In the early hours of January 14, 2024 the Department of Justice released its long-awaited election interference report against President-elect Donald Trump. It was a long and winding road to that moment—and one marked, ultimately, by justice delayed. In November 2022, Attorney General Merrick Garland appointed Jack Smith as special counsel to oversee criminal investigations by the Justice Department into former President Donald Trump's efforts to overturn the 2020 election and his retention of classified documents. The two cases were brought in different jurisdictions—with charges for the classified documents case filed in Florida and the elections case in Washington, D.C. After false starts, the blockbuster Supreme Court ruling on July 1, 2024 that former President Trump is entitled to some immunity from criminal prosecution for actions taken to overturn the results of the 2020 election, and the subsequent re-election of Trump in November, Smith and the DOJ dropped both cases. After Bill Barr buried the Mueller Report and went to work suffocating the remaining prosecutions in the Russia investigation, Donald Trump and his “lawyer,“ Rudy Giuliani, shifted their main narrative focus from Hillary Clinton to Hunter Biden—also with the help of Bill Barr. The first flailing attempts to smear Joe Biden with his son's connections to a corrupt Ukrainian business resulted in Donald Trump's impeachment and the arrests of Lev Parnas and Igor Fruman. But MAGA hit paydirt with the “discovery” of Hunter Biden's “laptop,” which first appeared mysteriously right around the time of Trump's first trial in the US Senate and then reappeared the following year, just in time to be the election year October Surprise. At first, the laptop, with its endless supply of digital proof of the depravity to which Hunter Biden had descended before he got sober the year before, didn't work out the way John Podesta's emails had. At first, journalists actually demanded proof the files were authentic and also tested whether they proved what Rudy Giuliani or NY Post claimed they did. But over the years, egged on by Fox News and enticed by the promise of easy sensation, they came to chase the dick pics because they were there, just as Murdoch's propagandists had done. And the process by which icky dick pics came to stand in for unsubstantiated claims that Joe Biden was corrupt sucked all the air out of DC reporting for years … and laid the groundwork for Trump's reelection. For the first time, Marcy Wheeler ties together the story of what is actually known about Hunter's laptop(s) and hard drives and the baffling characters who got their hands on them. She explains how the shameless leaking of the private data of the son of a former vice president and future president to his father's political opponents was never really treated as a crime. She also exposes how Trump's plot succeeded in sucking all the air out of Joe Biden's presidency and fueled problematic political prosecutions that haunt America and still twist our discourse today. John Durham was given an impossible job. They followed every available George Papadaopulus conspiracy, hoping to turn Hillary Clinton, a victim of the Russian attack on the 2016 elections, into the villain. And that fumbling effort continued long after Trump was evicted from the White House. Most people think of Bill Barr's interference in the Mueller Report in a very limited sense – a letter to Congress and a press conference. But it was far deeper and more deliberate than that. Bill Barr turned out to be the ideal consumer for the spin Paul Manafort, Devin Nunes, and Fox News spewed to cloak Donald Trump's vast connections to Russia. Armed with a passion for covering up Republican high crimes, an authoritarian worldview, and a view of executive power that resembles monarchy, Barr “reluctantly” returned to government with two goals. He wanted to kill the Mueller investigation. He then launched a counter-investigation that he hoped would reverse the special counsel's extensive record of convictions. Those plans, which he withheld from Congress during his confirmation hearings, were exacerbated by Rudy Guliani. The president's lawyer led the effort to transform the backlash to the Russia investigation into a “harebrained” counter-scandal of his own, based on Russian disinformation and Donald Trump's opportunistic persecution fantasies. Remember when Trump was impeached for holding up Ukraine aid to pressure Zelensky into fabricating a scandal about Biden? That's how Trump famously operates—pushing for a quid pro quo. That brings us to Egypt, a dictatorship with a track record of bribing Americans, including disgraced Democratic Senator Bob Menendez, who was found guilty on all counts of being a paid foreign agent of Egypt. In 2016, Trump met with Egyptian dictator Abdel Fattah el-Sisi behind closed doors at the U.N. General Assembly weeks before the election, likely breaking the Logan Act at a time when President Obama's foreign policy shunned el-Sisi for his human rights abuses and overthrowing Egypt's first democratically elected leader. But it gets worse. Trump's relationship with Egypt isn't just about money; it's about power—nuclear power. El-Sisi's regime is closely aligned with the Kremlin. Experts raised alarms about Russia's nuclear