How to Split a Toaster: A divorce podcast about saving your relationships
You're done with your divorce. That means you're done with lawyers, right? Not necessarily! In today's episode, Seth and Pete talk about a few cases in which you may need to talk to a lawyer again – if you want to appeal your divorce, and for post-divorce estate planning. It's a rare thing for judges to make mistakes when it comes to divorce cases, but it does happen. That's when you'd want to appeal your divorce. Seth and Pete talk about other situations that may require going this route, and who you'd talk to for it. We also talk about the difference between appealing your case and a ‘motion to modify.'While appealing divorces isn't as common, everyone going through a divorce should immediately do post-divorce estate planning. You've just gone through a divorce. All of your financial paperwork is already in your lawyer's hands. It's the perfect time to talk to an estate planning attorney. Plus, you want to make sure your ex is no longer included in your will or listed as beneficiary, right? They're very important topics in today's episode. Plus, we have three listener questions. The first is a follow-up to our recent conversation about vocation evaluations, particularly for those also dealing with mental health issues. The second asks about client confidentiality. The third is how to approach your lawyer if you feel their paralegals are making mistakes in your case. Great questions! As estate planning lawyers, we like to work with our clients on an individual basis. I think the most important part of estate planning is what happens to you, dear, in your lifetime. Jovana Popovich, Shareholder and Estate Planning Lawyer at Fizer Beck in Houston, joins us on today's show! Jovana talks about getting into estate planning, not sacrificing quality for speed, and the need for small firms to find a good fit.Her Firm/PracticeEstate planning boutique. Estate planning/estate administration for high net worth individuals. The firm also has a real estate group, M&A/corporate group, and non-profit group. She fell into the practice. In law school realized she didn't want to do litigation or Big Law. She wanted to interact more with people. Thought at first she might do family law. But later had coffee with a friend of friend who did estate planning. That friend happened to be at Fizer Beck and led to a research internship while in law school. She then took the estate planning classes at UT and wound up clerking and then ultimately getting hired by Fizer Beck.Estate tax exemption amount is always in flux, which means there is always new planning to do. And the question is always when the exemption is going to change and by how much. This also yields more income tax planning.Reminder that in 2010 we had zero estate tax! Check out George Steinbrenner. For those interested in estate planning, think about whether you like tax work, because estate planning is very tax-heavy. Then find a place to gain experience in tax if you can't get immediately into estate planning. Even corporate work can translate.COVID Update (as of 3/4/21)In the beginning, couldn't execute estate plans since it requires original ink signature, witnesses, notary, etc. all in line of sight. So how to do that while keeping everyone safe?Major difference is that all questions have to be answered before the execution ceremony. Pre-covid there would be a pre-execution meeting that could last 30-45 minutes and could lead to tweaks/changes in the plan. But now that all has to be done in advance of the ceremony. When it comes to wills and financial powers of attorney, no appetite from legislature to move to e-signatures.Advice for lawyers in practice:If you send a document to a client, they aren't going to know whether the law is right/wrong, but they are going to notice if their name is misspelled or there is a typo. So attention to detail is really important.Know your own faults and figure out how to fix themHard for high achievers to fail, but you will. And that's okay. You don't have to be perfect. Job in the first three years is to learn, and give a work product to the partner who can make some minor changes and then send it on to the client.Don't be in such a hurry that you turn in a sloppy product. Go as fast as you can while still turning in an error-free product.Write an issues list and then ask your partner which should be explored.Be a self-starter. May not know something but will go and try to figure it out and get as far as they can before asking for help. This helps give them context for a more productive conversation with the partner. Take the initiative to learn.Don't come in and ask "how does this work?" instead say "I think this is how this works; is that right? Am I missing something?"Advice for lawyers interviewing for jobsDon't have any typos in your documentsFor them, having tax experience looks goodThey are a small firm (18 lawyers), so you need to be sociable and able to get along with people. They are friendly and collaborative. Interests/hobbies/etc. are important. Want to see you are a good fit. Also want to see the person has a connection/strong desire to be in Houston long term. It takes effort to train"My boyfriend is getting a job in Houston so I want to be in Houston"...is not a great answer. What if the guy moves to another city? There can be a big firm (don't really care) / small firm (do really care) dynamic here.On Business DevelopmentWork at a firm with a long history where the clients are built in!Find out who your best referral sources are and build those relationships (for them it is CPAs and financial advisors)Speak at CLEs; get on webcasts with referral sourcesRapid Fire QuestionsName one trait/characteristic you most want to see in an associate: detail orientedWhat habit has been key to your success: keep your time as you goFavorite app/productivity tool: timekeeping softwareFavorite social distancing activity: socially distanced picnic in the park with dog/friendsFavorite legal movie: Paper Chase and Legally BlondeThanks again to Jovana Popovich for joining us on the show!

