Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in McElrath v Georgia. In this case, the court considered this issue: Does the Double Jeopardy Clause of the Fifth Amendment prohibit a second prosecution for a crime of which a defendant was previously acquitted? The case was decided on February 21, 2024. The Supreme Court held that the Double Jeopardy Clause of the Fifth Amendment prohibits a second prosecution for a crime of which a defendant was found by a jury to be not guilty by reason of insanity. Justice Ketanji Brown Jackson authored the unanimous opinion of the Court. The Double Jeopardy Clause of the Fifth Amendment protects individuals from being tried or punished more than once for the same offense, establishing that a verdict of acquittal is final and prohibits any future prosecution for the same offense. An acquittal includes any decision demonstrating the prosecution's failure to provide sufficient evidence for criminal liability, making such a verdict inviolable and irreversible. This principle is crucial, ensuring the finality and integrity of jury verdicts in protecting defendants' rights. In this case, the jury's verdict of not guilty by reason of insanity on a malice-murder charge constitutes an acquittal, because it signifies the insufficiency of the prosecution's evidence for criminal liability. Notwithstanding Georgia law to the contrary, the determination of an acquittal for double jeopardy purposes rests on federal law, rendering the state's characterization non-binding. The validity of an acquittal remains unaffected by the consistency of jury verdicts or any speculation about the jury's reasoning, which is consistent with the jury's exclusive domain to decide on guilt or innocence and the Double Jeopardy Clause's outright prohibition on multiple prosecutions for the same offense. Justice Samuel Alito authored a concurring opinion to clarify that the Court's decision does not express any view about whether a not-guilty verdict that is inconsistent with a verdict on another count and is not accepted by the trial judge constitutes an “acquittal” for double jeopardy purposes. BREAK: CUofGA STORY 1: Marietta Couple Indicted for Child Molestation Brian Deshawn Phillips, 46, and Elizabeth Anne Cooley, 23, face charges including child cruelty and molestation, accused of assaulting an underage girl over two years at a Marietta hotel. Phillips is also accused of molesting other women in Cobb. The 27 charges include aggravated child molestation, trafficking persons for sexual servitude, and cruelty to children. Phillips allegedly assaulted underage girls at various Cobb locations and burglarized a woman's home for assault. Cooley is accused of aiding Phillips. Phillips faces additional charges of firearm possession and marijuana possession. He was convicted in Florida in 2003 for child fondling. Both are held without bond at the Cobb County Adult Detention Center since their January 30 arrests. STORY 2: State Court Candidates Talk Tech, Character and Challenges Candidates for Cobb County State Court post 7, including incumbent Carl Bowers and challengers Crystal Stevens McElrath and Matt McMaster, discussed the qualities of a good judge, the role of technology in the court system, and the benefits of electoral challenges at a forum. Bowers emphasized integrity and transparency, McElrath highlighted her ability to understand people, and McMaster emphasized empathy and self-awareness. They all agreed on the importance of technology in the justice system and expressed support for online hearings. Valeria Rodriguez, student body co-president, described the event as a last hurrah for the graduating class, emphasizing the unity and enjoyment shared by all attendees regardless of their social groups. Principal Marvin Crumbs praised the event as one of the best proms in the school's history, marking it as a smashing success. Clint Cook, executive director of Life Rolls On Atlanta, emphasized the organization's mission to empower people with disabilities to engage in activities like skating. Despite pandemic-related challenges, nearly 60 participants enjoyed the event, coming from various locations. Volunteers like Cody Appleton assisted participants, teaching adaptation and mobility skills. Skaters, including Jacob Lee, expressed excitement and determination to master new tricks. STORY 7: Cobb County Water System Reports 250 Gallon Sewage Overflow On April 26, the Cobb County Water System reported a wastewater sewer overflow of approximately 250 gallons at 3413 Belleford Court NE in Roswell. The overflow, caused by grease, discharged into a tributary leading to Sweat Mountain Creek. The Water System was notified at 12:20 p.m. and managed to stop the overflow by 2:25 p.m. Upon arrival, Water System employees observed sewage escaping from a secured manhole lid into the tributary. They used a jet machine to clear the sewer line and spread lime on the affected area. No fish kills were observed during their assessment. On February 21, the Supreme Court unanimously decided McElrath v. Georgia, holding that a jury’s verdict that the defendant was not guilty by reason of insanity of malice murder constituted an acquittal for double jeopardy purposes notwithstanding any inconsistency with the jury’s other verdicts.McElrath concerned the case of Damian McElrath, who in 2017 was tried for malice murder, aggravated assault, and felony murder Under Georgia Law, in a case where a defendant is claiming insanity at the time of the crime, the jury can render one of four possible verdicts: Guilty, Guilty but Mentally Ill, Not Guilty by Reason of Insanity, or Not Guilty. The jury rendered a split verdict, finding McElrath not guilty by reason of insanity on the malice murder charge and guilty but mentally ill on the felony murder and aggravated assault charges. McElrath challenged his guilty but mentally ill conviction as repugnant to his acquittals. The Georgia Supreme Court, instead of overturning his conviction, vacated both the conviction and the acquittal and remanded the case for a retrial. McElrath then filed a plea in bar asserting that the Double Jeopardy Clause of the United States Constitution prohibited the State from subjecting him to a second trial on the malice murder charge. BREAK: CUofGA STORY 1: U.S. Supreme Court Rules Cobb Man Cannot Be Retried for 2012 Killing In a landmark ruling, the U.S. Supreme Court has overturned a Georgia Supreme Court opinion, ruling that Damian McElrath, who was tried for the 2012 stabbing death of his mother, cannot be retried for malice murder. McElrath, diagnosed with schizophrenia, stabbed his mother over 50 