Deferred Action for Childhood Arrivals, known as DACA, has given more than half a million immigrants protection from deportation since 2012. The program has allowed people brought to the United States as children to work, buy property, start businesses and raise families. The program has weathered plenty of challenges in its 12-year history, and now many recipients are worried that president-elect Donald Trump will try to end the program like he did during his first term. We talk with DACA recipients about how they are preparing for the future and what could happen next. Immigration continues to be a key issues in the run up to the 2024 election year. Polling suggests immigration is ranked as one of the most pressing topics among voters across the nation. Earlier this month, President Joe Biden announced several executive actions designed to clamp down on immigration. If the number of crossings surges, the new order will prevent migrants from seeking asylum. The policy is similar to moves made during the Trump administration, which were successfully challenged in court. The ACLU has already vowed to challenge Biden's actions, as well. Among all of the rhetoric, what is the reality on the ground, at the U.S.-Mexico border and here in Maryland? Marielena Hincapié joins us to discuss the latest. Given his background as a former federal prosecutor, clients trust Agustin Orozco to lead complex white collar cases and investigations, handle contentious and sophisticated pretrial litigation, and successfully prove highly difficult cases at trial. Agustin's experience as a federal prosecutor and government contracts attorney leaves him uniquely situated to help clients where government contracts and white collar intersect. Agustin represents clients in criminal and civil government investigations and enforcement actions. He also represents and counsels clients on matters involving federal, state, and local government contracts. Agustin has litigated civil False Claims Act matters and other government contracts issues, such as disputes, claims, and terminations, as well as suspension and debarment matters. He is also experienced in matters involving the Foreign Corrupt Practices Act, including conducting investigations abroad and counseling clients on compliance issues. Prior to rejoining the firm as a partner, Agustin was an assistant U.S. attorney in the Public Corruption & Civil Rights Section of the U.S. Attorney's Office for the Central District of California. While serving in this role, Agustin represented the United States in criminal investigations, prosecutions, and/or appeals of public corruption, bribery (both domestic and abroad), conflicts of interest, honest services fraud, procurement fraud, wire fraud, mail fraud, obstruction of justice, money laundering, tax, and civil rights crimes. He worked on hundreds of criminal cases, served as lead counsel in federal trials, examined dozens of witnesses on direct and cross-examination, delivered opening and closing arguments, and briefed and argued multiple cases before the U.S. Court of Appeals for the Ninth Circuit. During law school, Agustin was an extern for the Hon. Barry Russell at the U.S. Bankruptcy Court in the Central District of California and interned at the National Immigration Law Center in Los Angeles. He also served as the co-chair of La Raza de Loyola and as chief justice of the Scott Moot Court Honors Board. Agustin is active in the community and serves as a commissioner on the Judicial Nominees Evaluation Commission of the State Bar of California; on the steering committee of Just the Beginning, Los Angeles; and as a board member of For People of Color Inc. He is also a board member of the Federal Bar Association-Los Angeles and on the Executive Committee of the Los Angeles County Bar Association's Privacy & Cybersecurity Section. Agustin previously served on Project LEAD, where he helped teach elementary school children about the criminal justice system, and as vice chair of the LACBA's Diversity in the Profession Committee. Agustin was selected to the Pathfinder Program of the Leadership Council on Legal Diversity in 2016.

