When I came to collect, he told me that he is only offering fifty cents on the dollar. He said that if I don't accept that, he won't pay anything at all. Is he a gazlan?Answer: Typically, the halacha is that a peshara (compromise) is like a sale in that a forced compromise is valid, just like a forced sale.However, that is only true if both sides agree to compromise because the actual ownership is in doubt. In this case, everyone admits that one party owes the other the full amount, but one side is forced to accept a compromise because the other informed him that he won't receive anything otherwise. This would be considered a gift, rather than a compromise, and a forced gift is not valid.However, the Maharashdam is of the opinion that even a settlement like this is considered a mechira, rather than a matanah, because the claimant is receiving a benefit from it. He says that if this were not the case, no settlement will ever be enforceable. Even in his case, where a man who was in debtor's prison for owing money agreed to settle with his own debtor in order to get at least some money from him, he rules that the settlement is valid. As long as the threat of non-payment is serious, the settlement cannot be invalidated even by issuing a Modaah.Although most acharonim rule against the Maharshdam, the question remains if the debtor can say “kim li” in order to allow a settlement to stand.Another consideration would be if the creditor signed a shtar mechillah. Without a Modaah it might be difficult to overturn such a shtar. However, there a Modaah might help because he can use it to demonstrate that he only agreed to the settlement under duress.

Email us at info@baishavaad.org Rav Yosef Dovid JosilowskyQuestion: A fellow walks into someone's house, picks up an item that he wants, puts money on the table, and says, “I'm buying this item whether you like it or not.” Is this a valid sale?Answer: We said in the last segment that a forced sale is valid, and the Shulchan Aruch rules that this is true even if the seller does not say that he consents to the sale.There is a difficulty with this ruling in that it seems to contradict a Gemara in Bava Kama that defines the difference between a gazlan and a chamsan in that a gazlan steals without paying, while a chamsan does pay. The Gemara then asks: If someone gives money, people do not consider this to be a sin at all. Why is he classified as a chamsan? The Gemara responds that we are referring to a case where the seller never consented to the sale.This Gemara seems to be saying that a forced sale is only valid if the seller says that he consents. If so, how could the Shulchan Aruch rule against an explicit Gemara?The Nesivos Hamishpat explains that the Gemara is not talking about a sale that was forced by threatening to harm the seller. There, his expression of consent is not needed because we assume that he does agree to sell the item in order to save his life. This Gemara, however, is speaking about a case similar to the one in question, where someone simply took his friend's item against his will and paid for it. In this case, where the situation does not lead to the presumption that the seller probably consented to the sale, the Gemara says that his explicit consent is needed to validate the sale.Accordingly, we cannot say that the case in question is a valid sale unless the owner actually expresses consent to sell the item.

He is getting many offers to buy the house but he is not interested in moving. One day, someone walks over to him, pulls out a gun, and says, “Your house is worth $1 million. I am buying it right now.” Is this sale valid?Answer: The Gemara says that if someone is forced to sell something, the sale is valid. The Rishonim debate whether the seller has to at least express his consent to the sale. The Shulchan Aruch rules that as long as money is exchanged, the deal is valid, even if the seller never said that he agrees.The reason is, based on the circumstances, we can assume that the seller agreed to the sale in order to save his life, even if he didn't openly say so.Question: What if the buyer demands a discount? For example, what if he forces the homeowner whose house is worth $1 million to accept $900,000 for it?Answer: The Rishonim write that a sale due to duress is only valid if the item is being sold for a fair price. Whereas, if the buyer forces him to sell at a discounted price, the sale would not be valid. The reason for this distinction is that while a forced sale is valid, a forced gift is not. If the buyer forces the seller to give him a discount, he is essentially forcing him to give him a gift, which is not a valid transaction.

A few months ago, Madelyn Eybergen joined this show as Canada's university cross-country champion. Today, she's back as a world champion, but not in running. Instead, she conquered one of the fastest-growing sports in endurance: hybrid racing. If there were ever a competition to crown the world's most well rounded endurance athlete, Eybergen would be able to make a strong case. She's no stranger to reinvention after trading the high jump for the track and quickly becoming one of Canada's brightest young distance running stars. Nickademus de la Rosa is no stranger to mountaintops, of both the literal and metaphorical variety.  For much of the 2010s he was at the top of the ultrarunning world, rattling off podium appearances at some of the longest, toughest and most iconic events in the sport, and boasting a list of completions almost as long as the races themselves. Of all the highs, perhaps none was greater than his finish at the 2013 Barkley Marathons, a race often deemed the toughest in the world, with only 26 finishes in its 30+ year history.  Yet, while a victory on one of the sport's greatest stages brought the promise of a legacy cemented, it also served to further deepen an identity rooted in performance, one perpetuated by a constant striving for the next win. While de la Rosa's immense talent for the trails allowed him to dictate his own story for years, his performance-centric identity collapsed when an abrupt diagnosis and open-heart surgery forced him to retire from competition in 2017. What followed were years of soul-searching and grappling to rediscover a sense of self outside of sport.  That journey ultimately led him to mental performance coaching, using his education in sport and performance psychology and the hard-earned lessons from his own career to help athletes separate their self-worth from performance and free themselves to compete at their best. Hey friends! Backups are not as cool as pentesting, but boy do they matter when things go sideways. This week I'm sharing how a Proxmox backup disk space meltdown led me to a completely overhauled — and honestly pretty bulletproof — backup setup for both home and work. Claude played a big role in helping me sort it all out. Here's what we get into: The backup history tour — I've been through CrashPlan, Dropbox, Backblaze (which saved my bacon after my house fire in 2019!), and a mystery one that may or may not have had "Panda" in the name. These days I'm settled on ARQ for personal backups — dead simple, backs up to just about everything (Dropbox, OneDrive, Google Drive, even their own ARQ Cloud for ~$80/year), and all data is encrypted at rest. Not a sponsor, but they should be. The 3-2-1 rule — I actually asked Siri mid-episode, and she initially thought it was a grounding/anxiety technique. (Valid, I guess?) The real answer: three copies, two different media, one offline. I've got a local copy plus OneDrive, Google Drive, and Dropbox — so I think I'm covered. The work side: Proxmox + PBS — My "data center" is a beefy Hetzner Proxmox box with about a dozen VMs. I had Proxmox Backup Server (PBS) set up on a secondary Hetzner box, happily cranking away… until it ran out of disk space and started yelling at me every night. Claude to the rescue — I spun up a Claude project, fed it terminal output and retention configs, and it gave me a straight-up honest assessment: either gut your retention policy (risky) or get more disk. It then walked me through Hetzner's auctions page — which I didn't even know existed — to find a storage-heavy, low-horsepower box. Ended up with two mirrored 8TB drives plus a 14TB drive for around $40/month. Not cheap, but totally worth it as a business expense. The new setup — PBS is now on its own dedicated Hetzner box. VMs from both my data center and my home NUC Proxmox box back up there nightly. Claude also suggested using that 14TB drive as an SFTP target for ARQ, giving me yet another redundant copy of all my personal data. It'll take a few weeks to fully sync, but I'm running some flavor of the 4-3-2-1 rule now (I made that up). Proxmox forever — Someone wrote in asking if I'd go back to ESXi now that Broadcom brought back the free version. Hard no.
