Education remains a barrier to hospice care, Rachel Jordan, director of legislative affairs and advocacy at Hospice of the Chesapeake, said. There is still a lot of fear and stigma surrounding the word hospice. The provider, which has four locations and recently began offering high-flow oxygen, tries to reassure people that hospice does not have to mean forgoing treatment. As a nurse practitioner, Jordan said her goal is to support the patient and family, improve the symptom burden and increase quality of life. The African-American community, in particular, has mistrust pertaining to hospice, she pointed out. To help spread the word about hospice to this community, she reaches out to local Black churches. And to raise awareness about hospice among caregivers, she is working with nursing programs at institutions of higher education to intertwine hospice and palliative care education throughout the curriculum. Her organization is working to prepare for the Hospice Outcomes and Patient Evaluation (HOPE) tool, which is set to begin Oct. 1.Follow us on social media:X (formerly Twitter): @McKHomeCareFacebook: McKnight's Home CareLinkedIn: McKnight's Home CareInstagram: mcknights_homecareFollow Hospice of the Chesapeake on social media:Facebook: Hospice of the ChesapeakeLinkedIn: Hospice of the ChesapeakeShow contributors:McKnight's Home Care Editor Liza Berger; Rachel Jordan, Director of Legislative Affairs and Advocacy, Hospice of the Chesapeake

This Day in Legal History: United States v. Peters DecidedOn February 20, 1809, the U.S. Supreme Court issued its ruling in United States v. Peters, a case that reinforced the authority of federal courts over state legislatures. The dispute arose when the Pennsylvania legislature attempted to defy a federal court order regarding a financial judgment. Chief Justice John Marshall, writing for the Court, held that allowing states to override federal judicial decisions would threaten the constitutional structure and weaken the judiciary's role as an independent branch of government. The ruling reaffirmed the supremacy of federal law, a principle later cemented by cases like McCulloch v. Maryland and Cooper v. Aaron. The case stemmed from a long-running legal battle over a prize ship seized during the Revolutionary War. A Pennsylvania state court had refused to comply with a federal ruling ordering restitution to the ship's rightful owners. In his opinion, Marshall emphasized that state governments could not interfere with federal judicial authority, warning that such actions would lead to anarchy. Pennsylvania resisted the decision, but the ruling set a lasting precedent that federal courts have the final say on legal disputes involving national law. This decision played a crucial role in shaping American federalism by ensuring that states could not undermine federal judicial power. It reinforced the constitutional principle that the judiciary must remain independent to uphold the rule of law. In doing so, United States v. Peters helped establish the judiciary as a coequal branch of government, capable of enforcing its decisions even in the face of state opposition.President Donald Trump has announced plans to nominate several former advisers from his first term to key Justice Department positions. John Eisenberg has been tapped to lead the national security division, while Brett Shumate will head the civil division. Shumate, currently acting in that role, has been involved in defending the administration against lawsuits related to federal worker dismissals and agency restructuring. He previously worked at the law firm Jones Day and defended Trump's unsuccessful attempt to limit birthright citizenship.  Eisenberg, who served as legal adviser to the National Security Council during Trump's first term, has held multiple senior roles in the Justice Department and clerked for Supreme Court Justice Clarence Thomas. Patrick Davis is set to lead the Office of Legislative Affairs, marking his third time in the department. All three appointments require Senate confirmation.  The nominations follow Trump's directive to remove all U.S. attorneys appointed by former President Joe Biden, claiming the Justice Department had been politicized. This move underscores Trump's continued efforts to reshape the department with loyalists from his previous administration.Trump picks first-term loyalists for top Justice Department posts | ReutersMastercard's £200 million settlement of a long-running lawsuit over card fees is facing opposition, raising concerns about the future of UK class action funding. The lawsuit, originally valued at £10 billion, was brought on behalf of 44 million British consumers, meaning each claimant would receive only about £2.27 if all sought payment. The deal is being challenged by litigation funder Innsworth Capital, which stands to receive half the settlement, arguing that the terms are unfair given its £45 million investment in the case.  