When Insurer Let's Insured Unilaterally Choose Additional Insureds it has no Standing to Complain An insurer, by drafting an open-ended additional insured endorsement that allowed its insured, by entering into contracts under which the insurer would be obligated to provide a defense to people unknown to the insurer and which did not require that its insured to obtain the insurer's approval of the contracts or require its insured to disclose the identities of the third parties or require that named insured name those parties as additional insureds. The insurer assumed the responsibility of providing defenses for certain unknown and unnamed third-party beneficiaries. In Westfield Insurance Company v. Walsh/K-Five Jv (I-14-4208); Walsh/K-Five Jv (I-14-4209); Walsh Construction Company Ii, Llc/K-Five Construction Company Jv, a Joint Venture; Walsh Construction Company Ii, Llc; K-Five Construction Corporation; Arch Insurance Company; and Royce Brown, Defendants, Walsh/K-Five JV (I-14-4208), Walsh/K-Five JV (I-14-4209), Walsh Construction Company II, LLC/K-Five Construction Company JV, a Joint Venture, Walsh Construction Company II, LLC, and K-Five Construction Corporation, 2022 IL App (1st) 210802-U, No. 1-21-0802, Court of Appeals of Illinois, First District, Third Division (August 17, 2022) compelled the insurer to live up to its agreements. FACTS Westfield Insurance Company (Westfield) filed a declaratory judgment action seeking a determination that it owed no duty to defend or indemnify defendants in an underlying personal injury lawsuit that occurred at a construction site at which Walsh and K-Five were operating a joint venture. In the underlying lawsuit, Royce Brown (Brown), an employee of VMR Contractors, Inc. (VMR), a subcontractor at the construction site, injured himself carrying rebar. Coverage under the Policy That's what occurred in this case. Because the plain language of the Contractors Endorsement mandates that the endorsement does not apply to "any person or organization covered as an additional insured on any other endorsement now or hereafter attached," the joint venture exclusion therein did not negate coverage for Walsh, K-Five or the Joint Venture, as additional insureds under the Additional Insured Endorsement. The Court of Appeal affirmed the circuit court's rulings that granted defendant Walsh Construction Company II, LLC's motion for a partial judgment on the pleadings, granted defendants Walsh/K-Five JV (I-14-4208), Walsh/K-Five JV (I-14-4209), Walsh Construction Company II, LLC/K-Five Construction Company JV and K-Five Construction Corporation's motions for partial summary judgment and denied plaintiff Westfield Insurance Company's motions for summary judgment where plaintiff had a duty to defend defendants. ZALMA OPINION Insurers who give away their underwriting pen to others have learned its decision was expensive. In this case the insurer gave the insured the right to make anyone with whom it contracted additional insureds. By so doing Westfield gave away its right to underwrite its obligation to insure and found it was insuring multiple people it had no idea, when it issued the policy, it insured. Cases like this one should cause insurers to reconsider whether it has sufficient premium to cover the risk it is letting its named insured to impose on it by entering into a contract with others. Host: Jeremy Cherny interviews James Oryszczyn, Director of Security & Network Services at an Am Law 200 Law Firm “I support network applications, video conferencing, and bundling security. We have a lot of sensitive client data. So we get a lot of client audits making sure that we’re complying with all security programs - and also making sure that we keep hackers out.” Why is security so important for an Am Law 200 Law Firm? Some of the larger clients have very sensitive data and that data gets breached, it's going to cost them quite a bit of money. So why it’s important is reputation. number one. Number two is losing clients. You don't want to be on the front page of the news. Number three, your clients trust you with the data. So you have to make sure you're protected and doing the right things because you're agreeing to certain stipulations and what they call outside counsel guidelines. Outside counsel guidelines are actually the arrangement that most clients have with law firms that explain billing, explain how you're going to do the work, and finally, they have a lot of security requirements in those outside counsel guidelines. So what'll happen is a lot of the clients will come in and they'll audit us saying we're doing what we said we're going to do when those outside counsel guidelines. How do you stay on top of the latest security threats? There’s a number of things. I listen to a lot of podcasts and read a ton of different blogs. We also have a managed security provider that sends us information when there are types of critical security alerts that we need to be aware of. How do you handle awareness training for your clients and for your team? We have a product called KnowBe4, which we do yearly security awareness training through that. A lot of it's for compliance purposes, along with having good security awareness training programs. We have a fairly robust HIPAA practice or healthcare practice. So the healthcare attorneys, on a monthly basis, send out tips on how to be secure. Because of HIPAA, they are very secure environments. So a lot of the users get tips from them too.  Have you ever had to really sit down with someone who keeps clicking on things they’re not supposed to? Generally, no. We have an IT security mailing list that people send stuff to. So most of the attorneys are very scared to click on something they shouldn't. They're very judicious about actually sending it over to be reviewed, which I appreciate. Every so often, you'll have somebody click something they shouldn't, but it's getting rarer and rarer. What’s your home network like? If you’re familiar with Palo Alto networks, I have a Palo Alto firewall with a bunch of threat protection on it. I’m running a VMR system with about 10 VMs. One of those VMs is a product called Teapot, which is a ree honeypot where I can actually see people trying to attack my network. I have some three-layer switches and some pretty advanced wireless stuff. For my wireless network, I split it into two - I have, what I call, my Internet of things. So that is my fire alarms, thermostats, things of that nature. Then I have just my regular network.