ambitions in the Middle East, where earlier this year Russia began building a nuclear power station in Egypt. Trump's ties to these dangerous players demands that the Biden administration, or potentially a Harris/Walz administration, appoint a special prosecutor to continue the investigation into Trump and Egypt, killed by Trump's attorney general William Barr, the GOP cover-up king. Just like the last time she was on, each of you gave as good as you got.I tend to agree more with her, because I fear that sometimes you come off as what Jeane Kirkpatrick called the “blame America first crowd” — not that we haven't committed our sins. But if we didn't exist, Putin would still be evil and want to recreate the Warsaw Pact, and the mullahs in Iran would still be fanatics despite our CIA involvement. It's complicated.Another on foreign policy:I despise Putin, my sympathies are totally with the Ukrainians, and I get angry when people like Rod Dreher and Tucker Carlson imply that the Russians were forced by the West to invade Ukraine. But, so what! You hit the nail on the head with the Obama quote — that Ukraine is never going to mean as much to us as it does to them (the Russians). You also made another very good point that the Russians can't even conquer Ukraine, but we're supposed to fear they will march West? How they going to do that?!Another took issue with several things from Anne:You raised the immigration issue, and Applebaum completely dismissed it: Hungary doesn't have a migrant crisis. … Because it's a useful symbol [to] create fear and anxiety. … This is the oldest political trick in the book, and the creation of an imaginary culture war is one of the ways in which you build support among a more fearful part of the population.WTF? Are Hungarians not allowed to see what is happening in every other European country that has allowed mass migration and see the problems it has caused and proactively decide to prevent this?! Are they not allowed to be concerned until Budapest has the banlieues of Paris, the car bombing gangs of Sweden, and the grooming gangs of England?! And in Germany, it has been recently reported that almost half of people receiving social payments are migrants.Applebaum followed that up with an even bigger gobsmacker about Biden's cognitive decline: “This is another road I don't want to go down, but I know people who met with Joe Biden a couple months ago, and he was fine” (meaning I just want to make my statement but will not allow you a rebuttal). And then:I've met [Harris] a few times, mostly in the context of conversations about foreign policy and about Russia and Ukraine and other things. And she's an intelligent conversationalist. … I was impressed with her. And these are way off-the-record conversations... And I was always more impressed with how she was off the record. And then I would sometimes see her in public. And I thought, she seems very stiff and nervous. … You'd like her if you met her in real life.Translation of both of these excerpts: “You plebes who aren't insiders just don't understand, but trust me — the connected insider — instead of your lying eyes.”Another adds:I think for the next few months, you're going to have to push people like Anne Applebaum to be more open to criticizing the Biden-Harris record. She's a smart person with important things to say, but she clearly dared not criticize the current administration, lest she be seen as helping Trump. And another:She says, unironically, that autocrats rig court systems with exotic new lawfare to attack their political enemies to seize or cling to power. I wonder what that makes Alvin Bragg and Merrick Garland.This Dishhead listened to the episode with his teenage son:The notion that Trump supporters want a dictator is beyond ridiculous. They are among the most individualistic and freedom-loving people in America. They are the Jacksonians, the Scots-Irish heart of this country. They are ornery as hell, and if Trump tried to force them into anything, he'd have another thing coming. Just look how he tried to get them to take “his” vaccine. That didn't work out so well, did it? The truth is, they view people like Anne as the ones who are taking away their rights and freedoms through their absolute dominance of the media and all cultural institutions. Now maybe Trump will deliver them from that and maybe he won't, but that is what they are seeking — not a dictator, but someone who will break the hideous grip that the liberal elite has on the culture.My son is 18 years old and was also listening to the episode. He is highly engaged in national and world affairs, and he also thought Anne was way off track. He's already announced to his mother (much to her chagrin) that he will be casting his first vote for Trump. And get this: he's going to Oberlin College this fall. I can assure you he's not looking for a dictator. He's looking to say “eff you” to a system that has no use for upper-class, normal white boys like him. The elites hate him and his friends.But I'm glad you have a diversity of views on the Dishcast. It really is the best. I look forward to listening to it every week.I can't back Trump, but I do think your son is onto something. On a few other episodes:Lionel Shriver — I love her! I wished you'd talked more about her novel, Mania. It's not perfect, but