Former African National Congress (ANC) Veterans' League spokesperson Carl Niehaus has been expelled from the ANC. The ANC's national disciplinary committee (NDC) found Niehaus guilty of six charges of misconduct. The charges are in connection with comments Niehaus made in July outside former president Jacob Zuma's residence in Nkandla, northern KwaZulu-Natal, where he protested against Zuma's incarceration for being in contempt of the Constitutional Court. In a letter dated 12 December 2022, ANC NDC chairperson Ralph Mgijima cited Niehaus' disparaging remarks against the judiciary as having led to him being charged by the party. Niehaus had called the Constitutional Court's ruling "a travesty of justice”. “The flimsy report of the state capture report of the Public Protector was used to force president Zuma to announce the state capture commission eventually. President Zuma did not want to do so of his own volition,” Niehaus said. According to the findings, Niehaus also said, “The law is being used selectively as an instrument to fight political and factional battles.” In his defence, Niehaus argued that the utterances were made while executing an order of the Umkhonto we Sizwe Military Veterans' Association as its national spokesperson. He also argued that the ANC does not have a policy on what utterances may not be made against the judiciary. The NDC, however, indicated that the ANC's national executive committee (NEC) in 2018 supported the establishment of the state capture commission under then Deputy Chief Justice Zondo and called on all ANC members to give full cooperation to the commission and respect its recommendations. Mgijima also highlighted that on 29 June 2021, ANC national spokesperson, Pule Mabe, reiterated the ANC's position on the Constitutional Court judgment when he said that although the party was going through a difficult period, the party “reaffirmed its commitment to upholding the rule of law and fulfilling the aspirations of our constitutional democracy”. ANC member Fikile Mbalula was among party leaders who testified against Niehaus. However, his testimony was later not given any consideration when passing judgment as the accused was not afforded the opportunity to cross-examine him. Niehaus brought former MKMVA treasurer-general Des van Rooyen to give testimony on his behalf. In his findings, Mgijima said the committee believed that the charges for which Niehaus had been found guilty were severe. “As such, the charged member's plea that he be sanctioned with a reprimand if found guilty is wholly inappropriate." The NDC resolved that “the charged member [Niehaus] is expelled from the ANC". In handing down such a hash ruling, Mgijima said the NDC had taken into consideration that the utterances were made by Niehaus “at a time when the circumstances surrounding the arrest and subsequent committal to prison of former president Zuma was very volatile as evidenced by the subsequent riots which took place in KwaZulu-Natal and parts of Gauteng and resultant loss of life and limb and damage to and loss of property”. The NDC found that Niehaus had not demonstrated any remorse and persisted in his view that the ANC was violating its constitution and his rights by disciplining him. “The NDC took into consideration the fact that the charged member is a senior and long-standing member of the ANC, had served a term of imprisonment for his political beliefs, and held strong and sometimes contrary views on the policies of the ANC and positions adopted by the NEC from time to time." Niehaus was not immediately available for comment.

President Cyril Ramaphosa is leading the African National Congress (ANC) branch nominations for party President with Zweli Mkhize also in the running as the party prepares for its upcoming 55th National Conference. Announcing the final list on Tuesday, the party's Electoral Committee chairperson Kgalema Motlanthe said 89% of the ANC branches have successfully participated in the nomination process, surpassing the 70% threshold required for the National Conference. The conference will take place between December 16 and 20 at Nasrec, in Johannesburg. A total of 3 543 out of 3 982 branches in good standing have held successful Branch General Meetings which produced the approved outcomes of the nominations for both branch delegates and National Executive Committee (NEC) candidates. Ramaphosa received 2 037 nominations from branches for President while Mkhize received 916. For the position of ANC Deputy President Paul Mashatile received 1 791 nominations, Ronald Lamola collected 427 and Oscar Mabuyane received 397. Battling it out for the National Chairperson position, Stanley Mathabatha collected 1 492 nominations, Gwede Mantashe received 979 votes and David Masondo received 501. For the Secretary-General position Mdumiseni Ntuli leads with 1 225 nominations, Phumulo Masuale received 889 and Fikile Mbalula garnered 749. Nomvula Mokonyane received 1 779 nominations for Deputy Secretary-General and Febe Potgieter received 905. The African National Congress (ANC) has delayed the start of its nomination processes for ANC leadership so that membership figures can be audited. The party was due to begin branch meetings on Wednesday, where ANC branches could nominate their preferred candidates for the party's top leadership as well as the national executive committee at the December conference. But the deadline for the renewal of ANC branch membership was extended, resulting in a delay. ANC spokesperson Pule Mabe said on Wednesday: "We are expected to finalise the audit process this week. The treasurer general will receive the report by Friday. The report will then serve before the special NEC on Sunday. A special NEC must adopt the final audited membership. When this is done, it constitutes credentials of the national conference."
