This week, we got a surprise nomination for the top role at the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). On Tuesday, President Donald Trump quietly submitted Robert Cekada's nomination to the Senate. Cekada is currently ATF's Deputy Director and has worked at the agency for the last 20 years. To dissect what the pick means for gun politics and policy, we've got Bearing Arms' Cam Edwards back on the show. Cam said Cekada's background in law enforcement is likely to make him relatively uncontroversial in the Senate, which boosts his odds of being confirmed. He said Cekada could even gain at least some bipartisan support. But he also noted the same quality could irk some gun-rights activists. Cam agreed that Cekada was a much less aggressive pick than the two that former President Joe Biden made. He said picking a career ATF official to head up the ATF is unlikely to please those who want to see the agency change dramatically or even go away altogether. Still, he noted the gun industry is very supportive of Cekada's nomination and that could help sway other gun-rights advocates. Ultimately, he said the pick is likely to keep the ATF on its current trajectory. How people feel about the ATF's 2025 track record is probably a good barometer of how they'll feel about Cekada. NWT Nominee Program applications open November 10 with revised eligibility criteria The third 2025 intake of the Northwest Territories Nominee Program opens on November 10 at 9 a.m. These additional spots come following extensive advocacy work by the Government of the Northwest Territories (GNWT), leading to the Government of Canada's decision earlier this month to restore the territory's yearly full allocation of 300 nominations. To fill the remaining nomination spots in a timely manner, the program guidelines have been updated through to the end of 2025, changing eligibility criteria for applicants and employers. These revised guidelines include three key changes: 1. Removing the limit on employer applications: Employers will no longer be limited on the number of applications they can submit based on business size. 2. Removing work permit expiry date requirements: Under the revised guidelines, applicants with a valid work permit who meet all other eligibility criteria may now apply, regardless of their work permit expiry date. 3. Reinstating the previous work experience requirement: The Skilled Worker and NWT Express Entry streams will return to the work experience criteria used in 2024 and earlier. Applicants must have at least one year of full-time work experience within the last 10 years in the same or a similar occupation as the one for which they are being nominated. This experience may come from different employers. These changes will remain in place for the remainder of 2025. Application intake closes November 24, 2025, 5 p.m. The Northwest Territories Nominee Program will aim to process up to 103 eligible applications in order to meet its revised 300 nominations for 2025. Applications received in excess of 103 or applications that cannot be finalized by December 23, 2025, will be withdrawn. Edward Forst told lawmakers Thursday that he wasn't privy to the decision-making behind the General Services Administration's deal with xAI's Grok — but if confirmed to lead the agency, he signaled openness to examining the process that led to the procurement of the generative AI chatbot known for having an antisemitic meltdown. During a Senate Homeland Security & Governmental Affairs Committee hearing, ranking member Gary Peters, D-Mich., asked the GSA administrator nominee if he shared his concerns about Grok, pointing to the day the tool “produced racist and antisemitic content widely across [Elon] Musk's social media platform.” Forst, a former private equity and financial services executive, told Peters that he had “not been a part of the decision” by the GSA to contract for the chatbot from the Musk-owned AI firm. With some additional pressing by Peters, Forst acknowledged that procuring a tool with a history of racist and antisemitic posting is “not, I think, the signal we would necessarily want to send to the country.” Peters attempted to get Forst to commit to pausing use of Grok until the committee received “documentation about the details of the procurement, including whether the GSA actually performed a comprehensive risk assessment.” Forst wouldn't go that far on Grok, which once referred to itself as “MechaHitler.” But he did says his commitment to the lawmakers is that he will “meet with the team, and I'll understand the process used in selecting them, and I'll make sure that we have all the facts and if there was incompleteness to the process, that we'll rectify it.” A pair of federal judges said staff use of generative artificial intelligence tools and premature docket entry were behind error-ridden orders they issued, according to letters made public by Senate Judiciary Chairman Chuck Grassley on Thursday. Judges Henry T. Wingate and Julien Xavier Neals, who sit on the U.S. District Courts for the Southern District of Mississippi and District of New Jersey, respectively, both stated in letters that their law clerks had used AI tools to draft orders that were then entered into the dockets before they had been reviewed. Both judges also described measures to prevent repeat issues. The letters come after the orders from both judges were ridden with errors — including misquotes and references to parties not in the current cases — and later withdrawn. Speculation swirled as to whether those judges used AI, which is known to hallucinate, in their orders. Earlier this month, Grassley, R-Iowa, sent letters to both jurists asking for an explanation. The communications published Thursday are responsive to those inquiries. In his response, Neals indicated that previous reporting by Reuters that a “temporary assistant” had used ChatGPT was correct. “In doing so, the intern acted without authorization, without disclosure, and contrary to not only chambers policy but also the relevant law school policy.” Neals said he