To learn more about job search strategy for F-1 international students, visit https://www.icaway.com/ I received an email from an F-1 international student whom I had been mentoring, and my heart sank as soon as I read the subject line: "Didn't get selected for H-1B." I could feel their disappointment and frustration. They had been hoping to stay in the US and work at their dream job, but now that opportunity seemed to have slipped away. I reminded them that they still had their STEM OPT and could try again next year. I also suggested that they speak with an immigration attorney to learn more about other visa options. I hope to share this story and encourage others to advocate for international students and propose changes to the H-1B system. We need to create a fair system that recognizes the valuable contributions that international students make to our society and the American economy. It's time to recognize their contributions and create a system that values them for the incredible assets they are. Workers Could Get $1.75 Million Over Meat Plant Raid

On Wednesday, a federal judge approved a settlement for Latino meat processing plant employees in Tennessee who were targeted by an immigration raid in 2018, according to the AP. According to the Tennessee Lookout, about 100 Southeastern Provision Plant employees stand to share $1.75 million dollars.The workers who were held as a result of the raid, sued, claiming that the IRS and Department of Homeland Security targeted them illegally. The settlement to the class action lawsuit is scheduled to receive final approval on February 27, 2023. According to the settlement, each worker is expected to receive between $5,000 and $6,000. The U.S. is also on the hook for an additional $475,000 that will be shared by the seven employees who made excessive force and unlawful arrest claims. About $150,000 will go towards attorneys fees and other expenses for the Southern Poverty Law Center and National Immigration Law Center. Part of the problem comes down to how the search warrant was obtained. Agents said they were only looking for records regarding a tax evasion case against plant owner James Brantley. However, attorneys showed that the agencies used the search warrant to mount a large-scale workplace immigration raid.At the time, it was believed to be the largest raid of a workplace in nearly 10 years. According to video of the raid obtained by the Tennessee Lookout, when agents entered the facility, they separated white plant workers from those with brown skin, made fun of the Latino workers and roughed up at least two employees.

Ilya Kaminsky, the 2020 Anisfield-Wolf Book Awards winner for poetry, joins The Asterisk* to talk about the political asylum that brought his family from the former Soviet Union to Rochester, N.Y., his unlikely transition from lawyer to poet and when he knew to publish after 15 years of working on “Deaf Republic.” Celebrated for his facility with the Russian, Ukrainian, sign and English languages, Kaminsky clerked for the National Immigration Law Center, then became the Court Appointed Special Advocate for orphaned children in Southern California. In his mid-20s, he sent a manuscript to the Tupelo Press, which published it as “Dancing in Odessa.” Hailed as the harbinger of a major new voice, this first book reached a global audience, translated into more than 20 languages. “Deaf Republic” received even broader critical acclaim, causing the British Broadcasting Corporation to declare Kaminsky “one of the 12 artists that changed the world in 2019.” Poet Rita Dove, an Anisfield-Wolf Book Awards juror, said she was haunted by the book: “It's a parable that comes to life and refuses to die.” Kaminsky sat down with The Asterisk* in January of 2021 from his home in Atlanta, where he has served since 2018 as the Bourne Chair in Poetry at the Georgia Institute of Technology.

On Tuesday, the Supreme Court heard oral arguments from three lawsuits demanding the Trump administration preserve Deferred Action for Childhood Arrivals, or DACA. The Obama-era program has granted protection from deportation and a work permit to at least 700,000 undocumented people who were brought to the United States as children. The court's conservative majority appeared poised to side with President Trump in ending the program, while some of the court's liberal justices seemed skeptical of Trump's efforts. In September 2017, the Trump administration announced it planned to terminate DACA, arguing the program was “illegal” and “unconstitutional,” but three lower courts disagreed and have kept the program alive, thanks to lawsuits filed by California, New York and D.C. Immigrant rights activists have been pushing the Supreme Court to save DACA, with dozens of immigrants with DACA recently taking part in a 16-day, 230-mile march from New York to the steps of the Supreme Court. We speak with Martín Batalla Vidal, the lead plaintiff in the New York federal lawsuit challenging the Trump administration's attempt to terminate DACA, and Trudy Rebert, a staff attorney at the National Immigration Law Center, which also filed suit to block the Trump administration's cancellation of DACA. The Leadership Conference on Civil and Human Rights hosted a press call to discuss the need for the Senate Judiciary Committee to determine whether Attorney General nominee William Barr is committed to upholding the civil rights of all people. With Barr’s confirmation hearings beginning on Tuesday January 15th it is crucial that the nation’s top law enforcement officer and leader of the U.S. Department of Justice is committed to our country’s ongoing progress toward equal justice. Civil rights leaders joining the call were Kristine Lucius, Executive Vice President for Policy, The Leadership Conference on Civil and Human Rights, Janai Nelson, Associate Director-Counsel, NAACP Legal Defense and Educational Fund, Inc., Michael Collins, Director of National Affairs, Drug Policy Alliance, Avideh Moussavian, Legislative Director, National Immigration Law Center and Sharon McGowan, Chief Strategy Officer and Legal Director, Lambda Legal. First Kristine Lucius from The Leadership Conference on Civil and Human Rights stated, “Under former Attorney General Sessions, we saw nearly unbridled disdain for the Justice Department’s