The birthright citizenship case and immigration raids have drawn headlines and national attention, but Lucas Guttentag, who teaches immigration law at Stanford and Yale law schools, says some of the Trump administration's most consequential immigration changes are unfolding with far less public scrutiny. Guttentag, one of the nation's leading immigration law experts and founder of the ACLU Immigrants' Rights Project, joins host Professor Pamela Karlan for a wide-ranging conversation about current American immigration policies. Guttentag discusses his time in the Biden administration and compares policies in the first Trump administration with those of the second. He also focuses on the Immigration Policy Tracking Project, an effort he launched in 2017 with law students to document every Trump administration immigration policy, implementation memo, directive, and related legal challenge. The tracker, he explains, is designed to make visible what can otherwise be hard to see: hundreds of policy changes that, taken together, are reshaping the immigration system. The episode examines what these changes mean for immigration courts, bond hearings, temporary protected status, green card applications, and the lawyers challenging the administration in court. One of Guttentag's central points is that immigration is a civil system, not a criminal one, and the distinction matters for anyone trying to understand what is happening now. Oregon lawmakers passed eight immigration bills in the last legislative session that ended in March, and Gov. Tina Kotek signed them into law in April. The package of bills came as a response to a host of federal actions in 2025 that put immigrants and their families in jeopardy. Oregon was the first in the nation to become a sanctuary state in 1987 and has strengthened its protections in the intervening years. It is already illegal for law enforcement or public agencies to cooperate with federal agents without a warrant. The new laws strengthen existing protections and establish new ones. Among other provisions, they direct schools and hospitals to create alert systems, formalizing responses to federal actions. And they protect immigrant’s data and aim to prevent employer retaliation. Isa Peña is the director of strategy at Innovation Law Lab, an immigrant rights organization that lobbied for the bills. She joins us to share more about what the laws will do and the difference they’re expected to make for immigrant communities in Oregon.

There's praise for the 'tight ship' Immigration New Zealand's running. Data released to Newstalk ZB reveals just over 65 thousand visa applications were turned down in 2025, plunging from more than 83 thousand in 2024. The rejection rate last year sat at around 6.3% – while the two years before both sat at 7.3%. Queen City Law Managing Director Marcus Beveridge told Mike Hosking Immigration New Zealand's making efficient decisions to keep the bad guys out. He says they've had computer and personnel issues in the past, but it now seems they've got things humming pretty well. There's also little surprise at the countries making up rejections – India made up almost a third of them, followed by China and Pakistan. Beveridge told Hosking India's seen similar numbers for years, as it's always been considered a high-risk country, but Fiji often sees quite a bad rejection rate as well. In this event, David Myers welcomes legal scholar Hiroshi Motomura to join Luwei and explore the complex role of borders in shaping politics, conflict, and belonging. Ying explains how historical border instability, especially in regions like Alsace and Eastern Europe, have had long-term effects on the populations of these regions, including decreased trust in the government and greater support for populism. She also examines modern border fortifications, showing that while walls may reduce nearby cross-border violence, their overall effectiveness is mixed, as militant groups often adapt their strategies. Motomura expands the discussion by reframing borders as more than physical lines, emphasizing their legal and social functions in defining inclusion and exclusion. Hiroshi Motomura is the Susan Westerberg Prager Distinguished Professor of Law at the UCLA School of Law and the Faculty Co-Director of the UCLA Center for Immigration Law and Policy. He is a scholar of citizenship and immigration, influencing across a range of academic disciplines as well as federal, states, and local policy making. He has written multiple award-winning books including Americans in Waiting: The Lost Story of Immigration and Citizenship in the United States (Oxford 2006) and Borders and Belonging: Toward a Fair Immigration Policy (Oxford 2025). Over the past year, like no other time in recent memory, immigration law and enforcement has been in the spotlight. Guest William Menard is a longtime immigration attorney and a managing partner at the California immigration law firm Root Law Group.
