In this episode, we're dealing with some heavy allegations. Jim Sarver claims Warren County District Attorney Rick Hernan, in 2002 and 2003, tried to set him up to take the wrap for Damien's murder, after he was arrested on unrelated charges. Sounds crazy, right? Well, first let's talk to Rick, and then Sarver, and then let's see what happened in an interstate case involving Warren County, Pa., and Chautauqua County, N.Y., in the late 1980s - the murder of Kathy Wilson. Hernan and Det. John Herzog both participated in that case as well. What's the thing we learned a few episodes about lessons? When we don't learn them we're destined to repeat them.... --- Send in a voice message: https://anchor.fm/letsfinddamien/message

This week on Suns Mode looks much better than the last. The Suns are finally winning games on the schedule again. The team has also made a big decision. Robert Sarver will no longer be the controlling owner of the Suns as the team has found someone to purchase the stake. Hear a brief bit about Mat Ishbia during the episode. The Suns had a horrible injury report last week. It slightly improves this time around. The weather outside is frightful, but the sports world is so delightful. I'll have some shiny gifts under the tree, but some coal in a stocking or two as I spread some cheers and jeers over the next hour. On deck: (3:58) After a birthday shoutout and sending well wishes to those celebrating Christmas, Hanukkah, Kwanzaa during this holiday season, I begin the podcast with the shocking news of legendary Steelers RB, Franco Harris, passing away at the age of 72. He transitions just days before the 50th anniversary of the greatest play in NFL history (The Immaculate Reception), the docuseries 'A Football Life' that will air Friday night on the anniversary of the play, then have his number retired on Christmas Eve where the Raiders invade Pittsburgh, which are the two teams in the divisional playoff game 50 years prior that made this play famous. Week 16 has a few interesting matchups, including the Thursday night contest between the top two quarterbacks drafted in 2021 (Jaguars Trevor Lawrence and the Jets Zach Wilson) as both are fighting to position themselves in the AFC playoff hunt. I'll go through a laughable Christmas Day schedule, but highlight the key games that'll have postseason implications as we're down to the final couple of weeks of the year. I'll also get into where the NFL Sunday Ticket is moving to after almost three decades with DirecTV. (29:21) I make a brief mention of the NHL as it's relatively quiet. The Hurricanes have stormed to the top of the Metropolitan Division, tied with the Devils. Besides that, all is pretty mellow. (29:53) What's not mellow is the activity of the New York Mets this offseason. They shockingly sign Carlos Correa as his deal with the Giants bottomed out due to red flags regarding his medical past. There is SO much to unpack here. The amount owner Steve Cohen has spent this offseason, the payroll ballooning to over $380 million dollars, the pressure and expectation of this team, the bullseye on their back, which all culminates to one thing. They are the new Evil Empire. I'll touch on a few signings over the past few days (i.e. Seth Lugo, Noah Syndergaard, etc.) as I believe the free agent period will start to quiet down after an active past couple of weeks. (47:03) There's a new owner in the NBA circles as Mat Ishbia, a CEO of a mortgage lending company has purchased the Suns and Mercury for a record $4 billion dollars. We can say good riddance to erstwhile owner Robert Sarver and all of his baggage and filth over the past several years. What's going on with the Warriors? They'll limp home after a 1-5 road trip, where on the back end lost to the Knicks and Nets by 38 and 30, respectively. Is there something going on behind the scenes as they try to get their season on track? I'll debate the 2023 nominees for the Naismith Basketball Hall of Fame. We know Gregg Popovich, Dwyane Wade and Dirk Nowitzki are no-brainers. What about Tony Parker? Or Pau Gasol? (56:20) The Masters are telling the LIV golfers to come on down to Augusta in April. There's no surprise that they've elected for them to participate. What about the PGA Championship, the US Open and Open Championship? Will they follow suit? Today's word of the day is ‘brooms' as in swept as in cleaning the floor as in 4-0 as in the Houston Astros are headed to the World Series after shutting down the New York Yankees in the Bronx last night. The Yankees wanted this. The Yankees fans wanted this. The Yankees got more than they could handle. (19:30) The Philadelphia Phillies are headed to the World Series. Bryce Harper and Rhys Hoskins bats exploded. The starting pitching has taken over. They are playing out of their minds! The San Diego Padres blew the lead in back to back games and are headed home. (32:35) Review: Bullet Train. (35:30) NPPOD. (38:50) Adam Silver met with the Phoenix Suns employees and held a Q+A. It was very odd because of the questions he chose to answer. He addressed the Sarver situation. He addressed tanking? Why would he do that? I hope you had a great weekend! Have an even better Monday! Last week, Robert Sarver, the owner of the NBA's Phoenix Suns and the WNBA's Phoenix Mercury, announced he would be selling both teams. The decision came after ESPN revealed nearly two decades of harassing behavior by Sarver, and after the NBA slapped him with a one-year suspension and $10 million fine. How was Sarver's bullying able to go unchecked for so long? Does his departure signal a positive step forward for professional U.S. basketball, or a continuation of the status quo? Guest: Amira Rose Davis, assistant professor of Black studies at the University of Texas at Austin, and co-host of the feminist sports podcast, Burn It All Down. The aftermath of the Robert Sarver investigation has been anything but what the NBA had hoped. Sarver, the subject of a massive investigation by ESPN and later the NBA, was suspended one year for racist and misogynistic behavior. Fans and players felt it wasn't enough, and had been calling for the Phoenix Suns' owner's banishment from the league. The WNBA's Phoenix Mercury, who Sarver also owns, came forward and said they were excluded from the investigation altogether. One week later, Sarver has put both teams up for sale. Baxter Holmes, the ESPN reporter who kicked off this entire saga, explains why