STORY 5: Local Historic Preservation Group Gets Bench Honoring Enslaved Residents of Cobb The Friends of the Concord Covered Bridge, a historic preservation organization in Cobb, has been awarded the Toni Morrison Society's "Bench By the Road" project to honor former enslaved residents. The organization plans to install a commemorative bench in the Concord Covered Bridge neighborhood to recognize all previously enslaved people in Cobb County, particularly the family of Matilda Ruff. The bench will be the 33rd location worldwide and the first in Cobb County under the Bench by the Road Project, aimed at providing a reflective space to remember the enslaved, their forgotten lives, and Toni Morrison's writings. The incident occurred around 8:45 p.m. near Austell Circle. The man was struck by a black BMW driven by Blake Carlton, 43, of Atlanta, as he crossed outside of a marked crosswalk in an unlit area of the road. The pedestrian was taken to Wellstar Kennestone Hospital but succumbed to his injuries. The driver, Carlton, was unharmed. The incident is currently under investigation, and anyone with information is urged to contact Cobb police at 770-499-3987. STORY 3: Statewide group recognizes Cobb's Magistrate and Probate Courts for their ability to clear cases Cobb County's Magistrate and Probate Courts in Georgia have received recognition from the Judicial Council of Georgia for their outstanding caseload management. The courts were acknowledged for falling within the Top 10% of Georgia courts in terms of clearance rates, indicating effective case management. The Chief Magistrate Judge, Brendan Murphy, highlighted the importance of ensuring access to justice and commended the dedicated team for their efficient service. In 2022, the Magistrate Court handled a substantial caseload, including civil cases, county code violations, first appearance hearings, and warrants. The Probate Court, responsible for various matters, also efficiently processed estate, guardianship cases, weapons carry applications, and marriage licenses. She encountered a violent, methamphetamine-intoxicated suspect, Michael Holcomb, who was naked and attacking people. Despite being assaulted and losing a tooth, Palarche fought to prevent the suspect from harming others. Deputy Sheriff Jeremy Hudgins and Deputy Sheriff Randall Lossing from the Cobb County Sheriff's Office also received the Medal of Valor for their courageous response during a shooting incident while attempting to serve a warrant. Additional awardees were recognized for their heroic efforts in various emergency situations, including the Cobb County Police Department and Austell Fire Department. The ceremony marked the beginning of Public Safety Appreciation Week in Cobb County. STORY 5: Major mixed-use development off I-575 back on Planning Commission's radar A 57-acre mixed-use development near I-575 and Chastain Road in Cobb County is facing its first hearing before the Cobb Planning Commission. The proposal by Strategic Real Estate Partners includes 425,000 square feet of office and warehouse space on 32 acres, 141 townhomes, 200 age-restricted apartments, and 30,000 square feet of retail space on the remaining 25 acres. The Bells Ferry Civic Association supports the residential aspect but opposes the three warehouses due to concerns about the size, intensity, and 24/7 operation of the facilities, as well as increased commercial traffic and environmental impacts. The project is considered a Development of Regional Impact. The unelected Judicial Officer had put a protective order surrounding her Mother's "Medical Records" that she is not to "share them," and she fully believed her wording was directed toward the ACTUAL records. The Trustee's Attorney tried to get her to sign a gag order as part of a settlement, which of course Laurie did NOT "settle". Other than physically "sharing" her Mother's Medical records, Laurie is not gagged. Laurie can speak freely about the experience which is still ongoing, of course due to money to be made by Attorneys. BEWARE. There is so much to this story, so sit down and listen. The involvement of some of Laurie's siblings in this saga is VERY important, but is no different than if a third party did this to her own mother. But due to the "lens cover" of a "family squabble" to be used as an excuse by agencies, attorneys, doctors, mandatory reporters, etc., Laurie's Mother is a victim of the very "safety net" that should have saved her. To the State of Arizona and all the shameful individuals that participated in this expensive charade, it has been life altering for her Mother. Had ONE, just ONE person done their job to protect her, the last 6 years would not have happened. She had a "Rock Solid" TRUST that was supposed to prevent what happened and she was never supposed to be in Probate Court, but the "TRUSTEE" filed a Petition in June of 2021 to Prevent her from being sued or charged on any of the "offenses or breeches" that she had committed due to "time-barring". Laurie and another "noticed" that a sibling objected to the 600 pages (intended to inflict emotional distress and harassment so that they would not respond). Laurie used to work as a Paralegal for a Probate Lawyer and what she saw then, in 2007-2008 was horrifying and some of the problems were in exposed by the local media and by CBS national news. Laurie thought things had changed after that, but it remains "status quo" today. No one represents "the Ward". Slam the Gavel welcomes Thomas Pepe to the podcast. Thomas lost his father in 2020 and he didn't even know his father had passed and didn't even know an autopsy was done stating that his father died of natural