Protect inheritance from son-in-law and daughter-in-law so that it goes to your kids and grandkids. It's not necessarily because my clients do not like their son in law or their daughter in law, which is entirely possible, it could be just that they're afraid that once they get a lump sum of money, that you have worked your entire life to accumulate, that they are gonna blow it on something frivolous as soon as they receive it.Download our ESTATE PLANNING STRATEGIES TO PROTECT YOU AND YOUR FAMILY https://geni.us/strategies

Our philosophy in life and in business is to follow the Golden Rule, and that is to treat others as you would want to be treated. Do unto others as you would have them do onto you. My name is Brian O'Neil. I am a partner in the Corporate Tax section here at Moore Ingram Johnson and Steele and I primarily handle business transaction work including mergers and acquisitions, franchising and secured lending. Following the Golden Rule has worked very well for our firm over many years and in fact, I've represented some of the same clients for over 30 years. With respect to my business transactional work, I refer to myself as a Deal Maker not a Deal Breaker. If you get the wrong business attorney and a transaction, you can end up with a problem and a deal not happening so we build ourselves as attorneys that get things done and get the deals closed. Someone asked me once how do I go about making decisions or dealing with a difficult issue that comes in the door and I know it sounds somewhat hokey but I will ask myself, "What would Jesus do?" The old WWJD and I found that when I do that, I end up making a better decision and my reaction or action will turn out to be better when I have done that. I'm most passionate about faith, family, the firm and the Georgia Bulldogs. I'm here to assist you in any way I can and it's been a great pleasure to me to help a business get started and then, build and grow to eventually have businesses after 10, 20, 30 years sell out for a nice return for the owner and that's extremely satisfying to me to assist and be a small part of that for them.
“No question is stupid if you don’t know the answer.” Hello, my name is Matthew Howard. I am the senior partner of our tax department here at Moore Ingram Johnson & Steele. My practice comprises really first and foremost of heading up our tax department at MIJS. I graduated with a degree in law obviously, but also a master’s degree in tax so all I do in one form or another is taxation. I would say the three big areas are trust and estate work for clients, really all over the country, but primarily concentrated in Georgia. We do an awful lot of tax controversy work here at this firm where the Internal Revenue Service takes a position with either a corporation individual or partnership that we believe is unfair and untoward and not supportive by the law so we will help them and shepherd them through that entire process all the way through the administrative level at the Internal Revenue Service as well as US tax court if necessary. And the third area of our practice that I oversee is our captive insurance company practice. I am involved really exclusively in making certain that corporations that want to employ their own insurance company, known as a Captive Insurance company do it for the right reasons and they have a business purpose for doing it and not just a tax purpose. There has been a lot of litigation over in the 80s and 90s and a lot of guidance coming out of the Internal Revenue Service that has helped individuals and corporations who set up captives do them for the right reasons and it’s our job in this department, the tax department, that is to make sure that they are setting the individuals that create these and formed these and ran these are doing them for the right reasons. So anyone that knows me beyond probably 10 minutes will know I’m very passionate about two things. First and foremost about my faith. I have not been a man of faith most of my adult life, but over the last few years I did find my faith and I thank God for that, primarily. And the second thing I’m most passionate about is my family. I have a lovely wife, five children, and four dogs whom I adore. I am most appreciative of the opportunity to have worked at this firm for now going on 28 years, not just because it’s a great place to practice, the individuals are nice from Susan who greets people at our front desk to every staff member, the attorneys, very collegial place to work but first and foremost this is a place where we can express our faith and we think of the clients first; they absolutely come first. That is our mantra. We return phone calls, we return emails, and we truly put our interests second to our client base and I think that has served us well over the years. So I’ve shared with you my primary areas of concentration. They’re obviously subsets of that but if you do have any questions, please feel free to call.
