Adam Montgomery had twenty-one criminal cases in New Hampshire alone when a Massachusetts juvenile court judge decided he was fit to raise a child. The Harmony Montgomery case began the moment Judge Mark Newman awarded sole custody of a five-year-old girl to a man whose record included a stabbing, a suspected homicide, and shooting another man in the face. The court moved so fast it didn't wait for the required home study to be completed. Ten months after that ruling, Harmony was dead.Now the New Hampshire Supreme Court has reversed Montgomery's murder conviction on procedural grounds — the latest in a chain of institutional failures that stretches across two states and seven years. The court found that trying the murder charge alongside a separate assault charge in one trial denied Montgomery a fair proceeding. The assault evidence was airtight. The murder evidence depended on a single witness with credibility problems. The strong case dragged the weak one across the finish line, and the Supreme Court sent it back.But the system failures started long before the courtroom. DCYF caseworker Demetrios Tsaros was assigned to investigate reports that Harmony was being harmed — despite having served as Adam Montgomery's youth counselor fifteen years earlier. He visited the home, found it filthy, saw bruising around Harmony's eye, never spoke to the girl, and emailed police that everything looked fine. Manchester police responded to the Montgomery residence sixteen times in a single year. Prosecutors made Adam Montgomery an offer at sentencing in the Harmony Montgomery case: reveal where you put your daughter's remains, and we'll recommend a lighter sentence. He sat in the courtroom and said nothing. He walked into his own jury selection smiling. He refused to attend most of his trial. And he has never once told anyone where Harmony is.That silence now sits alongside a unanimous New Hampshire Supreme Court decision reversing Montgomery's second-degree murder conviction on procedural grounds. The court ruled that trying the killing charge and a separate assault charge together in one trial prejudiced the jury. The assault evidence was strong — multiple witnesses, no dispute. The murder evidence depended almost entirely on Kayla Montgomery's testimony, and the court found the jury may not have convicted without the assault case propping it up.The state intends to retry the murder charge. Montgomery remains behind bars on assault, evidence tampering, witness tampering, and what he did to Harmony's remains — hiding her in a duffel bag, a car trunk, a ceiling vent at a homeless shelter, and a walk-in freezer at the pizza shop where he worked. He used lime on his own daughter's body. He rented a U-Haul and drove her remains to a disposal site somewhere between Manchester and Massachusetts. Lawmakers have released a 12-page report detailing how failures by the state's top child protection agency contributed to a crisis at the Sununu Youth Services Center in Manchester. And a proposal to build a data center in Nottingham has been withdrawn after statewide backlash over the plan. Pedersen The Attorney General's Office  DCYF FACES CONTINUED SCRUTINY OVER DAYCARE PAYMENTS DCYF Secretary Tana Senn gave an update Thursday to the department's oversight board following a recent audit that identified approximately $37 million in questionable childcare subsidy payments. Senn argued: The audit findings represented extrapolations rather than confirmed fraud Many childcare providers felt unfairly targeted Public scrutiny created stress and anxiety throughout the childcare community According to Senn: “A lot felt like they were under attack probably for no very good reason.” Center Square reporters noted they have spent months investigating providers receiving: Tens of thousands of dollars monthly Large taxpayer subsidies Payments tied to locations where little or no evidence of childcare operations was visible Oversight Board members, including Sen. Nikki Torres, reportedly expressed frustration that the audit discussion received limited time during the meeting.  LONGVIEW SUPERINTENDENT ARRESTED Longview School District Superintendent Karen Cloninger was arrested Thursday morning following an investigation into allegations surrounding the district's boys basketball program. The director of the New Hampshire Division for Children, Youth and Families is disputing many recent allegations at the state's youth detention center. Marie Noonan testified before lawmakers this week after concerns of abuse or improper restraint were detailed in reports by the Disability Rights Center and the Office of the Child Advocate. Noonan sent a letter to the Disability Rights Center late last week arguing that the Center's investigation and visits to the facility are having a negative impact on the kids and staff there. And New Hampshire is full of historic homes, barns and churches that are at risk of falling apart. But there's a shortage of people who know how to repair them. Over the last two episodes, I've told you the story of five-year-old Dennis Vaughan Jr., known affectionately as “Boo,” who died in his grandmother's house on Christmas Eve, 2019. They were ultimately placed in the Laconia, New Hampshire, home of their maternal grandmother, Sherry Connor. This week, Drewby and Yergy head to Laconia, New Hampshire... a place that's really important to them, to discuss the tragic case of Dennis "Boo" Vaughan, a little boy who never had a chance at life.  After being born to a young mother and an abusive father who was in his 50's (both who were experiencing substance use issues at the time), Dennis and his siblings went to live with his grandmother, Sherry Connor. The problem was, Sherry was also extremely abusive, so Dennis wasn't safe in either environment. Adam Montgomery has been convicted in the death of his 5-year-old daughter, Harmony. Her body has never been recovered. It only took the jury six hours of deliberation spread over two days, to hand down the verdict. Police said that “on or about Dec. 7, 2019,” Montgomery repeatedly struck 5-year-old  Harmony “in the head with a closed fist.”   New Hampshire police say the then 5-year-old vanished sometime between November 28 and December 10, 2019. Her disappearance was not reported for two years.    The family of Harmony Montgomery says the New Hampshire Division For Children Youth and Families failed the little girl. According to Blair Miller, who adopted Harmony's younger brother, DCYF officials told him, Harmony had been reunited with her father. Miller had asked about the possibility of adopting Harmony as well.  According to court documents, Kevin Montgomery, Adam's Uncle, called DCYF after he noticed Harmony had a black eye. Before Oakley Carlson turned one, she was taken out of the care of her biological parents Jordan Bowers and Andrew Carlson, and placed with foster parents, Jamie Jo and Erik Hiles. Eventually, around the end of 2021, people noticed that Oakley wasn't with the rest of her family. Due to some quick thinking by Oakley's sister's school principal, she ultimately led authorities to uncover that there had been no verified sightings of Oakley for almost a year. When authorities questioned Jordan Bowers and Andrew Carlson, they shut down and became uncooperative. When they search the family home that had recently been on fire for several hours, they find blood but no Oakley. She remains missing to this day.
