Trump instructing the Department of Justice to halt enforcement of the decades old, much-dreaded Foreign Corrupt Practices Act (FCPA) pending a one-year review. Philip Rohlik is a counsel in the Shanghai office of Debevoise & Plimpton LLP. He is a member of the firm's White Collar & Regulatory Defense and International Dispute Resolution Groups whose practice focuses on international investigations, securities law and dispute resolution. He is recognized by “The Legal 500 Asia Pacific – Greater China” (2024-2025) for his anti-corruption and compliance practice and has been described as “very thorough and hands on," and "excellent investigation lawyer". Based in Asia since 2011, Philip leads the firm's dispute resolution team in Shanghai. He received a B.A. summa cum laude with honors from St. Louis University in 1997. Tom Fox is based in West Texas and a prominent member of the compliance community and one of the most well-known legal practitioners when it comes to the FCPA. Over the past 15 years, he has been a general counsel and chief compliance officer. He is now an independent consultant, assisting companies with anti-corruption, anti-bribery compliance, and international transaction issues. He is also the author of the award-winning FCPA Compliance and Ethics Blog and the international best-selling book “Lessons Learned on Compliance and Ethics.” His podcasts have won numerous w3, Davey, Communicator, and Webby awards for podcasting excellence. Tom is the author of the seminal text “The Compliance Handbook,” now in its 5th edition published by LexisNexis. Andrew Levine is a partner at Debevoise & Plimpton LLP, who specializes in white-collar regulatory defense and internal investigations. He joins Vince Walden to discuss the compliance journey, what initiatives compliance professionals should take in 2021, and the recently updated DOJ compliance journey. The DOJ guidance that came out in June 2020 is a step in the right direction in terms of understanding how prosecutors incorporate compliance programs into their decision-making, Andrew says. It offers real, actionable advice for building a framework for analyzing a computer program. The guidance is centered around three critical questions: Is the program well designed? Is it adequately resourced and empowered to function effectively? And, does it work in practice?  As prosecutors' expectations for what makes up an effective compliance program continue to rise, leaders should think about enhancement opportunities. “Don't let the perfect be the enemy of the good,” Andrew counsels. “Develop a reasonable plan, think about resourcing for implementation, think about a timetable that works, and then execute while understanding that the compliance journey is a never-ending one.” Resources Andrew Levine on LinkedIn

Corruption has become a hot topic in Public International Law in recent years. In particular, its prevention has been the subject of numerous treaties and soft law instruments, and it has been wielded as a defence to both investment treaty claims and commercial contract claims (which in turn raises questions of private international law). Yet the source and theoretical underpinnings of a supposed international norm prohibiting corruption remains opaque. Tribunals and commentators make reference to “international public policy,” but the question remains whether the supposed prohibition of corruption is a rule of international law, and where it features in the hierarchy of norms. We propose to examine (i) the current “state of play” (i.e., the various ways in which international law addresses and reprimands corruption), (ii) whether Public International Law prohibits corruption and, if so, the source and status of that norm; and (iii) what the future of international anti-corruption efforts might look like. Bio: Samantha Rowe is International Counsel, and Ciara Murphy is an associate, in Debevoise & Plimpton LLP’s international dispute resolution group. Their practice focuses on international arbitration and public international law. They represent both sovereign states and companies in international investment and commercial arbitrations across a range of sectors. Ms. Rowe received her B.A. (Hons.) with First Class Honors in English Law and French Law from the University of Oxford, Wadham College, a Certificat Supérieur de Droit Français from the Université de Paris II Panthéon-Assas, and an LL.M. in International Legal Studies from New York University. Prior to joining Debevoise, Ms Murphy was a law clerk to Judge Greenwood and Judge Yusuf at the International Court of Justice. She holds an LLB from Trinity College Dublin, an LLM in EU Law from the College of Europe and an LLM in international and comparative legal practice from the University of Michigan.

Recorded in May 2017 - Hon. Lorna G. Schofield ’81 is a United States District Judge for the Southern District of New York. She was nominated in 2012 by President Obama and confirmed by a unanimous vote of the US Senate. For 20 years previously, Judge Schofield was a litigation partner at Debevoise & Plimpton LLP in its New York office. Her practice focused on litigation in complex commercial matters, including regulatory and white collar criminal investigations, class actions, corporate bankruptcies, and other business disputes. Her trials included the successful defense of Rosie O’Donnell in her contract claim against the publisher of Rosie magazine, and of a big four accounting firm in a class action in which the jury returned a defense verdict after only 30 minutes. Judge Schofield previously served as a federal prosecutor and worked on cases involving arms dealing, domestic terrorism and white collar crime. She began her legal career as an associate at Cleary Gottlieb Steen & Hamilton. She is a former Chair of the Section of Litigation of the American Bar Association. Judge Schofield has written and spoken frequently about trial tactics and women in the legal profession. Judge Schofield is the first Filipino-American federal judge to be appointed under Article III of the US Constitution.