Sarver suddenly changed his mind about selling, what this means for the NBA…and how this story is far from over. In this episode, Lindsay Gibbs, Shireen Ahmed and Jessica Luther break down the recent report on the behavior of Robert Sarver, owner of the Phoenix Mercury and Phoenix Suns basketball teams. But first, they talk about the retirement of tennis great Roger Federer. Then, they dig into a report released by a law firm and commissioned by the NBA to look into allegations of of Robert Sarver's sexist and racist violations of common work place standards. The NBA responded by fining Sarver $10 million and suspending him for one year. The team talks about the damning results including statements from over 100 individuals that witnessed many accounts of sexist, vulgar, and racist behavior by Sarver as well as how Sarver uses the WNBA team the Mercury as a shield for his actions. They also discuss reactions from players, sponsors, and the league, as well as comparable cases of deplorable owners, like Donald Sterling, in recent years. Following this discussion, they preview a special Patreon segment about NBA commissioner Adam Silver's disappointing reaction to the report on Sarver, saying team owners are held to different standards than everyone else. Then, you'll here a preview of this week's interview with Sabreena Merchant, basketball writer for SB Nation, on a WNBA finals recap and budding off season storylines. Next, they burn some of the worst in sports this summer on the Burn Pile. Then, they celebrate those shining light, including Torchbearers of the Week, the Las Vegas Aces, who won the franchise's first WNBA title over the Connecticut Sun. Last week, after the NBA announced a one year-suspension of Phoenix Suns owner Robert Sarver, many NBA players and stakeholders spoke out: saying the punishment wasn't strong enough. Sarver was accused of racist, sexist, and misogynist behavior by scores of employees, chronicled by ESPN in an investigation from fall 2021. It's a situation that in some ways mirrors that of former Los Angeles Clippers owner Donald Sterling, who was banned for life from the NBA when audio tapes revealed he had made racist statements. But thus far, the NBA has maintained that Sarver's behavior does not warrant the same punishment as Sterling's. So today, Brian Windhorst explains why the NBA ruled as it did with Sarver, whether the backlash from the players will amount to anything, and what the whole affair says about the balance of power in the NBA. Lakers fans have been looking for signs all season that Russell Westbrook is on his way out of town. This week, we learned his 13,500 square foot Brentwood home is indeed on the market. Does that mean the trade rumors are coming to fruition? Is he on his way out of town? Not so fast. Ever since it turned out Kevin Garnett buying a house in Malibu didn't in fact mean he was a Future Laker, we've understood the relationship between real estate deals and NBA transactions is tenuous. Could Westbrook know something we don't? Obviously. He's been on the block all summer, and nothing outwardly has changed with his situation. Maybe inwardly - meaning with Westbrook, Rob Pelinka and so on - some agreement has finally been forged. But... probably one doesn't really have much to do with the other. Westbrook, even if he's traded to Salt Lake City, won't be playing there and still will own a house in Los Angeles. So sorry Lakers fans. Westbrook may be traded yet, but the house was likely going on the market either way. Meanwhile... The Lakers have some questions facing them once camp opens. A big one? What does the starting lineup look like? It's easy to come up with the five people you THINK will be suiting up for Darvin Ham at the opening jump ball this season. But who SHOULD be in that group? And what exactly does "should" mean in this context? HOSTS: Andy and Brian Kamenetzky SEGMENT 1: Russell Westbrook's house is up for sale. First, it's beautiful. Second... it doesn't mean he's being dealt soon. SEGMENT 2: Why the Westbrook trade saga is just so different than others. Plus, pushback on Sarver from inside the house. SEGMENT 3: Who should start? It's not been a good week for the NBA. While we inch closer to training camps and the start of all the fun stuff, the league announced it would be suspending Phoenix Suns owner Robert Sarver for a year and fining him $10 million for ... well, a tremendous amount of racism and misogyny that permeated the organization for years. An independent review confirmed the core of what ESPN's Baxter Holmes revealed in a report last year, and put the league in a postion where it had to act. Still, the consensus is that Sarver got off easy, and when Silver spoke to the media about it Wednesday, he seemed to confirm that different rules exist for owners vs. players, when it comes to conduct. Certainly Lakers star LeBron James seemed ticked, Tweeting his disapproval. As did Chris Paul. Others will surely follow. But Silver inelegantly noted the League's hands are tied, insofar as it comes to removing Sarver from his team. They can suspend him, and could have suspended him longer. But removing him as owner? That's a taller order, full of courtrooms and legal jousting. So is this a situation more like the Clippers, when Donald Sterling was suspended for life, and eventually squeezed to sell the team? Is it more like the investigation that revealed deep problems in the culture of the Dallas Mavericks? Something in between? What does the league think is going to happen next? And finally, how do fans react when ownership does things they're ashamed of (or should be), while the team is quite good? For a long time, the Suns under Sarver were seen as bad not just because Sarver's personality has always been suspect, but because he was seen as cheap. Even when Phoenix was winning, Sarver wouldn't spend to sustain it. How much honor would fans trade for a shot at winning? What are they willing to overlook? Why, for all of their problems, does this sort of thing (thankfully) not seem to have happened in El Segundo, even while other issues persist? HOSTS: Andy and Brian Kamenetzky SEGMENT 1: The NBA punishes Robert Sarver. LeBron James responds. SEGMENT 2: Did the NBA let Sarver off easy? If so, why? SEGMENT 3: How much are fans willing to compartmentalize if it means a winning team? Why doesn't this sort of thing happen with the Lakers? Support Us By Supporting Our Sponsors!