The Competition Appeal Tribunal in London must now decide on the first contested settlement in the UK's emerging class action framework. The case comes amid growing uncertainty in the sector following a 2023 Supreme Court ruling that invalidated many litigation funding agreements. Further legal tests are expected, as the Court of Appeal is set to review funding arrangements for lawsuits against Apple and Sony later this year.  Consumer advocate Walter Merricks, who led the case, and Mastercard defend the settlement, stating that economic assessments now value the claim at under £200 million due to prior legal setbacks. The tribunal's decision could significantly impact future litigation funding in the UK.Mastercard landmark deal challenged in test for UK class action funding | ReutersA U.S. judge is scrutinizing a Justice Department request to drop corruption charges against New York City Mayor Eric Adams, raising concerns about political interference. The request, ordered by a Trump-appointed official, has led to multiple resignations within the Justice Department, with critics arguing it ties Adams' legal fate to his cooperation with Trump's immigration policies. Adams, facing reelection, has denied any wrongdoing, while some Democrats fear dismissing the case would make him indebted to the Trump administration. The Justice Department's request to drop the charges "without prejudice" leaves the possibility of future prosecution, a move former federal prosecutors warn could be used as leverage.  The judge overseeing the case, Dale Ho, is a former civil rights attorney and Biden appointee whose nomination faced Republican opposition. Ho has a background in voting rights advocacy and previously challenged Trump administration policies before the Supreme Court. His handling of the Adams case will be the most high-profile decision of his judicial career. Legal experts note that while Ho cannot force prosecutors to continue the case, he can question their motives, particularly the timing of a potential re-filing after the New York mayoral election.  This case underscores broader concerns about the Justice Department's independence under Trump, with critics accusing his administration of using federal prosecutions to reward allies and punish opponents. Adams has previously claimed, without evidence, that the charges were political retribution from the Biden administration. Meanwhile, New York's political establishment is divided, with some calling for Adams' resignation and others waiting to see how the case unfolds. Governor Kathy Hochul has reportedly met with political leaders to discuss Adams' future, further intensifying the controversy.US judge questions 'unusual' request to drop Eric Adams case | ReutersWho is Dale Ho, the judge deciding whether to drop Eric Adams' case? | Reuters This is a public episode. This includes installing new fire hydrants, upsizing waterlines, and adding emergency generators and water storage tanks. Since 2009, the partnership has leveraged $20 million in federal funding to implement over $52 million in critical fire suppression projects, with an additional $120 million needed over the next five years to safeguard Tahoe's communities from wildfire. Rich wonders if the global market is reacting to the wide-spread perception that Kamala Harris could win the 2024 presidential race? Several days ago, during a rally in Atlanta, Georgia, Donald Trump warned that if Harris wins the election, the world will see an economic crash. 6:10pm- Fetterman Warns Kamala's Team About Shapiro: Holly Otterbein of Politico writes: “Pennsylvania Sen. John Fetterman is concerned about the possibility that Vice President Kamala Harris might choose his state's governor, Josh Shapiro, as her running mate, and his advisers have privately relayed those worries to Harris' team, according to three people familiar with the conversations. Fetterman's advisers suggested to Harris' team that the senator believes that Shapiro is excessively focused on his own personal ambitions. His reservations about Shapiro reflect a long-running rivalry between the two ambitious Democrats, who have risen on parallel tracks in a politically crucial state.” You can read the full article here: https://www.politico.com/news/2024/08/03/fetterman-shapiro-harris-vp-00172557 6:15pm- Josh Shapiro Wants To Be Barack Obama: Katie Glueck of The New York Times writes: “Mr. Shapiro described Mr. Obama as someone ‘whose example I've tried to emulate' in an interview last week, but he declined to comment on ‘any communications that I have with President Obama.' Some have suggested—sometimes lightheartedly, sometimes mockingly—that Mr. Shapiro has taken his goal of emulating Mr. Obama's example literally. Among the likenesses: