As our country heads into a pivotal 2024 election, we unpack the creation and the legacy of one of the most significant legislative achievements in American history, the 1964 Civil Rights Act. The 60-year-old Civil Right Act – bold, imperfect at creation, and controversial – demanded a fundamental fairness in American life that today remains an unfinished task. In June 1963, President John Kennedy urged Congress to enact a comprehensive civil rights bill, driven by widespread resistance to desegregation and the murder of civil rights activist Medgar Evers. Following Kennedy's assassination, President Lyndon Johnson championed the bill, ultimately securing its passage the following year, despite intense resistance that included a 54-day filibuster by opponents. At the bill's signing on July 2, 1964, President Johnson was joined by Dr. Martin Luther King, Jr. and other civil rights crusaders. The Civil Rights Act barred unequal voter registration requirements, banned discrimination on the basis of “race, color, religion, or national origin” in places of public accommodation, in public education and in federally-assisted programs, banned discrimination based on “race, color, religion, sex, or national origin” in hiring, and expanded the U.S. Commission on Civil Rights. The passage of the Civil Rights Act was a watershed moment in American history. It effectively ended the era of notorious “Jim Crow” laws, previously upheld by the Supreme Court, which permitted racial segregation under the pretext of “separate but equal.” Since 1964, Congress has expanded the Civil Rights Act to strengthen the protection of essential civil liberties. Nate Feltman is co-owner of the IBJ Corporation, publisher of the Indianapolis Business Journal, the Indiana Lawyer and the Court & Commercial Record. Nate also is the CEO of NJF Consulting, LLC, which provides acquisition and business consulting services. From 2010 - 2017, Nate was President, CEO and co-owner of Home Health Depot, Inc. (HHD) and its subsidiary, Genesis Healthcare Services, LLC, providers of complex rehabilitation mobility equipment, hospice, respiratory and home medical equipment. During his tenure, HHD grew from one location in Indianapolis, to 20 locations in 6 states, and from 30 employees to 240 employees, while quadrupling revenue.  Nate was also a partner with the law firms Faegre Baker & Daniels and Ice Miller, in Indianapolis, and Altheimer & Gray in Chicago, where his practice focused on representing public and private companies with their merger and acquisition activities, as well as advising local governments on public-private partnerships and economic development strategies. Before his U.S. legal experience, Nate spent nearly four years in Moscow, Russia (1994-1998) with the international law firms Baker & McKenzie and Steptoe & Johnson, where he represented companies seeking to do business in Russia. Last week, the European Court of Justice released its much awaited decision in Data Protection Commissioner v Maximilian Schrems, commonly known as Schrems II, which addressed which privacy requirements governments and corporations within the European Union will be required to secure before participating in international data transfers. The court's decision casts serious doubt on many of the measures currently in place, most notably in relation to the United States's own national security and surveillance activities, and thus raises new questions about how the European Union would continue to interact with the global digital economy. To discuss these developments, Scott R. Anderson sat down with Peter Swire, professor of law and ethics at the Scheller College of Business at the Georgia Institute of Technology and himself a former privacy official in the Clinton and Obama administrations, and Stewart Baker, currently of counsel at Steptoe & Johnson and previously the assistant secretary for policy at the Department of Homeland Security during the George W. Former Governor of Puerto Rico Luis G. Fortuño is the head of Steptoe & Johnson's corporate practice. He represents investment funds and Fortune 500 companies in regulatory, public policy, public-private partnership (P3) and project finance, finance, and other corporate matters in the United States and throughout Latin America. Luis' 12 years of government service includes serving as Puerto Rico's governor and as its sole representative in the U.S. House of Representatives. Under his leadership as governor from 2009 to 2012, Luis's signature public-private partnerships law paved the way for two of the largest recent infrastructure investments in the U.S., one in Puerto Rico's highway system and the island's main international airport. Other P3 transactions during his tenure included schools, energy projects, and ferry services. Their paper, "The Privacy Paradox II: Measuring the Privacy Benefits of Privacy Threats," uses empirical data from Google consumer surveys to study how many people actually experience the technologies often accused of eroding privacy as increasing their privacy instead.  In an event at the Brookings Institution, Ben sat down with Stewart Baker of Steptoe & Johnson and Amie Stepanovich of Access now to discuss the paper.
