With the CAA and the possibility of enacting the National Register of Citizens (NRC), many claim that Muslim immigrants living in India will now be turned into refugees, with more barriers for reentry into the country. Protests have erupted in India after the Indian Government announced on Monday that the Citizenship Amendment Act, or CAA, which was passed in 2019 but not not enforced, will now be brought into effect. The CAA will come into force on the eve of elections, and is India's first religion-based citizenship test, discriminating against Muslims and other refugees. This act has brought about critique from many student groups throughout the country, as well as human rights groups and state government leaders. So, why is this act so controversial? According to Prime Minister Narendra Modi of the Bharatiya Janata party, the goal of the CAA is to help the persecuted. An article from the intercept states, “that he has framed the CAA as a noble effort to welcome Hindus who are oppressed in neighboring Muslim-majority countries.” However, the intricacies of the law make it clear that it will prevent many Muslim refugees from entering India. Before the law was passed, all foreign nationals must spend 11 years in India before gaining citizenship eligibility. Now, the CAA will expedite this process to only 5 years for certain groups fleeing persecution who arrived before December 31, 2014. These groups are Hindus, Buddhists, Jains, Christians, Parsis, and Sikhs seeking asylum from Afghanistan, Pakistan, and Bangladesh. According to Aljazeera, Muslim asylum seekers will still need to wait 11 years, and, unlike other religious groups, will be required to have valid documentation to justify their presence. This means that once they reapply for citizenship through the online portal provided by the government, they will become refugees, and in order to reenter, many will need the proper documentation, which is unlikely that they will have.  Additionally, the passage of the National Register of Citizens, which is designed to deport people without the proper papers, is leaving very few options for Muslim asylum seekers. Although the law is only in effect in the northeast state of Assam, many fear it will become a nationwide policy. With these two policies combined, the country would be able to deport all “illegal” immigrants, and only allow reentry to Hindus, Sikhs, Parsis, Buddhists, Jains, and Christians, according to Aljazeera.  Modi has denied any wrongdoing, but many critics have noted the previous anti-Muslim actions this year, such as the move to strip Kashmire of autonomy back in August of 2023, and a long history of violence and breaches of international law in the six detention centers located in Assam, where majority Muslim asylum seekers are being held, says the Intercept. The Hindu writes that West Bengal Chief Minister says the CAA would take away rights and lead people to detention camps, later stating, “Those who are being asked to apply, the moment they apply, from becoming citizens they will become illegal refugees. What will happen to your properties, your jobs and the studies of your children? Everything will be declared illegal.”  These actions have drawn criticism from all over the country, with hundreds of thousands of protestors, majority being students. However, the intercept noted that some students were protesting against the snti-Muslim policies, while other were protesting the expedited process for any group of immigrants. According to Aljazeer, Many are regarding the actions of the BJP as unconstitutional, citing article 14 of the constitution. The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.     Summary of Recent ICJ Rulings Against Israel | News

    Today, Shireen shares with us the recent court ruling from the case brought to the International Court of Justice by South Africa against Israel. Script: Hello everyone, and welcome back to another episode of Seeking Refuge News. I'm Shireen Kaur, and today we will be discussing the recent court ruling from the International Court of Justice, or the ICJ, regarding the genocidal actions committed by Israel in Palestine. For context, South Africa brought Israel to the ICJ on December 29th, 2023, accusing Israel of intending to commit a genocide against the people of Palestine. In this 84 page document, it was argued that Israel's action in Gaza intended to destroy “a substantial part of the Palestinian national, racial, and ethnic group.” This is a direct violation of the 1948 Genocide Convention, says foreignpolicy.com. One of South Africa's lawyers, Tembeka Ngcukaitobi, stated, “The intent to destroy Gaza has been nurtured at the highest level of state.” Within this filing, South Africa lists eight actions against Palestinians in Gaza that are genocidal in nature. (Foreignpolicy.com) (1) Killing Palestinians, including children, in large numbers, (2) Causing serious bodily and mental harm to Palestinians, including children, and inflicting on them conditions of life intended to bring about their destruction as a group, (3) Causing mass displacement and expulsion of Palestinians from their homes, alongside the large-scale destruction of homes and residential areas, (4) Depriving Palestinians of access to adequate food and water, (5) Depriving Palestinians of access to adequate medical care, (6) Depriving Palestinians of access to adequate shelter, clothes, hygiene, and sanitation, (7) Causing destruction of life for the Palestinian people, (8) Imposing measures intended to prevent Palestinian births.    