Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in Bissonnette v LePage Bakeries Park St., LLC. In this case, the court considered this issue: To be exempt from the Federal Arbitration Act, must a class of workers that is actively engaged in interstate transportation also be employed by a company in the transportation industry? The case was decided on April 12, 2024. The Supreme Court held that a transportation worker need not work in the transportation industry to be exempt from coverage under Section 1 of the Federal Arbitration Act. Chief Justice John Roberts authored the unanimous opinion of the Court. In Circuit City v Adams, the Court held that Section 1's exemption covers “transportation workers” based on the characteristics shared by the specific categories of “seamen” and “railroad employees” mentioned in the statute. In the more recent Southwest Airlines v Saxon case, the Court rejected an “industrywide” approach, emphasizing that the focus is on the work the individual performs, not the industry of their employer. The Court reasoned that imposing a “transportation industry” requirement would lead to complex line-drawing problems about what counts as that industry. Moreover, the statutory text and precedent do not support limiting “seamen” and “railroad employees” to particular industries. While there is a legitimate concern that Section 1 might be read too broadly, transportation workers play a direct and necessary role in the interstate transport of goods, ensuring that the exemption remains appropriately narrow. Therefore, the appeals court erred in compelling arbitration solely because the workers were in the bakery industry. The opinion is presented here in its entirety, but with citations omitted. En el mundo del comercio electrónico, escalar una marca online rápidamente puede parecer un desafío inmenso, pero para quienes están dispuestos a aprender y perseverar, es completamente posible. Jose Miguel Lepage, emprendedor de eCommerce desde 2019, ha generado más de $30MM con sus marcas en Estados Unidos, y comparte las claves para llevar un negocio a nuevas alturas en poco tiempo. El primer paso, según Jose, es confiar en uno mismo y en el potencial de la marca: "Muchas veces nos pasa en redes sociales que a veces vemos una persona normal y no confiamos de que esa persona puede generar tanto dinero y eso limita nuestra meta", explica. Sin embargo, este proceso debe ir acompañado de educación constante. Jose insiste en la importancia de aprender de quienes ya han logrado resultados: "Creemos que el mejor contenido muchas veces es gratuito, cuando en realidad poder invertir en educación es muy importante. Es conveniente comenzar con educación gratuita y luego comenzar a invertir y ser parte de una comunidad para pasar al siguiente nivel", señala. Uno de los principales retos al escalar una marca es estar preparado para el crecimiento, lo cual implica tener los recursos necesarios en todo momento. Jose admite que cometió errores al principio, como no tener suficiente stock para la demanda. Y subraya que el éxito rápido no llega sin esfuerzo: "Para poder escalar rápido, hay que estar preparado y que sea proporcional a lo que uno quiere llegar. El método fácil no existe. Es preferible ir poco a poco". La gestión del capital y el equipo son aspectos fundamentales en este camino: "El capital es importante para comenzar porque te permite tener las unidades necesarias para llegar a tu número objetivo", afirma Jose. Conforme la marca crece, los clientes también aumentan sus expectativas, y es vital contar con un equipo que pueda responder a esas demandas. "Tienes que tener personal para que responda a las necesidades o reclamos de esos consumidores para poder tener una buena satisfacción del cliente", destaca. A medida que el negocio escala, la publicidad se convierte en una herramienta esencial: "Para llegar a números más grandes tienes que generar publicidad por todas partes y eso una sola persona no lo puede lograr", advierte, indicando la necesidad de un equipo de marketing y un buen apoyo financiero. Actualmente, Jose lidera un equipo de más de 25 personas distribuidas entre Estados Unidos y otros países, cubriendo distintas áreas del negocio. Esto demuestra que la diversificación de talento es crucial para manejar un negocio a gran escala. Sin embargo, asegura que “ser CEO no es un trabajo fácil” y resalta la importancia de conocer todas las áreas del negocio para tomar decisiones informadas y evitar errores costosos al contratar personal. Para ello es importante que las personas contratadas estén bien capacitadas: "Uno da por sentado que la gente que uno contrata te va a trabajar bien, cuando en realidad es más difícil conseguir una persona buena que una mala", opina. Jose pone énfasis en la necesidad de organización y expectativas claras desde el principio para que los nuevos empleados puedan realizar sus tareas de manera efectiva. Finalmente, Jose recalca el valor de la persistencia y la dedicación absoluta al negocio: "Es persistencia, constancia y ganas de aprender. Eso nos separa del 99 por ciento de la gente común". Escalar una marca online requiere sacrificios que pocos están dispuestos a hacer, pero para aquellos que priorizan su negocio al mismo nivel que su familia, las recompensas son inmensas. Since Dobbs v. Jackson Women’s Health Organization, state courts and legislatures have grappled with its legal and policy implications, especially as they pertain to abortion and IVF. In LePage v. Center for Reproductive Medicine, for example, the Alabama Supreme Court held that frozen embryos should be regarded as “children” for the purposes of Alabama’s Wrongful Death of a Minor Act. And in Planned Parenthood v. Mayes, the Arizona Supreme Court upheld an 1864 law that bans all abortions in the state except those deemed necessary to save the life of the mother.These recent rulings have been highly criticized by commentators on both sides of the aisle, and they raise important questions about the legal status of IVF and abortion in the wake of Dobbs v. Jackson Women’s Health Organization. For example, in both cases, the courts interpreted the law in accordance with textualist principles, and the state legislatures swiftly enacted measures to address the state supreme court decisions afterward. Are these cases therefore examples of the proper allocation of powers, where the judiciary says what the law is, and the legislature is tasked with implementing policy? With the question of abortion being returned to the legislative process post-Dobbs, do these cases invite more thoughtful dialogue about abortion and IVF policy, or do they sow further acrimony? Were these cases rightly decided? Can we articulate a legal standard vis-à-vis abortion and IVF that is both thoughtful and conceptually consistent? Alabama's IVF ruling. Last week, Alabama's Supreme Court ruled in favor of a group of couples suing an Alabama storage facility under the state's wrongful death law after their frozen embryos were lost in an accident. The groundbreaking ruling, in a case dubbed LePage v. Center for Reproductive Medicine, P.C., treated the embryos as children who should be afforded certain legal protections, a theory championed by some anti-abortion groups that has now gotten its first validation from a major U.S. court.
