We're joined this month by William A.( “Sandy”) Darity to discuss reparations for Black Americans. Sandy Darity is Samuel DuBois Cook Professor of Public Policy, African and African American Studies, and Economics and the director of the Samuel DuBois Cook Center on Social Equity at Duke University. A founding theorist of stratification economics and foremost scholar of the racial wealth gap in the United Stats, Darity is perhaps best known for his committed public advocacy for acknowledging, redressing, and resolving histories of racist violence against enslaved black people and their descendents through a federal program of reparations for black Americans. In April 2020–just weeks into the COVID-19 pandemic and two months before the global uprisings that followed the murder of George Floyd–Darity and co-author Kirsten Mullen published the book From Here to Equality: Reparations for Black Americans in the 21st Century. We speak with Professor Darity about this book–including its conception, reception, and circulation over the last few years. We also ask Darity about related projects like his proposals for “Baby Bonds” and a Federal Job Guarantee. Welcome to the gospel greats.Shadrach Meshach Lockridge was the past or Calvary Baptist Church, a prominent African-American congregation in San Diego, California, from 1953 to 1933. He was known for his preaching across the United Stats and around the world.Lockridge was born in Robertson County, Texas, the oldest of eight children and the son of a Baptist minister. A graduate of Bishop College in Marshall, Texas, he worked for two years as a high school English teacher. In 1940 in Dallas, he felt led to preach.He held doctorates and numerous honorary degrees, and was often sought as a public speaker, even after he retired in 1993. He served as guest lecturer at numerous schools and universities and on the faculty of several others, including the Billy Graham School of Evangelism. Lockridge was active in the civil rights movement, and under his leadership Calvary Baptist hosted several of its leaders, including Martin Luther king Jr. Lockridge was great with words, and his best known message is "Amen" ("That's My King").Lockridge was born March 7, 1913, and he died April 4, 2000. Suzanne DiMaggio specializes in what is called Track Two diplomacy with countries that have limited or no diplomatic relations with the United Stats. In practice, this has meant that she's spent countless hours over the last nearly twenty years in meetings with North Koreans and Iranians and those encounters have lead to some major diplomatic breakthroughs.    We kick off defining our terms. She explains what Track Two diplomacy means, as opposed to, say "back channel" diplomacy. We then preview an upcoming major summit between the Kim Jong UN and South Korean president Moon Jae-in. Bills Highlighted in This Episode H.R. 1155: Searching for and Cutting Regulations that are Unnecessarily Burdensome Act of 2016 (SCRUB Act)" Retrospective Regulatory Review Commission Establishes a new five-year commission that will review government rules to determine which ones should be eliminated "to reduce the costs of regulation to the economy." The Chairman will be appointed by the President and must have "experience in rulemaking". The other eight members will come from lists created by the majority and minority leaders in Congress of "individuals learned in rulemaking". The commission will have subpoena power and "the attendance of witnesses and the production of evidence may be required from any place within the United Stats at any designated place of hearing within the United States." The bill appropriates $30 million which are available until expended. The commission members will be paid, and will be given travel expenses including a per deim. The commission will hire staff, who will also be paid. The commission can hire "experts or consultants", and may "lease space and acquire personal property" "to the extent funds are available" The commission will review the Code of Federal Regulations to find rules "that should be repealed to lower the cost of regulation to the economy". Priority will be given to "major rules" which have been in effect more than 15 years, impose paperwork burdens" which could be reduced without "significantly diminishing" regulatory effectiveness. Goal is to reduce the cost of Federal regulations by 15% with a "minimal reduction" in the effectiveness of the regulations. Criteria for recommending repeal Whether the rule achieved its purpose and could be repealed without "significant" recurrence of adverse effects If technology, time, economic conditions, market practices, or "other relevant factors" have rendered the rule obsolete. If the rule is ineffective If the rule has "excessive compliance costs" or "is otherwise excessively burdensome", as compared to rules that give goals instead of orders and "give economic incentives to encourage desired behavior" If the rule "inhibits innovation in or growth of the United States economy" If the rule "harms competition" of entities based in the United States "Such other criteria as the Commission devises..." Repeal procedure If Congress passes a joint resolution approving the Commission's repeal suggestions, the Federal agencies will have to repeal the rules within 60 days of the joint resolution's enactment. Repealed rules can