Growing up and working to support his family, he witnessed firsthand the injustices and inequalities many of the women in his village faced daily. After moving to the United States and going to University, he felt the responsibility to fight the injustices that existed in West Africa.In 1996, Tchala met his partner Prairie Rose Hyde, who was invited to his village as an environmental volunteer in the Peace Corp. Inspired by a shared calling to do right by the world, Alaffia, a social enterprise, was born. With an understanding of the value of indigenous West African resources and sustainable business ideologies, the two launched Alaffia's first shea butter collective in 2003 and in 2004 established the Alaffia headquarters in Olympia, Washington.For the last nearly 20 years, Tchala's green and fair trade organization has created sustainable programs in West Africa that have improved the lives of over 250,000 individuals. Proceeds from the sale of Alaffia's beauty and personal care products are returned to communities in Africa, such as those in Togo and Ghana, to fund their multiple empowerment programs including Maternal Care, Reforestation, Regenerative Agriculture, Eyeglass, Bicycle and in 2021 Female Genital Mutilation Eradication.Since inception, they have built 16 schools, planted over 99,000 trees, provided more than 10,000 bicycles and 30,000 eyeglasses, donated school supplies to more than 37,000 students, and funded over 6,500 births. How does it work? Women's cooperatives in West Africa handcraft indigenous ingredients, such as unrefined shea butter and African black soap, using traditional African methods. Products are then finished at Alaffia's U.S. headquarters in Olympia, Washington. Proceeds from the sale of their personal care products are returned to communities in Africa, such as those in Togo and Ghana, to fund their community programs.Today, Alaffia is available in Whole Foods nationwide and continues to redefine the natural products industry through its values of Beauty, Equality and Empowerment, fair trade, and safe, efficacious hair, face and body care.Agency of One - Take the stress out of hiring a freelancer or full-time employee. Today I talked to Debi Kleiman about her new book First Pitch: Winning Money, Mentors, and More for Your Startup (Babson College Publishing, 2020). For anyone who has ever watched Shark Tank, you know that investors respond not only by investigating business metrics but also by trying to get a sense of the entrepreneurs' drive, smarts, and openness to coaching. This episode covers both the “clues” investors look for like confidence and the 4H framework that Kleiman has honed by listening to well over 1,000 pitches in-person during the course of her career. From a headline that sets the context, to making the audience feel something, taking them on a hero's journey of what might be possible if this startup gets funded is crucial. Before I dive into what you’ll hear in this episode of Immigration Law for Tech Startups, I want to highlight a few things: I’m looking for international startup founders who have a strong case for filing for Entrepreneur Parole, which is the closest status to a startup visa in the U.S. If your startup is a Delaware C-corp, you have at least a 10% stake, raised at least $300,000 from investors, and are interested in joining me on this journey, fill out this form. Even if you don’t qualify, fill out the form to stay on our interest list. I’m honored to have been selected to be a mentor at 500 Startups, a top global startup accelerator program. International startup founders, check out 500 Startups!   Now, on to the matter of holding two H-1B jobs (concurrent H-1Bs) that I discuss in detail in this episode of Immigration Law for Tech Startups.   An H-1B visa is tied to a specific job with a specific employer. However, there are no limits on the number of H-1B jobs an individual can hold and no minimum—or maximum—number of hours a person can work in an H-1B position. Given that, an individual can hold concurrent H-1B visas from different employers: You can keep your current H-1B job while creating your startup, which can sponsor you for a second H-1B and avoid the lottery. Or an employer can avoid the H-1B lottery if the employee gets an H-1B visa from a university, a nonprofit associated with a university, or another lottery exempt employer first.   Reach out to us if we can help you navigate the H-1B process. In this episode of Immigration Law for Tech Startups, I’m joined by my amazing colleague, Nadia Zaidi, an associate attorney and a member of our business team at Alcorn Immigration Law. We discuss what sponsoring employers should do after the H-1B lottery, whether their H-1B candidate was selected—or not.   We layout the H-1B petition filing timeline and things you should consider when putting together an H-1B petition. If your candidate was selected, and you haven’t done so already, we recommend hiring an experienced immigration attorney right away. We also offer up a host of other options to those employers and their prospective employees who were not selected in the lottery, so don’t panic! We’ve got you covered! How to Get Press Coverage for Your Startup? Getting your small business mentioned in the local and national press is a great way to gain exposure and potentially new business. But certainly cannot guarantee to get any new sales. From personal experience, I published an award winning book on the food of Jersey (Channel Islands) which received a double page spread in the Islands main newspaper. It did not generate any sales at all. On the other hand, I have been mentioned in articles and the phone has rung off the hook. There simply is no way of knowing but you have to create the opportunity for it to work. This episode of Immigration Law for Tech Startups is the second in a two-part series on how to plan for this year’s upcoming H-1B lottery in March.   