From April 11, 2022: The period after Watergate and President Nixon's resignation saw an unprecedented barrage of congressional efforts at reforming the executive branch. The period after Donald Trump's departure from office has seen no comparable spree of legislative action—at least not yet. In a recent Lawfare article, Quinta Jurecic and Andrew Kent explored the disparity and the reasons for it, and they analyzed whether any of the legislative reforms that have been so far proposed have any prospect of passage. They joined Benjamin Wittes to talk about why things are so different today than they were in the late 1970s, what happened in that period and whether Congress will actually be able to do anything now.To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare. A Vancouver, Washington man accidentally dropped his wedding ring into Lake Tahoe during his wedding ceremony. It slipped right out of his hands, through the cracks of the dock and into the water. The couple could see the ring sitting on a rock about 15 feet deep and 40 feet off shore. Marlee, the soon-to-be wife told KTXL that instead of jumping into the water and finishing the ceremony, the couple turned to Facebook. Andrew Kent, the groom made a post on a “Tahoe Scuba Divers” page hoping a member wold make the trip to grab his ring. “Is there anyone in this group that would be willing to help us out?” Kent asked on March 12. “Or if anyone knows anybody that could lend a hand? Any help is appreciated!” The responses were positively overwhelming with many divers wanting to help. As soon as the administrator for the Facebook group Phil Abernathy read the post, he knew he wanted to help. “I knew that I would have some free time the following morning, and I genuinely love to dive,” Abernathy told McClatchy News. “I have done many different training courses. So It’s nice to be able to use the skills that I have trained.” Abernathy dove into the water and returned the ring safely back to the ecstatic couple. “At that moment the feeling of joy was one that no words can describe,” said Abernathy happily. With Joe Biden’s popularity rising in battleground states (according to several recent polls), Democratic lobbyists and party officials are urging the presidential candidate to try and win over purple and even conservative-leaning states like Georgia and Texas. But most of his advisors are urging a more conservative path, encouraging him to focus on states he knows he can win. David and Sarah discuss these opposing strategies and offer their insights on what a winning 2020 presidential campaign should keep in mind. In today’s episode, they also discuss the president’s pardoning power, theological and constitutional arguments related to the death penalty, and Trump’s tweet about re-examining the tax-exempt status of academic institutions that “are about Radical Left Indoctrination, not Education.” They wrap the podcast by responding to a listener’s question about what to include in an intro philosophy course. Show Notes: -New York Times piece on warring factions within Biden’s campaign, Fox News poll, University of Texas poll, Dallas Morning News poll, CBS/YouGov poll. -Death penalty opinion. -Andrew Kent’s congressional testimony. -Ex Parte Garland case from 1866. -Notes on Virginia ratifying convention from Brookings Institution. -“The Traditional Interpretation of the Pardon Power Is Wrong” Atlantic article by Corey Brettschneider and Jeffrey K. Tulis. -John Rawls’ A Theory of Justice.

. . On February 21, the Supreme Court will hear argument in Hernandez v. Mesa. In July of 2010, a 15-year-old adolescent named Sergio Adrian Hernandez Guereca and his friends were playing along a concrete structure on the border of the U.S. and Mexico. When Jesus Mesa, Jr., a U.S. Border Patrol Agent arrived, he detained one of the youths on the border, and shot and killed Hernandez, who was hiding behind a pillar of the Paso Del Norte Bridge on the Mexican side of the border. Hernandez’s parents sued Agent Mesa under the Fourth and Fifth Amendment for the use of unlawful and disproportionate force. Agent Mesa argued that the Fourth and Fifth Amendments did not apply because Hernandez was not a U.S. citizen. The District Court found for Agent Mesa, while the U.S. Court of Appeals for the Fifth Circuit held that the Fifth Amendment Protections against deadly force applied but the Fourth Amendment did not, and that Agent Mesa should not receive qualified immunity. -- Professor Andrew Kent of Fordham University School of Law and Professor Stephen I. Vladeck of UT Austin Law School joined us to examine the case and its implications for extraterritorial application of the Bill of Rights and for qualified immunity. -- Featuring: Prof. Andrew Kent, Professor of Law, Fordham University School of Law and Prof. Stephen I. Vladeck, Professor of Law, The University of Texas at Austin School of Law.
