Is there such a thing as right and wrong, or is morality a fabrication of social and evolutionary design? Enlightenment thinkers, such as Hobbes and Rousseau, believed that morality is a social construct. Contemporary atheist philosophers, like Paul Kurtz and Michael Ruse, are convinced that evolutionary biology is responsible for a sense of morality. Judeo-Christian thinkers throughout millennia have said that moral laws require a moral law giver. And Friedrich Nietzsche dismisses the entire conversation, arguing that all morals are illusory constraints adopted by weak willed peons.NotesThe featured painting is an oil on canvas by Caspar David Friedrich, painted in 1818. It is titled, "Wanderer Above the Sea of Fog." I selected it because it is widely considered one of the greatest masterpieces from the Romantic Era––an era that was destroyed by the horrors of the 20th century. On this week's episode of Versus Trump, Charlie, Jason, and Easha discuss a decision from a federal court in Los Angeles ordering the Government to grant citizenship to both children of a same-sex couple born abroad to one U.S. parent. The trio dig into the little-known world of how children born abroad to U.S. parents are granted citizenship to understand whether the State Department has been discriminating against same-sex couples. Federal law says that children born abroad are citizens at birth if they are "born of parents," one of whom is a U.S. citizen. In the Dvash-Banks case, the parents are a married same-sex couple, one of whom is a U.S. citizen, but only one of two twins is genetically related to the U.S. citizen father. Under an obscure policy, the State Department granted citizenship to the genetically-related twin but denied it to the other twin—even though the U.S. citizen parent is the "parent" of both children. On this week's episode of Versus Trump, Jason and Charlie discuss last month's federal court decision holding that Maryland could not proceed in its lawsuit that sought a declaration that the Affordable Care Act is constitutional and must be enforced. Easha and Jason start by explaining the unusual lawsuit, which is the inverse of the more widely-reported case Texas v. United States. In Texas, red states are seeking to strike down the ACA; in Maryland, that state is trying to uphold it. But, as they explain, a district court a few weeks held that Maryland could not proceed because, despite the Administration's hostility to the ACA, it does continue to be enforced (at least in meaningful part), so the court held there was no live case or controversy. In this episode, we (and Ron) get to learn a little bit about the title of this book aka The Chamber of Secrets. But before that, a whole bunch of stuff happens:- Harry and Ron get assigned detentions. McGonagall smartly tailors the detentions - Harry gets assigned time with his favoritest Defense Against the Dark Arts Professor and Ron has to clean the trophy room, in the Muggle way, with Filch. Talk about fun. During his detention, Harry hears a disembodied voice but can't be sure where it was coming from or who it could be.- Harry almost gets another detention from Filch for dripping mud in the corridor but is saved by Nearly Headless Nick. Nick also invites him to his 500th Deathday Party on Halloween; Harry agrees to attend, with Hermione and Ron, out of sheer gratitude.- As per Ron's prediction, the Deathday party turns out to be dead depressing so they split midway to go back to the feast. Harry hears the disembodied voice again in the corridor (Ron and Hermione can't), except this time it's saying a lot of scary stuff like 'Rip. Tear. Kill.' and 'I smell blood'. Harry runs towards the voice, a confused Ron and Hermione in tow, and end up in front of some writing on a wall ('The Chamber of Secrets is open. Enemies of the heir, beware') and a petrified cat - Mrs. Norris. The entire school shows up just after they do and catches them at the scene of the crime.- Filch accuses Harry of killing his cat because Harry figured out he's a Squib. But thankfully, Dumbledore believes that Harry had nothing to do with the incident and gets him off the hook. Hermione remembers reading about the Chamber of Secrets but she doesn't have her copy of Hogwarts, A History to refresh her memory and all the copies have been borrowed from the library. So, she interrupts Professor Binns during a History of Magic lecture and asks him. "Eat slugs, Malfoy!" In episode 3 of season 2, we discuss the events leading up to Ron coming to Hermione's defense. From what? Let's find out.After they find out that they cannot get past the barrier in platform 9 3/4, Ron and Harry put their heads together to come up with a misguided and dangerous plan. They decide to ride the flying car to Hogwarts. What could go