One is as old as one feels, so goes the saying, but according to Pule Mabe, as long as you are not Thabo Mbeki's age, you are young. The ANC's national spokesperson has suggested that people under 50 should be considered “youth”. This is revealed in a leaked recording of last week's special ANC national executive committee (NEC) meeting convened to update members of the body on nomination and election processes for the party's 55th national conference scheduled for December as well as guidelines leading to the event. In the leaked clip, Mabe can be heard addressing the ANC's proposal to have 25% of the NEC positions reserved for young people.
South Africa's financial watchdog says it has reached an agreement with a pension fund for African National Congress (ANC) employees to get the party to pay it R10-million a month until its arrears are cleared. The Financial Sector Conduct Authority (FSCA) said on Thursday that the party had not been paying contributions to its staff provident fund, which has 535 members. "The African National Congress, which is a participating employer in the fund, has not met its obligations in terms of making regular retirement fund contributions into the fund," it said. The governing party has occasionally struggled to pay salaries to its staff on time. In January, some staff members picketed outside its headquarters at Luthuli House over outstanding wages. Last month members of the National Education, Health and Allied Workers' Union again accused the party of not paying salaries on time. The FSCA announcement shows that the party has also been deficient in paying contributions to the pension funds of employees. The watchdog said it had reached an enforceable undertaking with the fund to implement an agreement it has with the ANC to pay R10-million into the fund every month "until the arrear contributions are extinguished". The fund will also need to provide monthly updates to the FSCA about things like deductions from employees' salaries and how much it still needs to pay. It also needs to provide monthly updates to members on the status of the arrear contributions. Mvusi Mdala, a representative of ANC employees, said if the party did indeed pay the R10-million per month as outlined in the agreement, he hoped it would not come "at the further expense" of employees. ANC staff members had still not been paid their salaries for July, he said, which he described as an "unbearable situation". He said employees also didn't know when or whether they would receive their August salaries. FSCA commissioner Unathi Kamlana said in a statement that the onus on ensuring that there are no arrear contributions rested with the trustees of a fund. "Both employers and funds are reminded of the importance of treating their workers and members fairly by honouring their obligations as enshrined in various legislation," he said. ANC spokesperson Pule Mabe reportedly joked in July that "if the ANC was running a cash-in-transit heist", it would be able to say with certainty that "robberies" would give it enough cash to cover its staff's salaries.

