Florida State was offered a do-over in their lawsuit against the ACC in Florida. Judge Cooper ordered FSU to amend their complaint, giving them a major opportunity to revise or even expand their arguments in their quest to break away from the ACC's Grant of Rights. Ashley Moody, the Attorney General in Florida, is considering backing up Florida State University in their fight with the ACC over the Grant of Rights. The specific issue that has caused Moody to act is “sovereign immunity” and whether FSU, as a state institution, can be sued. Judge Cooper in Leon County, Florida was not satisfied by the language of Florida State's complaint against the ACC. He ruled “dismissal with leave to amend” and will give FSU seven days to amend their argument after personal jurisdiction. It's a small victory for the ACC but the judge noted that he has not ruled against Florida State. They will have seven days to amend their complaint and then the ACC will have twenty days to respond. NIL has now gotten another step closer to becoming “pay for play” and student athletes becoming university employees. The Commonwealth of Virginia passed a new State law on Thursday morning that allows universities within VA to directly pay players through NIL. This takes third parties out of the equation and allows their universities to directly cut checks to their student athletes in exchange for marketing campaigns. While the law explicitly states that athletes are not to be considered university employees, we have certainly taken a big step closer to that eventuality. NCAA rules do not allow players to be paid directly by schools, but they likely can not beat Virginia in court over this matter. A Leon County, Florida judge has denied the ACC's motion to stay, giving Florida State a court victory in their home state. FSU's quest to try and break the ACC's Grant of Rights will continue. A new proposal for a college football “super league” has been reported by Andrew Marchand and Stewart Mandel of The Athletic. The proposal would essentially take the NCAA out of major college football and create eight divisions of ten teams, with one of those divisions composed of rotating members who are promoted and relegated. Where the proposal makes the most sense is that it would create one entity for negotiations with a prospective union that would represent the players on NIL, transfers and salary structure.