Late-breaking news: I recorded this episode before the State Department announced that international students who are currently abroad and holding or applying for new F-1 or M-1 visas will be granted national interest exemptions to the suspension of travel from Europe, the UK, Brazil, and South Africa due to the COVID-19 variant strains, according to Law360. The announcement also stated that business travelers, investors, academics, and journalists traveling on a visa to the U.S. can apply for a national interest exemption. This episode of Immigration Law for Tech Startups is the first in a two-part series on how to plan for this year’s H-1B lottery in March given the recent changes to the process.   Whether you’re a large corporation or an early-stage startup, I recommend hiring an experienced immigration attorney to help you navigate the complex H-1B lottery and filing process. Getting legal guidance is particularly important given the vast array of new rules and procedures that have been put in place under the Trump administration, particularly in recent months, and because it remains uncertain what will change—or whether anything will change—under the Biden administration. The Alcorn team is keeping close tabs on the latest developments and will keep you posted.   The biggest change the Trump administration made prior to leaving office was replacing the random H-1B lottery with an H-1B allocation process based on the highest wages paid to H-1B candidates given the position and work location. I’m calling it the new play-to-play rule for H-1Bs. Although it will pressure employers to raise salaries, the new wage-based H-1B lottery will add substantial predictability to the process.   Make sure to tune in to part 2 of H-1B Lottery Planning. 044: 7 of the Most Startup-Friendly Visas Explained

In this episode of Immigration Law for Tech Startups, I discuss the top seven most startup-friendly visas and green cards and what startup founders can and cannot do on each of them.   Unlike Canada, Australia, the U.K., and New Zealand, the United States does not have a startup visa. Congress attempted to create a startup visa through legislation in 2010, 2011, and 2013, but each effort failed. Shortly before leaving office, the Obama administration created the International Entrepreneur Rule through an executive order. After delaying the rule’s implementation, the Trump administration eliminated it, prompting a lawsuit from the National Venture Capital Association. In 2017, a federal district court ordered U.S. Citizenship and Immigration Services (USCIS) to implement the rule. The Trump administration filed a new proposal to end the rule in 2018, but never finalized the proposal. While not officially ended, the International Entrepreneur Rule has not been implemented.   In a report issued this year on startup visas, the National Foundation for American Policy estimated that if the U.S. had created a startup visa in 2016, it would have led to the creation of as many as 3.2 million jobs in the U.S. by 2026.   Even without a startup visa, startup founders have many ways to live and work in the U.S. The top seven options are: B-1 visa L-1A visa E-2 visa H-1B visa O-1A visa EB-1A green card EB-2 NIW green card   Please share this episode with any startup founders or entrepreneurs who can benefit from it. In this episode of Immigration Law for Tech Startups, I’m thrilled to discuss the Biden administration’s plans for reforming the U.S. immigration system.   Before I dive in, I know we’ll see meaningful changes in the U.S. under President Biden and Vice President Kamala Harris, from the way we govern ourselves, to our relationships with other countries and people around the world, and what immigration law will look like for startups, founders, investors, inventors, highly-skilled professionals, and families.   The Biden administration will undo most of the policies that the Trump administration put into place and restore the moral imperative in the U.S to do the right thing. I will cover the six main pillars that will guide Biden’s plan to create a more fair and humane U.S. immigration system and what that means for: A startup visa A path to citizenship for Dreamers Work visas, such as the H-1B The public charge rule The green card process, including the Visa Bulletin, and green card wait times, particularly for individuals born in India and China The diversity green card Citizenship through naturalization S. Immigration and Customs Enforcement (ICE) The Muslim bans Family separation at the border Asylum and refugee policies Detention and deportation Temporary Protected Status (TPS)   Remember, the way you can support the United States on its new path of immigration reform is to share your story, talk with reporters or write a letter to the Senator or Congressman who represents your district. In this episode of Immigration Law for Tech Startups, I’m joined by Eileen Wu, the founder of Luminarii, a creative agency that helps investors and entrepreneurs unlock the power of their authentic stories by leveraging marketing strategy, communications, and media expertise. Eileen advises many tech startup founders on how to get the attention of investors by optimizing their startup’s story. She also provides media training and coaching to C-suite executives and venture capitalists.   “Storytelling is so important now more than ever for domestic and international entrepreneurs in light of COVID when we’re being inundated with Zoom calls and PowerPoint presentations,” she says. “Investors are investing in teams they haven’t met before. That really levels the playing field for international entrepreneurs.” Because an entrepreneur’s first interaction with an investor these days is more likely to be through a pitch deck rather than an in-person conversation at a conference or cocktail party, spending time and energy developing your startup’s story has become even more important.    We listen to the elevator pitches of two entrepreneurs, Phil Wennker, co-founder of Mnemonic AI, and Alkis Pananakakis, co-founder of Vuel. 041: Investing in Immigrant Entrepreneurs with VC Carmen Palafox

