To learn more about job search strategy for F-1 international students, visit https://www.icaway.com/ I've been getting a bunch of requests from new international grads who are on the hunt for jobs in this tough economy. And guess what else? Their OPT is about to start! So, I wanna share four cool strategies with you that can actually stop the OPT unemployment allowance clock. If you just graduated and your OPT is about to start! You have only 90 days after your OPT starts to find a job that's related to your field of study. What I'm going to share today is based on real stories from a few international students who have used these strategies to stop the clock. Before deciding to pursue any of these options, please remember to contact your International Student Services office to ensure eligibility. Consider volunteering to avoid accruing unemployment days.  How can you find non-profit organizations in your area to volunteer with? One effective way is to utilize online platforms and directories that connect volunteers with non-profit organizations. Websites such as  https://www.volunteermatch.org/  https://www.idealist.org/en  https://engage.pointsoflight.org/  can be great resources to find volunteer opportunities.  2. Consider seeking contract jobs. Contract work can be a viable option for your first-year OPT. Many companies and organizations hire contractors for short-term projects or assignments.  These contract positions can provide valuable work experience and help you meet the employment requirement of your OPT period. And sometimes, when you're a good fit for the team, you may have a chance to convert your contract role into a full-time opportunity. 3. consider reaching out to your professors for an offer letter that can potentially be considered an OPT job opportunity. Your professors may have research projects or other academic initiatives where they could hire you as a research assistant or provide you with a job offer letter. This can be a valuable experience and help you fulfill the employment requirement during your OPT period. 4. explore the possibility of building your own business and working on OPT. Remember, these are options for you to pause the OPT clock in your first year after graduation while looking for a full-time job at your dream company. For STEM international students who are on OPT and when you're approaching your STEM extension, your employers must be e-verified in order to utilize your STEM OPT for work in the US.   To check whether the employer is verified or not, check out the link I provided in the caption below. To learn more about job search strategy for F-1 international students, visit https://www.icaway.com/ I just received a message from an international student whose OPT will begin in less than a month and have only 90 days of unemployment to stay in the U.S.  The student asked if I could help them because they've applied to multiple job postings online but haven't received any interview invitations. The student is feeling discouraged due to news of layoffs and hiring freezes, and they don't know what action to take to find an OPT job.  If you or someone you know is in a similar situation, here are some actionable steps that can be taken to search for an OPT job opportunity within a short period of time. Firstly, it's important to ensure that you don't exceed the OPT 90-day unemployment allowance without a job offer in place and risk losing your F-1 status.  So you're probably wondering about the 90-day unemployment allowance and how it works. Optional Practical Training or OPT means F-1 students' work authorization to work off-campus. your work authorization after your graduation is called a Post-Completion OPT Say you already graduated and you are eligible for OPT. You'll have a limited time to be unemployed when your OPT starts. For post-completion OPT, you have 90 days of unemployment, and for STEM OPT, you have 90 days plus an additional 60 days during the 24-month STEM OPT extension period. It's important to note that this 90-day unemployment period counts both weekdays and weekends.  Even if you travel outside the US, your time spent outside the country will still count as unemployment However, don't worry, there are options available to you if you're in your first year of OPT. If this is your first year OPT, Did you know that the term "employed" is not as specific as you might think?  Whether it's a paid or unpaid job, finding a job related to your course of study can help stop the 90-day unemployment allowance clock.  Don't forget to reach out to your International Student Services Office at your college or university to ensure that the job is compatible with your OPT. If you are under a time crush, it's worth considering options such as temporary jobs or volunteering positions that will allow you to remain in the country.  The requirement is that the work must be at least 20 hours per week. Just be sure to check with your International Student Services office to ensure that you are eligible for these options. It can be tough for students to find jobs within three months, and without connections and a personal coach, your search time may extend to an average of five to six months. Therefore, it's important to maintain your status with a backup plan and continue your full-time job search. In short, if your OPT is about to start, please develop a backup plan and find options that allow you to stay past the 90-day unemployment allowance period.  Also, It's a smart move to hold onto your OPT unemployment allowance time for unexpected situations like losing your job or transitioning between jobs.  This way, you'll have a safety net to fall back on when you need it most. It's better to have a backup plan in place, just in case. Remember to keep your International Student Services office in the loop and explore all options, including part-time work, temporary jobs, and volunteering positions.  