Israeli President Isaac Herzog condemned South Africa's allegations on Tuesday, calling them “atrocious and preposterous. Israel is expected to argue this on Friday. The Israeli Foreign Ministry has already written, “Israel is at war with Hamas, not with the people of Gaza…it is committed to conducting its operations in accordance with international law … and wishes no harm to Palestinian civilians anywhere.”  On January 26th, however, the ICJ has found it is "plausible" that Israel has committed acts that violate the Genocide Convention and that they must ensure “with immediate effect” that Israeli forces do not commit any of these acts, according to NPR. Additionally, the court voted 15-2 that Israel must take all measures to stop anything in relation to genocide in Gaza, and voted 16-1 that Israel must prevent and punish those involved with inciting genocide against Palestinians in the Gaza strip. (NPR) Another 16-1 vote ensured the provision of “urgently needed humanitarian aid and basic services.” Israel has now received 30 days to report back on the measures that they have been told to move forward taking. Benjamin Netanyahu does not find this ruling appealing, saying, “LIke every country, Israel has an inherent right to defend itself.” He goes on to reject the ruling, “The vile attempt to deny Israel this fundamental right is blatant discrimination against the Jewish state, and it was justly rejected... We will continue to do what is necessary to defend our country and defend our people." Considering this is the second time a state has ever tried to litigate the charge of genocide to another state (the first time against, Myanmar, who promptly ignored the ruling), there are many uncertainties to how this ruling will be enforced, or if it will be at all.  Considering that the United States is Israel's closest ally, they would likely veto any attempt to impose sanctions at the U.N. Security Council. This, however, could come at the cost of international goodwill and possibly economic sanctions from individual states, according to NBC news. The United States has repeatedly reiterated its stance that the accusations against Israel are unfounded. Washington's own calls for the minimization of civilian harm and increasing humanitarian assistance are consistent with Friday's ruling. NBC further states, “The U.S. recognizes that the court plays a vital role in the peaceful settlement of disputes,” and a State Department spokesperson said, “we will continue to monitor this proceeding as it moves forward.” Of course, the U.S. government's history of support for Israel makes any intervention or “peaceful settlements” unlikely.  Here in the U.S., there are groups combating the governments role in Israel genocide. TIME stated on January 25th that a federal court case has been filed against President Biden and two U.S. cabinet officials for “allegedly being complicit in Israel's genocide against Gazans.” This was filed by Palestinian human rights groups and the nonprofit Center for Constitutional Rights. TIME said, “Defense for Children International-Palestine v. Biden seeks to stop the U.S. from supporting Israel, which plaintiffs say has cost them the lives of family members, and will be heard in Oakland California.     Escalation of Humanitarian Crisis in Syria

    In today's episode, we discuss the rising humanitarian crisis in Syria. Hello everyone, my name is Anusha, and welcome back to Seeking Refuge News. Today, we will be talking about the rising humanitarian crisis in Syria. As international attention centers on the Israel-Gaza crisis, reports indicate an escalation in the bombardment of northwest Syria by Syrian government forces and their Russian allies. Al Jazeera notes on November 14, 2023 that the attacks in October which are concentrated on cities and villages in the countryside of Idlib and Aleppo, have resulted in the deaths of 66 civilians, including 23 children, and the injuries of 270, 79 of whom are children, as reported by a Syrian volunteer emergency rescue group. Opposition leaders and emergency volunteers point out that Russia and the Syrian regime are exploiting the world's distraction to intensify their campaign in northwest Syria. The motive is to exert pressure on Turkey and Syrian opposition factions, regarding issues such as the opening the international road between Syria and Turkey. AP News notes the Syrian government, backed by Russia, intensified its northwest campaign following a drone attack in the government-held Syrian town of Homs, one of Syria's deadliest attacks in years. David Carden, the U.N. deputy regional humanitarian coordinator for Syria says, “We're at the most significant escalation of hostilities since 2019. What Syrians want above all is to return home to their homes, but right now they do not feel safe to do so.” Humanitarian agencies and rights organizations have documented strikes hitting hospitals, schools, and other civilian infrastructure, further exacerbating the dire situation in Syria's 13-year conflict, which has so far claimed the lives of over half a million people. The increased violence in northwest Syria has led to a humanitarian crisis, with thousands of individuals being displaced. According to a report from the REACH initiative published on November 14, 2023, 84,093 individuals departed from 58 communities, with 71% returning to their communities during the assessed period of October 3 from October 17. Simultaneously, 55,157 individuals arrived in 135 communities, but only 11,981 returned to their previous communities. The situation has sparked the largest outburst of violence in the Greater Idleb region since 2019, with airstrikes and shelling causing massive numbers of civilian casualties and displacements. Furthermore, according to Al Jazeera on November 15, 2023, in a significant development, France has now issued arrest warrants for Syria's President Bashar al-Assad, his brother, and two other high-ranking officials, following a criminal investigation into the use of banned chemical weapons against civilians in Syria. The warrants are related to chemical attacks in the town of Douma and the district of Eastern Ghouta in August 2013, resulting in the deaths of over 1,000 people.     Israel's Bombing of Jabalia Refugee Camp