In this episode of Immigration Law for Tech Startups, I’m excited to welcome Carmen Palafox, a venture capitalist based in Los Angeles who is launching her own firm, 2045 Ventures. She is on the Board of Directors of the National Venture Capital Association (NVCA) and is a founding board member of Latinx VC, a group of experienced venture capitalists who connect, engage, and foster the Latinx VC ecosystem. Carmen offers up her invaluable advice and best practices for startup founders, including Dreamers, who are seeking investment capital. Carmen describes herself as a “generalist investor,” which means that “I am industry agnostic,” she explains. That said, she gets most excited about startups in fintech, climate tech, ed tech, and healthcare. “And I’m not afraid of hardware,” she adds. Most recently a partner at MiLA (Make in LA) Capital, which focuses on hardware startups, Carmen is starting 2045 Ventures based on the thesis of diversity. “Diverse teams outperform non-diverse teams,” she says. “Diverse perspectives bring more opportunity to the table. Diverse founders are able to build relevant products and services that expand to reach broader communities. Diverse perspectives and networks will capture more of the market.” 2045 Ventures will invest in pre-seed, bridge, and seed 1 stage companies. Carmen anticipates investing in about seven companies a year. “That’s not a lot,” she acknowledges. “Fifty-eight percent of the startups I’ve invested in have immigrant founders on their founding team,” Carmen says. “I’m very passionate about immigration reform,” That’s why “it’s imperative for the U.S. to have a startup visa to remain competitive. We as a country should be trying to retain high growth startups. In this episode of Immigration Law for Tech Startups, I discuss the immigration-related due diligence process for startups. It’s very important for international founders, international tech talent, and investors to know about devising immigration strategies for founders and top talent and ongoing compliance with immigration laws. During the due diligence process, potential investors investigate the company they’re looking to invest in or acquire, documenting all the current and prospective risks, such as business operations, finances, intellectual property, sales, and potential litigation. In this episode of Immigration Law for Tech Startups, I’m thrilled to be joined by my trusted colleague and longtime friend Lindsey Mignano, founding partner of Smith Shapourian Mignano, a corporate law firm based in San Francisco that focuses on startups. We often assist each other’s startup clients with corporate structuring and immigration matters. Today, Lindsey shares her vast expertise in establishing and structuring startups and her insights on industry trends and the best strategies for raising funds, taking on investors, and growing a startup. Lindsey says investment activity is returning after coming to a screeching halt during the early weeks of the COVID-19 pandemic. She cited a recent study by First Republic Bank that found that 70% of investors are growing more comfortable deploying Series A or larger investments without an in-person meeting. This greater flexibility among venture capitalists also signals greater comfort with remote founders. Previously, investors would require an in-person meeting, as well as require the founding team to immigrate to the U.S. as a condition for funding. But with COVID-19 and given that working remotely has gone well since March, investors are becoming “location-agnostic,” Lindsey says.   Although investment activity has resumed, Lindsey points out that smaller pre-seed and seed funds are expected to do fewer deals this year, and larger funds are contracting slightly in this tough economy. Based on her firm’s clients, “we’ve found that those startups that can afford to bootstrap are taking the time to do that now because the practical reality is that COVID is throwing their business metrics and milestones off,” she says. “So, they’re taking time to regroup, reorganize, figure out how they can meet milestones before presenting new data to potential investors. I would say that’s wise, not only because of the COVID-19 world we’re living in, but because this is an acquirer-friendly, investor-friendly negotiating environment. It’s not a startup-friendly financing environment” Lindsey also pointed to a memo that Sequoia Capital sent to its founders and CEOs during the early days of COVID-19 before shelter-in-place became a reality that all startup founders should use as a guide to ensure the health of their business. In this episode of Immigration Law for Tech Startups, I share some of the immigration strategies that we have used to help startup founders successfully come to or remain in the U.S. to create or grow their startups. Unlike other countries looking to spur innovation and job creation within their borders, the United States does not have a startup visa. So, startup founders must work within the existing immigration framework and find a visa or green card that best fits their situation and goals.   Most of the startup founder clients we work with are in the U.S. on a nonimmigrant visa, such as B-1/B-2 visitors for business or pleasure, F-1 for students, J-1 for researchers, L-1, TN, H-1B, or O-1. Many of those individuals on an H-1B were born in China or India and are facing long waits for green cards due to annual numerical and per-country caps, but are itching to start their own companies.   