causes. However the will went missing. Thomas's father had four children including a set of twins. This probate issue has caused mass havoc within the family. The siblings are using the courts to ruin Thomas's life and brag about it. The issue is the will was never registered with the state of Florida and now Thomas is finding himself as administrator and being forced into probate court. Thomas explained that it has taken eight years to sell his mother's home. He explains that they have taken something so simple and complicated it and how society is taught to look at things in conflict and create it. Thomas wants to honor the deceased and honor his father's wishes. We discussed how easy it is to get away with a crime. Thomas said that he signed a document where the escrow was $25,000.00 and then he was presented with the same document, or so he thought but the escrow figure was now $2,900.00. This is explained fully as Thomas discussed this issue. Also, no one will listen to his story including law enforcement. Society is really not safe under the laws and the laws are designed only to make money. Thomas cares about his father and honoring his memory but for others it's all about the money. On January 13, 2023, Thomas will be the defendant in a hearing. In this week's episode we are going to talk about inheritance and inheriting your parents house. If you are watching this video because a loved one has passed, we are so sorry for your loss and we hope that this video can offer some help during this time. After the Will and Probate process you and your siblings will want to have a family meeting and discuss where everyone is and what you want to do with the property. It is important to delegate responsibilities so that you and your family know who will be responsible for each aspect of the house. It is also important to manage the utilities and insurance for the property. So take a look at your plan and what you need for the house to function. Work with a Title Company to see if there are any encumbrances on the property. When the time comes to go through belongings see what you want to keep, donate, and sell. If you need more support there are companies that can tackle a lot of this for you. If you decide to sell the property, there may be some small repairs that you can make before listing the property. It is also important to look at tax implications with your accountant to understand exactly what your costs are after you sell the property. Make sure that when you and your siblings come to an understanding make sure you get everything in writing. Regardless of the relationship it is important to reach out to an attorney if disputes arise. There are so many options for what you can do with a property and you do not have to rush into any decision. Whether you buy out your siblings, sell the property, or decide to turn it into a rental, a good real estate agent can help you decide what is the best option for your situation. Slam the Gavel welcomes Sam Sugar, M.D back to the show. Dr. Sugar was last on the show season 3, episodes 33 and 39. The state of Florida has a fund designated for kids born with birth defects and it is funded by doctors in Florida. Doctors pay money every year into this multi billion dollar fund. This led to a discussion on a case of a child born blind, but thrived at school up to graduation. However, he was abducted out of school and put into a guardianship due to the fact he was sitting on a million dollar lawsuit. He was taken away from his friends and his mother. To this day, his mother doesn't know where he is. Isolating him from his friends and peers is taking a toll on him. This is not “in the best interest.” Legislation cannot fix this. Profit is what drives the abuse across the country known as professional Guardianships. Dr. Sugar explained that there are no juries in guardianships nor family court. The Title IV Social Security program is generating billions of dollars that punishes people who marry as well as destroy the family unit and this is an unacceptable as well as devaluing the 2 parent home. CPS and Adult Protection Svcs. does more harm than good. It is best to uncover and educate people unaware of these problems. Do everything you can to avoid equity courts and do not hire lawyers to solve family problems. Slam the Gavel welcomes back Sam Sugar, M.D. to the show. we discussed how to prevent a Guardianship/Professional Guardianship from happening and what to do if you cannot. Dr. Sugar recommended having Advance Directives that state that under no circumstances that you want a guardianship. Also make sure a Health Care POA is in place and a Will. Make your wishes well known to family members as well as settling family disputes, as Guardianships can start with a disgruntled family member. There could be an estimated 3-3.5 million Guardianships in the United States and this creates a negative impact on families affected by a loved one being placed into a Guardianship. Families find their money being thrown away in years to multiple decades of litigation affecting their own health and welfare fighting for their loved one. We discussed the dark history that goes back to Parens Patriae and how in 1929 Equity Courts joined with civil and criminal courts as well as the history of the Osage Tribe and the book written by David Grann, "Killers of The Flower Moon," that goes into more detail on what really happened to the Osage Tribe and how that evolved into the FBI and J. Edgar Hoover. This history of the Orphan Trains were discussed and how churches and others thought it was a great idea to put homeless children onto trains and ship them off to help farmers farm their land.