    Today, we are discussing the current conditions of Jabalia Refugee Camp and the situation in Gaza. Script: Hi everyone, I'm Anusha and you're listening to Seeking Refuge News, a podcast sharing the human stories of refugees. Today, we are here to update you on the conditions of Jabalia (ji-bah-li-ya) Refugee Camp, located on the north end of the Gaza Strip, which is where the Israeli Army has carried out one of the deadliest bombings yet. (Al Jazeera) On Tuesday, October 31st, Israeli forces began the bombing of Jabalia refugee camp, killing over 50 and injuring hundreds, and was followed by five more air raids that all hit residential areas of the camp. These actions sparked backlash from many Arab Nations, including Saudi Arabia, Qatar, Egypt, and the UAE. The air raid on Tuesday was followed by another bombing on Wednesday, the second blast destroying over 20 buildings, according to the Washington Post. These air raids came amid Israeli's bombing of the Gaza Strip, which has so far killed 10,022 people, including more than 4,104 children, since the fighting began on October 7th, according to Palestinian authorities. Over 70% of the deaths are reported to be women and children, says CNN. For context, Jabalia Refugee Camp is a densely populated area that was established after the Arab-Israeli War of 1948, when hundreds of thousands of Palestinians were expelled from their homes that became a part of the newly established State of Israel and were later denied return. Now, the area is composed of crowded shops, apartments, and houses packed so close together that the streets in between them are barely wide enough for a car to pass, according to CNN. People living in close quarters like this makes missiles even more detrimental to the camp. There is now a massive crater in the center of the camp, and the injured are looking for a safe place to go. According to a statement by the Israeli Defense Forces (IDF), the initial airstirke was “successful” in killing several members of Hamas, including Ibrahim Biari, whom Israel describes as one of the Hamas commanders responsible for the attacks on Israel on October 7th. Several sources report the Israeli military announcing that the attacks killed him, however, Hazzem Qassem, a spokesperson for Hamas, has denied the presence of any senior commander and deemed this claim “an Israeli excuse for killing civilians.” This back and forth has been very common in the weeks following the Israeli offensive in Gaza, with claims of Hamas commanders hiding in hospitals, ambulances, and residential areas, while Hamas claims this is not the case. It is becoming increasingly hard for the international community to discern what is the truth. However, one reaction from the international community is becoming more prevalent, and that is, even if there are senior Hamas commanders hiding among citizens, does that warrant airstrikes on the whole areas, killing and endangering more women and children? The answer would be no, according to international law. The United Nations Human Rights Office has weighed in, saying that these attacks on Jabalya, “could amount to war crimes” considering “the high number of civilian casualties and the scale of the destruction,” which was reported by CNN's social media. The Secretary General of the United Nations, Antonio Guterres (goo-tersh), said in a statement that he was, “deeply alarmed by the intensification of the conflict.” International humanitarian law, he said, “is not an a la carte menu and cannot be applied selectively.” (Washington Post). The news is developing rapidly in Gaza, therefore many of the numbers and figures we've used could already be outdated, so we encourage our listeners to do their research and stay up to date on the current events in the region.     Today, we are discussing the current situation in Gaza and related topics. Script: Hello everyone, I'm Claire Mattes, and you're listening to Seeking Refuge News, a podcast sharing stories of refugees and the world events that affect them. Today, we are going to give an update on the situation between Gaza and Israel. According to the Gaza Health Ministry - since the attack on Israel by Hamas, an Islamic Jihad group originating out of Palestine, on October 7th - 5,791 Palestinians in Gaza have been killed. Gaza is an area where almost half of the population are children. Thus, as a result of the deadly airstrikes, the Israeli government has murdered 2,360 children so far. As reported by Reuters, in one day, on October 23rd, Israel launched over 400 airstrikes, killing more than 700 Palestinians, the highest death toll in a day so far. Israel says that this airstrike killed Hamas commanders, hitting militants as they were preparing to launch rockets toward Israel and striking command centers and a Hamas tunnel shaft. Ammar al-Butta, a survivor of an airstrike, says that there were about 100 people in his area, including many who had come from Gaza City, which Israel has ordered civilians to evacuate. Ammar further notes, “They were sheltering at our home because we thought that our area would be safe. But apparently, there is no safe place in Gaza.” 13 people from his family have died due to the aforementioned airstrike. On October 18th, there was a deadly