Scores of protesters from different political parties gathered outside the Krugersdorp Magistrate's Court in Gauteng on Wednesday, for the expected court appearance of 80 people who were arrested for various offences in a police blitz. The police operation followed after the rape of eight women on a mine dump. To date, no one among the arrested suspects has been directly linked to the incident. The women were raped last week while filming a music video on the mine dump. Some of the men have been charged with being in the country illegally. DNA samples have been taken to determine if they were linked to the rapes. Members of the African National Congress (ANC), Democratic Alliance (DA) and ActionSA protested outside court. The protesters sang songs and held placards reading "Hands off our Women", and "Stop Rape". "We came here to join the picket line and communicate a clear message that we now need to go out and reclaim the streets of our communities. We can no longer allow criminals, illegal immigrants and rapists to roam around our streets without any action," said the ANC's Pule Mabe. "What happened here in Krugersdorp over the past week should serve as a wake-up call. We need our government to act [and] work with speed to deal with this issue of zama zamas (illegal miners), illegal immigrants, and illegal mining," he added. Mabe said the government should also compel mining companies to rehabilitate abandoned mines. "There are also environmental issues that affect our communities out there, and the dumps have been captured by criminals. "Also, there are people who want to turn South Africa into a playground. the things that they are not doing in their own countries. If you allow people to continue conducting illegal activities unattended, they then undermine your ability to function and govern," Mabe said. The DA's Gail Mphafudi, Mogale City MMC for health and social development, said they came to support the eight victims who were raped last week. "We are here to support the women to say 'No to gender-based violence', because we are seeing it is becoming a thing in SA, and it is unacceptable. "We are here today to support them to say that we stand with them against children and women abuse and gender-based violence," Mphafudi said. Mphafudi said illegal mining was a big problem on the Gauteng West Rand that was affecting infrastructure. "You don't even feel safe in your home because there might be a tremor that might lead to your house breaking down, so it is a health risk on its own. "It also poses a risk to people's lives because they are getting shot at and there is so much violence around zama zamas." She said Mogale City Mayor Tyrone Gray was working closely with law enforcement to deal with the issue. Most of the accused were from Lesotho, Mozambique and Zimbabwe. During the men's first appearance on Monday, the court heard that they were only facing charges of being in the country illegally. Some of them had previously been arrested on the same charge. They were deported but had returned. Twenty of the accused were juveniles, and their cases were transferred to the Children's Court.

The African National Congress (ANC) - as the national governing party which has overseen power utility Eskom for the past 27 years - noted with "grave concern" Eskom's announcement of Stage 4 load-shedding and says it may be deliberately done for "political ends". The party also admitted that it poured cold water on its manifesto promise of providing reliable energy. Eskom announced on Wednesday that it was pushing load-shedding to Stage 4 at noon on Wednesday, and this would continue until 05:00 on Friday. Stage 2 load-shedding would then be in effect until 05:00 on Saturday, as announced by the utility earlier in the week. "The latest bout of load-shedding is despite a commitment by the CEO of the utility to contain load-shedding and ease disruptions to power supply in mid-October," ANC spokesperson Pule Mabe said in a statement on Wednesday. "The ANC is further concerned that the announcement made by Eskom coincides with the first day of final examinations for thousands of matriculants across the country who must have the opportunity to study and write their exams uninterrupted by power outages. "Given the inconsistency in information and assurances received from the utility, the ANC is by all intents and purposes quite concerned that these acts may be the deliberate actions of some within Eskom for political ends." He said the ANC demanded "unequivocal answers" on the current state of power supply. "The mixed messages and lack of public transparency and accountability witnessed are a source of grave concern and suspicion," Mabe said. "It is also a direct affront to the ANC's commitment in our manifesto to ensure safe and reliable electricity supply to our communities." He said the ANC called for "leadership and transparency" in explaining to South Africans the state of power supply and to make an honest assessment on whether the right skills and leadership were at the utility's disposal under the current circumstances. "The anxiety and disruption meted upon our people by the inconsistency in messaging and failure to take the nation into confidence in the state of the grid must be condemned." Economic Freedom Fighters leader Julius Malema, on the campaign trail in Buffalo City on Tuesday, claimed the reintroduction of