Your honor, today we are filing for you to please dismiss this case on grounds that this was an unlawfully executed search and unreasonable search and seizure. This is an important and massive civil rights case because of the amount of animals they unlawfully seized from us, the large number of Pima employees involved. Today we submit conclusive evidence that PCSD PACC and APS falsified their reports against us. See the Attached still image of Trista being shoved into a cop car by Detective Noon #7977 timestamped at 8:45 a.m., 8/30/23. This contradicts their reporting of events, claiming our arrests, sending to jail and impoundment of our pets took place after "noon", "after the inspection." We were thus deprived of our right to due process, since they falsely charged, arrested and incarcerated us hours before the time they reported. We were deprived of any ability to explain during a walk-through or supervise, or film them and they failed to film themselves, a violation of their own departmental rules. These facts alone should be enough to dismiss this case, and open an investigation into serious allegations of misconduct on the part of 19 + sheriffs that day, who all falsely reported the times of our arrest, charge and incarceration and impoundment of our animals. We have ample evidence to support our claims - which have always been truthful and fact-based- that PCSD, PACC and APS carried out unlawful and unreasonable search and seizure of our pets. A second example: PACC investigator Leyva-Canez #3124 misrepresented the condition of my healthy birds, which I care for 24/7 and rarely leave the premises. In fact I had just fed and watered them like I do every early morning for the past several years. Leyva-Canez made a ludicrous claim in her report that"approximately all" of my 128 birds were "emaciated and had parasites"; yet when she turned in "evidence" to the testing department, they said there "was not enough information". Leyva canes says in the report she will provide more information later but conveniently never does. This is arguably a form of falsifying evidence so we move for all of Leyva-Canez reporting to be tossed out, as she violated the rules of own Department. In fact, all the Pima employees that day acted with impunity, flaunting the rules by never turning on their body cameras. This is effectively suppression of evidence that would exonerate us, the defendants so on grounds of violating the Bradley rule, please consider dismissing this case. We move dismiss this case at once, return our pets, and open an investigation into glaring and embarrassing misconduct by these taxpayer-paid employees, civil servants who are supposed to protect and serve us, not to plant and falsify evidence. Further, we ask your honor to award us the maximum punitive damages allowed in cases where egregious harm has been done against innocent, law abiding Pima residents and model American citizens like ourselves. We have had absolutely no marks on our records until now. When Ronald Reagan won the 1980 election it was called the Reagan Revolution, but it wasn't a revolution only because he defeated Jimmy Carter. The platform that Reagan ran on was also revolutionary for the Republican Party. Before Reagan won the Republican nomination for president that year the party had been dominated by a northeastern elite known as Rockefeller Republicans. This business and banking elite controlled the Republican Party since the Eisenhower administration and they were a powerful force in American politics. It was believed they were defeated for good in 1964 when Arizona Senator, Barry Goldwater won the Republican nomination on new conservative platform. However, in 1968 Richard Nixon, a Rockefeller Republican won the nomination and the presidency. When Nixon resigned in 1974 and was replaced by Gerald Ford, a Rockefeller Republican, Ford made Nelson Rockefeller his Vice President. In 1976 California Governor Ronald Reagan, challenged Ford for the nomination running on a similar conservative platform as Barry Goldwater. Reagan was narrowly defeated at the convention, but ran again in 1980 and easily won the nomination and the presidency. Many people believed that Reagan's win dealt the deathblow to Rockefeller Republicans, but is that true?
