Episode 69: Inside The FAA's Remote ID Ruling - Commercial Drone Rules And Regulations

Four days before the new year, after 53,000 public comments on the draft rule, and almost one year after the Notice of Proposed Rulemaking (NPRM) launch, the waiting is over. The Federal Aviation Administration has released its final Remote Identification (RID) Rule. What is Remote ID: The rule creates a new Part 89 in Title 14 of the Code of Federal Regulations, Remote Identification of Unmanned Aircraft. It essentially requires a “digital license plate” for unmanned aircraft (UA) to be operated in the U.S., one that both people on the ground and other airspace users can receive This rule is specifically for UA (the unmanned air vehicle itself) and not unmanned aircraft systems (UAS – which includes the control station and data link). This recognizes that manufacturers might make UA’s that are controlled by another manufacturer’s control stations. More importantly, it ensures that the UA will be broadcasting RID and not the control station. Very important if the UA goes lost link. Timelines: The Rule is effective 60 days from the expected publication date in the Federal Register in January 2021. Operators have thirty months and manufacturers have 18 months after this date to comply (i.e., 60 days plus 30 months). RID Is Needed For: UAs weighing 55 pounds or less that must be registered under part 47 or part 48 RID Is Not Needed For: • Homebuilt unmanned aircraft: defined as a UA that an individual built solely for education or recreation. Homebuilt UA can only fly in an FAA-recognized identification area (FRIA). • UA of the United States government armed forces. • UA that weigh 0.55 pounds or less on takeoff • Research UA: UA designed for the purpose of aeronautical research or test UA designed to show compliance with regulations. • Indoor UA Operations. The RID requirements only apply when the UA exits the interior of a building or structure and is operated outside, so indoor ops are not subject to RID. Types of RID The big news is this rule contains broadcast-only requirements. Network-based/internet transmission requirements and the use of third-party UAS Service Suppliers (USS) were eliminated “at this time.” UAs will broadcast the RID message elements listed below directly from the UA via radio frequency broadcast. The public can use personal wireless devices within range to receive RID. Correlating the serial number or session IDs with the registration database is limited to the FAA only, but can be made available to authorized law enforcement and national security personnel upon request. Compliance The Rule impacts not just operators, but also designers and manufacturers. It contains both design and production requirements. The FAA is using performance-based requirements. Manufacturers must show that their standard RID UA or broadcast module meets the performance requirements of an FAA-accepted means of compliance. Industry consensus standards will be one means, but they have not been accepted by the FAA yet.

Drone carries human kidney over Las Vegas desert in what could be the future of organ transportation Researchers at MissionGO and the Nevada Donor Network, an organ procurement organization, announced last week two successful test flights carrying a human organ and tissue via drones in Las Vegas. The first flight on Sept. 17 transported research corneas from one hospital to another about 2½ miles away. The second flight delivered research kidneys 10 miles, from an airport to a location outside a small town in the Las Vegas desert. It marked the longest organ delivery flight in drone history, surpassing the distance of a historic April 2019 flight, when staff now with the MissionGO team transported a kidney from the Living Legacy Foundation in west Baltimore to the University of Maryland Medical Center downtown. Organs are usually transported via commercial aircraft, but the coronavirus pandemic has drastically reduced the number of flights available. A kidney can survive outside the body for 36 to 48 hours after it has been recovered, according to the federal Health Resources and Services Administration. A study published in August 2019 in the journal JAMA Internal Medicine found the United States discards about 3,500 kidneys a year. Meanwhile, nearly 100,000 Americans are on the waiting list for a kidney transplant, and about 12 people die each day, according to the National Kidney Foundation. Although the Las Vegas kidney was for research purposes only, scientists who took biopsies before and after the flight concluded there were no changes to the tissue architecture and cell viability. 2. Walmart is using drones to deliver Covid-19 tests Walmart launched a pilot drone delivery program Tuesday that will drop off Covid-19 tests to homes within a one-mile radius of the North Las Vegas store. Customers will receive a text from DroneUp when the Quest Diagnostics (DGX) test is on its way. And depending on where there are cars and trees, the kits will land on people's driveways, front sidewalks or backyard. Delivery, which can take as little as five minutes, will be free. The samples can then be sent via FedEx to a Quest lab, which will send out results digitally. Test results typically arrive in two days. 3. What is DJI Local Data Mode? Here’s how it keeps drone flights secure Local Data Mode essentially works as a kill switch, blocking the app in use from sending data back and forth over the internet. This includes data being sent to DJI or third-party servers. The rest of the device and apps still remain connected to the internet. When using DJI’s drone apps, data is often sent between the app and DJI or third-party service providers’ servers. This allows the app to check for software updates, firmware updates, and collect relevant location data, such as maps and geofencing restrictions. By turning Local Data Mode on you would lose all of the above functions but gain more control over your privacy. To prove to the world that Local Data Mode does exactly what it says, DJI got an independent auditor to come in and tear it down. FTI Consulting, the company behind the audit found that DJI isn’t doing anything dodgy behind the scenes.

