Nearly every meme, YouTube video, and yes, even this very podcast, contains copyrighted work that may or may not be ... "officially" obtained. With millions of hours of audio and video uploaded to the Web every day, how can we possibly protect the intellectual property rights of creators? In short, we can't. BUT, laws and court cases dating back to the '90s have dramatically changed our perceptions of what intellectual property can be in an age where remix culture is the lifeblood of the Internet. This week on INFLUENCE, Duke University law professor Jennifer Jenkins joins Matt to unpack the differences between copyright, trademark, patents, fair use, and why Creative Commons and the public domain are so vital for online creativity. We also dig in on the ContentID algorithms that "police" copyright on large social platforms, and what the hell to do about generative AI that synthesizes new content from billions of copyrighted works. Jennifer Jenkins embodies the unwavering spirit of a lifelong caregiver. Her journey began at just 15, caring for her grandmother after cancer surgery. Later, tragedy struck when her brother, James, was wounded in Iraq. Alongside raising her infant child, Jennifer became his full-time caregiver and a tireless advocate for wounded veterans. Her responsibilities extended to her mother following a stroke, and despite these immense challenges, Jennifer welcomed a premature daughter into her life. Jennifer emphasizes the importance of counseling and self-care, including journaling and yoga, throughout her incredible journey. While gradually transitioning some of her brother's care to his partner, she remains a dedicated caregiver and an inspiration to those balancing family and the extraordinary demands of caregiving. Jennifer's story is a testament to resilience, compassion, and the necessity of support for those who dedicate their lives to caring for others. About Jennifer: Jennifer Jenkins understands the complexities of being a full-time caregiver. “I had to start from scratch finding the answers,” says Jennifer. “My brother's care required a unique set of skills that my background did not include. That's why the connections I've made through Wounded Warrior Project® (WWP) have been invaluable.” In 2005, her brother James was wounded in combat while on a mission with his Army Stryker Brigade in Iraq. James endured a traumatic brain injury (TBI), partial hearing and vision loss, damage to his spine, and post-traumatic stress disorder (PTSD). Jennifer's journey has helped her understand the sacrifices, challenges, and unmet needs that caregivers face daily. Her message of love and support is clear and empathetic: “I do not see my brother's needs as a burden. If I had to drop everything to help him, I would, and, quite frankly, I sometimes have. Thankfully, Wounded Warrior Project is always there to help us, too.” Support the show Confessions of a Reluctant Caregiver Sisterhood of Care, LLC Website: www.confessionsofareluctantcaregiver.com Like us on Facebook! Send us a Text Message.Jennifer Jenkins embodies the unwavering spirit of a lifelong caregiver. Her journey began at just 15, caring for her grandmother after cancer surgery. Later, tragedy struck when her brother, James, was wounded in Iraq.  Alongside raising her infant child, Jennifer became his full-time caregiver and a tireless advocate for wounded veterans.  Her responsibilities extended to her mother following a stroke, and despite these immense challenges, Jennifer welcomed a premature daughter into her life.Jennifer emphasizes the importance of counseling and self-care, including journaling and yoga, throughout her incredible journey.  While gradually transitioning some of her brother's care to his partner, she remains a dedicated caregiver and an inspiration to those balancing family and the extraordinary demands of caregiving. Jennifer's story is a testament to resilience, compassion, and the necessity of support for those who dedicate their lives to caring for others.About Jennifer:Jennifer Jenkins understands the complexities of being a full-time caregiver. Thankfully,  Wounded Warrior Project is always there to help us, too.” Support the Show.Confessions of a Reluctant Caregiver Sisterhood of Care, LLC Website: www.confessionsofareluctantcaregiver.com Like us on Facebook! With several asterisks, qualifications, and caveats, Mickey Mouse in his earliest form will be the leader of the band of characters, films, and books that will become public domain as the year turns to 2024. In a moment many close observers thought might never come, at least one version of the quintessential piece of intellectual property and perhaps the most iconic character in American pop culture will be free from Disney's copyright as his first screen release, the 1928 short “Steamboat Willie,” featuring both Mickey and Minnie Mouse, becomes available for public use. U.S. law allows copyright to be held for 95 years after Congress expanded it several times during Mickey's life. “It's sometimes derisively referred to as the Mickey Mouse Protection Act,” said Jennifer Jenkins, a professor of law and director of Duke's Center for the Study of Public Domain. “That's oversimplified because it wasn't just Disney that was pushing for term extension. It was a whole group of copyright holders whose works were set to go into the public domain soon, who benefited greatly from the 20 years of extra protection.” Current artists and creators will be able to make use of Mickey but with major limits. It is only the more mischievous, rat-like, non-speaking boat captain in “Steamboat Willie” that has become public. “More modern versions of Mickey will remain unaffected by the expiration of the Steamboat Willie copyright, and Mickey will continue to play a leading role as a global ambassador for the Walt Disney Company in our storytelling, theme park attractions, and merchandise,” Disney's statement said. Not every feature or personality trait a character displays is necessarily copyrightable, however, and courts could be busy in the coming years determining what's inside and outside Disney's ownership. Disney still solidly and separately holds a trademark on Mickey as a corporate mascot and brand identifier, and the law forbids using the character deceptively to fool consumers into thinking a product is from the original creator. Anyone starting a film company or a theme park will not be free to make mouse ears their logo. Disney's statement said it “will work to safeguard against consumer confusion caused by unauthorized uses of Mickey and our other iconic characters.” This article was provided by The Associated Press.

Duke copyright law professor Jennifer Jenkins joins us to celebrate and explain Public Domain Day.  After a twenty-year hiatus, copyrighted works began moving into the public domain in 2019. Now each year, we can re-discover works that are available to be re-purposed by creators without the legal burden of obtaining permission from the former copyright holders. This year, for example, includes works such as The House at Pooh Corner, Millions of Cats, The ThreePenny Opera, and the 800-pound mouse, as Jennifer calls him, Mickey Mouse (as well as Minnie) as seen in Steamboat Willie. Interestingly, in the context of our recent conversation about censorship, Lady Chatterly's Love enters the public domain this year and now can be explored and built upon by everyone. We also discuss Poor Things, the new film paying homage to Shelley's Frankenstein.  Jennifer explains it all in this lively episode: what copyright law is and was, what it covers, why the copyright period was extended, and what you, as a creator, can do with works now in the public domain.  We also get to talk about art, inspiration, Disney, monetization,  plagiarism, creative commons licenses —and even a bit more about Tom Lehrer.Jennifer's article about Public Domain Day 2024:https://web.law.duke.edu/cspd/publicdomainday/2024/?utm_source=newsletter&utm_medium=email&utm_campaign=newsletter_axiosam&stream=topThoughts? But the real star of show is Mickey Mouse, whose very first appearance in "Steamboat Willie" is now without copyright.
