Video Blog 24: Why Were the Chicago Cubs Sued for Copyright Infringement? And what does it mean for the small business going into court? Recently, the Chicago Cubs were sued for copyright infringement. I kind of find it weird that I'm going to be suing a baseball team for copyright infringement. But it happened. Why? Because the Cubs retweeted a tweet that was already the subject of a copyright infringement lawsuit. So, the author and plaintiff of the original copyright lawsuit decided to file against the Cubs for the retweet. I think it's ridiculous as well, but it survived a motion to dismiss. Why? The judge in the case said . . .I personally don't know if the retweet creates another copy and if it creates another copy, then there is contributory infringement on the copyright. For those of us who have bachelor's in computer science, we already know that that retweet doesn't create another copy. It points to it. But I think this is the ultimate thought on intellectual property in the court system. Judges aren't gods, they're people. If a judge isn't going to understand the situation, then you as a lawyer have to make the judge understand the situation. And in this particular case, it's just a pointer to something that's already infringed. And even that's a question as well, if a tweet itself is enough to infringe a copyright. There are multiple levels here where I think copyright infringement should fail, but the judge is keeping the case around because the judge doesn't understand them. That's really, I think, our biggest frustration as IP practitioners when we're in court, judges are coming from all sorts of different backgrounds. A lot of them especially if they're, criminal defense lawyers or if they're prosecutors, really don't understand intellectual property. It's our job to make them understand that. So that's what we're really looking to do when we're in court is start at the very beginning and make sure that the judge understands what the situation is. I'm Anthony Verna, managing partner of Verna Law. We focus on IP and advertising law and hopefully we can help you through situations such as this to make sure that the judges understand why you are in court, either to prosecute intellectual property infringement or to defend yourself from complex intellectual property infringement claims.

Dr. Schoch’s latest research put forth in his book Forgotten Civilization: The Role of Solar Outbursts in Our Past and Future points to the astronomical cause of the demise of antediluvian civilizations, as well as the scientific and archaeological evidence that supports his conclusions.

Scripture speaks of four categories of people when it comes to wealth: 1) the unrighteous rich; 2) the righteous rich; 3) the unrighteous poor; and 4) the righteous poor. However, the Bible has more warnings for the unrighteous rich than any of the other groups. Why? Our service will feel and function quite differently from a “typical” week at Revolution, and it will include elements that might be uncomfortable, including extended periods of silence and prayer, readings which give voice to frustration, doubt, and hurt, and stories about personal suffering that might be difficult to hear. But we want to invite you to listen and participate with us in this service, even if doing so is hard. Our hope is that this service will help all of us to better understand the value of this ancient Biblical practice and serve as a first step towards equipping us to put it to use in our own lives. But yes, today's episode is all about the up-and-coming Shonen Jump hit, Black Clover, to celebrate it passing 100 chapters, two years of serialization, and an upcoming anime. Colton never continued with Black Clover past the first chapter, but since the start of the year, he's been working his way through the series in preparation of doing this very podcast. It was a tumultuous journey, full of ups and downs as Colton struggled to decide whether he enjoys or hates the series. And now, three months later, he finally has his answer. I won't spoil his position, but to quote a certain letterer, "Hooray for stockholm syndrome!" Who is this "certain letterer" I'm referring to, you ask? Why, she's only our special guest for this episode, the one and only Annaliese Christman, the official english letter for Black Clover and World Trigger in Viz's Weekly Shonen Jump, not to mention a ton of other Viz titles including Terraformars and Goodnight Punpun. In the face of Annaliese's excited cries of "BLACK CLOVER!" even the cynical, cold-hearted Colton couldn't help but warm up to the series. But just in case, we had another backup prepared in the form of good friend and frequent guest Maxy Barnard of Friendship! Effort! Victory!, whose favorite currently-running Shonen Jump manga happens to be, you guessed it, Black Clover. Poor Colton. He never stood a chance... In this conversation mental strength expert, author and founder of Warrior Mind Coach, Gregg Swanson talks about the goals and how to develop a goal achieveing mindset.. The key to reaching goals is to develop a goal achieving mindset. We’ve all done this: You set a goal with the best intention to reach it and about four-to six-weeks into your quest, you start to falter, lose momentum and eventually fall off the path completely. Why? Were you lying to yourself about your commitment to reach your goal? Well, in a way you were, though not intentionally. While your conscious mind was making the commitment, your unconscious mind had its fingers crossed – so to speak. You see, reaching a goal such as getting in shape or getting out of debt requires you to alter what you normally do; to change your behavior. The challenge is your unconscious mind, whose job it is to automate behaviors to ensure that you not only physically survive but emotionally thrive, does not like change. A goal achieving mindset can only be developed by altering the thoughts and beliefs that make up the unconscious mind. Your unconscious mind drives your behavior. So, as Gregg point out in our conversation, while goals are set by the conscious mind, they are achieved by the unconscious mind. No matter what the conscious mind sets out to do, if the thoughts, beliefs, and learned programming of the unconscious mind are not altered you will snap back to old behavior patterns and fall short of your goal. So, making the changes in behavior that are necessary to achieve your goal, requires the cooperation of the unconscious mind. How do you gain the cooperation of your unconscious mind to get into a goal achieving mindset? You need to consciously choose a realistic goal and set an action plan to achieve it. As you work your plan, stay mindful and present to the thoughts and excuses that arises and the emotions and behaviors that result from them. Be diligent and document this resistance and explore the thoughts, beliefs, past experiences, and societal norms that support it. For example, you have set a goal to get out of debt and created an action plan. As you follow your plan, you should pay attention to thoughts like: “Ugg, I’ve been working so hard I deserve a new pair of shoes” or “I’ve been so stressed out I need to take a cruise and get away”. These thoughts bubble up from your unconscious mind, which in this case is ensuring that you emotionally thrive, and cause you to act in a way that is counter to your goal. In order to reach your goal, you need convince your unconscious mind that the new behaviors required to achieve your goal are beneficial to your physical and emotional survival. Paying attention to and altering thoughts is essential to developing a goal achieving mindset. In our chat, Gregg outlines several ways to do this including mental rehearsal and associating a value to the goal.