it's good.On the Stephen Fry pod, I was resistant! He's irritated me at times. But I loved it when you two started doing Larkin! I shouldn't admit this, but “Aubade” could be my autobiography. I think one or both of you misinterpret “Church Going.” Larkin doesn't wish he had faith. I don't think that's relevant to him. Fry talked about how he liked everything about Anglicanism except for the detail about God (and I always suspect that for Anglicans, God is a somewhat troubling detail). I'm probably just guessing, but I don't think that's Larkin. Larkin didn't wish he had faith. He was elegiac about the past in which there was faith. I think you'll see this sensibility in “An Arundel Tomb.”Agreed. Another on Shriver:She seems to think that “liberals” are mistaken in believing that everyone can be equal, but I think she is mistaken in thinking that is what they believe — at least those I know. Liberals do think that 1) expectations play a role in what people achieve; and 2) given the right circumstances, many people find they can achieve more than was expected. Low expectations do lead to low outcomes (and yes, there is research to support that statement). Does that mean everyone can do anything they wish? No. Neither you nor I will ever be a concert pianist, but let us not condemn everyone to the garbage heap based on false expectations.Thanks as always for your provocative discussions.Here's a guest rec:Musa Al Gharbi, a sociologist at Stony Brook, has written for Compact, American Affairs, and The Liberal Patriot. I have preordered the book, and it should be a timely read for an election in which class (education), not race, has become the preeminent dividing line in our politics.Here's a guest rec with pecs:I have a recommendation that may sound bonkers, but hear me out: Alan Ritchson, the actor whose career has taken off thanks to playing Jack Reacher on Reacher.The fact that he's really, really, really ridiculously good-looking is the least interesting thing about him. I'd love to hear a conversation between you and him for a few reasons. First, he's bipolar and speaks openly about it. Second, he started taking testosterone supplements after his body broke down from working out for Reacher, and he speaks openly about that too. Third, he's a devout evangelical Christian who speaks openly about his faith — and about his disgust with Christian nationalism and the hijacking of Christianity by many Trump supporters. Fourth, he posted what read to me as a thoughtful, sane critique of bad cops, thereby angering certain denizens of the Very Online Right. Thus, he could speak to a number of major Dishcast themes: mental illness, masculinity, and Christianity. To me, he manages to come across as a guy's guy whose comments on political matters sound like the result of actual reflection, rather than reflexively following a progressive script, which is how most celebrities come across. He's articulate, and the way he's navigating this cultural and political moment is fascinating. And if you do snag him, you should supplement the audio with video.Haha. But seriously, we're trying to keep the podcast fresh and this is a great out-of-the-box recommendation. Next up, the dissents over my views on Harris continue from the main page. A reader writes:I have no particular attachment to Kamala Harris, and share some of your concerns, but your latest column reads more like a Fox News hit piece than a real assessment. The main problem is that you seem to be judging Harris almost exclusively on the basis of statements she made in 2020, at the height of the Democrats' woke mania because of George Floyd. Do you not remember that she was destroyed in the primary because she was a prosecutor, and was to the right of almost everyone else in the primary, except for Biden and Sanders? That's why she lost: she wasn't woke enough. So as VP, of course she pivoted to shore up her appeal to the base, like any good politician would. It's terribly unfortunate that she had to tack hard left precisely as the country was moving back to the center and rejecting wokism, but that doesn't mean she's the “wokest candidate,” as you say. It just means she's a politician.My criticism also extended to her management and campaigning skills in the past. And look: I don't think it's fair to compare my attempt to review the evidence of her record with a Fox News hit-piece. It's important to understand her vulnerabilities as well as he core ideas, if she has any. This next reader thinks she is off to a good, non-woke start:I agree with your criticisms of Harris, at least some of them. We need to have stronger border enforcement, we can't have riots in cities, and racism is real but DEI excesses are also bad. And it's troubling that she has a history of being a bad boss. I can only hope that she has learned from her mistakes. But I take heart from her campaign speech in Wisconsin: she said not a word about DEI, nothing about “vote for me to show that you're not sexist/racist, because I'm a woman of color,” and not much about “Trump is a threat to democracy.” It was all, “I have experience dealing with sleazy crooks and sex offenders like Trump, and I want to help middle-class Americans and protect health care and a woman's right to choose.” Sounds like a popular message!You also say, “She is not a serious person.” Bro, have you *seen* the other party's candidate?