times in their west Cobb home, believing she was trying to poison him. He was found guilty, but mentally ill, of felony murder and not guilty by reason of insanity of malice murder. However, in 2020, the Georgia Supreme Court dismissed both verdicts. The U.S. Supreme Court's ruling asserts that the jury's verdict constituted an acquittal for malice murder, thus protecting McElrath from retrial under double jeopardy standards. This decision emphasizes that "an acquittal is an acquittal" regardless of its consistency with other verdicts. This ruling marks a significant moment for McElrath's defense team, who expressed their honor in representing "the forgotten mentally ill who get into serious trouble." STORY 2: Uncertainty Surrounds Cobb Commission's District Map: An Update on the Situation The future of the Cobb Board of Commissioners District 2 seat, currently occupied by Jerica Richardson, hangs in the balance due to an ongoing legal dispute surrounding redistricting. The validity of the county's self-drawn district map is under scrutiny, with a decision from the Georgia Supreme Court eagerly anticipated. If the court confirms the General Assembly's alternate map, which doesn't include Richardson's residence in District 2, her position could be jeopardized. The situation is further complicated by contradictory legislation regarding her seat and Richardson's refusal to step down. This may necessitate a special election, causing further disruption to the commission's operations and leaving residents uncertain about their representation. Amidst this uncertainty, Richardson has announced her run for the U.S. House of Representatives, attracting several candidates for her potentially vacant commission seat. STORY 3: Initial Hearings to Begin in City of Mableton Lawsuit Challenge The city of Mableton, Georgia, is facing a legal challenge that questions the constitutionality of its creation. The lawsuit, brought forward by five residents, will have its first hearing in Cobb Superior Court on March 6. The plaintiffs argue that House Bill 839, which allowed for Mableton's establishment and was passed by the Georgia General Assembly in 2022, is unconstitutional. They claim the bill violates the state constitution's single subject rule by creating both the city and community improvement districts in a single act. The suit seeks a declaratory judgment ruling that HB 839, and thus, the city, is void. Despite the ongoing legal battle, Mableton's Mayor, Michael Owens, stated that the city would continue with its operations and work on establishing commissions, authorities, and boards to assist in city development. Break: HENRY COUNTY SHERIF STORY 4: Pope Girls Basketball Team wins First State Playoff Win Since 2018 In a thrilling and long-awaited victory, the Pope High School girls basketball team clinched their first state playoff win since 2018, defeating Etowah 53-44 in the opening round of the Class 6A state playoffs. Standout player Abbey Bensman led the Greyhounds to victory with an impressive 18 points and seven rebounds. "Abbey is a special player," praised Pope coach Bill Blythe. "She does just about everything out on that court." The game saw Pope leading 32-29 in the third quarter. However, a successful 7-0 run gave them a comfortable lead going into the final quarter. Despite Etowah's best efforts, Pope managed to maintain control and secure the win. Sarah Gentry also made significant contributions, scoring nine points and six rebounds, including a crucial 3-pointer at the end of the first quarter, which put the Greyhounds ahead. The win propels the Greyhounds into Round 2 where they will host South Paulding on Saturday. STORY 5: Over $22K Donation for Literacy Made at Marietta Town Hall Meeting A significant donation of over $22K was recently made to promote literacy at a town hall meeting in Marietta. The meeting, hosted by Ward 5 Marietta City Councilman M. Carlyle Kent, saw Cobb Collaborative Executive Director Irene Barton receive a check for $22,100. This contribution will be utilized for two early literacy projects. $20,000 will assist Zion Academy in constructing a playground designed around an early literacy theme. The remaining $2,100 will fund 25 ‘Marietta Reads' packets per month for a year, intended to benefit pre-K age children throughout Councilman Kent's ward. We'll be back in a moment. Break: DRAKE STORY 6: McEachern reaches century mark in win over Westlake McEachern High School's basketball team achieved a stunning victory over Westlake, ending with an impressive 105-72 score in the first round of the Class 7A playoffs. Ace Bailey led the charge, scoring a game-high 32 points, with 24 of those earned in the first half alone. This win marks the first time McEachern has reached the century mark since the 2019-20 season. The team now looks ahead to their next challenge against Newton on Saturday. Despite the victory, Coach Tremayne Anchrum insists there's still room for improvement as they progress in the playoffs. The Georgia Supreme Court held that a jury's verdict of acquittal on one criminal charge and its verdict of guilty on a different criminal charge arising from the same facts were logically and legally impossible to reconcile. It called the verdicts "repugnant," vacated both of them, and subsequently held that the defendant could be prosecuted a second time on both charges. Two years ago, Shane McElrath was battling Chase Sexton for a 250SX Regional Championship. Today, Sexton is a bright shining star in the sport with multiple 450 wins and championship potential of the highest order. McElrath, meanwhile, has been battling just to get a ride, anywhere. He missed most of the '21 season with a back injury, riding for SmarTop/Bullfrog Spas MotoConcepts Honda. Then he ended up on four different teams in 2022, including one that folded, two fill-in rides, and then a a shot at building a team with Rick Ware Racing for the new World Supercross Championship. It was thrown together quickly, but Shane emerged with the SX2 Championship. Now, finally, he thinks he has some stability for the future, and a chance to show what he can do. For Dr. Thomas McElrath, MD-PhD in the Division of Maternal-Fetal Medicine at the Brigham & Women's Hospital, this telescope exists and is called LIFECODES. The LIFECODES Biobank is an extensive biobank of samples collected for over 14 years with data on over 6,000 pregnancies. It is used to look at biomarkers associated with pregnancy complications and the effects of environmental exposures on pregnancy outcomes. In this episode, we have interviewed Dr. McElrath to talk about his recent work published in Nature.