load-shedding was all part of a well-orchestrated, elaborate scheme by the ANC to steal votes from smaller parties. "Once the electricity switches off, we go stand next to the boxes, and no one is going to touch any box. There is no vote that is going to be stolen here," Malema said. The ANC responded, calling the allegations a "blue lie of the highest order". Meanwhile, in Cape Town, the Democratic Alliance's (DA's) mayoral candidate Geordin Hill-Lewis wrote an open letter to the city's residents, expressing his concern about load-shedding, particularly as the matric exams had started. "We, the people of Cape Town, should never accept the unacceptable. "The ANC is the real champion of the people, and all these others are Mickey Mouse parties." These were the words of African National Congress (ANC) president Cyril Ramaphosa to scores of supporters in Tshwane on Friday while canvassing for votes ahead of municipal elections. He was speaking in Ward 22 in Mabopane, Tshwane, where an ANC councillor Tshepo Motaung was recently gunned down. Motaung was shot over 20 times last month by unknown assailants. Ramaphosa's visit to the area comes just after Deputy President David Mabuza also went to Tshwane on an electioneering drive. The ANC lost Tshwane in 2016, and Ramaphosa said the party wanted to regain it. He said it was infighting that had led to the party losing power in 2016, and that this "would not be repeated". "You are in the trouble now because of the manner in which you voted, so lets go out in our numbers and vote for change, because the last time we did not go out in our numbers. "We should remove these pretenders that claim to work for the communities, and reinstate the ANC - the real champions of the people. The current municipality is only interested in the interests of a few minority, so you in the townships have been left to fend for yourselves. "Go out in your numbers and vote for change, because last time [in 2016] you did not go out in your numbers which resulted in this situation," said Ramaphosa. In 2016, the late then-chairperson in Tshwane Mapiti Matsena was the preferred candidate for the region over Kgosientso Ramokgopa. However, the Gauteng provincial executive committee and Luthuli House settled for then-MP and current Rural Development and Land Reform Minister Thoko Didiza as a so-called "compromise candidate". This move was followed by days of unrest across the metro, as people claiming to be Ramokgopa's supporters took to the streets and declared, "no Sputla [Ramokgopa's nickname], no vote". Later, the ANC lost control of the metro for the first time to a DA-led coalition government that has remained in charge ever since. 'You are setting a good example' Speaking on Friday, Ramaphosa added that "there should never be a situation where Tshwane is in the hands of another party". "Tshwane is the capital. The Union Buildings are in Tshwane. We can't therefore let this metro be in the hands of the opposition. This has to be rectified." Ramaphosa also praised the fact that the ward has since chosen a woman to stand as their ward candidate. "We are appreciative of the fact that in the ward you choose a woman, and you are setting a good example by choosing a woman that you trust and know will serve you." He added that, while past ANC candidates had disappointed communities, the current crop, including the newly-elected ward candidate in Mabopane, were not going to "steal from you, employ their friends and family members", but would priorities the needs of communities over their own. Ramaphosa's address also came after Defence and Military Veterans Minister Thandi Modise, her deputy Thabang Makwetla and Minister in the Presidency Mondli Gungubele were rescued after being held hostage by a group of military veterans who allegedly demanded R4.2-million each in special pensions. The ministers were meeting with the Liberation Struggle War Veterans (LSWV), comprising members of various armed groups that fought apartheid, including Umkhonto we Sizwe (MK), the Azanian People's Liberation Army (APLA) and the Azanian National Liberation Army (Azanla). The group demonstrated outside Luthuli House this week, leading to the evacuation of the ANC's headquarters. It remains unclear if whether an ANC member that voluntarily steps aside from a party position may also need to vacate their position as party deployee in government. This as the ruling party has reaffirmed that all its members facing serious criminal charges should voluntarily step aside or face being suspended from the party. The ANC is set to hold a special NEC meeting this coming weekend in order to formulate amongst other issues, the conditions and implications of its members choosing to step aside or being served with suspension letters. The first day of the ANC youth league's consultative national conference descended into chaos as disgruntled delegates vented out their anger on speakers. Yesterday some delegates kept shouting the name of former treasurer and presidential hopeful Pule Mabe, when speeches and messages of support were being delivered. The move was a protest against a decision to convert the conference which was supposed to elect leadership into a consultative one. The decision was announced on the eve of the conference when delegates were already on their way to University of Johannesburg's Soweto campus, where the conference is taking place.
