Attorney Thomas Maag joins Megan and Tom in studio discussing why he is challenging the Illinois weapons restrictions on 5th amendment grounds. 

With courts denying requests to delay the Jan. 1 deadline for Illinois gun owners to register now banned firearms with the state, lawsuits against the gun ban will continue in the new year. Last week, Southern District of Illinois federal Judge Stephen McGlynn denied a preliminary request for the Jan. 1 deadline to be delayed. Also last week, Attorney Thomas Maag filed for summary judgment against the law, alleging it violates citizens' Fifth Amendment rights against self-incrimination. www.commsolutionsmn.com- Property ownership is a bedrock of American society. It has been ingrained in the fabric of our great country since before the beginning. Yet, government has found a way to confiscate our property, despite what the constitution says. Government came up with eminent domain as a way to take that property back. They would just take what they wanted, when they wanted it. Then laws were tightened after the Kelo v New London case at the Supreme Court. This was a terrible decision that set lawmakers to tightening up the laws around eminent domain. Minnesota statutes state that there are certain situations in which the government can take your land. What does it mean when a property is blighted? What is "public use"? Of course these are defined very vaguely, so that the government still has the greatest opportunity to get what they want. The growing fascism in this country (and the world) has brought government and business together to take from the people, so that we are completely dependent on them. It's time for local governments to take action to further protect property rights by narrowing the scope under when eminent domain is allowed. We've got some ideas on how to start. We also discuss how the schools are losing touch with all common sense. With the recent blizzard, Robbinsdale schools closed for three days way too early... but the State High School Girls Hockey Tournament went forward as planned that night. Ummmm...? Our schools are in trouble and they don't seem to be getting any better. They are drifting further into propaganda and losing their neighborhood feel. Somebody help?    Slam the Gavel welcomes Cadence Harper, a 34 year-old Mother who grew up in Family Court and unfortunately is still in it. She is the Mother of a wonderful 13 year-old daughter.  She is also an Army Veteran and  Business owner of Farm Fairy, LLC.     Cadence is also an advocate of a social media platform on Facebook, called: USA Family Court: Class Action Team. We discussed her platform and how she has been wanting Family Court to just do the right thing. Cadence states she does have CPTSD and Attachment issues and has been trying to fix what was done to her as a child. Cadence is a child that was used as a pawn for her mother against her own father.    However, her own Mother became involved while Cadence and her ex had been co-parenting beautifully and inserted herself between Cadence and her daughter via Family Court. The issue is that the court has no jurisdiction over her case and her own Mother used the SAME GAL for Cadence as she is using for Cadence's own daughter for the last 20 years. There will be a three hour trial on 2/7/2022.    Cadence discussed IIED and what that entails as well as interference of Parental Rights. In the summer of 1966, the Supreme Court ruled that as a part of your 5th amendment protections, Law enforcement is required to advise you and to insure that you clearly state that you understand that you have certain rights, among which are the right to remain silent. Most of us rarely consider how important that is, nor do we consider that before 1966, Police could in fact, elicit a "confession" from a suspect from virtually anything that is said. Silence is the best course, and the Police cannot force you to say anything. In this episode, Michael and Andrew address an important question for witnesses appearing before a congressional committee: does the 5th Amendment protection apply in congressional investigations the same way it does in Article III courts? Although witnesses may be reluctant to avail themselves of the 5th Amendment, there are some situations where the risks of publicly testifying outweigh the possible negative connotation associated with exercising the privilege. In instances where the privilege is asserted, Michael and Andrew discuss the congressional committee's three likely responses.