airstrike on the al-Ahli hospital that killed nearly 500 people, as noted by Aljazeera. The Health Ministry in Gaza says it was Israel, and Israel says it was by the Palestinian Islamic Jihad who misfired a rocket. There have been multiple conflicting reports on who is to blame. The United Nations is now urging Israel to allow more aid to reach Gaza. Currently, the Israel blockade of food, travel route, supplies, etc. is worsening the already critical condition of the area. Dr. Rick Brennan, WHO Regional Emergencies Director, stated, “We are on our knees asking for that sustained, scaled up, protected humanitarian operation.” A Gaza Health Ministry spokesperson has said that all hospitals in Gaza are now running out of fuel to power their electricity generators, leaving them unable to treat severely injured patients. More than 40 medical centers in the area have ceased operations. Without an end to the deadly blockade, thousands more Gaza residents will die as a result of the continued airstrikes. On October 23rd, two Israelis kidnapped by Hamas were freed. According to AP News, one of the captives noted that on the way to her prison, she was beaten with sticks, bruising her ribs and making it difficult for her to breathe. In the prison, she notes that her treatment and conditions were clean and she had access to medical care and food. Currently, the US, Canada, France, Germany, Italy, and the UK support Israel and its right to defend itself. During the Cairo Peace Summit, many Arab countries expressed anger toward Israel, including countries who were once close allies to Israel such as Egypt. Many Arab countries demonstrate hesitancy to accept Palestinian refugees. They fear that if Palestinians leave, they will never be allowed to return - an event that occurred in the 1948 war when Palestinians fled as Israel colonized the area. Protests have erupted in all corners of the world in support of Palestine alongside protests in support of the Israeli state. Such protests have resulted in violence across oceans. On October 16th, 2023, PBS reports on the story of a six-year-old boy, Wadea Al-Fayoume, a Palestinian American 6-year-old boy in Illinois, was stabbed 26 times by his family's landlord in a hate crime relating to the current Israel-Palestine development. Samantha Woll, a Jewish leader dedicated to building ties between young Muslims and Jews, was murdered outside of her home in Detroit on October 21st, according to NDTV.     Today, we are discussing the recent events in the Middle East between Israel and Palestine. Script: Hello everyone, and welcome back to Seeking Refuge News, a podcast sharing the human stories of refugees, and world events that affect them. Today, we will be discussing the most recent developments in the war between Israel and Hamas, an Islamic Jihad group originating out of Palestine, and escalating with a surprise attack by Hamas launched out of Gaza, a Palestinian exclave, early last week. Israeli military forces are still battling members of Hamas that are holed up in several locations. These events are not random; they stem from a much larger conflict and are part of an ongoing war in the region that has gone on for decades. This conflict can be traced back to the Balfour Declaration, established in 1917, committing the British government to create an “establishment in Palestine of a national home for the Jewish people.” This led to a mass Jewish migration to the area for the next 20 years, many of whom were escaping Nazism in Europe, and resulted in the displacement of many Palestinians. These conflicts continued to emerge in 1948, 1967, 1989, and 1993. Over 1000 Hamas militants opened fire on citizens and soldiers, taking over 130 men, women, and children hostage and asking in return for their release the thousands of Palestinians imprisoned by Israel. Nearly 700 people have been killed in Israel, gunned down in towns, along highways, and hundreds were shot at a music festival in the desert. AP News states that “The Islamic Jihad group has said it launched the attack in response to mounting Palestinian suffering under Israel's occupation and blockade of Gaza.” Citizens from several different countries are still unaccounted for or have been reported dead since the attack, including Canada, the Philippines, Italy, the UK and the US. These recent events are causing mass displacement in the region, and creating more danger for the refugees already displaced here. After a series of retaliatory Israeli airstrikes in Gaza, there have now been more than 900 reported dead in Gaza, including 260 children, with many Palestinians now fleeing to U.N. shelters in numbers between 140,000-200,000. Airstrikes also targeted the Al-Shati and Jabalia refugee camps on Monday, according to CNN, and killed a large number of people according to the Palestinian Ministry of Health. As the conflict worsens and the death toll rises, people with a current refugee status in the region are in extreme danger, and many citizens that are now displaced will enter refugee camps in the region.     Today, we are discussing the recent events in Tel Aviv, where protests erupted between Eritreans that left dozens of people injured. Just a day after the protests, Prime Minister Benjamin Netanyahu made remarks to the public stating a plan to remove Eritreans living in Israel, as well as migrants from other parts of Africa, such as Sudan. Many claim that they cannot return to their home country due to conflict or repression, while the Israeli government recognizes them as economic migrants. This plan could include nearly 25,000 African migrants, and has raised questions about international law and their right to seek asylum.
