Environmental law in the United States can be a double-edged sword. "I think that when people think about environmental law, very frequently what they mean is environmental protection, and what that misses is the other side of the coin, that there is a whole lot of law that is meant to exploit the environment," says law professor Brig Daniels. When Daniels and his writing partner Alejandro Camacho looked at the literature available on the development of environmental law in the United States, they found it lacking. "Most sort of focus only on environmental protection laws emerging from the 1970s or possibly the progressive era, missing frankly centuries of legal history that drove exploitation," says Camacho. They hope to remedy this with their new book, Lessons for a Warming Planet: A Vital History of US Environmental Law. From colonial expansion that deprived Native Americans of their ancestral lands to modern day battles over the Clean Air Act, Lessons for a Warming Planet offers a broad history of how environmental law has been developed. Change can happen gradually, or all at once. Camacho and Daniels have identified five different eras with dominant ideologies, some pushing towards protection and others towards exploitation. But in all eras, there were elements of both, the authors say. "It isn't just a black and white sort of binary of any of these eras," Camacho tells host Lee Rawles in this episode of the Modern Law Library. "And of course, what often happened is that an undercurrent in any given era becomes the dominant era in a subsequent era." The latest era of environmental law is one of contention, without a dominant force yet emerging. Lessons for a Warming Planet warns that either exploitation or protection could hold sway in the next era. "The thing that I hope that people understand is that looking back, one of the things that is so prevalent is that we didn't get the history that we had due to luck," says Daniels. "A big chunk of way we got our history was due to effort." Which of these three do you most relate to right now? Why do you think that is?What would it look like in your daily life to take one small step toward getting 'unstuck' from whichever of these three places you identified with?In Exodus 14:13-14, Moses confidently tells the Israelites, 'Do not be afraid! Stand firm and you will see the deliverance the Lord will bring you today. The Lord will fight for you; you need only to be still.' But then God immediately tells Moses to stop crying out and to move forward instead. Can you think of a time when you felt confident you knew what God wanted, but things unfolded differently than you expected? El redescubrimiento de las Canarias por parte de los europeos se produjo durante el siglo XIV. Una serie de expediciones mallorquinas, portuguesas, italianas y castellanas tocaron las costas insulares con diversos propósitos, desde la captura de esclavos hasta la evangelización. La presencia castellana se afianzó con la expedición de Jean de Béthencourt y Gadifer de la Salle entre 1402 y 1405, que ocuparon las islas de Lanzarote, Fuerteventura y El Hierro para convertirlas en señoríos castellanos. A mediados del siglo XV, La Palma, Tenerife y Gran Canaria seguían siendo independientes. Gran Canaria, la tercera isla más extensa del archipiélago, estaba dividida en dos guanartematos, el de Telde y el de Gáldar. Aquellos canarios tenían una sociedad relativamente compleja que vivía de la agricultura y la ganadería caprina. Era además una isla fácil de defender por su gran tamaño y su abrupto relieve. Pero los castellanos estaban determinados a conquistar la isla porque era de gran valor estratégico para controlar las rutas marítimas hacia el África occidental. Tenía además un potencial azucarero similar al de Madeira, una isla más al norte que los portugueses habían convertido en un próspero ingenio. El tratado de Alcazobas, firmado en 1479 tras la guerra de sucesión castellana, permitió a los Reyes Católicos concentrarse en las Canarias a cambio de reconocer la primacía portuguesa en Madeira, las Azores, Cabo Verde y el golfo de Guinea. La Corona decidió entonces asumir directamente la conquista de Gran Canaria como una empresa propia. La primera fase comenzó en junio de 1478 con el desembarco de Juan Rejón en La Isleta, donde fundó el Real de Las Palmas. La batalla del Guiniguada enfrentó a las tropas castellanas con los canarios mandados por el guanarteme de Gáldar y por el caudillo Doramas. Pese a la bravura indígena, la superioridad técnica castellana se impuso. Las disputas internas culminaron con la ejecución del alcaide Pedro de Algaba por orden de Rejón, que sería asesinado posteriormente en La Gomera por agentes de Hernán Peraza. En 1480 la reina Isabel intervino nombrando a Pedro de Vera, un jerezano curtido en la frontera granadina, que abandonó la idea de batirse con los canarios en campo abierto. En su lugar se decantó por avanzar hacia el interior de la isla fortificándose por el camino. Junto a eso de Vera explotó en su beneficio las rivalidades internas, se atrajo aliados indígenas y contó con la labor evangelizadora de fray Juan de Frías, lo que anticiparía los métodos que aplicarían décadas después Hernán Cortés y Francisco Pizarro en las Indias. La conquista concluyó entre 1482 y 1483. La captura del caudillo Tenesor Semidán, al que bautizaron en Castilla como don Fernando Guanarteme, resultó de una importancia capital. Guanarteme se encargó de ir convenciendo a los isleños para que no resistiesen a la conquista. Pero no lo consiguió con todos. Los irreductibles, capitaneados por Bentejuí y el faycán de Telde, se atrincheraron en Ansite. Rodeados por las tropas castellanas el 29 de abril de 1483 se arrojaron al vacío antes de rendirse. La Corona procedió entonces al repartimiento de tierras, introdujo la caña de azúcar y se formó una sociedad mestiza con colonos peninsulares y de otras partes de Europa. De aquel crisol humano y cultural surgiría la Gran Canaria moderna. In February, the Trump administration repealed it. That move puts the future of federal climate policy in question. Professor Alejandro Camacho explains what the endangerment finding did and why it mattered for policies ranging from vehicle emissions to power plant rules.