They both managed to end up with family dogs named ‘Bo.' And Mr. Shapiro's cadence, rhythms and sometimes even hand gestures can seem so reminiscent of the former president's that some people have started jokingly referring online to Mr. Shapiro, who is Jewish, as ‘Baruch Obama.'” You can read the full article here: https://www.nytimes.com/live/2024/08/05/us/harris-trump-election 6:20pm- While speaking with Lesley Stahl, former Speaker of the House Nancy Pelosi vehemently denied that she was responsible for convincing Joe Biden to dropout of the 2024 presidential race. 6:40pm- Todd Shepherd of Broad + Liberty writes: “Gov. Josh Shapiro (D) is now claiming that after his Secretary of Legislative Affairs had been accused by a subordinate of sexual misconduct and harassment in the workplace in 2023, he did not find out about either the accusations or the resulting investigation until ‘months after' the events. The new revelation, stemming from a statement made by Shapiro's spokesperson to the New York Times, raises a fresh set of questions, especially given that the governor met with a number of female state senators soon after news of the scandal broke to reassure them that his office took workplace sexual harassment seriously.” You can read the full article here: https://broadandliberty.com/2024/08/04/shapiro-claims-he-didnt-know-of-sexual-misconduct-allegations-against-his-staffer-until-months-later/ 6:50pm- Is Minnesota Governor Tim Walz going to be Kamala Harris's VP pick? Multiple heated confrontations and disagreements over how best to handle the cocaine ensued after a Secret Services Uniformed Division officer found the bag on July 2, 2023, a quiet Sunday while President Biden and his family were at Camp David in Maryland, the sources said.” You can read the full article here: https://www.realclearpolitics.com/articles/2024/08/05/former_secret_service_chief_wanted_to_destroy_cocaine_evidence_151392.html 4:30pm- Wendi Strauch Mahoney—Investigative Journalist at Uncover DC—joins The Rich Zeoli Show to discuss her latest report, “Federal Air Marshal Whistleblowers Report Tulsi Gabbard Actively Under Surveillance via Quiet Skies Program.” You can read the full article here: https://uncoverdc.com/2024/08/04/fams-whistleblowers-report-tulsi-gabbard-on-quiet-skies-list 4:50pm- The Left Blames Trump For Everything: Journalist Matt Taibbi hilariously reacted to a very bizarre New York Times op-ed: “The New York Times ran a guest editorial by Belle Boggs, a North Carolina author who had a bat fly in her house. It didn't bite her, but she needed a sheriff's deputy, a county health nurse, state animal control, the CDC, and an E.R. doctor to tell her what to do about that. Naturally, the episode led her to think of Donald Trump.” You can read the full article here: https://www.racket.news/p/bat-scares-egghead-couple-trump-blamed 4:55pm- While speaking with Lesley Stahl on CBS, Congresswoman Nancy Pelosi (D-CA) said she believes Joe Biden's presidency has been such a success that he should be added to Mount Rushmore! 5:00pm- While speaking with Ainsley Earhardt on Fox News, Usha Vance clarified J.D. Vance's comments about “childless cat ladies”—explaining that her husband wasn't attempting to criticize anyone but was merely emphasizing how difficult it is to be a parent in the United States. Is Usha the Trump Campaign's secret weapon? 5:15pm- Byron Donalds vs George Stephanopoulos: Congressman Byron Donalds's (R-FL) appearance on ABC's This Week devolved into chaos when “unbiased” host George Stephanopoulos condemned Donald Trump and his campaign's surrogates for saying Kamala Harris has used her racial identity for political gain. While Donalds continually attempted to clarify Trump's previous statements, Stephanopoulos interrupted over and over again. Citing a Politico article, Rich reminds that audience that in 2019—during the 2020 Democrat Primary—it was Democrats that questioned Harris's racial identity. 5:30pm- Why did Robert Kennedy Jr. leave a dead bear cub in Central Park? Bradford Betz of Fox News writes: “Presidential candidate Robert F. Kennedy, Jr. released a bizarre video on X Sunday, in which he tells comedian Roseanne Barr about the time he dumped a dead bear cub in New York City's Central Park a decade prior…RFK tells Barr he was on his way there when a woman in a van in front of him hit a young bear and killed it.” You can read the full story here: https://www.foxnews.com/politics/rfk-jr-admits-dumping-dead-bear-cub-central-park-roseanne-barr-listens-bizarre-video 5:40pm- Did Donald Trump just say he thought Canadian Prime Minister Justin Trudeau might be the son of former Cuban Dictator Fidel Castro? 6:05pm- On Monday, the Dow Jones Industrial Average fell over 1,000 points. Meanwhile, Japan's Nikkei plunged 12% —the largest drop since the Black Monday crash in 1987.