vital role as the nation’s primary agency for protecting people’s rights. For nearly two years, Sessions destroyed families and communities by attacking voting rights, restarting the War on Drugs, failing to enforce constitutional policing policies, rolling back protections for LGBTQ individuals and justifying officials separating children from their parents and locking immigrant children in cages. William Barr’s record suggests more of the same. Our families and communities deserve better and members of the Senate Judiciary Committee have an obligation to seek assurances from Mr. Barr that he will not be Sessions 2.0.” Then Janai Nelson, NAACP Legal Defense and Educational Fund, Inc., added, “If confirmed, William Barr will inherit the abominable legacy of Jeff Sessions, who established policies that undermined and attacked the civil rights of communities of color. The Trump Justice Department has dismantled racial diversity efforts and rescinded guidance on racial disparities in school discipline and special education, promoted voter suppression and abdicated its obligation to protect the civil rights of persons who encounter the criminal justice system. Senators must determine whether Barr will continue to weaponize the Justice Department and eviscerate civil rights protections or whether his record suggests that he can repair and restore integrity and fairness to the Justice Department and ensure that all persons are treated equally under the law. Next we heard from Michael Collins, Drug Policy Alliance, who added, “Trump is appointing someone who has long been a cheerleader for mass incarceration and the war on drugs. It shows the Administration’s true colors and undermines any recent criminal justice reforms. During this nomination process, I hope that Senators from both parties take Barr to task for his retrograde views on drug policy and criminal justice, instead of giving him an easy ride like they did with Jeff Sessions.” Then Avideh Moussavian, National Immigration Law Center stated, “William Barr’s own track record and his unmitigated support for former Attorney General Sessions is cause for serious alarm. In his own right, Barr has supported border militarization, criminalization of migrants, and subjecting vulnerable populations of HIV+ Haitian asylum seekers to indefinite detention. His open praise for Sessions -- from explicitly supporting the first and most egregious version of Trump's Muslim ban to implicitly supporting policies to turn immigration judges into mass deportation agents and forcibly cage thousands of children in order to coerce their parents to abandon their legal right to claim asylum -- shows he will continue to weaponize the role of the DOJ and Attorney General to devastate the rights of those who most need its protection.” Then we heard from Sharon McGowan, Lambda Legal and former senior official in the Civil Rights Division of the U.S. Department of Justice who concluded, “Jeff Sessions transformed the Department of Justice from a guardian of civil rights into a weapon of discrimination and bigotry and William Barr has made clear that he is eager to pick up where Sessions left off. As Attorney General under George H.W. Bush, Barr defended what CBS News described as ‘the world’s first and only detention camp for refugees with HIV’ and only just a few weeks ago, William Barr ‘saluted’ Jeff Sessions for his efforts to nullify legal protections for LGBT people. The Department of Justice needs new leadership to get it back in the business of defending civil rights and equal justice under law for all people. William Barr, through his own words and actions, has proven himself unworthy for this important role.” The Leadership Conference on Civil and Human Rights is a coalition charged by its diverse membership of more than 200 national organizations to promote and protect the rights of all persons in the United States. The Trump administration is poised to propose new regulations that would further limit immigrant access to vital safety net programs. Leaked copies of the draft regulations revealed a dramatically expanded “public charge doctrine” under which immigrants could be denied admission to the United States or permanent residency if they or their dependents have used or are considered likely to use public benefits programs. Such changes would increase poverty, stress, and fear among immigrant communities. How can you and your organization fight back? In our May 2018 episode of the Advocacy Exchange, our monthly conversation with advocates advancing change, we discussed the Protecting Immigrant Families, Advancing Our Future campaign and the efforts to get as many poverty advocates as possible to oppose these regulations. Currently, she is working on a book that examines the legal and moral implications of mind sciences research on policing and criminal procedure. Her scholarship has been published by law journals at Yale, Cornell, Northwestern, Southern California, and Minnesota, among others. Her article, “Police Efficiency and the Fourth Amendment” was selected as a “Must Read” by the National Association of Criminal Defense Attorneys. Her co-edited book, The Constitution and the Future of Criminal Justice in America, was published by Cambridge University Press in 2013. Tom’s final guest today is Marielena Hincapie, executive director of the National Immigration Law Center. The U.S. Senate is scheduled to take up immigration reform tonight. During budget negotiations that resulted in two brief government shutdowns, Senate Democrats extracted a promise from Majority Leader Mitch McConnell to begin debate on a fix for DACA (Deferred Action for Childhood Arrivals) and comprehensive reform of immigration policy.President Trump has issued a deadline of March 5th for Congress to come up with a fix for the DACA program, which Mr. Trump ended last fall.Speaker of the House Paul Ryan has said that he, too, is committed to finding a fix for the 800,000 young people in the DACA program, but, despite Minority Leader Nancy Pelosi’s marathon speech on the House Floor last week, Ryan has made no promise about bringing immigration legislation to a vote in the Congress.Hincapie, on the line from Washington, D.C., offers her perspective on what’s next for DACA, and for immigration policy moving forward.

