We also discuss how to jerry-rig your Wealth Planner to project a “Die with Zero”-style drawdown, by popular demand—as well as the potential for a book club or community. Transcripts, show notes, production credits, and more can be found at: https://moneywithkatie.com/dangerous-advice. On this week's episode of THE FINANCIAL COMMUTE, host Chris Galeski welcomes Wealth Planner & Estate Attorney Brian Standing to discuss advanced estate tax planning strategies. Here are some key takeaways from their conversation:- Estate tax laws are set to sunset in the next year and a half, potentially reducing the exemption amount from over $13 million to $7 million per person.- High net worth individuals with estates over $26 million (married) or $13 million (single) should consider advanced estate tax planning to avoid higher taxes.- Irrevocable Life Insurance Trusts (ILIT) help create liquidity to pay estate taxes without forcing the sale of assets. This trust owns the insurance policy to avoid taxation on the proceeds.- Spousal Lifetime Access Trusts (SLAT) allow assets to be given to a spouse, maintaining indirect access to income while reducing estate taxes. This strategy has risks, such as the potential for divorce.- Charitable Remainder Trusts allow individuals to donate assets to a charity in the future while retaining income from those assets during their lifetime.- Family Limited Partnerships (FLP) help reduce estate tax liability by discounting the value of restricted or non-controlling ownership interests in assets like real estate or businesses.- Brian advises listeners to organize their assets, income, and future needs to facilitate effective estate tax planning before the law changes in 2026.

What You Need to Know About LA's New Mansion Tax

On today's episode of THE FINANCIAL COMMUTE, host Chris Galeski invites Wealth Planner and Estate Attorney Brian Standing to discuss the Measure ULA tax that went into effect for the City of Los Angeles on April 1, 2023. This new law has increased tax from 1% to 4% on the sale of any real estate in the City of LA that is at least $5 million in gross value. If the property sells for over $10 million, the tax will increase to 5.5%. This includes any type of property (residencies, commercial, etc.). This heightened tax does NOT apply to gifting, inheritance, spousal transfers, or transfers into business entities.  The intent of this increased tax is to raise money for affordable housing and rent assistance. However, Chris and Brian agree this tax law may potentially increase rent; by discouraging development in the City of Los Angeles, fewer new residences will be available to meet rental demand, leading to an increase in rental prices. Furthermore, if buyers of rental real estate bear part of the increased costs (as sellers may require), those costs may ultimately pass through to the tenants as increased rent.Brian recommends listeners to wait and see how Measure ULA plays out before trying to execute tax-saving strategies. Some people have been considering selling their property in increments, but Brian says strategies like this may not work since Los Angeles may still recognize it as one whole property. Disclosures:Information presented herein is for discussion and illustrative purposes only. Retirement is a new concept in human history, but the way we fund retirement is even newer. After all, the 401(k) and IRA were legislated into existence less than fifty years ago. How Secure Act 2.0 Could Affect Your Retirement

Financial Commute

Play Episode Listen Later Jan 24, 2023 18:09 Transcription Available

On this episode of The Financial Commute, Chris Galeski is joined by Wealth Planner and estate attorney Brian Standing to discuss Secure Act 2.0.  For those who are 64 to 72 as of 2023, the age to start taking RMDs (required minimum distributions) will increase to 73 in 2023 and 75 in 2033. The penalty for failing to take an RMD has been reduced from 50% to 25%; if it was not intentional and is corrected in a timely manner, the penalty decreases to 10%.  The Act also included changes to education funding: if the beneficiary of a 529 plan does not use the money in their plan for school, a certain amount of those assets may be rolled over to their Roth IRA. However, this policy does not start until 2024, the rollover amount has an aggregate lifetime limit of $35,000, the 529 account must have existed for at least 15 years, and the rollover money must have been in the 529 for at least 5 years to permit the transfer. Therefore, Brian encourages listeners to consider opening a 529 account for their children as soon as possible, even if they may not need the money for school. Furthermore, people who have been contributing to the Roth option of their employer-sponsored 401(k) or 403(b) are no longer required to roll that money to an IRA to avoid RMDs (starting in 2024). Employer-match contributions can also go into a Roth IRA. The benefit of Roth accounts is that taxes are paid today so that the money is not taxed when it is later taken out for retirement.  Brian highlights another part of Secure Act 2.0 that helps employees who may not be able to afford retirement contributions because they are paying off student loans. The provision allows employers to make matching contributions to an employee's retirement plan based on their student loan payments beginning in 2024.  Chris and Brian encourage listeners to schedule time with an advisor to discuss how Secure Act 2.0 may impact them if they inherit a retirement plan from a deceased spouse, as there are new options and details may be more complicated based on one's individual situation.Disclosures:Information presented herein is for discussion and illustrative purposes only. How much money do you have to earn in a HCOL area to become a millionaire in 10 years or fewer? A few months ago, we released an episode about how much someone would need to earn (and spend) to go from $0 to a seven-figure net worth in a decade, and a few of our listeners from NYC and the Bay Area said, “Good try, but can you triple the spending and redo this?” I'm nothing if not accommodating, and the question brought up a whole new topic for me: Is living in high cost-of-living areas worth it? Moreover, how much do you really need to earn in, say, Manhattan to avoid slowing your financial progress? If you don't earn that much, how far “behind” are you likely to be? We're diving in. I have been—by all accounts—incredibly fortunate in my career thus far, but there are a few distinct takeaways I notice when I reflect on the last five years. Since I went to a public state university and studied communications (not exactly a field with investment banking-level compensation), I figured I'd be a median earner forever. Discovering the art of the side hustle (and freelancing, contract work, and online businesses) sent me down a meandering path of trial and error that I'm recounting on the show today.  When I started working, I earned $12/hour, which transitioned later to a full-time salary of $52,000. By 2021, as a 26-year-old with no advanced degree, my total cobbled-together income encroached on $400,000. Looking back on it, I realize: The rules are fake. You don't need to study finance or medicine at Harvard to make good money (though to be fair, I'm sure those things make it a lot easier). Regardless, it's my hope that something in this episode will spark something useful for you. Learn more about our sponsor, Vin Social: http://vinsocialvip.com/.
