For someone who has yet to reach his 27th birthday, Thomas Nobbs has already spent a lifetime in the world of competitive running. Since joining his first track club at age seven, the Vancouver native quickly found his stride, falling in love with the work harder/run faster equation that distance running offered. He also found his stride on the track and went on to assert himself as one of the country's top youth athletes, with a pair of national youth championship golds in the 3,000m and 2,000m steeplechase. But for someone who loved to work hard, the risks associated with a high-output approach began to grow, and Nobbs spent much of his late high school and early university careers sidelined with injuries, including multiple stress fractures. Nevertheless, the passion for running never faded, and after wrapping up a university career at UBC in 2022, Nobbs began exploring the world of longer distances on the road, a journey that eventually, and inevitably, took him to the marathon. Since debuting three years ago, the 26-year-old has steadily improved his time over 42.2 km, most recently with a breakout performance in March in Rockland State Park, NY, where he won the McKirdy Micro Marathon in 2:09:24. It was a three-minute personal best and made him the fourth fastest marathoner in Canadian history. After years climbing his way back through injury, the former youth champion finds himself once again among the best in the nation, and will make his Abbott World Marathon Major debut in October in Chicago, entering that field as the top-ranked Canadian. As Chanukah approached, he no longer wanted to give the gift, but he gave it anyway because he had already given his word. Can he later claim that the gift was invalid because he was giving it under duress?Answer: If he merely said that he would give the menorah, it would not be considered an oath that requires him to do so. At most, it would be what is called an “unso d'nafshei”, meaning that he pressured himself into giving it against his will so to speak. The Gemara says that “unso d'nafshei” is not sufficient grounds to be mevatel a matanah.The Gemara talks about a case of a man who wanted to marry a woman, and she said that she would only marry him if he gifted her a certain item. Under duress, he agreed to give her that gift. When his children protested, he clandestinely gave the same item to them as a present as well. The Gemara says that his giving it to his children demonstrates that he only gave it to the woman because he felt pressured to do so. Since this is clear from his actions, the matanah is batul. Based on this Gemara, the Rishonim rule that a gift can be invalidated if it is clear from the circumstances that it was only given under duress. Otherwise, the gift is valid even if he was feeling pressured to give it.If the father-in-law had made an oath to give the menorah, there might be grounds to annul the matanah. The halacha is that a get given after someone made a shavuah to give one is not valid. For this reason, we are matir neder before a get is given to ensure that it is not considered to have been given forcibly.However, the Nesivos writes that this only applies to a get, and not to a matanah. The Rambam says that a person needs “ratzon” when giving a get, which means he has to give the get solely because he no longer wants to be married to this woman, and not for any other reason. If he is giving it in order to fulfill his oath, it is invalid. A gift, however, does not need specific ratzon. As long as it is not given as the result of an oness, it is valid. Therefore, a matanah given to fulfill a oath is valid.Other Acharonim disagree and say that a matanah also needs ratzon, just like a get, and if it is given in fulfillment of an oath, it too is not valid.

For most of the past 40 years, the Canadian record in the women's 100m remained stagnant, hovering right under the 11 second barrier and moving just 0.04 over the span of nearly 4 decades. But that all changed earlier this month when Ajax, ON Sadé McCreath stormed to a massive lifetime best of 10.86 at the Edmonton International Track Classic, taking nearly a full 10th of a second off of the previous national record and becoming the first woman in Canadian history to dip under 10.90 seconds. And while the record-setting run marks a new era in Canadian sprinting, McCreath's own journey to Canadian record holder parallels the trajectory of the record itself. Is he a gazlan?Answer: Typically, the halacha is that a peshara (compromise) is like a sale in that a forced compromise is valid, just like a forced sale.However, that is only true if both sides agree to compromise because the actual ownership is in doubt. In this case, everyone admits that one party owes the other the full amount, but one side is forced to accept a compromise because the other informed him that he won't receive anything otherwise. This would be considered a gift, rather than a compromise, and a forced gift is not valid.However, the Maharashdam is of the opinion that even a settlement like this is considered a mechira, rather than a matanah, because the claimant is receiving a benefit from it. He says that if this were not the case, no settlement will ever be enforceable. Even in his case, where a man who was in debtor's prison for owing money agreed to settle with his own debtor in order to get at least some money from him, he rules that the settlement is valid. As long as the threat of non-payment is serious, the settlement cannot be invalidated even by issuing a Modaah.Although most acharonim rule against the Maharshdam, the question remains if the debtor can say “kim li” in order to allow a settlement to stand.Another consideration would be if the creditor signed a shtar mechillah. Without a Modaah it might be difficult to overturn such a shtar. However, there a Modaah might help because he can use it to demonstrate that he only agreed to the settlement under duress.

The Gemara then asks: If someone gives money, people do not consider this to be a sin at all. Why is he classified as a chamsan? The Gemara responds that we are referring to a case where the seller never consented to the sale.This Gemara seems to be saying that a forced sale is only valid if the seller says that he consents. If so, how could the Shulchan Aruch rule against an explicit Gemara?The Nesivos Hamishpat explains that the Gemara is not talking about a sale that was forced by threatening to harm the seller. There, his expression of consent is not needed because we assume that he does agree to sell the item in order to save his life. This Gemara, however, is speaking about a case similar to the one in question, where someone simply took his friend's item against his will and paid for it. In this case, where the situation does not lead to the presumption that the seller probably consented to the sale, the Gemara says that his explicit consent is needed to validate the sale.Accordingly, we cannot say that the case in question is a valid sale unless the owner actually expresses consent to sell the item.

The Shulchan Aruch rules that as long as money is exchanged, the deal is valid, even if the seller never said that he agrees.The reason is, based on the circumstances, we can assume that the seller agreed to the sale in order to save his life, even if he didn't openly say so.Question: What if the buyer demands a discount? For example, what if he forces the homeowner whose house is worth $1 million to accept $900,000 for it?Answer: The Rishonim write that a sale due to duress is only valid if the item is being sold for a fair price. Whereas, if the buyer forces him to sell at a discounted price, the sale would not be valid. The reason for this distinction is that while a forced sale is valid, a forced gift is not. If the buyer forces the seller to give him a discount, he is essentially forcing him to give him a gift, which is not a valid transaction.

A few months ago, Madelyn Eybergen joined this show as Canada's university cross-country champion. Today, she's back as a world champion, but not in running. Nickademus de la Rosa is no stranger to mountaintops, of both the literal and metaphorical variety. For much of the 2010s he was at the top of the ultrarunning world, rattling off podium appearances at some of the longest, toughest and most iconic events in the sport, and boasting a list of completions almost as long as the races themselves. Of all the highs, perhaps none was greater than his finish at the 2013 Barkley Marathons, a race often deemed the toughest in the world, with only 26 finishes in its 30+ year history. Yet, while a victory on one of the sport's greatest stages brought the promise of a legacy cemented, it also served to further deepen an identity rooted in performance, one perpetuated by a constant striving for the next win. While de la Rosa's immense talent for the trails allowed him to dictate his own story for years, his performance-centric identity collapsed when an abrupt diagnosis and open-heart surgery forced him to retire from competition in 2017. What followed were years of soul-searching and grappling to rediscover a sense of self outside of sport. That journey ultimately led him to mental performance coaching, using his education in sport and performance psychology and the hard-earned lessons from his own career to help athletes separate their self-worth from performance and free themselves to compete at their best.