Whether inside or outside the U.S., startup founders can self-petition for an EB-1A extraordinary ability green card or EB-2 NIW (National Interest Waiver) exceptional ability green card. In this episode, I discuss the nitty-gritty details of transferring an H-1B visa from one employer to another, as well as extending an H-1B and filing an amendment to an H-1B. The current moratorium on the issuance of new H-1B visas to most individuals outside of the U.S. has no impact on H-1B transfers, extensions, or amendments. Even if an individual is outside of the United States, if that individual has a valid H-1B visa, an employer could transfer and extend that individual’s H-1B under certain conditions. Eventually, consular processing for visas and green cards will resume. And the current moratoriums on not only H-1B visas but also J-1 and L-1 visas and green cards for individuals residing outside of the U.S. could end next year, depending on the results of this fall’s presidential election. Write your 15 minute business plan and then get moving providing goods and services for other people.  After all, the only person who reads most business plans is the person who wrote it - the business owner.  But unlike all those people who spend months writing a plan, you need to develop your 15-minute business plan and then start with the execution phase. Here is all you need. 15 Minute Business Plan for Your Startup (podcast outline) The key elements of a business plan are simple and should be obvious if you are getting ready to start making money and serving customers.  Your 15-minute business plan should answer the following questions: What problem(s) are you trying to solve? Do not be cute or wordy, just state what the problem is in normal words. Best to use the words you have heard potential customers use. Example: Help busy moms with preteen kids lose weight. They are so busy with kids that taking care of themselves is hard. Who you will serve? It needs to be someone who has the problem and is aware that they have it. For example, an overweight person who does not feel overweight or feel motivated to change it will not want your products. Example: Busy moms with kids who are from 5-12 worried about their weight. What products or services will you offer to solve that problem? Do not over complicate it, but think about the most valuable thing you can offer. The book  The Lean Startup calls this the MVP (Minimally Viable Product). Do not overthink it. Be clear. Example: An iPhone app that will trigger mom to plan her day the night before. What clothes she needs out to workout then go on with her day. What foods she needs to prep. Then during the day, the app will remind her what to eat and what exercises to do.  The goal - where you want to be in the next 3 years. Then break down to 1 year and 3 months.  Remember goals should motivate you and make you think you can do it - just outside of your comfort zone.  Goals are not a wish list - they are things you really are willing to work to accomplish Avoid the delusional zone. ($1billion in sales in 3 years)  Think simple steps. Do not overthink it. Create Mainline Goals, Big Win, and Stretch Goals Mainline - The minimum you want to see and still feel like it was a win.  Big Win - You will feel awesome  Stretch - If all works right and grows as you planned and other good things happen - this is a stretch.  Who is your competition?  Name the people - not just companies? How can you get to know them and be friends with them?  What makes you different Business proposition: We do X for Y so that they can Z. Unlike other companies, we … Example: We provide IT services for small companies that do not have IT experts so that they can focus on running their business. Leo Polovets of Susa Ventures joins Nick to discuss Raising Fund III, A Framework to De-risk Your Startup, & When to Explore vs. Exploit. In this episode, we cover: Give us an update on your investments at Susa since we last chatted? How has the thesis at Susa evolved over the past couple of years? Do each of the GPs at Susa have specialty areas of focus? This year Susa closed on 2 new funds - Susa III a $90M early stage fund, along with your first opportunity fund to which investors committed $50M. What was the elevator pitch to LPs and what worked well in the first two funds that resonated with LPs, leading to the successful raise? What would you have done differently in Fund I and Fund II if you could go back? What it takes to raise a Series A... often founders will have a singular focus on the vanity metrics -- they assume if they hit $2M in ARR they'll attract the A round at an attractive multiple from Tier 1 investors. But, we've seen this play out and it's not all that's required. Why is a singular focus on ARR a poor approach to raising money? Leo, you have an original framework here focused on de-risking the the major risks centers facing a startup. What are the high-level principles? The 9 risk centers that you've identified include Product Market Fit, Product Quality, Team, Recruiting, Sales, Market, Funding, Short-term Competition, and Long-term Competition -- can you pick one of these areas and walk us through an example? What are the common mistakes founding teams make with regard to these risks? Talk a bit about the balance between testing and execution?  How should founders balance figuring out the best path forward with running fast in the direction they think is best? Increasingly our founders have been sending us dealflow, operating as scouts, making angel investments in early stage companies. Where do you stand on this -- distraction that should be avoided or net benefit to those involved? In what ways have you changed most as an investor since the early days?
