Today's guest is historian and closet economist Clifford J. Rogers. Cliff is Professor of History at the United States Military Academy at West Point. Before arriving in West Point, he was a Fulbright fellow at the Institute for Historical Research in London and an Olin Fellow in Military and Strategic History at Yale. He was also a Leverhulme Visiting Professor at the University of Wales, Swansea. Cliff triple-majored in Economics, History, and Policy Studies for his BA at Rice University, and earned his MA and PhD in History from The Ohio State University. Cliff is the author of War Cruel and Sharp: English Strategy under Edward III, 1327-1360 (Boydell and Brewer) and Soldiers' Lives through History: The Middle Ages (Greenwood), among other works. He has twice won De Re Militari's Verbruggen Prize, once for War Cruel and Sharp and again for Soldiers' Lives, and also received that association's Bachrach Medal. Cliff is the recipient of the Royal Historical Society's Alexander Prize Medal and has been awarded the Army Historical Foundation's Distinguished Writing Award on three occasions. In addition to his monographs, Cliff has edited and co-edited multiple volumes, including the Oxford Encyclopedia of Medieval Warfare and Military Technology, which received the Society for Military History's Distinguished Book Award. He has published articles in The Journal of Medieval History, War in History, English Historical Review, and the Journal of Military History, among many others. His article “The Military Revolutions of the Hundred Years War” was awarded the Society for Military History's Moncado Prize. Cliff co-founded The Journal of Medieval Military History and serves as co-Senior Editor of the digital West Point History of Warfare. In 2016, he received the George C. Marshall Foundation Prize for the Use of Digital Technology in Teaching Military History for his work on that project. Professor Moore is a scholar of foreign relations law, international law, international human rights, and international development. Professor Moore has taught international law, international human rights, U.S. foreign relations law, civil procedure, legal scholarship, a plenary powers colloquium, and an international religious freedom clinic. As a teacher, he has been recognized with the University's R. Wayne Hansen Teaching and Learning Fellowship, the BYU Law Alumni Association Teacher of the Year Award, and the Student Bar Association First Year Professor of the Year Award. He is a member of the American Law Institute. As a human rights expert, Professor Moore serves on the Organization for Security and Cooperation in Europe's Moscow Mechanism. In 2020, he was elected to a brief term on the Human Rights Committee, a body of independent experts that oversees states' compliance with the International Covenant on Civil and Political Rights. Professor Moore also serves as an Associate Director of the International Center for Law and Religion Studies, which seeks to secure the blessings of religious freedom and belief for everyone. Between 2017 and 2019, Professor Moore served, variously, as the Acting Deputy Administrator and General Counsel of the U.S. Agency for International Development, the federal government's lead agency for international development and humanitarian assistance. From 2016 to 2017, he was the Associate Dean for Research and Academic Affairs at Brigham Young University Law School. He was a Visiting Professor at the George Washington University Law School from 2008 to 2009. Before joining BYU, Professor Moore clerked for Justice Samuel A. Alito, Jr. during the U.S. Supreme Court's 2007 Term. From 2003 to 2007, Professor Moore was an assistant and then associate professor at the University of Kentucky College of Law. He arrived at the University of Kentucky after researching and teaching at the University of Chicago Law School as an Olin Fellow from 2001 to 2003. From 2000 to 2001, Professor Moore clerked for Judge Samuel A. Alito, Jr. on the U.S. Court of Appeals for the Third Circuit. From 1996 to 2000, he was an Honor Program trial attorney at the U.S. Department of Justice, Civil Division, Federal Programs Branch. Professor Moore is a summa cum laude graduate of Brigham Young University Law School, where he served as Editor in Chief of the Law Review and graduated first in his class. He received his BA from Brigham Young University, where he was a Benson scholar and graduated summa cum laude, with University Honors, and as co-valedictorian of his college. Chester "Checker" E. Finn, Jr., scholar, educator and public servant, has devoted his career to improving education in the United States. At Fordham, he is now Distinguished Senior Fellow and President Emeritus. He's also a Senior Fellow at Stanford's Hoover