prohibits generative AI use in legal research and drafting of opinions and orders. While that policy was verbal in the past, he said it is now a “written unequivocal policy that applies to all law clerks and interns, pending definitive guidance from the AO through adoption of formal, universal policies and procedures for appropriate AI usage. Today we want to talk about the upcoming cases in this supreme court term, what we should be keeping an eye on, the potential impacts for our c3 partners, and what nonprofits can do during this term and future terms to advocate. Cases to watch out for this term Voting Rights and Money In Politics Louisiana v. Callais Issue: Whether a states efforts to comply with the VRA is, in itself, a form of racial discrimination (1) Rehearing from last term (2) The Court is playing politics (3) the VRA is on the chopping block Consequences: A final blow to the VRA, and increased difficulty for minority voters to participate in free and fair elections National Republican Senatorial Committee v. FEC Issue: Whether to maintain the federal limits on political party coordination w/ candidates in campaign advertising. (1) Could render campaign contribution limits meaningless, increasing the already outsized influence of money in politics (2) These cases on elections and voting rights can't be observed in a vacuum LGBTQ+ Chiles v. Salazar Issue: Whether Colorado's ban on “conversion therapy” for minors violates First Amendment protections of free speech and religious exercise (1) Religious litigants have been notoriously successful in this court (2) free speech and religious exercise have been used not to ensure equity or equality but to prop up Christian nationalist ideology. West Virginia v. B.P.J. Issue: Title IX and barring Trans athletes (1) This court continues to wade into culture wars (2) It's ruling in Skrmetti and Justice Barrett's assertion that Trans isn't a protected states (3) Embolden lawmakers to continue to write oppressive laws against trans individuals Executive Power & Civil Liberties Trump v. Slaughter Issue: whether statutory removal protections for members of the FTC – and agencies like it – “violate” the separation of powers. (1) The Court's emergency orders this summer (2) growing belief in the unitary executive theory (3) Likely to overrule Humphrey's executor Consequences: Collapse of independent agencies and with it, governing stability. What c3s can do: Supreme court advocacy is nonpartisan—you are free to stand for or against cases before any court or get involved in the cases. Litigation at the supreme court: c3s are often the best voice and represent groups who otherwise would not be heard or could not bring such large scale cases Amicus briefs Educating the public about cases and impacts of opinions As you know c3 public charities may engage in lobbying and there are ways through lobbying that can affect the courts at the federal or maybe the state level Nominee advocacy—Advocate for or against nominees to supreme court (lobbying) Remember the lower district courts and circuit courts as well Remember the lobbying rules if you are a c3: must track and report your lobbying the IRS and stay within your lobbying limits. The Environmental Protection Agency's pledge to “get out of the way” on chemical reviews to accelerate the buildout of artificial intelligence data centers doesn't mean those reviews would be any less “robust,” a top EPA nominee told lawmakers Wednesday. Appearing before the Senate Environment & Public Works Committee, Douglas Troutman — President Donald Trump's pick for assistant administrator for toxic substances — was pressed by Sen. Ed Markey, D-Mass., about comments made by EPA Administrator Lee Zeldin last month following a White House roundtable with AI and data center leaders. In a Sept. 18 press release, Zeldin announced that the EPA would begin prioritizing the review of new chemicals — under the Toxic Substances Control Act (TSCA) — that would be used in data center projects. Markey asked Troutman, a former chemical industry lobbyist, what provisions in federal toxic safety laws indicate the EPA can “get out of the way of reviewing chemicals for safety.” Troutman responded that “nothing will change with regard to the robust review based on the risk-based statute enacted under Section Five of TSCA.” Markey appeared unconvinced, telling Troutman that if he's confirmed, he will “be under orders from Administrator Zeldin to get out of the way.” The Massachusetts Democrat made the case that “big tech bosses” with ties to the administration could lean on the agency to bypass regular review protocols. Voting rights groups are asking a court to block an ongoing Trump administration effort to merge disparate federal and state voter data into a massive citizenship and voter fraud database. Last week, the League of Women Voters, the Electronic Privacy Information Center (EPIC) and five individuals sued the federal government in D.C. District Court, saying it was ignoring decades of federal privacy law to create enormous “national data banks” of personal information on Americans. On Tuesday, the coalition, represented by Democracy Forward Foundation, Citizens for Responsibility and Ethics in Washington (CREW), and Fair Elections Center, asked the court for an emergency injunction to halt the Trump administration's efforts to transform the Systematic Alien Verification for Entitlements into an immense technological tool to track potential noncitizens registered to vote. Until this year, SAVE was an incomplete and limited federal database meant to track immigrants seeking federal benefits. In an Oct. 7 court filing, the groups said an immediate injunction was needed to prevent permanent privacy harms due to the “illegal and secretive consolidation of millions of Americans' sensitive personal data across government agencies into centralized data systems” through SAVE. On Tuesday, the nomination of E.J. Antoni, the Chief Economist at The Heritage Foundation, to become the next Commissioner of the Bureau of Labor Statistics, was withdrawn.