wrong, right? Turns out, everything.Well, the car is seen by some mugglesThe car loses juice and starts to protest against the long drive.They hit a tree in the Hogwarts ground. The only tree that hits backRon breaks his wand.The car throws Harry and Ron out and drives itself into the forbidden forest.Finally, they get caught by Snape who is hell-bent on getting them expelled.Dumbledore arrives to save the day and lets them off with a detention. But their bad luck does not stop there. Ron gets a howler from Mrs. Weasley and Harry gets a lecture from Professor Lockhart. Harry, to his annoyance, gets a 'FAN' (not Ginny), who follows him around taking pictures and attracting more attention. You'd think things would get better for Harry at the Quidditch practice. But the Gryffindor team's practice is interrupted by the Slytherin team. They show off their brand new Nimbus 2001s, generously donated to them by Mr. Malfoy to get his son on the team.When Hermione points out that nobody in the Gryffindor team bought their way in, Draco Malfoy calls her a nasty word. Jason starts the discussion by explaning Trump's non-profit Foundation, the role of states in regulating non-profits, and the rock-solid evidence produced by the New York Attorney General that, for many years up to and including the presidential campaign in 2016, President Trump misused charitable funds and violated a litany of other laws that are supposed to ensure that non-profits actually benefit the public interest in some way. Jason and Charlie discuss their favorite allegations, including that the President let campaign staffers direct charitable funds to benefit the campaign and that he fraudulently used Trump Foundation money to pay off a debt owed by one of his golf courses. "Very fishy. Definitely dodgy." After Ron's heroic rescue of Harry who was imprisoned in the Dursley house, Harry updates the Weasley brothers on everything that happened during the summer. They have a very different take on the Dobby episode. Unlike Harry, they think that Dobby was sent by someone who hates Harry aka Draco Malfoy.At this point, it is important to note that the Weasley brothers and Harry are in a magical flying car. They are flying it back to the Burrow, where the Weasleys live. We meet Mrs. Weasley who is very angry about the boys flaunting the statute of secrecy in this way. She assigns them chores but doesn't forget to feed them. Mr. Weasley is happy to finally meet Harry but he is happier when he hears that the flying car works because he was the one who enchanted it. Harry has the time of his life in the Burrow. He likes how disorderly and loving the Weasleys are. When his second-year term is about to start, they all decide to travel to Dialog alley using floo powder. Harry, unfamiliar with this new complicated method of travel, ends up in Knockturn Alley, where he overhears a suspicious conversation between Mr. Malfoy and a dark magic shop owner Mr. Borgin.He is saved by Hagrid who brings Harry to the anxious Weasleys. They shop for a while and then go to Flourish and Blotts to buy their very expensive books. Here Harry and the gang meet their future Defense Against the Dark Arts teacher - the very colorful Gilderoy Lockhart.The summer holidays end. The Weasleys and Harry hurry to catch the Hogwarts Express. What happens next will probably not surprise you if you have read the books.--Wow. I am tired of typing the summary. So many things happen in these chapters. And I did not even mention Ginny, Percy or the lady selling human fingernails. This week, Jason, Charlie, and Easha are back with a regular episode to discuss a stunning recent development in Texas v. United States, a case by Texas seeking to invalidate the Affordable Care Act (Obamacare). Last month, the Trump Administration not only agreed with Texas that the individual mandate is unconstitutional, but it also told the district court that the requirement to cover everyone with a pre-existing condition on the same terms as healthy folks should be struck down as well. Easha starts the discussion by giving us a background on the Affordable Care Act, including previous major cases about it and the recent change in the law that zeroes out the tax penalty for not having health insurance. She then explains the Trump Administration's new legal position, which is 1) that the individual mandate is unconstitutional beause it's no longer a tax and 2) the guarantee of coverage for those with pre-existing conditions should also be struck down because Congress would not have wanted that provision without the accompanying individual mandate. They then discuss three aspects of the Administration's position. First, are they right about the mandate? Second, do they have any plausible argument on the pre-existing conditions point?
