This week's episode of the Parsing Immigration Policy podcast delves into the Insurrection Act, its historical uses, and whether it could legally authorize the use of the military to assist in the arrest and removal of illegal aliens.The Insurrection Act allows presidents to deploy federal troops not only in cases of insurrection but also when federal law can't practicably be enforced through conventional means. The Posse Comitatus Act, which many point to as preventing such a use of troops, is not the obstacle many assume it is.President Trump so far has only tasked troops with protection of federal facilities and agents, but, if he chooses to exercise it, he does have authority under the Insurrection Act to put them to work actually enforcing immigration law.“The Insurrection Act has been invoked by leaders of both parties to protect civil rights and to enforce federal law. Gavin Newsom called the Trump administration's efforts to enforce basic immigration law within his state “reckless” and “chaotic”, alleging that federal officials were trying to meet an “arbitrary arrest quota.” The Biden administration let in an estimated 12 million illegal aliens into the U.S. ICE would have to deport 8,000 illegal aliens a day to undo the damage done by the previous administration, which is not only unfeasible, but made more difficult by violent obscuration tactics employed by the Left in sanctuary cities, argues Victor Davis Hanson on today's edition of “Victor Davis Hanson: In His Own Words” “…on a good day, Tom Homan and ICE and the Border Patrol can maybe deport, they find, 800. But Joe Biden let in 10 times that number per day. So, they would have to step up their efforts by a magnitude just to get back to where Joe Biden started. If you let in 12 million people in the space of four years, you're talking about 3 million a year. You're talking 250,000 per month. So, you can see it's 8,000 a day and there's no way that that seems even feasible, even when the Left tries to obstruct that effort with sanctuary cities and district judges who entertain these lawsuits to stop it.”

Questions are being raised over cases where New Zealand-born teenagers fear being kicked out of the country for being illegal overstayers. A law change in 2006 removed the right to citizenship by birth for children born in New Zealand - but there's a wave of kids born after that date who are set to turn 18 and it's unclear what could happen to them. Immigration lawyer Alistair McClymont says he's representing some of these kids - who he feels are 'innocent' in this situation. "They need to be separated from adults who make conscious decisions to remain in a country unlawfully. These kids don't make those conscious decisions. They're just born - that's it." Earlier this year, President Trump signed an executive order aimed at ending birthright citizenship. He has placed this issue at the forefront of his immigration agenda and it is now being taken up by the Supreme Court. To have this conversation, we've brought together a constitutional law scholar and a political commentator.Cristina Rodríguez is the Leighton Homer Surbeck Professor of Law at Yale Law School. In 2021, she was appointed by President Biden to co-chair the Commission on the Supreme Court of the United States. Her recent book is called The President and Immigration Law. She's also the co-host of the new podcast: Unsettled: Immigration in Turbulent Times.Rod D. Martin writes The Rod Martin Report on Substack. He is also the Founder and CEO of Martin Capital. As a tech entrepreneur and venture capitalist, Rod was previously an advisor to Peter Thiel. Rod also served as policy director to Mike Huckabee, the former Governor of Arkansas.We talk a lot about the 14th Amendment in this episode. It was ratified in 1868 to give formerly enslaved people the right to vote. Here's what it says: “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.” Keep that phrase in mind. “Subject to the jurisdiction thereof.” It'll come up a lot.Our guests also discuss the Supreme Court cases Elk v Wilkins, Slaughterhouse, and Wong Kim Ark.