not be reissued without a new law enacted All records of public meetings and hearings will be published on the Commission's website within 1 week, Regulatory Cut-Go When an agency makes a new rule, they have to repeal a rule recommended by Commission so that costs of enforcement offset each other, but the agency must have a net reduction in costs Vote Passed the House of Representatives 245-174 There is an identical bill in the Senate: S. 1683 President Obama issued a veto threat Author Rep. Title 1: Sunshine for Regulatory Decrees and Settlements Any agency that is challenged by a private company on a regulation must publish the complaint online within 15 days. The suit can not be dismissed until after the complaint is published online and there is a public comment period. The agency much have a public comment period before settling cases and must respond to every comment received. A court can not approve of consent decree that doesn't "allow sufficient time and incorporate adequate procedures" for the agency to comply with all administrative rule making procedures and any Executive order that governs rulemaking. Title II: All Economic Regulations are Transparent Act Makes every Federal agency submit monthly reports) on the status of every rule they are working on. Rules can’t go into effect) until they have been published on the Internet for at least 6 months. Exemption for national security, emergencies, or implementing international trade agreements. Requires the first report to include cost-benefit analysis for all proposed or final rules for the 10 years) before the enactment of this law. The agencies will have 30 days to complete this report. Title III: Providing Accountability Through Transparency Requires agencies to publish summaries of their regulations on the Internet, capped at 100 words. If the publication of research data is delayed by 6 months, the Secretary must withdraw the rule unless that would cause "imminent and sever threat to human life". Study Which Delays Regulations A study on the regulatory effectiveness of the Stream Buffer Rule must be completed within two years and 90 days of this bill's enactment. The Secretary of the Interior can not issue any new rules or regulations related to the stream buffer zone rule until one year after the study is submitted. Congress and President Obama worked together to fast-track a new & unexamined NDAA into law. The new law essentially makes NSA data collection legal, cuts military pensions, and spends an enormous amount of money making sure the United States is able to destroy the entire world at a moment's notice. Links to Information in This Episode H.R. 3304: The National Defense Authorization Act of 2014 *The title has been changed to the National Defense Authorization Act of 2014 since it was signed into law. Previously, it was titled "To authorize and request the President to award the Medal of Honor to Bennie G. Adkins and Donald P. Sloat of the United States Army for acts of valor during the Vietnam Conflict and to authorize the award of the Medal of Honor to certain other veterans who were previously recommended for award of the Medal of Honor" The Cyber-security bill (Sections 932- 942) was added by Senator Jay Rockefeller. Section 1071 creates the "Conflicts Records Research Center" and allows states, foreign governments, and "any source in the private sector" to give money to the Department of Defense. Section 143 prohibits the military from retiring the RQ-4 Block 30 Global Hawk drones, which the Air Force doesn't want. Section 234 gives $15 million taxpayer dollars to "United States" companies so they can set up assembly lines for the Iron Dome missile defense system in Israel. No requirement for profit-sharing with the taxpayers was included. Section 242 says the United Stats shouldn't buy products that don't work unless the purchase is "to mainatin a warm line for the industrial base". Section 811 allows private contractors specializing in science, technology, engineering, math, medical, and cyber-security to be paid up to $625,000/year. The President of the United States makes $400,000/year. Section 813 makes it easier for the Department of Defense to hide their reasons for contracting with suspended or disbarred companies. Section 1011 extends the CIA/military program in Columbia for another year. Section 1013 expands the drug war to Chad, Libya, Mali, and Niger. Section 1033-1039 prevent prisoners from Guantanamo Bay prison from being transferred to prisons in the United States, but allows them to be transferred to their home countries if certain conditions are met. Section 1043 orders a report from the President regarding how he creates his kill lists. Section 1056 only allows the military to "prepare" to comply with the New Start Treaty, not to actually comply with the New Start Treaty. Section 1062 says that upgrading nuclear bombers "must remain a high budget priority." Sections 1701-1753 create new rules governing sexual assault in the military. The Congressional Research Service summary of the 2014 NDAA; note that the "Conference Report" numbers (H.R. 3304 is the conference report) are blank. The NDAA was passed via fast-track, which  means no amendments were allowed. H.R. 1960: The National Defense Authorization Act version that passed the House of Representatives earlier this year; it is officially a dead bill.