Days before the 2016 election, Rudy Giuliani went on Fox News promising a "big surprise," emphasizing his point with a Crypt Keeper cackle. "We've got a couple of things up our sleeves that should turn this around." The vast majority of the polls had Hillary Clinton comfortably winning. Paul Manafort, the Kremlin's longtime operative in Ukraine and Trump's longtime friend and neighbor, had laid low in recent weeks following a bombshell report out of Ukraine that he took millions of dollars in off-the-books payments from Ukrainian kleptocrat and wannabe strongman Viktor Yanukovych. However, Manafort broke his silence days before the election and wrote on Twitter: "Battleground states moving to Trump en masse. Media not liking the pattern. By Sunday, Trump will be over 270 in polls." But the polls said no such thing. Why were Giuliani and Manafort suddenly so confident Trump would pull off an upset? The 400-page Mueller Report and the bipartisan Senate Intelligence report both exposed how the Trump campaign and the Kremlin came to power in 2016: through pumping out disinformation to suppress the vote, cyberattacks stealing sensitive data, and hacking the voting systems of all 50 states. That very illegal strategy has been in play ever since and is mainstream for the MAGA fascist movement openly trying to overthrow our democracy and install a Christian nationalist dictatorship, with Trump as their long-awaited strongman, a perfect God's imperfect vessel. In this episode Hawk discusses the events surrounding the release of the infamous "Access Hollywood" tape in October 2016, just weeks before the presidential election. Hawk, details how the tape, which featured Donald Trump making lewd comments about women, was incredibly damaging to his campaign and led many Republicans to withdraw their support or call for him to drop out of the race. In response, Trump's campaign worked with Russian intelligence and WikiLeaks to release hacked emails from the Clinton campaign as a distraction from the tape's fallout.Hawk cites evidence from the Mueller Report and a 2020 Senate Intelligence Committee report, both of which confirmed that the Trump campaign welcomed and encouraged the release of emails stolen by Russian hackers and funneled through WikiLeaks. Roger Stone, a close Trump ally, had advance knowledge of the WikiLeaks releases and coordinated with the campaign to maximize their impact. But we're going to need a new Special Prosecutor to round all of the big names up. And a Senate Judiciary investigation on how this sack of crap was turned into the prosecution of the president's son, and the attempted impeachment of the sitting president. In an election year. At the direction of Vladimir Putin. We've been invaded again. And the Russians didn't need to shoot or bomb their way in here. Because all the Comers and Greenes and Jordans and Grassleys and Hannitys and Trumps just opened the doors for them. And may they burn in hell for doing so. Because I think Smirnov is flipping. Remember this shocking story from the 2016 election? The Trump campaign gutted Ukraine aid in the official RNC platform. Today this is mainstream for the GOP, with McConnell folding on Ukraine aid. This is catastrophic for the US and the world. The recent transformation of the GOP into the Party of Putin began gradually, with only a few in Congress, like former Congressman Dana Rohrabacher, who the Kremlin considered an asset, according to the FBI. In 2018, current House Speaker Mike Johnson took tens of thousands of dollars in dark money campaign donations linked to a Russian oligarch close to Putin who was part of the larger Kremlin operation exposed in the Mueller Report. The oligarch is Konstantin Nikolaev, who bankrolled Kremlin spy/GOP honeypot Maria Butina, who was arrested as part of the Mueller investigation, after pretending to be in love with NRA/GOP operative Paul Erickson. After Mike Johnson got caught taking donations linked to Nikolaev and other Russians (Oops!), he gave it back. But it was part of a wider operation used by the Russians in countries around the world to entrench their power in, known as “the golden handcuffs.” Johnson blames other extremists in his party, like concentration camp guard Marjorie Taylor Greene, for "slowing down" Ukraine aid. They're not slowing down aid; they're blocking it, to help their financial backers in the Kremlin win. Johnson and Trump are part of the Kremlin's long game. They develop their assets, then spread their influence deeper and deeper. This began with a few fringe people, like Rohrabacher. Now it's mainstream. This is state capture. What happens if we lose our country? No place is safe. If you think things are bad now, the entire world will be forced to live under the Kremlin's mafia state: violence and terror win, deciding everything. No more laws and elections. Many Republicans watched in shock as the Kremlin hijacked their party. But it was Republican operations, like Citizens United, that helped Russian dark money entrench the Kremlin's influence in the United States. More Americans must wake up that the loss of Ukraine is also the loss of our democracy. What's happening in Ukraine and the U,S. is an ongoing crime of state capture.