The depravity of Donald Trump's fear-mongering, xenophobic, anti-Muslim politics are now in full swing. The new president has barred people from seven Muslim-majority countries — Iran, Iraq, Libya, Somalia, Sudan, Syria, and Yemen — including, to an unclear and ultimately-walked back degree, lawful permanent residents, from entering the United States for ninety days. All refugees are barred for 120 days, and refugees from Syria are barred indefinitely. What's gotten less attention, but is also quite serious, is that Trump slashed the overall number of refugees slated to be admitted this year by more than half. Today, we bring you two interviews. The first is with Nicholas Espíritu from the National Immigration Law Center, one of the groups mounting legal challenges against the ban, who will explain the legal and constitutional challenge to the Muslim and refugee ban. The second is with Linda Sarsour, the executive director of the Arab American Association of New York, a leading supporter of Bernie Sanders' primary bid, and co-chair of the Women's March on Washington.

Some candidates for the US presidency, for example, are campaigning on platforms that would include severe restrictions on immigration to the United States as well as a complete ban of Muslim immigrants. In the first of a two-part CMSOnAir series, “Shaping a Nation: The Past and Present Struggles Over Immigration," the Center for Migration Studies of New York (CMS) speaks with Charles Wheeler, Director of Training and Legal Support at the Catholic Legal Immigration Network, Inc. (CLINIC) where he manages support and advocacy work on immigration law and related issues affecting immigrants. Prior to CLINIC, Mr. Wheeler directed the National Immigration Law Center for more than ten years and practiced and taught immigration law for two decades. He has served on the boards of the National Immigration Forum, American Immigration Lawyers Association, National Immigration Project of the National Lawyers Guild, and other leading organizations. Listen NowOver 20 million immigrants live in the US, approximately half of whom, or 11 million, are undocumented.  Because immigrants are frequently employed in low-wage jobs they largely lack health care coverage.  Legally residing residents are able to acquire coverage via the ACA's state marketplaces however they are typically required to wait five years to apply to qualify for Medicaid. Undocumented immigrants are neither able to buy marketplace coverage even if they pay the full premium nor are they typically allowed Medicaid coverage.   Last November the President announced a pathway to citizenship for undocumented immigrants but whether this will improve their ability to obtain health insurance is unclear.During this 23-minute discussion Mr. Padilla explains the genesis of the five-year waiting period for legal immigrants to apply for Medicaid, why undocumented immigrants are unable to purchase marketplace insurance at full cost, where (and how) immigrants typically get health care services and moreover what, if any, effect will the President's executive order actions announced last November have in providing health care coverage for undocumented immigrants.      Angel Padilla is a Health Policy Analyst at the National Immigration Law Center (NILC) where he works to develop and implement NILC's federal immigrant health policy agenda.  Prior to joining the NILC in 2014 he was an immigration policy consultant at the National Council of La Raza.  Prior still he served as a Legislative Assistant to Rep. Luis Guiterrez (D-IL).  Mr. Padilla also interned at the Department of Homeland Security.  He holds an undergraduate degree from the University of California at Berkeley and a graduate degree form the Princeton University's Woodrow Wilson School of Public and International Policy.The National Immigration Law Center website is at: http://www.nilc.org/.