With these strategies in mind, you can increase your chances of finding employment and maintaining your legal status in the U.S. Now that we have talked about the importance of not exceeding the OPT 90-day unemployment allowance, let's focus on the steps you can take to build your career brand and increase your chances of finding employment. I could feel their disappointment and frustration. They had been hoping to stay in the US and work at their dream job, but now that opportunity seemed to have slipped away. I reminded them that they still had their STEM OPT and could try again next year. I also suggested that they speak with an immigration attorney to learn more about other visa options. I hope to share this story and encourage others to advocate for international students and propose changes to the H-1B system. We need to create a fair system that recognizes the valuable contributions that international students make to our society and the American economy. It's time to recognize their contributions and create a system that values them for the incredible assets they are. I don't know an international student who has started a company and pursued it full-time in the U.S. after graduation. What's stopping them? Well...the law. Immigration law makes it illegal for non-citizens to earn money in the U.S. except in very narrowly defined scenarios.  This the second in a two-episode series for international student founders. In this episode of Immigration Law for Tech Startups, I share some of the immigration strategies that we have used to help startup founders successfully come to or remain in the U.S. to create or grow their startups. Unlike other countries looking to spur innovation and job creation within their borders, the United States does not have a startup visa. So, startup founders must work within the existing immigration framework and find a visa or green card that best fits their situation and goals.   Most of the startup founder clients we work with are in the U.S. on a nonimmigrant visa, such as B-1/B-2 visitors for business or pleasure, F-1 for students, J-1 for researchers, L-1, TN, H-1B, or O-1. Many of those individuals on an H-1B were born in China or India and are facing long waits for green cards due to annual numerical and per-country caps, but are itching to start their own companies.   Whether inside or outside the U.S., startup founders can self-petition for an EB-1A extraordinary ability green card or EB-2 NIW (National Interest Waiver) exceptional ability green card. This episode of Immigration Law for Tech Startups was recorded before the Trump administration’s July 6, 2020 directive that requires international students on F-1 and M-1 visas to take at least one in-person class in the fall or lose their visa status and be forced to leave the U.S. As of this writing, the administration has yet to finalize this directive that prevents international students from entering the U.S. or remaining in the U.S. while taking a full online course load even as the COVID-19 crisis continues. In the spring, U.S. Immigration and Customs Enforcement (ICE), which oversees the Student and Exchange Visitor Program (SEVP), allowed international students to take a full online course load through the summer semester due to COVID-19 without facing deportation. The new directive requires colleges and universities to inform ICE about the educational format they plan to offer in the fall. Meanwhile, Harvard and the Massachusetts Institute of Technology sued the administration in federal court on July 8, 2020, asking the court to prevent the administration from enforcing the new directive and declare it unlawful. In addition, the University of California has also announced its intent to file a lawsuit against the federal government for violating the rights of the university and its students. In addition, many top universities, including Brown, Columbia, New York University, Stanford, and University of Pennsylvania, promised to protect international students. International students are critical to U.S. colleges and universities and the U.S. economy more broadly. International students often pay full tuition at U.S. colleges and universities many of which are facing declining enrollment and state funding cuts. International students make up more than than 20 percent of the student body at many top U.S. universities. They contributed $41 billion to the U.S. economy and supported or created 458,000 jobs during the 2018-2019 academic year, according to NAFSA. What to look for? Does the position require a degree and does the applicant have the specific degree? Will the employer be required to seek a work visa?  H-1B employers required to pay for attorney’s fees and filing fees.  Can employer wait until October 1 (or beyond) for the employee to begin working? If transferring from a previous H-1B – how many years on H-1B, do they have an approved immigrant petition (could extend time beyond 6 years).  Premium Processing suspended until at least February. Will employee risk transfer? Will the employment be “off-site”?  Must show proof of right to control the employee and cannot “bench”  Can you provide SOWs, itinerary, etc. See itinerary requirements. Creative solutions to still be able to hire the person your company needs! Is the applicant from Chile, Singapore, Northern Mariana Islands, Canada, Mexico, Australia?  May be other alternatives. Is spouse on a visa category which extends work authorization to employee? (E-3, L-1, etc.) STEM OPT extension to 36 months. 3rd party firms as a protective layer? Offshore options - Canada or Mexico? In this episode, we discuss the drastic new Visa Waiver rules that revoke ESTA clearance of people who hold dual citizenship with a European country as well one of the following- Iran/Iraq/Sudan and Syria. We also provide news update on the STEM OPT extension issue- STEM OPT will be extended until May 10, 2016. We are also very honored to speak with WA State Representative Brady Walkinshaw. He is running for Congress also. His family immigrated from Cuba, he grew up in the agricultural industry and has much understanding about immigration related to these issues.