Abstract: Retinitis Pigmentosa (RP) is an incurable inherited retinal degeneration affecting approximately 1 in 4,000 individuals globally. The goal of this work was to identify drugs that can help patients suffering from the disease. To accomplish this, we screened drugs on a zebrafish RP model. This model expresses a truncated human rhodopsin transgene (Tg(rho:Hsa.RH1_Q344X)) causing significant rod degeneration by 7 days post-fertilization (dpf). Consequently, the larvae displayed a deficit in visual motor response (VMR) under scotopic condition. The diminished VMR was leveraged to screen an ENZO SCREEN-WELL (R) REDOX library since oxidative stress is postulated to play a role in RP progression. Our screening identified a beta-blocker, carvedilol, that ameliorated the deficient VMR of the RP larvae and increased their rod number. Carvedilol can act directly on rods as it affected the adrenergic pathway in a rod-like human Y79 cell line. Since carvedilol is an FDA-approved drug, our findings suggest that carvedilol can potentially be repurposed to treat RP patients. Copy rights belong to original authors. This pain and hypersensitivity are mediated by extrinsic primary afferent neurons (ExPANs) that innervate the colon. Recent studies indicate that the colon epithelium contributes to initiating ExPAN firing and nociceptive responses. Based on these findings we hypothesized that the epithelium contributes to inflammation-induced hypersensitivity. A key prediction of this hypothesis is that inhibition of the epithelium would attenuate nociceptive signaling and inflammatory hypersensitivity. To test this hypothesis, the inhibitory yellow light activated protein archaerhodopsin was targeted to the intestinal epithelium (villin-Arch) or the ExPANs (TRPV1-Arch) that innervate the colon. Visceral sensitivity was assessed by measuring the visceromotor response (VMR) to colorectal distension (CRD), with and without yellow light illumination of the colon lumen. Inhibition of the colon epithelium in healthy villin-Arch mice significantly diminished the CRD-induced VMR. Direct inhibition of ExPANs during CRD using TRPV1-Arch mice showed that ExPAN and epithelial inhibition were similarly effective in reducing the VMR to CRD. We then investigated the effect of epithelial and ExPAN inhibition in the dextran sulfate sodium (DSS) model of inflammatory bowel disease (IBD). Inhibition of the colon epithelium significantly decreased DSS-induced hypersensitivity and was comparable to inhibition of ExPANS. The synthesizer that originated from a Google artificial intelligence program can now be yours as an open-source, build-it-yourself project. The NSynth Super uses a machine-learning algorithm developed at the Google research project called Magenta, and it creates entirely new sounds from the acoustic qualities of original input sounds. The NSynth Super has a touchscreen that you use to drag between many different combinations of four original sounds. This new technology will require some work for you to build. The Danish company TC Electronic has announced the TC2290-DT hardware controlled delay plug-in. This a modern version of the TC2290 dynamic delay that was an influential and expensive piece of gear back in 1985. The USB powered desktop hardware recreates the look and feel of the original rackmounted delay. And TC Electronic’s engineers have modeled the new plug-in to try to bring the lush delay tones of the past into a plug-in that will work in all major DAWs. The TC2290-DT  will be available in June of 2018 for $349 USD. Slate Digital has updated its Virtual Mix Rack channel-strip plug-in to VMR 2.0. The VMR interface resembles a rack of 500-series dynamics modules and lets you create your ideal mixing channel strip from dozens of analog modeled preamps, EQs, compressors, filters, and more. New features include a row of instant recall buttons for your favorite setups, a button to Clear the rack, undo and redo buttons, and more.
