' application for leave to appeal a Supreme Court of Appeal (SCA) ruling that Zuma should return to prison. The apex court found the department's appeal "bears no reasonable prospect of success" and dismissed the application with costs. Zuma was jailed in July 2021 after he was sentenced to 15 months for contempt of the Constitutional Court after he refused to obey an order to appear before the Zondo Commission. However, hardly two months later, he was released on medical parole after then national commissioner of correctional services, Arthur Fraser, overruled the Medical Parole Advisory Board's (MPAB) recommendation that the former president did not qualify. The Democratic Alliance, AfriForum and Helen Suzman Foundation asked the Gauteng High Court in Pretoria to review Fraser's decision and set it aside, which it did. Zuma and the DCS then appealed, but the SCA upheld the High Court's decision. The SCA found Zuma "has not finished serving his sentence". It said: "He must return to the Estcourt Correctional Centre to do so. Whether the time spent by Mr Zuma on unlawfully granted medical parole should be taken into account in determining the remaining period of his incarceration, is not a matter for this court to decide." "It is a matter to be considered by the commissioner (Makgothi Thobakgale). If he is empowered by law to do so, the commissioner might take that period into account in determining any application or grounds for release." After the Constitutional Court's decision last week, the SCA's ruling stands.

Former president Jacob Zuma is currently unwell and seeking medical assistance in Moscow, Russia, News24 has confirmed. This is as the Constitutional Court on Thursday dismissed the Department of Correctional Services' application for leave to appeal a Supreme Court of Appeal (SCA) ruling that he must go back to prison. Two sources with direct knowledge of Zuma's trip said the former president had left on Monday for Moscow, where he was receiving medical treatment. He flew commercially to Russia, accompanied by six VIP protectors paid for by the state. Jacob Zuma Foundation spokesperson Mzwanele Manyi confirmed to News24 that the former president was in Moscow and was seeking medical assistance. "He went for medical check ups. He has not been feeling well," Manyi said. He is expected to return to South Africa next week. Zuma has long relied on the Russian healthcare system, ever since he was allegedly poisoned in 2014. In dismissing the application for leave to appeal Zuma's medical parole, the Constitutional Court said an appeal had "no reasonable prospects of success". This means the November judgment of the SCA, which said: "Mr Zuma, in law, has not finished serving his sentence. He must return to the Estcourt Correctional Centre to do so," stands. Reacting to judgment in the President Cyril Ramaphosa and former president Jacob Zuma court case, former ANC member Carl Niehaus said the judiciary will lead the country to collapse. Ramaphosa had applied to the Johannesburg high court to set aside his prosecution as unconstitutional and unlawful. He asked the court to interdict any “further steps” in pursuing the prosecution and to excuse his appearance in court on January 19, as demanded by the former president. Zuma filed a case against Ramaphosa, arguing he is an “accessory after the fact” in relation to charges Zuma is pursuing against prosecutor Billy Downer and journalist Karyn Maughan. The court granted Ramaphosa the interdict which means he does not have to appear in the dock on Thursday. Suspended Public Protector Busisiwe Mkhwebane's latest report on former South African Revenue Service (SARS) official Ivan Pillay – who last week lambasted her investigations into SARS – has been invalidated "by agreement" with her office. The Gauteng High Court in Pretoria on Monday ordered that the report, which centred on an 18-year-old IT contract, "is reviewed, declared unlawful and set aside" in each instance where it related to Pillay. More damagingly for Mkhwebane, whose impeachment inquiry continues on Wednesday, the high court also found that the beleaguered Public Protector acted "in breach" of Pillay's constitutional rights by failing to provide him with: "any notice whatsoever of the investigation; "any of the rights to which he is entitled to in terms of section 7(9) of the Public Protector Act, 23 of 1994; and "any right to be heard on the remedial action that the first respondent contemplated granting against him." Given that Mkhwebane has routinely been lambasted by the courts for failing to afford the subjects of her most barbed investigations – including President Cyril Ramaphosa and Public Enterprises Minister Pravin Gordhan - these same rights, the high court's ruling is very likely to be part of the arsenal of evidence that she needs to address when she testifies at her impeachment inquiry. In her now partially invalidated report on the SARS' IT contract, Mkhwebane recommended that the Hawks consider investigating alleged criminal conduct by current and former SARS bosses, including Edward Kieswetter and Gordhan. She released that report on SARS' 2006 contract with software firm Budge, Barone & Dominick (BBD) less than three hours after the State Capture Inquiry found in its latest report that Gordhan was instrumental in resisting the Guptas' takeover of Treasury. The complaint of "maladministration, improper conduct and procurement irregularities" which prompted the probe, had been launched by former government spokesperson, and current Jacob Zuma Foundation frontman, Mzwanele Manyi, in 2016. While SARS had used a specific Treasury regulation, which provides for deviation from normal procurement processes without the need to put it out to tender, Mkhwebane said she "could not find compelling reasons for them to do so". The Public Protector Act also says that the Public Protector should not consider any complaint unless its reported within two years of the incident, barring special circumstances. Mkhwebane, in this case, said she was deviating from the two-year rule because of "special circumstances". While the Office of the Public Protector has yet to comment on the high court's ruling, Pillay's lawyers have released a statement, in which they noted that Mkhwebane's latest SARS report was the third in which she made adverse findings against Pillay. Both of the other two Public Protector reports that made findings against Pillay – including the so-called SARS "Rogue Unit" report and the report on his early retirement – have been overturned by the courts. "Testifying as a witness on Friday, in the proceedings of the Section 194 Parliamentary inquiry into the fitness of advocate Busisiwe Mkhwebane to hold office, Mr. Pillay highlighted a litany of similar abuses of power in these investigations conducted by the Public Protector against him," his lawyers said.

The Jacob Zuma Foundation has announced that the former president will lay criminal charges against State advocate Billy Downer for allegedly leaking affidavits containing information about his health. The charges will be laid on Thursday, according to foundation spokesperson Mzwanele Manyi. In a tweet on Wednesday, the foundation said: "As indicated in court on 22/09/21 H.E Prez (sic) Zuma will be laying criminal charges against adv Billy Downer for his admitted conduct which is in breach of Section 41 (6) read with [Section] 41 (7) of the NPA Act." The foundation invited the media to a briefing outside the Pietermaritzburg SAPS on Thursday at 13:00. During Zuma's court case last month, his advocate, Dali Mpofu, SC, said, "Former president Zuma takes the strongest possible exception to what was done with his confidential information and the way it was treated in this court." Mpofu said it amounted to "criminal activity", and added that Zuma wanted to lodge a complaint of prosecutorial misconduct against Downer with Judge Piet Koen, who is deciding his application for a special plea.
Former President Jacob Zuma opened a criminal case against National Prosecuting Authority (NPA) advocate Billy Downer on Thursday for allegedly making public affidavits that relate to Zuma's medical information. Zuma was accompanied to a Pietermaritzburg police station by his daughter Duduzile Zuma-Sambudla as well as his foundation's spokesperson Mzwanele Manyi. The foundation says Downer's alleged conduct breaches sections of the NPA Act. Reacting to the charge against Downer, the NPA said while the law must be allowed to follow its course, it was concerned about the context in which the charges were laid. “Adv Downer SC is a highly respected prosecutor who has carried himself with integrity throughout his career in the NPA.