Institution. Finn served as Fordham's President from 1997 to 2014, after many earlier roles in education, academe and government. From 1999 until 2002, he was John M. Olin Fellow at the Manhattan Institute and previously at Hudson Institute. In 1992-94, he served as founding partner and senior scholar with the Edison Project. He was Professor of Education and Public Policy at Vanderbilt University from 1981 until 2002. From 1985 to 1988, he served as Assistant Secretary for Research and Improvement and Counselor to the Secretary at the U.S. Department of Education. Earlier positions include Staff Assistant to the President of the United States; Special Assistant to the Governor of Massachusetts; Counsel to the U.S. Ambassador to India; Research Associate at the Brookings Institution; and Legislative Director for Senator Daniel P. Chaim Saiman is a world renowned scholar who holds the Chair in Jewish law at Villanova University.He is the author of the book,Halakhah: The Rabbinic Idea of Law which has met with wide acclaim.Professor Saiman regularly guides law students in the finer points of contracts,insurance regulations and coverage disputes and stresses the responsibilitythat citizens have towards each other'sprivate property.He also is an instructor each semester to a select group of aspiring lawyers taking his groundbreaking courses in Jewish Law.Rabbi Kivelevitz questions Professor Saiman on the challenges and rewards of giving over information culled primarily from the Talmud and the Halachic codes to students that are representative of all walks of American life.Saiman spells out his approach for conveying honestly the finer details of sugyos to non-Jews,without resorting to obvious apologia.He articulates his case that the Yeshiva trained students in his lectures are gaining an appreciation for Gemara material in mature authentic ways that were unavailable in the Yeshivos they studied in.Taking Hashavas Aveidah and Kibbud Av as examples ,the Professor indicates how the sources studied with respect and depth yield telling precedents to the foundations of American legal principles that continue to be fleshed out by legal scholars.Saiman sees his Yeshivish students as the vanguard of a growing dynamic sort of ba'al habos, thoroughly American, assiduous and identifiable as a Charedi. Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast, Good Law | Bad Law, is joined by Brian Fitzpatrick, a law professor at Vanderbilt University and self-proclaimed “life-long Republican”, to discuss class action lawsuits, and specifically, Brian’s recent book on the subject, The Conservative Case for Class Actions.   In his new book, Brian makes the case for class action litigation a conservative’s view point. Arguing that conservatives, and even libertarians, believe that markets need at least some policing to thrive, from laws that enforce contracts, to laws that prevent companies from committing fraud, to laws that prohibit price fixing. Aaron and Brian break down what a class-action is, what the requirements are, and just how important they are to protect consumers from corporate wrongdoing.   Brian illustrates the different types of conservatives he sees and explains that there are only two ways of policing the marketplace: 1) private lawsuits filed by private citizens and their lawyers or 2) more government regulation. He argues that, for the same reasons conservatives prefer other private sector solutions to problems, they should prefer private enforcement of the law as well. Acknowledging that the class action is not perfect, Brian shows, in his book and in today’s episode, that our system is working better than one might expect given all the widespread misunderstanding and misinformation about class action lawsuits.  He also suggests a few tweaks that he hopes will persuade opponents to keep the class action around for the next generation of consumers, employees, and shareholders alike.   Brian Fitzpatrick’s research at Vanderbilt focuses on class action litigation, federal courts, judicial selection and constitutional law. A graduate of Harvard Law, Brian went on to clerk for Judge Diarmuid O’Scannlain on the U.S. Court of Appeals for the Ninth Circuit and Justice Antonin Scalia on the U.S. Supreme Court. After his clerkships, Professor Fitzpatrick practiced commercial and appellate litigation for several years at Sidley Austin in Washington, D.C., and served as Special Counsel for the Supreme Court Nominations to U.S. Senator John Cornyn. He joined Vandberbilt’s law faculty in 2007 after serving as the John M. Professor Li talks about his research methodologies and findings on Chinese companies' compliance with U.S. regulatory institutions.   