The First PX4 Developer Summit in Zurich marked an inflection point for the developer community and the industry as a whole. More than 200 developers from 20 countries filled the halls of ETH Zurich, the birthplace of PX4, to learn how they could contribute to the fastest growing open source code base for UAVs. Richard Lopez is the National UAS Operation Executive with Hensel Phelps Construction Co., an employee-owned company founded in 1937 that over the last 80 years has grown to be one of the nation’s most recognized general contractors, serving both public and private clients. Richard leads the implementation of new sUAS technology, software, and advancements at Hensel Phelps to increase efficiency and safety on the jobsite while providing valuable information for forecasting, recordkeeping, and as part of the procurement effort. In this episode we go through all the steps it took to launch a drone program in both the risk averse construction industry and the strict regulatory environment of the 333 exemption era. Since then, Hensel Phelps has evolved its drone program into an example for the entire construction industry to follow. Just recently it received the first-ever waiver to fly over people with the aid of a parachute from the FAA. After hearing Richard talk about what he and his team have done with drones over the last few years, we think you’ll understand why they were the first.

If you're trying to obtain a waiver from the FAA you should be looking into SORA. The Specific Operations Risk Assessment (SORA)guidance represents the consensus of various national aviation authorities on a common process to identify, qualitatively assess, and manage the safety risk posed by unmanned aircraft systems(UAS), when preparing the safety case required for regulatory approval to conduct certain types of operations. It is the de facto standard for assessing the risks of a UAS operation. To talk about SORA we invited Andy Thurling, Chief Technology Officer at NUAIR, which is the organization that manages the NY UAS Test Site at Griffiss International Airport. At NUAIR he leads technical research on current and future UAS technologies, evaluates potential paths to implementation and industry standards for approval by regulators, and also test techniques to verify compliance. Andy was Director of Product Safety and Mission Assurance at AeroVironment in Simi Valley, California.He is active in standards bodies such as ASTM and RTCA and internationally as a subject matter expert to the JARUS working group developing SORA. Judith Sherman is currently the Chief of HIV and AIDS at UNICEF Malawi. Her career in international public health began in 1988. She has been living in Africa since 1992, including Guinea, Morocco, Zimbabwe and Malawi. Her interest in using drones to advance health outcomes began in 2014 with an in-flight magazine and a casual conversation with a drone enthusiast colleague. In 2016, Judith launched UNICEF’s first drone initiative – a feasibility study on using drones to transport laboratory samples for early infant diagnosis of HIV. Since then, she has led efforts to establish Malawi’s drone regulations, develop Africa’s first humanitarian drone air corridor, use drones for emergency preparedness and response, and build local capacity to integrate drone operations and drone-acquired data into development.
