For the past 20 years, it seems as if wherever there's been a sports law story involving athlete rights, Michael McCann has been near the epicenter of it. Whether it was as a member of former Ohio State player Maurice Clarett's legal team in the groundbreaking Clarett v NFL, case; co-authoring a book with Ed O'Bannon, the former UCLA men's basketball player who found his likeness had been sold off by the NCAA to EA Sports for a college basketball video game, or writing for Sports Illustrated or Sportico, Michael McCann has been both in the trenches and writing about them. Michael McCann is a Visiting Professor of Law at Harvard Law School and Founding Director of the Sports and Entertainment Law Institute at the University of New Hampshire Franklin Pierce School of Law, where he is also Professor of Law. Our conversation centers around recent key developments in Johnson v NCAA, including the decision by the judge to certify class action status for all Power 5 athletes with regards to BNIL; the new ability for the NLRB to certify joint employer status in cases beginning later this year; Dartmouth's MBB unionization appeal as we begin the basketball season, and his stark predictions for the future of college sports.

The 2002 BCS National Championship Game featured two undefeated teams, more than 50 future NFL players, and a pass interference call that is still talked about today. In this episode, we'll go back to that night at the Fiesta Bowl where the top-ranked Miami Hurricanes came into the game riding a 24-game winning streak and looking for its second-straight national title. On the other side, Jim Tressel's Ohio State Buckeyes represented the Big Ten for the first time ever in the BCS title game with a stout defense and conservative offense. The Buckeyes took advantage of five Miami turnovers to take the lead early but the Ken Dorsey led the Hurricanes to a game-tying field goal as time expired. In the first overtime, Ohio State had to score a touchdown and a 4th and 3 incompletion in the endzone appeared to end the game, but a late flag came in. The pass interference call gave the Buckeyes the ball on the one-yard-line and they'd punch it in. The Buckeyes would keep the Hurricanes off the scoreboard in the second overtime to complete the 14-0 season and claim the 2002 national championship. We went back to watch this game, look at the circumstances leading up to this showdown, and then discuss everything we noticed before, during, and after this game.

For over half of the 20th century Youngstown, Ohio was the place to be. The "Steel Valley" was one of the strongest cities in the "Industrial Heartland of North America". The removal of the steel industry in the 1960's and 1970's brought this city to its knees and its hasn't been able to stand up ever since. Since 1990 the city has lost nearly 30% of its population. Over the years it has been in the national news but not for the right reasons. At different points over the past few decades it has been know to have the highest murder rate per capita in the US was well as the highest arson rate per capita. It was one of the last mafia strongholds in the US. One of the most highly regarded college football players of our era was a Youngstown boy. Maurice Clarett set the freshman rushing record at Ohio State and was the key piece to Ohio State winning a national championship in 2002. Debacle after debacle led to a high speed police chase in 2006 which resulted in Clarett being maced because the taser couldn't penetrate his Kevlar body armor. Oh, and police found two samurai swords, an AK-47 and 2 handguns in his car. Ummmm, what the hell were you gonna do Maurice?!?! TWO samurai swords?!?! Kevlar?!?! AK-47?!?! And who can forget Kelly "The Ghost" Pavlick, the lanky but powerful middle weight content who KO'd the seemingly unbeatable Jermaine Taylor to gain the middle weight title in what was dubbed as the "Fight of the Year" in 2007. However, years of substance abuse and legal troubles caused this once prominent fighter to fall back into the shadow. Yep, Youngstown boy. As much struggle as Youngstown has had over the years I believe there is something that can help this city regain some of its prominence: craft beer. Craft beer distills down into 2 core elements: artistry and hard ass work. Youngstown Ohio has both. In the episode I sit down with my pal Brian Ford (my co-host in the now-defunct-but-hopefully-soon-reanimated Mixtape Podcast) to chat with Ira and Marcy Gerheart, founders of Noble Creature Cask House. Noble Creature was built from the bones of an old church right in the heart of Youngstown. These two LOVE Youngstown and are happy to do their part to bring some good vibes to this city that has dealt with enough heartbreak for a lifetime. If their creativity, determination, and blue-collar attitude is a sign of what craft beer will bring to Youngstown then I think we will see this great city rise to prominence once again. En Puerto Rico hay varios podcasts muy populares en Iberoamérica: ‘Masakote’ con Chente Ydrach, ‘Hablando de Tecnología’ con Orlando Megal, ‘Mi Isla Doncella’ con el periodista Carlos Weber, ‘Teobytes’ con Jesús Rodríguez-Cortes y ‘Mirada Científica’; de Enrique Vargas, que fue transmitido en la radio pública nacional. Productora de podcasts decide no usar más el término ‘podcasts de marcas’. Pacific Content, una de las primeras productoras de podcasts (crearon el podcast de Slack) han decido no utilizar más el término ‘branded podcasts’ (podcasts de marcas) y están ahora utilizando “Original Podcasts with Brands’ (Podcasts originales con las marcas). Steve Pratt, co-fundador de Pacific Content, explicó la razón del cambio. El término ‘podcasts de marcas’ probablemente disuade a un buen número de oyentes para probar el programa. Aaron Mahnke, uno de los podcasters independientes más exitosos de Estados Unidos, escribió un artículo titulado ‘10 Consejos para lograr un súper podcast’. Le recomiendo esta lectura porque Mahnke sabe lo que dice. Su podcast de narraciones ‘Lore’, comenzó como el suyo y el mío grabándose en el apartamento donde vivía. ‘Lore’, inspiró una serie de TV y ahora Mahnke vive del podcasting. Episode edited by the great J Scott Donnell Bio: Maurice Clarett has traveled throughout the nation speaking to universities, businesses, non-profits, faith based organizations and high schools. His life experiences have led him to be one of the most sought after speakers. Maurice had a massive amount of success at Ohio State becoming the first freshman running back to start, being named Big Ten freshman of the year, and setting the freshman rushing and touchdown season record. He was also instrumental in helping Ohio State clinch the National Championship in 2002 with two pivotal plays "the strip" and scoring the go ahead touchdown. This was Maurice's only season at Ohio State due to a series of events that took place in his life (These events be seen in the ESPN 30 for 30 documentary "Youngstown Boys"). After much success on the field Maurice had trouble finding that same level of success off of the field and found himself serving 7 1/2 year prison sentence. It was there that Maurice began to take that work ethic and discipline that brought him so much success as a football player and began to focus it on himself as a person. He began to educate himself through college courses and reading books in his topics of interest such as the economics, finance, and business. His growth became evident to those around him as he would share what he had learned and began motivating those around him. It was this type of leadership that permitted him to be released 4 years early. Upon being released Maurice went right to work in developing what he has envisioned. He wanted to create a platform that would allow him to connect, educate, and empower people in their life and/or profession. Maurice soon found himself connecting with the nation’s top business executives with the most notable being Warren Buffet. His ability to connect with his audience in a practical way leaves those who hear his words feeling inspired. Maurice believes that when you compound positive reinforcements in your life, over time, you begin to receive the benefits from them.
Maurice Clarett is a former American football running back. During his freshman year at Ohio State University in 2002, he helped lead the Buckeyes to a national championship. In a widely unexpected move, Clarett was drafted on the first day of the 2005 NFL Draft with the final pick of the 3rd round (#101 overall) by the Denver Broncos. He is well known for unsuccessfully challenging the NFL's draft eligibility rulesrequiring a player to be three years removed from high school and for his tumultuous life outside of football, including his dismissal from Ohio State, several arrests, and later, imprisonment.