Dr. Ji Li is professor of law at Rutgers University and a member of the associate faculty of the division of global affairs. Professor Li received his Ph.D. in political science from Northwestern University and J.D. from Yale Law School where he was an Olin Fellow in Law, Economics and Public Policy. Before joining the Rutgers faculty, he practiced corporate and tax law for several years in the New York office of Sullivan & Cromwell. Professor Li’s teaching and scholarship explore a broad range of topics including international business transactions, taxation, contracts, comparative law, Chinese law and politics, and empirical legal studies. With a trade war brewing between Washington and Beijing, mounting public scrutiny, and repeated warnings by U.S. officials that Chinese investment in certain industries constitutes a national security threat, Chinese investment and commercial activity in the United States face many challenges, which cast doubt on the trajectory of Chinese outward direct investment in the United States. As these issues flare up, Chinese companies in the United States face another hurdle that has not garnered the same attention: U.S. corporate law and regulation. As Chinese firms expand around the United States, their presence in American courts grows. Chinese companies, including state owned enterprises, must adapt to adhere to American corporate governance standards and legal requirements that are not prevalent in China. These Chinese companies face a steep learning curve as they navigate the legal and regulatory complexities of a market-based economy. In a new book, The Clash of Capitalisms? Chinese Companies in the United States, Rutgers University Law School Professor Ji Li analyzes the adaptation of these firms to U.S. tax, non-discrimination, and employment law, as well as CFIUS compliance. Professor Li shared his research, and discussed the future of Chinese investment in the United States and other free market economies, on September 20, in New York City.   Dr. Ji Li is professor of law at Rutgers University and a member of the associate faculty of the division of global affairs. In this book Kathleen Burk examines the different kinds of power the two empires have projected, and the means they have used to do it. What the two empires have shared is a mixture of pragmatism, ruthless commercial drive, a self-righteous foreign policy and plenty of naked aggression. These have been aimed against each other more than once; yet their underlying alliance against common enemies has been historically unique and a defining force throughout the twentieth century. This is a global and epic history of the rise and fall of empires. It ranges from America's futile attempts to conquer Canada to her success in opening up Japan but rapid loss of leadership to Britain; from Britain's success in forcing open China to her loss of the Middle East to the US; and from the American conquest of the Philippines to her destruction of the British Empire. The Pax Americana replaced the Pax Britannica, but now the American world order is fading, threatening Britain's belief in her own world role. Speaker: Kathleen Burk is Professor Emerita of Modern and Contemporary History at University College London. Her general field is international history, concentrating especially on politics, diplomacy and finance. Kathleen specialises in the twentieth century, although publishes on earlier periods as well. Her primary area of research is Anglo-American relations, on which she has published three books and a number of articles, but she has also written on the history of merchant banks, and on international history generally. Furthermore, Kathleen writes on wine and its history, on which she has published a book and a number of articles.' Her newest book, 'The Lion and the Eagle: The Interaction of the British and American Empires, 1783-1972', will be published next June.' This lecture is given annually in memory of Professor Saki Ruth Dockrill, who first came to the Department of War Studies in 1983 as a research student supervised by successive Heads of Department, Wolf Mendl and Lawrence Freedman. She went to Yale University as a John M. Olin Fellow in 1988-89 before returning to the Department as a MacArthur Fellow and then in 1992 as a lecturer in war studies; promotion to senior lecturer followed in 1997 and then appointment to a personal chair as Professor of Contemporary History and International Security in 2003. Professor Dockrill was a leading international historian, with four substantial, well researched books to her credit and five edited or co-edited. One of her best books was a study of the defence policy of Harold Wilson's two Labour Governments, 1964-70, and she made a notable contribution to the revival of Wilson's reputation as Prime Minister that had begun in the early 1990s.
