In episode three of this special series of Defensible Decisions discussing Ogletree's Talent Risk Assessor, shareholders Scott Kelly (Birmingham/Washington) and Chris Near (Columbia) are joined by Chrissy Blantz from the firm's Data Analytics team to examine separations and terminations—an area of the employment lifecycle where legal risk is often most acute. Using a hypothetical multi-state employer, the speakers walk through how a statistically significant flag in overall separation rates can be disaggregated by involuntary versus voluntary terminations and further broken down by separation reason codes to identify the actual driver behind the pattern, in this case, disproportionate use of temporary, time-limited roles. The episode illustrates how a data-driven, legally informed inquiry, conducted under privilege and properly documented, builds a defensible position even when the underlying cause turns out to have a legitimate explanation.

Kevin Surace, Chief Executive Officer at TokenCore, opens with the attack path he says is doing the most damage right now. A phishing email carries a PDF and no links, so it clears the filters. The domain is one character off from the real one, the site is pixel perfect because AI built both the page and the message, and the employee approves an auth prompt they were already expecting. The code was real and the approval was real. Kevin Surace points out that auth apps and passkeys run over cellular and Wi-Fi, so the prompt has no way to know the request came from ten thousand miles away. Anything a person can read or hand over can be shared, and by his account an attacker needs about thirty seconds of trust to get it. Passkeys moved the target rather than removing it. Kevin Surace counts 39 separate passkey attacks in the wild within two weeks of Microsoft telling customers to migrate, and points to Michael Grafnetter of SpecterOps, who presented passkey and Entra research at Black Hat. He walks through the FIDO2 counter that WebAuthn treats as optional so shared passkeys can move between devices. What changes with TokenCore in the mix is where the proof sits. Kevin Surace describes signing into Entra in under two seconds, both passwordless and ID-less, over secure Bluetooth, with the device carrying no apps and no screen. Proximity holds it within three feet of the computer being logged into, the credential stays bound to the original domain, and fingerprints stay off the network. Agents raise the same question in a new place. Kevin Surace describes a policy where an agent action above a million-dollar check needs a person to approve it, and notes that another agent, a hacked one, or a bad actor can clear that approval just as easily. A biometric gate is what tells you the CFO was actually in the room, which is a governance answer as much as a security one. For CISOs, identity architects, and risk owners, the question worth asking is what an identity program looks like when the proof of a person becomes the control, and how much residual risk that removes from privileged access, financial approvals, and agent workflows. Anja Huwe växte upp i ett välbärgat hem utanför Hamburg. Hon övervägde en karriär som makeupmodell innan hon hörde The Adverts låt "Bored teenagers" och blev punkare. Tillsammans med fyra andra unga kvinnor bildade hon gruppen Xmal Deutschland som debuterade med singeln "Scwarze Welt" 1981. Anja flyttade hemifrån och delade lägenhet på Reeperbahn med flera blivande Einstürzende Neubauten-medlemmar. En av dem, Alexander Hacke (som vid den här tiden var ihop med Christiane F, Tysklands mest kända ex-heroinist), föreslog att Anja och hennes vänner skulle försöka sig på en karriär i London eftersom de lät så brittiska. Skivbolaget 4AD nappade och snart turnerade Xmal Deutschland med Cocteau Twins och fick en stor publik på andra sidan kanalen. Albumen "Fetish" och "Tocsins" hjälpte till att forma den genre som snart blev känd som "goth". 1990 splittrades Xmal Deutschland och Anja Huwe sadlade om till tv-producent på Viva, Tysklands motsvarighet till MTV, där hon gjorde det elektroniska dansmusikprogrammet "Housefrau". Men hon skrev ingen egen musik utan blev i stället bildkonstnär. Först 2024 solodebuterade hon med albumet "Codes" och nu hälsar hon på hemma hos Strage för att prata om tyska punkupplopp och om sina blandade känslor inför att hyllas som gothdrottning. In this episode, Dave and Jamison answer these questions: I work for a small software company on a team of about 7 or 8 engineers. I like working here. I like the people, the autonomy, the pay, my boss, and the stack among other things. I try to remind myself of this regularly so I don't take it for granted. I've been here for about 2.5 years and would love to continue working here. Our CTO, like many, has become a big AI cowboy coder. Every few months, he vibe codes a new project and then decides to interrupt the full workloads that we have a limited number of engineers to do to hand his project off to be cleaned up, worked into the product, and solve all of the problems that remain once actually put into practice. This usually ends up going to a different engineer per project, who is then tied up with the CTO's whims and is no longer available to do the work planned by product. Our EM knows this and knows the frustration and lost velocity, but what can he do? (rhetorical, not the question) Most recently, I was tasked with implementing some reporting dashboards he did into the product, but he specifically asked me to make it in such a way that he can continue to work on and add to because he can't be bothered to run the actual product. This is very concerning to several of us. He has no clue what he's writing or how bad it is. We've talked about perhaps making him do PRs, but a) who can make him, he's the CTO, and b) he'll have no clue what to do with PR pushback given that he has no clue what he wrote. And again, who can make him actually fix it if he asks us to rubber stamp it? (rhetorical, not the question) I've been listening to the show for years and I've talked to friends at other companies, so I know this is everywhere. Is it as everywhere as it seems? Is it worth finding a new place to work where the CTO isn't running so rampant? As I stated before, I'd rather not leave, but if I talked about that as a concern, I don't want it to sound like an ultimatum, even if maybe it is at some level. Is this just the new reality for us, or is there something that can be done? I am a senior software engineer at a big tech company. I live in central Europe but my team is in the US and I'm 9 hours ahead. I have 7:30 pm meetings and sometimes take an hour before and/or after this meeting to prep or follow up. Previously I slept in later and started later to deal with these meetings. However, now my daughter is starting kindergarten and I wake up early (5-6AM) to be with her, drop her off, etc. Now in the evening meetings my brain is fried and I can't even articulate myself well. The next day I think about so many things I wish I had said in those meetings. I can't quit as I make 160K right now and I would only be making 60-80K tops in my country and have some financial commitments. Relocation to the US is also not an option because I have kids and don't want them to move. So far I have been skipping meetings and my manager has not expressed concern but I feel so detached from my team. I don't even know what most of my peers are working on. It feels like I am out of ideas to make this better. Please share your space wisdom with me :)
