A 34-year-old Lafayette man riding a motorcycle allegedly pulled out a handgun and shot at two other motorcyclists at the intersection of 18th and Everett streets Sept. 14 between 5:30 and 6 p.m. The victims reportedly told the man, Keylin Holly, to stop following them when they stopped at the intersection the shooting took place, according to a probable cause affidavit filed Wednesday. The number of gang-affiliated offenders sentenced to home detention has increased by nearly 60 per cent in six years, according to Department of Corrections data. The National Party says the rise is concerning from a “public safety” perspective and believes its policy of making gang membership an aggravating factor at sentencing will make it more likely they will spend time in prison, rather than home detention. Labour says National's policy “just tinkers with the status quo”, and the party is “dangerously straying into the territory of disregarding” constitutional arrangements. Answers to Written Parliamentary Questions from National's Justice spokesperson Paul Goldsmith regarding the number of people who were sentenced to home detention and were identified to be gang-affiliated each financial year since 2017/18 reveal a 59 per cent increase, with 623 people with gang affiliations being sentenced to home detention in the 2022/23 financial year. The figures, provided to the Herald, do not include a breakdown of what offences each person was sentenced for. Home detention can only be granted by a judge and is used as an alternative to imprisonment. It is intended for offenders who would receive a jail term of two years or less. Corrections said home detention was “both a punitive and rehabilitation sentence”. “It requires an offender to remain at a suitable and approved residence at all times and be monitored 24 hours a day, seven days a week. “Offenders on home detention must also complete programmes designed to address the causes of their offending.” Between 2017 to 2022 the number of people being sentenced to home detention overall decreased by 15 per cent, according to Ministry of Justice figures. The increase in gang affiliates being sentenced to home detention coincides with a 61 per cent increase in the gang population in New Zealand since 2017. He also cited a 33 per cent increase in violent crime during the same period. “Ultimately our concern is for public safety and as we've seen in recent cases home detention doesn't necessarily mean being at home all the time, it can, well, mean going off to work, and for certain people that may well be appropriate ... there are certain circumstances, particularly for non-violent crimes or for ones that don't involve serious violence that may make sense, but what we worry about is when it extends to those more serious crimes and gang activity. “Our particular concern around gang activity is for the overwhelmingly negative impact that they have on our communities.” He believed National's policy of making gang membership an aggravating factor at sentencing, and limiting judges' ability to reduce sentences, with a maximum discount of 40 per cent, would reduce the likelihood that sentences were downgraded from imprisonment to home detention for gang members. “There will be circumstances where [home detention] is appropriate but what I would point to is the significant increase in violent crime over the same period, a significant increase in gang membership over the same period, and at the same time we're seeing more gang members on home detention and all those things don't add up to me.” Justice Minister Ginny Andersen. Photo / Mark Mitchell In response, Justice Minister Ginny Andersen said National's policy on making gang membership automatically an aggravating factor at sentencing “just tinkers with the status quo”. “Which as it stands means being in a gang or an organised crime group is already an aggravated factor at sentencing.” She cited the sentencing of Mongrel Mob president Turanganui John Ormsby-Turner in March for murder as being an example of connections to organised crime being considered as an aggravating factor. “Their other policy around limiting judges' ability to reduce sentences has been panned by experts as unworkable and was clearly poorly thought out,” she said. “If National are serious about gangs, they should consider putting up some evidence-based policies that actually work, such as the Government's gang legislation brought in this year, which has already been used twice by police to crack down on gangs when they are in conflict.” Andersen, who is also Police Minister, said statistics showed the number of people who had been sentenced to home detention had remained “relatively stable” since 2013. “The decision to sentence someone to home detention is one made by a judge, not the Government. National are dangerously straying into the territory of disregarding this part of our constitutional arrangements.” The figures come after a string of high-profile cases where gang members or affiliates were sentenced to home detention. Last month, 17-year-old Tana Ormsby-Turner, a Mongrel Mob prospect involved in a gang-related murder, was sentenced to 12 months of home detention after Justice Francis Cooke began with a starting point of seven years' imprisonment and applied around 70 per cent in discounts. In June, Kane Ronaki, the nephew of the Mongols MC gang's vice president, was sentenced to home detention after he was found guilty following the Operation Silk trial of two firearms charges - including one loaded shotgun - and one charge of possessing explosives - the five shotgun shells in the shotgun. In October last year, William Nelson-Bell, a Killer Beez gang member who took part in four South Auckland drive-by shootings on his 18th birthday, was sentenced to a year of home detention. In June last year, police launched Operation Cobalt - a nationwide crackdown on gangs - following a spike in intimidating behaviour and violence by gangs, particularly the drive-by shootings between the Killer Beez and Tribesmen in Auckland in the first half of 2022. Operation Cobalt included a specialist ring-fenced team of 40 staff in Auckland. Last week, National's police spokesperson Mark Mitchell received a barrage of criticism from Andersen for claiming that half of 41,000 charges laid through Operation Cobalt were “minor offences”, despite those charges potentially including burglary, theft, drink-driving and breaches of bail. Mitchell told the Herald he did not think offences including burglary were minor, but said he could only work with the data the Government supplied which only referenced offence categories and not a breakdown by charge. Andersen said it was “frankly appalling” to undermine the efforts of police officers working to limit the harmful reach of gangs. “I want Mark to step up and explain to the police frontline why he has a problem with them arresting gang members for burglary and theft. “And I want him to explain why he doesn't think that reckless driving that endangers lives is more than ‘minor'.” Sam Sherwood is a Christchurch-based reporter who covers crime. Today on Crime & Entertainment, we have Justin DeLoretto AKA "Mooch." Mooch has a fascinating journey from his days in the Punk Rock scene of Oregon, Ca, which ultimately led him to the world of Outlaw Motorcycle clubs. Mooch's first major club association was with Vagos. While they were not as popular as some of the other clubs that are known worldwide, they definitely did not lack the qualities that optimized the Outlaw culture. After the Vagos, Mooch joined the Mongols Motorcycle Club. At the time that Mooch joined the Mongols, the club was run by Ruben Doc Cavazos. Doc was eventually arrested and the club went through a lot of changes, including the Mongols patch being seized by the federal government. Mooch stayed in the club and eventually rose to the rank of Regional Rep. After stepping back and re-examining the landscape of his situation, Mooch decided to walk away from the Mongols. He eventually went on to earn a degree as well as his Masters which led him to the career path of becoming a social worker. This career change offered him the opportunity to help guide young people down the right path and put their lives on a positive track. Two Centralia men who are a part of the Mongols Motorcycle Club were sentenced to two years probation Wednesday in Clinton County Court after they pleaded guilty to charges stemming from a violent incident in July in Carlyle. According to court records, 35-year-old Michael Allen Burton, and 29-year-old Bryson Lee Williams were originally charged with Class X felony armed robbery, Class 2 felony robbery, Class 3 aggravated battery in a public place, and Class 4 felony mob action. Williams was additionally charged with a second Class 3 felony for aggravated battery in a public place. Gregory Rogers, 51, was developed as a suspect in the case after Bartlesville police responded to a call that shots had been fired about 8:30 p.m. at the Kickstand Saloon, 1810 S.W. Frank Phillips Blvd. There they found two bar employees who had been shot, Austin Standeford and Van Parson, and “several” witnesses, Bartlesville Police Chief Tracy Roles said. Police learned that an altercation had arisen at the bar, which bills itself as Oklahoma's destination for bikers from all walks of life, and that a singular shooter had fatally wounded the victims before fleeing. River Run Riot Nevada fight between Hells Angels MC and Mongols MC River Run Riot refers to the 2002 Laughlin, Nevada fight between Hells Angels MC and Mongols MC which left 3 dead and several injured.Laughlin is located just under 100 miles south of Las Vegas, Nevada and is the host to the Laughlin River Run. The Laughlin River Run is an annual motorcycle rally which was first established in 1983. Years later the agreement would be broken, when the Mongols wanted to move further north. Information is that a member of the Iron Order, a proclaimed law abiding biker club, shot a member of the Mongols MC, a proclaimed 1%er outlaw motorcycle gang (OMG). The evidence & research we have done supports each club's proclamations at this point. I have already written several articles on this incident with a fair and balanced perspective, unlike the rarely read articles the basement bloggers are releasing. The mainstream media can't report correctly either because they are obviously and likely unknowingly being fed bad information by special interest. Mainstream media will never have an insight into biker clubs and culture like we do. We are simply reporting on the recent one hour CNN special called "Inside the Mongols Nation", which was hosted by Lisa Ling. We had numerous emails requesting we cover the story and put truth and perspective to it. We listened to our audience and recorded this podcast episode for that reason. We take a fair and balanced approach & have much insight and perspective into what is fact and what is fiction based on our experiences. There were many facts that were reported in the CNN special and also many things that make little or no sense. Make note that we have never reported that every single biker in every criminal outlaw motorcycle gang is committing daily criminal acts. That would make us like them to assume and place broad stereo types. However, it is fact based on history and evidence that there are factions within these outlaw 1%er clubs that are committing and continue to commit criminal acts to include murder, assault, extortion, racketeering, robbery, & drug trafficking just to name a few. And it is tolerated within the clubs and many look the other way. Organized motorcycle gangs are becoming much more astute when it comes to the Racketeering Influenced and Corrupt Organization Act (RICO). You'll here it when criminal indictments are handed down on individual outlaw club members. Leaders in these biker gangs will say such things as.......that may have occurred, but the club did not know about it. RICO allows the Federal Government to go after entire criminal organizations such as outlaw biker gangs to dismantle them. It is a cat and mouse game and by keeping things loose in the club and letting smaller groups conduct criminal acts it does not involve the "organization" as a whole, thus helping avoid RICO prosecution. Attorneys for these biker gangs have trained leaders on what to say and how to help avoid RICO. Lisa Ling believes she had "exclusive" & "unprecedented" access to the Mongols for this special, but we find out quickly that is not the case. In fact, she was not allowed in a closed-door meeting and that is certainly not full access and leaves much to be speculated on. It is humorous at best when she tries to talk with club members, who just chuckle and say nothing of importance. The Mongols MC National President Dave Santillan, who also goes by Lil' Dave, seems to have organized this public relations attempt. Even he doesn't answer many of Ling's questions during the few times she asks serious questions backed by evidence. He steers away from them, becomes very uncomfortable, and his body language speaks for itself. Many criminal outlaw biker gangs have been manipulating main stream media for many years now and this is nothing new. It is a public relations move that Dave Santillan is now attempting. Outlaw clubs like this use main stream media to have them see what they want them to see in hopes of bettering their overall image to the general public. It's actually a really brilliant move and does work for them many times. I'm not surprised that Santillan sought a left wing liberal media outlet like CNN, because Fox News certainly would not have been manipulated like this. Lisa Ling and CNN were clearly not given access to complete a true and full story of the Mongols, but I give Ling credit for trying. She did a good job with the limited information she was allowed to gather and see. Even she says she can only draw conclusions on what she was "allowed to see" by the Mongols MC. Although we think that it was a good attempt at manipulating the media, in the end it appears to be a failure. Based on Santillan's and other club members lack of responses and evasiveness to valid questions, it leaves the public even more suspicious in our opinion.
